This Day in Legal History: The Housing Act of 1949On July 15, 1949, President Harry Truman signed the Housing Act of 1949, a centerpiece of his “Fair Deal” and one of the most ambitious housing laws in American history. Its stated goal was breathtaking in scope: “a decent home and a suitable living environment for every American family.” To get there, the Act poured federal money into public housing construction, expanded federal mortgage insurance, and created the urban renewal program to clear and redevelop so-called “slum” neighborhoods.The Act's legacy is genuinely double-edged, and it's worth telling honestly. On one hand, it expanded homeownership for millions and built hundreds of thousands of units of public housing. On the other, its implementation became one of the great engines of racial segregation in the twentieth century. Urban renewal too often meant bulldozing established Black neighborhoods—critics bitterly renamed it “Negro removal”—and the public housing built in their place was frequently segregated by design and concentrated in already-poor areas. Meanwhile the federal mortgage machinery it fed continued the practice of redlining, steering the benefits of homeownership toward white families and away from Black ones.That mixed legacy is why the Housing Act belongs in a legal-history conversation about civil rights. The same federal government that would, within a few years, order schools desegregated in Brown v. Board of Education was, through its housing policy, actively entrenching residential segregation—and residential segregation is what makes school segregation so durable, because in America where you live largely determines where you go to school. Human beings have always loved to gamble. Archeological records suggest we've been doing it for the last 12,000 years, since the end of the last Ice Age. But for as long as we've been playing games of chance, we've worried about what they might be doing to us. For thousands of years, everyone from Aristotle to George Washington condemned gambling, an ancient anxiety that ran so deep it became something like a moral consensus. And then that consensus evaporated. In the span of a decade, both Canada and the US legalized sports betting. Now anyone with a smartphone and a credit card can wager on basketball, hockey, or American cornhole. But it turned out that was just the beginning. A few years later came “prediction markets” like Kalshi and Polymarket that let you bet on, well, just about anything: whether the US will invade Cuba, the odds of James Comey being sent to prison, and whether Jesus Christ will return before 2027. That last one, by the way, is currently sitting at 3 per cent on Polymarket. If betting on missile strikes, military coups, and political prosecutions feels kind of gross, I'm with you. But James Surowiecki thinks we should give prediction markets a chance. Surowiecki is the author of The Wisdom of Crowds, a book he wrote more than 20 years ago, where he argued that large groups of ordinary people are actually better than experts at making predictions. It's become something of a foundational text for these markets: the idea that they can crowdsource knowledge, aggregate what millions of people believe about the future, and use that signal to make better decisions. Tartaglione says that Maurene Comey — the federal prosecutor handling his case (and previously working in the U.S. Attorney's Office in the Southern District of New York) — pressured or promised Jeffrey Epstein some form of preferential treatment or freedom if Epstein would implicate Tartaglione or assist in his prosecution.
