Today's daf is sponsored by Miri Darchi in loving memory of her father Aharon Shimon ben David and Malka Tzirel.  Abaye raises a difficulty against Rabba's position, that males before reaching maturity cannot father a child, from a verse in the Torah regarding a man who engages in relations with a shifcha harufa. The drasha on that verse includes a male over the age of nine. However, the difficulty is resolved, as this is not an indicator that the child can impregnate a woman at that age. Another difficulty is raised against Rabba from a braita of Rabbi Yishmael that derives an exemption for a ben sorer u'moreh who himself is a father - how could he be a father if he did not impregnate the woman before reaching maturity, since according to Rabbi Kruspedai, there is only a three-month window after reaching maturity to be a ben sorer u'moreh? This is resolved as well by explaining Rabbi Yishmael's drasha as the source for Rabbi Kruspedia's ruling - the three months is based on the fact that the child could potentially be called a father within three months of reaching maturity as his wife could become pregnant and would be showing it after the first three months. Rabbi Kruspedai's opinion is based on the majority of women who give birth at nine months and begin showing at three months and doesn't consider a woman who gives birth at seven months and would be showing at two and a third months. Could this prove that woman who gives birth at seven months also begins showing at three months and not at a third of her pregnancy (two and a third months)? This suggestion is rejected as he follows the majority. However, is that really true? This contradicts the concept that in capital law we try to find any possible way to exonerate the accused from the verse "and the congregation shall save." Two Mishnayot are brought to prove that we do follow the majority even in capital cases, but the second one is rejected as it can be explained differently. Beit Shamai and Beit Hillel disagree about a mother who has an incomplete sexual encounter with her minor son. Does this disqualify her from marrying a kohen, as she could be considered a zona from the interaction? Rav Chisda (either quoted someone else or he was quoted by someone else) explains that they all agree if the child was nine, that she would become disqualified, and if he was younger than eight, then she would not. Their disagreement is about a child who is between eight and nine, as in the days of the Tanach men were able to father children at eight, even though already in the time of the tannaim, this was no longer the situation. The debate is whether we learn from those times or follow what is true presently. What is the source that in the times of the Tanach men fathered children at age eight? At first, they try to prove from Shlomo, as his great grandfather Achitofel was twenty-six years older than him. However, this proof is rejected, as the lineage includes Bat-Sheva who was a woman and she could have been younger, and the men were older. The second attempt is brought from Avraham and Sara, but this is rejected as well as it is not clear whether Avraham was older than Sara's father, Haran or younger. Cours sur le Tanach par Rav Dynovisz

RESUME DU COURS : Nous avons vu que, selon nos Maîtres, Avshalom préfigure Gog et Magog, dernière révolte de la civilisation occidentale chrétienne contre Israël, d´où jaillira la Délivrance finale. Comme nous l´avons dit, Avshalom avait pris sur lui la nezirout, c’est-à-dire qu´il s´était retiré du monde. Mais, bien que naziréen, il convoita néanmoins le pouvoir et planifia de s´en emparer. A son image, et paradoxalement, la religion fondée par celui disant "mon royaume n´est pas de ce monde" est celle qui eut, dans l´histoire, un pouvoir qu´aucune autre n´eut jamais ! "Avshalom mit au monde 3 fils, et 1 fille qu´il appela Tamar (il voulait montrer qu´il portait sur lui la souffrance de sa sœur et qu´il se battait pour les valeurs morales et spirituelles dans ce monde). "Cela faisait deux ans qu´Avshalom était revenu à Jérusalem, mais le roi refusait de recevoir son fils. Avshalom envoya une missive à Yohav, lui demandant absolument de voir son père, mais Yohav refusa. Après un nouvel essai, Avshalom dit à ses serviteurs : allez mettre le feu à tous les champs de Yohav." La Torah décrit ici le type fondamental de celui qui se prend pour le modèle : il se présente comme la morale suprême et comme la religion d´"aimer son prochain comme soi-même", mais la Torah nous montre que celui qui se croit meilleur que les autres perd toute notion de ses limites : il ruine et détruit ceux qui ne pensent pas comme lui, ou qui ne lui permettent pas de montrer qu´il a raison. Dans le personnage d´Avshalom, la Torah a fixé le prototype de celui qui, au nom de sa compréhension personnelle, tue et fait des horreurs ; on verra qu´ensuite, il voudra aussi tuer son père et violera