Navigating a Biased Second Opinion in Workers' Compensation ClaimsIf you're an injured worker whose workers' compensation claim has been accepted but now faces a second opinion examination that seems prejudiced or improperly conducted, you may be at risk of losing your benefits. This guide provides practical tips and remedies to protect your rights and ensure fair treatment when a second opinion physician's findings appear influenced by a claims examiner aiming for a predetermined outcome.Understanding the SituationWhen a second opinion physician determines that your injury is not work-related, the claims examiner may issue a Notice of Intent to Terminate Compensation. This notice typically gives you 30 days before your benefits end. The claims examiner often supports this decision with a Memorandum to the Director, outlining the reasons for denying your claim. This memorandum is a document that you never see but has a lot of prejudicial influence on the second opinion's determinations. There is a lot of these types of memorandums that hurt injured workers looking for fairness and help but instead receive a predetermined prejudiced outcome that is negotiated in these type of memorandum that often hurt the injured worker claimant. If the second opinion feels biased or the examination was not conducted appropriately, you have options to challenge the findings and protect your benefits. Acting quickly and strategically is critical.Steps to Take1. Request Key DocumentsTo build a strong case, you need access to the documents influencing the decision. Take these actions immediately:Obtain the Memorandum to the Director: Request a copy of this document from the claims examiner. It details why your claim is being denied and is essential for your treating physician to understand the basis of the denial.Request the Second Opinion Doctor's Report: Ask the claims examiner to send a copy of the second opinion physician's report to your treating physician. Morgan had not turned 45 yet, so she hadn't received a screening colonoscopy for colorectal cancer. But when she noticed blood in her stool at age 41, she did exactly what she should have and sought medical evaluation. After months of missteps became years of dismissive care, she realized it was time for a second opinion at Siteman Cancer Center. With the help of WashU Medicine radiation oncologist Hyun Kim, MD, co-director of the Young-Onset Colorectal Cancer Program, Morgan was given a treatment plan that provided the care she needed. A fabulous re-cast episode from season 3! Sooner or later, we all spend some time in the hospital, so Greg and Ed riff on their myriad experiences in Bangkok hospitals over the years. But before we get into that, we should note - due to Thailand's strict defamation laws, some of the places we talk about will remain nameless. But with that out of the way, we can say that Thailand in general has pretty good medical care, and it is standard advice for travelers in neighboring countries to get over the border into Thailand if they have any medical problems. But, as Ed notes, Thailand does not have very good legal protections against medical malpractice: if a doctor makes a mistake, don't expect significant financial compensation from the Thai justice system. Greg and Ed then trade anecdotes about their own experiences in the Thai medical system, each with some good and bad things to say. Ed's life has been literally saved by competent doctors; Greg passed himself off as a Jedi in lieu of a real religion; both have been saved a ton of grief by getting a second opinion. Your mileage may vary, but both Greg and Ed agree, as a pure value proposition (i.e. what you get for the money), Thailand, though far from perfect, is a pretty good deal. What if receiving a medical diagnosis was as simple as shopping online? The growing home diagnostics industry says it can be. At-home testing was widespread during the COVID-19 pandemic, but more health tech companies also offer DIY kits that test for food allergies, fertility and thyroid function, among other things. Some medical experts are wary of this on-demand model, but health tech investors say it can make health care more accessible. Marketplace's Lily Jamali spoke to Chrissy Farr, author of the Second Opinion newsletter, and Anarghya Vardhana, a partner at the Maveron venture firm, about the prospects of the industry and how it affects relationships between patients and doctors.
