Even if you're using a brand name first, whoever files a trademark has the most rights. 6. Before creating the branding for your business, do a basic search on uspto as well as Google Search. 7. Hiring a lawyer for applying for a trademark adds further safeguard due to the extended search. 8. It's important to file the branding with the words used for the business instead of only the logo, so that it's always covered even when changing the branding colors and logo. 9. The beauty industry is one of the harder industries to get a trademark due to general wording that overlaps in the industry. 10.The trademark process can take a year or more after filing. 11. Trademarks can also negotiate terms specific to the state, but its typically federal. 12. If you're using a name before someone registers and sends a cease and desist, you can appeal it. 13. If a client is booking online and checks a box to agree to the policy, it's in written form and easier to enforce the charge. 6. If you don't have clarity on how charges work, when and what the stipulation is, it will be harder to legally hold the charge against the client. 7. Usually what can legally be held against you as a service provider is what you don't include, not what you do include. 8. Be careful when asking to hold credit card information, you need to get authorization to charge their card. 9. As far as holding a non-compete for an employee, it is meant to protect both parties. It's a red flag if a salon has you sign a non-compete if you are a 1099. 10. A non-compete shouldn't prohibit an employee from being able to work if they left. 11. As an employee, consider negotiating the terms of the contract before finalizing. 12. As a freelancer when signing a contract with a brand, if asked for a non-compete for a longer duration, negotiate either a higher rate or for a shorter timeframe. Keep in mind, the brand's contract doesn't typically work favorably for the artist. 13. Look for words like perpetuity because the intellectual property can belong to the brand if you don't negotiate it down. 14. Make sure you license it to them rather than them taking ownership of it. 15. Once you publish something online, you hold the copy-write to it. You need to give permission to someone else using your content, it could be copy write infringement. 16. It's easier to escalate as necessary rather than deescalate a situation. 17. Try reaching out to the brand directly first before reporting, this is where you can negotiate a paid relationship with them. 18. If you feel nervous about signing a contract, think of it as a way to protect both parties and to prevent miscommunication. As readers may remember, The Beekeeper has been one of my favorite movies of the year thus far. One thing in particular I loved about it was the costume design: It's an underappreciated artform, conveying character through clothing, and the costuming in this film perfectly conveyed a range of characters, from “taciturn hero” to “crazed killer” to “crypto douchebag.” Which is why I'm very excited to have Kelli Jones, the film's costume designer, on this week to talk about The Beekeeper and her work elsewhere. Missouri's 54th governor is back in Jefferson City for today's 1:30 unveiling of his official portrait. It will take place in the Missouri Capitol Rotunda. Former Governor Matt Blunt (R) was elected governor in 2004 at the age of 33, making him the second-youngest governor elected in state history. He served as governor from 2005-2008 and was secretary of state before that, serving from 2001-2004. He beat then-Missouri House Speaker Steve Gaw (D-Moberly) in the secretary of state's race in 2000. He narrowly defeated then-Auditor Claire McCaskill (D) in Missouri's 2004 gubernatorial race. Missouri Governor Mike Parson hosts today's 1:30 portrait unveiling. Parson deputy chief of staff Kelli Jones tells 939 the Eagle that they're expecting a crowd of about 50 people, which include Governor Parson, former Governor Blunt and his family and Lt. Governor Mike Kehoe. Former Governor Blunt joined us live on 939 the Eagle's "Wake Up Mid-Missouri", telling listeners that he's seen a photo of the portrait and that he's impressed. Kelli Jones, a virtual lawyer for entrepreneurs and small business owners, is our guest this time. Her work is primarily focused on trademarks, contracts, and early business consulting. She's on the show to discuss the recent Glasser Images lawsuit and how couples can avoid being in a similar situation. To begin, Kelli dives into why contracts are important, especially when working with wedding vendors. Contracts outline expectations, but they also provide protection. It is also an important way of communicating specific details with your vendors. When hiring someone for your wedding, it's easy to get caught up in the excitement, but you don't want to forget to cover your bases legally. Kelli discusses the Glasser Images lawsuit and the situation as she understands it to this point. One thing that really struck Kelli is that a few couples had already paid in full right up to the day that the company announced they were going out of business. She notes there is a lot about this situation that seems odd or simply doesn't make sense. No couple wants to find themselves in the same situation, and Kelli shares what they should do to avoid it. There are some things in particular you should review in your contract, especially in terms of what's refundable and what's not. She also touches on what you should do if your contract is breached. When working with vendors for your wedding, make sure there is a contract in place and always review it fully so you know the agreements for scheduling, cancellations, and refunds. Setting boundaries and expectations ahead of time will support you through the process, even if things happen that are out of your control. I meant to meet today's guest during my trip to Denver for Outdoor Retailer in August, but sadly, I ran out of time. But the lack of that face to face meeting fortunately didn't prevent us from connecting for