ses femmes ! "Yohav vint trouver Avshalom : "pourquoi tes serviteurs ont-ils brûlé mes champs ?" Avshalom lui répondit : "c´est moi qui doit te demander des comptes ! C´est moi qui brûle, tous les jours, à l´intérieur ! Pourquoi m´as-tu ramené, si c´est pour me laisser mourir sans pouvoir voir mon père ?" On voit la force de l´hypocrisie qui retourne ses propres torts contre l´autre, l´accusant au point qu´il se sente coupable ! Yohav, déconcerté par tant d´hypocrisie, ne trouve rien à lui répondre. Pourtant, Yohav est un vrai guerrier, un dur, et même la seule personne dont David ait dit "j´ai peur de lui". C´est toujours l´art de nos ennemis, qui tuent et ruinent, puis se font passer pour les victimes et nous font nous sentir coupables ! C´est ainsi que Yohav alla chez le roi, lui raconter la souffrance de son fils. Avshalom avait dit : "Je veux parler avec le roi et faire valoir mes droits. Je veux lui prouver que je n´ai pas fauté." Il était sûr de pouvoir convaincre David. "Avshalom arriva devant le roi, se prosterna devant lui. David embrassa son fils". Mais il ne lui dit pas un mot. "Avshalom s´en alla. Et ce fut après cela…" qu´il commença sa révolte contre son père. Rashi explique qu´Avshalom interpréta le silence de David, et le fait qu´il l´ait embrassé, comme un pardon complet et une approbation de ce qu´il avait fait. En réalité, David ne réagit pas parce qu´il était brisé. Il savait que tout ce qui se passait était l´accomplissement de ce que le prophète Nathan lui avait annoncé : que de sa maison sortirait le mal, à cause de sa faute avec Bat Sheva. Il était dans une forme de dépression et ne savait pas comment réagir. Avshalom crut pouvoir en déduire que son père n´était plus à la hauteur et qu´il fallait qu´il le remplace. Par divers types de manipulations démagogiques, il se créa un nom dans le pays et parvint à rallier une grande partie du peuple, contre David. Il construisit son personnage sur 4 piliers : grâce à ses cheveux longs de naziréen, il se présentait comme étant détaché de ce monde ; par le nom de sa fille, Tamar, il signifiait qu´il était le saint défenseur de la morale ; en recevant le peuple pour "rendre justice" aux opprimés, il prétendait être le juste juge ; il voulait se faire passer pour l´homme de l´amour, proche de son peuple. "Et ce fut au bout de 40 ans qu´Avshalom vint chez le roi et lui dit : laisse-moi partir à Hevron, car je dois accomplir mon vœu." Hevron est la ville des racines d´Israël. Mais c´est aussi, explique le Malbim, la capitale de la tribu de Yehuda. Avshalom entreprit de réunir aussi autour de lui la tribu de Yehuda. Nos Maîtres expliquent qu´il attendit que ce soient écoulés "40 ans" depuis que le 1er roi avait été oint par Shmuel. 40 ans est le chiffre qui symbolise la fin d´un cycle et le début d´un autre. De même qu´il fallut attendre 40 ans pour que l´ancienne génération disparaisse dans le désert et que la nouvelle entre en Eretz, Avshalom se dit que l´ancienne royauté devait disparaître, pour que la nouvelle puisse prendre le pouvoir. Il utilise les symboles d´Israël pour créer son mensonge puis déclare : l´ancien est fini, et il doit disparaître ; je suis le nouveau. C´est pourquoi nos Maîtres y voient Edom. Avant même la naissance de la religion et de la civilisation édomique, nos Maîtres nous en ont déjà donné tous les signes ! Tous les éléments étaient présents dans la Torah, pour nous mettre en garde. C´est pourquoi, quand apparut le mensonge, les vrais Juifs le refusèrent ! Dès le début, Avshalom s´est posé comme une essence de roi, qui a le droit de se créer une justice complémentaire à celle de la Torah. Il tua son frère car, comme roi, il s´en voyait le droit, oubliant que David était encore roi, et que son frère Amnon, en tant qu´aîné, aurait dû succéder à David. En réalité, il lui fallait tuer Amnon pour s´ouvrir la voie de la royauté, et il se présenta donc comme le justicier ! Derrière les grands modèles de l´humanité, se cachent des hypocrites qui veulent prendre le pouvoir, soit par la force, soit par les cheveux longs et la démagogie de l´amour. La Torah nous avait prévenus : un jour, se lèvera quelqu´un fonctionnant exactement comme Avshalom. Mais nous ne pouvons être trompés, car la Torah ne nous présente pas un tel langage de miel et d´amour. La Torah est gvoura, difficulté : elle ordonne la circoncision d´un bébé ; pour sortir d´Egypte, il fallut égorger et rôtir l´idole des Egyptiens, le jour même de leur fête idolâtre, au risque de nos vies ! Celui qui prétend nous prendre en charge et nous sauver est seulement un Avshalom. Quand on décompose le mot klipa, choisi par nos Maîtres, on obtient : kal yafé, facile et beau. Car ce qui est séduisant, c´est le mal : nos Maîtres présentent le mal comme ce qui semble faire du bien, mais le bien immédiat est forcément la couverture du mensonge qui se cache derrière. Miel, mensonge et mort vont toujours ensemble.

