Recently, a debate about appointing judges has gained momentum in light of cash allegedly being found in the house of a Delhi High Court judge. What began as a discussion about transparency in judicial appointments has widened into a broader conversation about the functioning of India's justice system, which is already strained by millions of pending cases. But concerns run deeper than just courtrooms. A recent report, called the India Justice Report 2025, flags critical issues across four pillars of the justice system: police, judiciary, prisons, and legal aid. The report shows that no State or Union Territory has fulfilled its own commitments for improving representation, particularly for women and SC/STs, within the police force. Vacancy rates remain alarmingly high, regular training is neglected, and appointments to the judiciary continue at a sluggish pace, weakening public trust in institutions meant to uphold the rule of law. Against this backdrop, two critical questions emerge: How can India strengthen the foundations of its justice delivery system? What institutional reforms are urgently needed to ensure fairness, inclusivity, and efficiency for all? We are smack dab in the middle of telling about the history of Texas during the Civil war. There's no exact count of how many battles and skirmishes that were fought in Texas. In fact, most of the Texans who fought for either the confederacy or the union took part in battles in Tennessee, Virginia, or elsewhere in the South. There were however four notable battles that did take place in Texas, well the first actually was in New Mexico, but it started in Texas. They are on March 28, 1862, Battle of Glorieta, the Battle of Galveston October 4, 1862. the battle of Sabine Pass, on September 8, 1863, The Battle of Palmito Ranch, was the last battle of the civil war on May 13, 1865. What I want to talk about today is one of what many historians consider to be a key (while not necessarily a major battle) is known as the Battle of Glorieta, which occurred on March 28th, 1862. Now it actually took place, not in Texas, but in New Mexico at Glorieta Pass which is in Far West New Mexico. The Confederate force, named Brig. Gen. Henry Hopkins Sibley's Army of New Mexico, actually consisted primarily of men from Texas. The “army” invaded New Mexico, which was Union Territory and captured Fort Fillmore which was located close to the settlement of Mesilla. The “army” then won another skirmish at Valverde in February of 1862. After that they moved northwest, moving along the banks of the Rio Grande, and by early March they occupied Albuquerque and Santa Fe. After their successful mini invasion, they stopped to gather supplies and rest while they planned their attack on Fort Union which was the Federal Supply Center. It was about 100 miles northwest of Santa Fe and was a major stop for travelers who were on their way to the gold fields in Colorado. Meanwhile, Colorado attorney Colonel John Slough put together a group of volunteers from the gold fields and joined together with detachments of cavalry and infantry from Fort Union to create a force of about 1,300 men. Then on March 22nd, Slough led the group on a march to engage the Texans near Santa Fe. Simultaneously, Sibley moved his main column of men towards Fort Union. Meanwhile, a confederate force of men led by Major Charles Pyron who stayed in Santa Fe, decided to move towards the east along the Santa Fe trail.in an attempt to find and engage with the union forces. He led his troops from Cañoncito in the early morning hours of the 26th of March and almost immediately ran into Slough's advance guard. Slough guard had just about 420 men and was led by Maj. John M. Chivington. The two forces see each other, the Texans decide to form a traditional straight ahead battle line that blocked passage. The Union forces simply outflanked them by climbing up the hills that bordered the trail. Seeing they were about to lose, the confederate forces retreated back towards a small valley that is known as Apache Canyon. This valley had multiple fields that had been cultivated for farming and it was there they decided to setup another similar battle line, much like the one they had abandoned. Once again Chivington simply ran a flanking action and this time, since it was more open, he also had his cavalry charge the Texans. As