this episode as one of her sales associates kindly made the introduction. Kelli Jones is the founder and owner of NOSO Patches, a Jackson Hole, Wyoming-based business comprised of adhesive patches that assist in the repair of rips and tears in your outerwear. What started out as simply a better-looking alternative to duct tape, NOSO has grown to a staff of 5 in-house and 15 outside sales reps while annually moving tens of thousands of units in just 5 short years. I was excited to hear her story, but I honestly wasn't anticipating her absolutely infectious joyful nature. She's a dirt bike rider, mountain biker, wake boarder, hiker, back country skier, and all around bad ass. I really hope to make it back to Jackson where we will certainly be sharing some whiskey. Kelli Jones is the Co-founder and Co-CEO of Be Nimble Foundation, where the goal is to create a fully diverse and inclusive tech ecosystem. Born and raised in Indianapolis, Indiana, Kelli got her start as a business owner running an experiential marketing agency in the entertainment industry. In 2013, Kelli was introduced to the startup accelerator business model and launched Be Nimble Foundation in 2016. Be Nimble is a 501(c)(3) social enterprise with the goal of advancing diversity initiatives to create fully inclusive tech ecosystems. They focus their efforts on workforce development and start-up and entrepreneurship support. Be Nimble helps people gain high-paying jobs in technology and support diverse start-up founders through our accelerators, workshops, and pitch competitions. They are there to close the economic wealth gap and create generational wealth for their community. Through intention, planning, and some serendipity, Kelli partnered with Allos Ventures to launch Sixty8 Capital in 2019. Kelli Jones joined Allos Ventures in 2020. As Program Manager, Kelli will help Allos identify and evaluate investment opportunities and enhance its presence in the marketplace. She will also support Allos portfolio companies with activities such as investor and mentor introductions. Prior to joining Allos, Kelli was the Program Manager for Techstars, where she supported early stage start-ups in the Heritage Group Hardtech Accelerator; and was Director of People, Culture, and Brand for Givelify. Kelli is also a founder of Be Nimble Foundation and Black Hatch Fund, which support tech and tech-enabled start-ups founded by Black and Brown founders in Indiana. Before relocating to Indianapolis in 2017, Kelli lived in Los Angeles, CA, working as Director of Sales & Marketing for two venture-backed media companies, HipHopDX and Blavity. She spent the majority of her career in New York, running an event and experiential marketing agency working for brands like Google, HP, Microsoft, Lipton/Brisk, Redbull, Samsung, and Akai. Don co-founded Allos in 2010, but he did some pretty cool stuff before that, too. Don's tenacity and entrepreneurial drive exhibited itself early in his career, when he was so frustrated that Hewlett Packard had come on campus his senior year solely to recruit electrical engineers (as a production and operations management major, he was more of an industrial engineer) that he accosted the recruiter in the hallway and refused to let him leave until he'd managed to secure a job offer. After working as an operations manager in Hewlett Packard's Circuit Technology Group, serving on the corporate-wide team responsible for the selection of a new ERP system, and having co-founded two small software companies along the way, Don left HP for business school. Upon graduation, he joined The Boston Consulting Group as a consultant, and then Diageo, where he was a manager of strategy for Guinness Americas and Caribbean (he assures us that testing the product was not part of his job responsibilities, but merely a perk). He first moved into the venture capital world with the Fox Group in New York, where he participated in the early funding of companies including WebMD, before being recruited to join Gazelle TechVentures as its second managing director in April 2000. Gazelle was ranked in the top quartile for venture funds nationally for its 2000 vintage, and Don participated in all of the firm's successful investments, including Rubicon Technology (NASDAQ:RBCN), a former Russell 2000 company, where he served as executive chairman. And five years after meeting John, who was serving on the executive committee at Gazelle, Don agreed to join Blue Chip as a managing director, where he managed investments in software and services companies Aprimo and Intradiem. Don has served on the advisory boards of the Entrepreneurship and Innovation Centers for IU and Ball State, and is Chairman Emeritus of the advisory board for Indiana University’s School of Informatics and Computing. Don is a frequent lecturer at IU, Notre Dame, Butler University and has twice taught the Entrepreneurship capstone course at Purdue University. Diversity and inclusion are arguably the most important issues in tech culture right now. Companies on and between the coasts, from startups to global corporations, recognize more and more the positive impacts of improving diversity and inclusion. In fact, our tech censuses in Indianapolis and Cincinnati this year revealed that it’s the top-ranked social issue by members of both communities. Belles & Whistles are Jaymie Jones and her 17-year-old daughter and Kelli Jones. The ladies have already garnered a growing following on social media, including over 16,000 fans on Facebook. Their music can heard on over 70 radio stations across the USA, in 1,800 retail outlets, and streamed on CMT.com, GACTV.com and ZUUS Country. They’ve achieved international video airplay on two original songs, “Boy Like You” and “Princess.” The duo has played for audiences all over the country at fairs, festivals, clubs, radio shows, and writers rounds. Belles & Whistles enjoy connecting to audiences with their personal lyrics, strong harmonies and genuine performances, as the audience shares in their onstage chemistry and their joy in performing.