RESUME DU COURS : Nathan dit à David "puisque tu reconnais ta faute, tu ne mourras pas." Mais il faut aussi une réparation. Quand nous avons blessé quelqu’un, ou cassé quelque chose, même si la faute est pardonnée, il nous arrive des épreuves, des issourim. Car la faute, la parole ou l’action mauvaise, a fait entrer en nous des impuretés, a dégagé des énergies négatives et causé des destructions. Il faut nettoyer toutes les saletés qui ont été accumulées dans notre âme, réparer notre être, et ceux que nous avons abîmés autour de nous. Hachem a prévu cette purification : nous avons, enfouies en nous, des forces qui, si nous les déployons, sont purificatrices et vont nettoyer toutes les impuretés entrées en nous. Ces forces nouvelles que nous allons déployer seront, en nous, comme des eaux purificatrices. Nathan avait déjà annoncé à David quelle serait sa punition : "un mâle se lèvera de ta maison. Il prendra tes femmes devant tes yeux". Puis suivent 3 versets, et est ajouté : "sache que l’enfant de Bat Sheva va mourir." Hachem frappa le bébé de Bat Sheva, qui était dans un état désespéré. David pria pour sa guérison, et il jeûna. Il ne pouvait même plus se lever.... Au bout de 7 jours, l’enfant mourut... David se leva immédiatement, remit ses habits royaux, se rendit au Tabernacle pour se prosterner devant Hachem, puis rentra chez lui et demanda qu’on lui prépare un festin. "Tant que l’enfant était vivant, j’ai jeûné, j’ai pleuré, car je me disais : peut-être qu’Hachem va pardonner et l’enfant vivra. Maintenant qu’il est mort, à quoi cela servirait-il ? Après avoir mangé, il alla vers Bat Sheva, s’unit à elle et naquit un enfant qu’ils appelèrent Shlomo, que D. aima. Hachem envoya Nathan dire aux parents : cet enfant sera appelé "Yedida, l’amoureux de D., car c’est ce que D. veut." Pendant 9 mois, au Beit HaMidrash, tous avaient fait honte à David. Puis, quand l’enfant, à peine né, tomba malade et mourut, tout le peuple y vit la punition d’Hachem. Mais, si cette mort avait été une punition d’Hachem, David aurait dû être encore plus affligé après qu’avant, car cela aurait signifié qu’il n’était pas pardonné. Bat Sheva lui aurait été interdite. Et il n’aurait pas pu aller au Temple. Or, David fit tout le contraire ! Car Nathan avait déjà dit à David : tu es pardonné, et c’est seulement après qu’il ajouta : l’enfant mourra. Cette mort n’est donc pas une punition. David ne se sent pas coupable, et c’est pourquoi il va avec sa femme, car il sait qu'elle ne lui est pas interdite. Si D. avait voulu punir David, selon le principe "mida ké negued mida", ce n’est pas l’enfant qui serait mort, mais c’est David qui aurait été envoyé à la mort, comme il y avait envoyé Ouria. David ne se trompe jamais, dans l’interprétation de ce qui lui arrive. Il sait qu’il y a des épreuves qui sont une punition, onesh, et d’autres qui sont un tikoun, une réparation, et qui sont constructrices : Hachem veut permettre à l’homme de dévoiler des forces surhumaines, et d’atteindre un niveau qu’il n’aurait pu atteindre. Si l’épreuve qu’il subit l’abat et qu’il s’écroule, c’est qu’il s’agit d’une punition. Mais si c’est un tikoun, l’homme se lève immédiatement, et gagne. David sait qu’il n’a pas fauté. D. lui donne des tikounim, des épreuves, pour lui permettre d’atteindre le niveau d’être le père du Mashiah. Il mit au monde Shlomo, c’est-à-dire la lignée du Mashiah. Les épreuves de David sont toutes les douleurs de l’enfantement, pour mériter d’être les parents du Mashiah. Le Talmud dit même que la faute de David avec Bat Sheva a été voulue par Hachem. Hachem a envoyé dans David ce yetser hara de l’impatience, car il voulait qu’il faute, afin qu’il devienne, pour l’humanité entière, le modèle de la teshuva qui est toujours possible. David savait que, pour mériter d’être le père du Mashiah, il fallait s’élever à des niveaux surnaturels de compréhension