a result, at least 70 Confederates were captured, it is estimated that 4 others were killed, and about 20 were wounded. After this setback, Pyron retreated back to his main camp at Cañoncito from where he dispatched a messenger asking the main Texan force to send him reinforcements. Meanwhile Major Chivington, who also suffered some casualties, 5 men killed and 14 wounded, decided to return to the main Union camp which was 12 miles away at a station known as Koslowski's Ranch. You only went to the site and informed the people through a loudspeaker,” unquote.The BJP expelled 37 office-bearers across the state today who are set to contest as Independents in the upcoming Maharashtra Assembly elections, citing “indiscipline”. Highly placed sources in the BJP confirmed the development and said that despite repeatedly urging the rebels to withdraw their candidature, these 37 candidates who hold different posts in their respective district units did not pay heed to the party's request. These districts include Zanskar, Drass, Sham, Nubra, and Changthang. According to the official website of the Ladakh administration, two districts made up the Union Territory — Leh and Kargil. Where Leh had six sub-divisions, Kargil had four.According to records accessed under the Right To Information Act, The Indian Express learnt official scrutiny that lasted nine years till 2019 tracked 1,084 complaints of Government jobs being acquired on fake caste certificates. The RTI records were made available for 59 of the 93 ministries and departments under the Government. Records from the Department of Personnel and Training show, from these cases, 92 personnel were dismissed from service,. These numbers assume significance given the Puja Khedkar case who is in the dock for allegedly presenting dodgy caste and disability certificates to secure a seat in the civil services.The findings of the Justice Hema Committee and the numerous sexual misconduct allegations that emerged against several male insiders since the panel report's release have finally led to the collapse of the Association of Malayalam Movie Artists as its office bearers submitted mass resignation on Tuesday. While Malayalam superstar Mohanlal stepped down as president of the association, Manorama Online reported, all members of the executive committee have also submitted their joint resignations. This comes a day after the party called a 12-hour bandh in the state to protest against the alleged police action on protesters during the Nabanna Abhijan.Amid torrential rains in Gujarat, a runway side wall of the Rajkot International Airport collapsed on Thursday. Rescue operations are underway across the state, where the rain fury has claimed about 35 lives since Monday. The Army and Indian Coast Guard have been evacuating people from flood-affected districts. These districts include Zanskar, Drass, Sham, Nubra, and Changthang. According to the official website of the Ladakh administration, two districts made up the Union Territory — Leh and Kargil. Where Leh had six sub-divisions, Kargil had four.Meanwhile, the Bharatiya Janata Party released its first list of 15 candidates for the 2024 Jammu and Kashmir Assembly polls today. Earlier in the day, the BJP had released a list of 82 candidates, which reportedly mentioned those contesting in the second and third phases as well, which they took down shortly after its release. The elections to the 90-member J&K Assembly will be held across three phases on the 18th of September, the 25th of September, and the 1st of October. Results will be announced on the 4th of October.According to records accessed under the Right To Information Act, The Indian Express learnt official scrutiny that lasted nine years till 2019 tracked 1,084 complaints of Government jobs being acquired on fake caste certificates. The RTI records were made available for 59 of the 93 ministries and departments under the Government. From these cases, 92 personnel were dismissed from service, records from the Department of Personnel and Training (DoPT) show. These numbers assume significance given the Puja Khedkar case who is in the dock for allegedly presenting dodgy caste and disability certificates to secure a seat in the civil services.The second #MeToo movement that has hit the Malayalam film industry continued to bring more actors under the shadow of alleged