des messages divins, et c’est pourquoi il devait traverser des situations inextricables. Dans un psaume, il dit "mon cœur est vide" (de yetser hara) et il comprend qu’il est entraîné dans un processus qui le dépasse et que c’est Hachem qui agit, en tout cela. En hébreu, le mot "nissayon", épreuve, signifie "élever". En effet, dans le Judaïsme, par l’épreuve, D. ne veut pas nous détruire et nous casser, mais nous élever, comme un père le fait pour son enfant. Tout le monde le comprit plus tard, quand Shlomo inaugura le Temple, et que les portes refusèrent de s’ouvrir. Shlomo dit "fais-le pour mon père David", et les portes s’ouvrirent. Tout Israël comprit que David n’avait jamais fauté. Et il est devenu pour tous "David mele’h Israël, ‘hai vékayam". Il est, pour l’éternité, le modèle unique de la perfection et du Mashiah, car il a tout traversé, dans le bien comme dans le mal, et il est toujours resté le guerrier d’Hachem.

RESUME DU COURS : "David dit à Ouria "rentre dans ta maison, prends soin de toi..." Ouria sortit du palais mais, au lieu de rentrer chez lui, il dormit à l’entrée du palais." Ce qui constituait, vis-à-vis du roi, un très grand affront. Il voulait humilier David. David le rappella et lui demanda pourquoi il ne rentrait pas chez lui. Mais Ouria lui répondit "l’Arche sainte et les tribus d’Israël, et la tribu de Yehuda campent dans des tentes, et mon maître Yohav et les serviteurs de mon maître Yohav sont livrés à tous les dangers, et je rentrerais dans ma maison pour boire, manger et m’unir à ma femme ? De qui te moques-tu ? Tu ne mérites ni ce monde, ni l’autre !" Il insulte David. De plus, dans toute la Torah, quand on s’adresse au roi, on cite toujours Yehuda avant Israël ; et on ne parle pas de "mon maître Yohav", puisque c’est le roi qui est le maître de tous ! On voit clairement que c’est la haine qui anime Ouria. David aurait pu ordonner immédiatement sa mort, puisqu’il est "mored bémal’hout", il insulte le roi, ce qui le rend passible de mort. Mais David ne réagit pas et lui dit seulement "tu peux rester où tu es." C’est seulement le 3ème jour, lorsqu’Ouria dut repartir à la guerre, que David lui confia une lettre pour Yohav, lui disant de mettre Ouria en 1ère ligne des combats. Mais il faut souligner que ces combats existaient avant que David n’y envoie Ouria, et que d’autres milliers de soldats se battent au même endroit, dans les mêmes dangers. Ce n’est donc pas une situation de danger que David a créée spécialement pour Ouria. David ajouta "il sera frappé et mourra", car il sait comment le monde fonctionne : celui qui insulte le roi mérite la mort ; David aurait pu le tuer lui-même et ne l’a pas fait, pour être sûr qu’il ne recherche pas son propre intérêt. Il laissa D. agir. Et, en effet, "pendant que Yohav encerclait la ville, il mit Ouira à l’endroit où se trouvaient les meilleurs combattants. Les gens de la ville sortirent. Une partie des soldats d’Israël tombèrent, dont Ouria. Yohav envoya une missive à David, pour lui dire qu’une partie des meilleurs combattants d’Israël étaient tombés, et parmi eux Ouria. David lui répondit de continuer les combats et de faire tomber la muraille de la ville." Ce qui montre clairement que ce combat n’avait pas pour but de tuer Ouria. Mais pourquoi Ouria a-t-il insulté David, et voulu montrer son mécontentement en dormant à la porte du palais ? Il n’était pas d’accord avec la façon dont le combat était mené, car Yohav faisait le siège de la ville, au lieu d’attaquer et détruire la ville. Car une attaque coûte de nombreux soldats à Israël, et David et Yohav voulaient épargner des vies. Mais un siège peut durer longtemps, maintenant les soldats sous des tentes, et c’est ce qu’Ouria avait reproché à David, refusant de rentrer chez lui pendant que ses compagnons d’arme étaient sous des tentes. On comprend donc que, certes, David a fauté sur le plan