sexual misconduct as actor Minu Muneer alleged today that she faced physical and verbal assault from various actors, including a two-time CPI(M) legislator in Kerala Assembly. While twenty-three people were killed in Pakistan's Balochistan, gunmen killed at least nine people, including four police officers and five passersby, in the Qalat district. According to Assistant Commissioner Musakhail Najeeb Kakar, the assailants blocked the inter-provincial highway in Musakhel's Rarasham district, offloading passengers from several buses. Meanwhile, the Congress has decided to hold a nationwide protest on June 21 (Friday) demanding justice for the NEET candidates.Patna High Court set aside the Bihar government's notifications to raise reservations in government jobs and educational institutions from 50 per cent to 65 per cent today. On 7th of November last year, the Nitish Kumar-led Mahagathbandhan government raised the Bihar quota and reservation in the state effectively became 75 per cent when the 10 per cent quota for economically weaker sections (EWS) is taken into consideration. The bench said that it is “infringing upon right to equality”.The death toll in the hooch tragedy in Tamil Naidu increased to 34 today, with around 100 others hospitalised — five of them in critical condition. Most of the victims consumed the spurious liquor at Karunapuram in Kallakurichi on Tuesday night. As the spurious liquor started to take effect yesterday, they were admitted to hospitals. Nine pilgrims were killed and over 41 injured after terrorists fired on their bus in Reasi, which resulted in the vehicle plunging into a gorge. This is not a new trend; the south has rarely followed the electoral trend set by the north. In the 1977 Lok Sabha elections, while the Congress was wiped out in the Hindi heartland, it continued to hold onto its seats in the south. Similarly, in the last nine years, even at the peak of its popularity the BJP has been unable to breach the southern fortress as convincingly as it would like to. On the 22nd of April, Pakistan announced that its Foreign Minister Bilawal Bhutto Zardari will visit India for a multilateral meeting with his Shanghai Cooperation Organisation, or SCO, counterparts. The abrogation of Article 370 and reducing Jammu & Kashmir to a Union Territory in August 2019 has not helped in ending terrorism, belying the tall claims of the Modi government. ‘सबका साथ सबका विकास', यही नारा है BJP का। दुनिया के सबसे बड़े लोकतंत्र की सबसे बड़ी पार्टी होने का दावा करने वाली BJP ने हमेशा ही खुद को अलग बताया है, ये कह कर कि हम सबको साथ लेकर चलते हैं। हालांकि ज़मीनी सच्चाई कुछ अलग दिखाती है। 6 जुलाई, 2022 यानी कि कल बुधवार को अल्पसंख्यक मंत्रालय यानी कि Ministry of Minority affairs मंत्री Mukhtar Abbas Naqvi ने इसितफा दिया क्योंकि उनका कार्यकाल ख़तम हो चुका था। Mukhtar Abbas Naqvi के इस्तीफे के बाद भारत के इतिहास में पहली बार ऐसा हुआ है कि दुनिया की सबसे बड़ी पार्टी होने का दवा करने वाली BJP से एक भी मुस्लिम सांसद या विधायक नहीं है। तो जब प्रतिनिधित्व नहीं है, मुस्लिम नहीं है तो फिर कैसे सबके साथ सबका विकास का नारा सही है, इसी पर चर्चा करेंगे आज। नमस्कार, आदाब, सत्श्रीअकाल, मैं हूँ Sahiba Khan और आप देख रहे हैं UNCUT. आज यानी कि 7 जुलाई के बाद, सत्तारूढ़ भारतीय जनता पार्टी (भाजपा) के पास लोकसभा या राज्यसभा में एक भी मुस्लिम सांसद नहीं होगा। राज्यों और केंद्र शासित प्रदेशों माने Union Territory की 31 विधानसभाओं में से किसी एक में भी मुस्लिम विधायक नहीं होगा। लोकसभा और राज्यसभा में कुल मिलाकर 4908 सीटें हैं। लोकसभा की 543 सीटें, राज्यसभा की 245 सीटें और बाक़ी legislative bodies की सीटें मिला लें तो बाकी 4120 का आंकड़ा आ जाएगा। पत्रकार रहे और पूर्व केंद्रीय मंत्री MJ Akbar, जिन पर अक्टूबर, 2018 के #MeToo watershed moment में कई महिलाओं ने sexual harassment के आरोप लगाए थे, उन्हें भी बीच में से ही अपने पद से इस्तीफा देना पड़ा था। उनका कार्यकाल 29 जून को समाप्त हो गया। इसके बाद, भाजपा के राष्ट्रीय प्रवक्ता सैयद ज़फर आलम का कार्यकाल 4 जुलाई को समाप्त हो गया और इसके ठीक तीन दिन बाद राज्यसभा में सदन के deputy leader और फिर Minority Affairs के मंत्री मुख्तार अब्बास नकवी का कार्यकाल 7 जुलाई को समाप्त हो गया है। लोकसभा में BJP के आख़िरी मुस्लिम सांसद शाहनवाज हुसैन थे, जो 2009 के General Election में बिहार के भागलपुर से जीते थे। भारत में मुसलमान पूरी आबादी का करीब 15.5% है। तो अब सवाल वही आ कर खड़ा हो जाता है कि जो पार्टी सबका साथ सबका विकास की बात करती है उसमें भारत के 20-22 करोड़ की मुस्लिम आबादी का एक भी