des intentions, mais légalement et pénalement, il n’a commis aucune faute, à la fois parce que Bat Sheva était divorcée de son mari envoyé à la guerre ; et parce que, Ouria voulant tellement se battre, David l’avait fait envoyer au front ! Ayant insulté le roi et étant passible de mort, Ouria fut tué. Certes, David a agi avec précipitation, car il avait vu qu’il s’agissait de réparer la faute de Adam HaRishon, et que de lui et Bat Sheva sortirait le Mashiah. La faute des grands est toujours, non de faire le mal, mais de mal faire le bien. Le verset dit "ce fut au moment de la teshuva (du retour) du temps." Car, depuis la faute de Adam, ceux qui devaient être ensemble avaient été éloignés. D’abord, l’homme est éloigné de D. qui dit "où es-tu ? ", le corps de l’âme ; et c’est le début de l’exil, qui est l’éloignement de l’endroit où l’on doit être : Adam est chassé du Gan Eden. Nos Maîtres expliquent que le na’hash avait voulu prendre Hava pour lui, et se débarrasser d’Adam. La 1ère faute de l’humanité est donc décrite comme l’essai d’une capture de celle destinée à un autre, à Adam. C’est le secret d’après lequel "D. mézavègue zivouguim", D. fait des mariages, et le rôle du na’hash est d’empêcher qu’ils ne se rencontrent, puis d’essayer de séparer les couples et détruire les familles juives. Bat Sheva était le zigoug de David. Le Malbin fait d’ailleurs remarquer que le texte dit "elle entendit que son mari était mort, et porta le deuil de "baala". Dans le même verset, il est dit d’abord "ish", puis "baal" (qui signifie maître, ce qui a une connotation de quelqu’un qui oppresse), ce que le Malbin explique ainsi : rétroactivement, Bat Sheva compris qu’il était seulement pour elle "baal", et non son vrai zivoug.

RESUME DU COURS : C’est la rencontre entre David et Bat Sheva, qui se trouve dans le chapitre 11 (le chiffre 11 fait allusion à l’attribut de Kéter, de la Couronne ; et aussi à la dimension qui est au-delà de l’entendement). "Et ce fut vers le retour du temps" (Nos Maîtres expliquent que Bat Sheva était destinée à David depuis les 6 jours de la création et, depuis, ils avaient été séparés et se cherchaient ; ils se retrouvent au moment où le temps ramène ceux qui s’étaient éloignés, c’est-à-dire au mois de Ellul, mot composé des 1ères lettres de "ani lédodi védodi li" : Israël revient vers D, et D revient vers Israël). "Au moment où se dévoilent les rois (car va naître la lignée du Mashiah), David avait envoyé Yohav et toute l’armée d’Israël, faire la guerre à Amon (actuelle Jordanie), et il était resté à Jérusalem" (d’habitude, il était à la tête des armées, mais c’est ici le mois d’Ellul, et David se bat sur le plan spirituel, pour faire tomber les ennemis spirituels qui empêchent l’union entre Hachem et Knesset Israël). Dans la journée, David devait s’occuper du royaume, et il priait la nuit : "il se lève à minuit, et monte sur le toit de son palais. Il voit une femme, très belle." Et l’âme de David la reconnaît. "Il envoie des messagers qui lui disent : elle s’appelle Bat Sheva (ce qui signifie la fille du 7, qui est la dimension de la royauté) C’est la petite fille de A’hitofel, grand conseiller de David. Elle est l’épouse de Ourya Ha’hiti. Son nom est un code pour nous faire comprendre qui il est. Les ‘hitim, étaient l’un des 7 peuples Cananéens qui ont disparu depuis l’époque de la conquête, où ils ont été chassés par Yehoshua et son armée. Dans la Torah, ce sont les ‘hitim qui possédaient Maarat HaMakpéla, le caveau des pères, et Avraham avait dû le libérer en l’achetant à Ephron. Le mari de Bat Sheva s’appelle ‘hiti, pour montrer qu’il a aussi pour fonction d’empêcher l’union : il a été créé pour empêcher Bat Sheva de revenir à son vrai mari. Son nom, Ourya, est composé de "our" (une lumière produite par un feu, c’est-à-dire éphémère). Et de "ya", youd hé, qui sont les 2 1ères lettres du Nom divin.