शख्स आखिर कैसे नहीं है। इसका जवाब जानना आसान नहीं है। इसलिए हमें कुछ patterns follow करने होंगे। एक बात तो ये है कि सियासी जानकारों का का मानना है कि BJP से मुसलमान हताश और निराश हैं। ध्रुवीकरण की राजनीती के चलते मुसलमान पुरज़ोर कोशिश कर रहे हैं कि वोट पूरा एकतरफा पड़ जाए। एक फैक्ट ये भी है कि भारत में इस समय मुसलमान BJP candidates को हराने के लिए वोट डाल रहे हैं। BJP को भी ख़ास फायदा नहीं हुआ मुस्लिम candidates field करने में तो उन्होंने भी सोचा कि हटाओ, जब फायदा ही नहीं तो फिर ये representation का लिबास भी क्यों पहना जाए। UP में चुनाव के दौरान कई मुस्लिम बहुल इलाकों में गए तो लोगों ने यही कहा कि BJP के candidates कहते हैं कि हमें आपके वोट की ज़रूरत नहीं क्योंकि बाकी तो हमें वोट कर ही रहे हैं। कई लोगों को ऐसा भी लगता है कि BJP खुद बहुत चाओ से प्रचार-प्रसार नहीं करती अगर उस इलाके में मुस्लिम ज़्यादा हैं। हालांकि ये theory रामपुर और आज़मगढ़ में गलत साबित हुई। रामपुर में कुल 51% मुस्लिम आबादी है। रामपुर, जिसे Azam Khan का गढ़ मन जाता रहा है, वहां Ghanshyam Lodhi 40,000 वोटों से जीत गए। आजमगढ़ में भी SPA के धर्मेंद्र यादव को BJP के दिनेश यादव ‘Nirahua' ने हरा दिया। इस पर भी एक counter argument ये है voting के दिन कई चुनाव क्षेत्रों से और गली-कूचों से खबरें आईं कि पुलिस मुसलमानों को वोट डालने ही नहीं दे रही है। खुद आज़म ख़ान ने ट्विटर पर video और तसवीरें साझा करीं जहाँ लोग कह रहे हैं कि उन्हें वोट नहीं डालने दिया जा रहा। अखिलेश यादव ने भी कहा कि fake voting कराई जा रही है, कई voting booths में EVM मशीनें ख़राब पाई गई हैं। खबरें तो ये भी आईं कि SPA के नेताओं और कार्यकर्ताओं को BJP ने खासा परेशान किया उस दिन। आपको बताती चलूँ कि आजमगढ़ में उस दिन वोटिंग percentage 49.43 था और रामपुर जैसे मुस्लिम बहुल इलाके में voting percentage था 41.39. BJP ने भी दोनों क्षेत्रों में OBC factor ध्यान में रखते हुए OBC कैंडिडेट्स ही चुने। उसमें अगर वोट करने पर रोक की खबरें, EVM ख़राब और पार्टी कार्यकर्ताओं को परेशान करने की ख़बरों को साथ लेकर देखा जाए तो शायद ये नहीं कहा जा सकता कि अब मुस्लिम समाज भी धीरे-धीरे BJP का वोटर बन रहा है। अब आ जाते हैं एक और थ्योरी पर - कि क्या मुसलमान SPA का मोह छोड़ रहे हैं? bypoll नतीजों से तो ऐसा ही लग रहा है। मगर ये नतीजे संसद में पुख्ता दिखाई नहीं दे रहे क्योंकि मुस्लिम कैंडिडेट ही नहीं है दुनिया की सबसे बड़ी पार्टी के पास। मगर मोदी सरकार लोगों को हमेशा चौंकाती ही है। चाहे वो महाराष्ट्र के मुख्यमंत्री का चयन हो जिसमें एकनाथ शिंदे को हाल ही में मुख्यमंत्री बनाना हो या फिर झारखंड में हेमंत सोरेन को रिझाना हो। जी हाँ कांग्रेस के साथ गठबंधन में बनी झारखंड मुक्ति मोर्चा की सरकार का BJP की तरफ झुकाव जगज़ाहिर है। BJP की राष्ट्रपति nominee Droupadi Murmu को सोरेन सरकार ने अपना समर्थन दिया है। तो सियासी रणनीति समझना अभी बहुत मुश्किल है। हमें ये भी याद रखना होगा की ऐसे नाज़ुक माहौल में जहाँ एक तरफ नूपुर शर्मा के बयान की खाड़ी देशों ने निंदा की और BJP को उन्हें पार्टी से हटाना पड़ गया, क्या ऐसे समय में दुनिया की सबसे बड़ी पार्टी का तमगा पहने BJP सही में मुस्लिम नेता नहीं रखेगी? बातें तो ऐसी भी हो रहे हैं की उप राष्ट्रपति की कुर्सी पर मुख़्तार अब्बास नक़वी भी बैठ सकते हैं। और कहीं न कहीं 2024 में BJP को मुस्लिम वोट की जब ज़रूरत पड़ेगी ही, तब के लिए शायद मोदी सरकार का भारत के मुसलमानों के लिए ये एक प्लान हो सकता है। प्रतिनिधित्व कम तो होगा ही मगर शून्य पर होना एक बहुत निराशाजनक बात होगी क्योंकि भारत पर कई देशों की और खासकर कि मुस्लिम देशों की नज़रें गढ़ी हुई हैं। बाहरी रिश्तों को संजो कर रखने वाले PM Modi शायद अब ये रिस्क नहीं लेंगे। देखना होगा कि अंत में लोग सरकार के किस फैसले से चौंकते हैं। OUTRO Host: @jhansiserani Sound designing: @lalit1121992 Guest: Arathi Radhika Jerath

In August 2019, when Article 370 was reduced to a shell, and the state of Jammu & Kashmir whittled down to a Union Territory, the Central government promised to turn it into the most developed state in the country within five years. Long a part of the BJP's ideological agenda, Home Minister Amit Shah said on the floor of Parliament at the time that Article 370 was the biggest hurdle in the path of normalcy in Kashmir. Earlier in May, as it redrew Jammu and Kashmir's electoral map, the government's three-member Delimitation Commission recommended creation of six assembly constituencies in Jammu and one in Kashmir. With this, there will be 47 assembly segments in the Kashmir division and 43 in Jammu. So there are 90 assembly seats in JK, up from 83 earlier. According to the 2011 Census, the population of Jammu and Kashmir is 12.5 million. Of them 6.89 million live in Kashmir, 5.38 million in Jammu and 2, 74,00 in Ladakh. The exercise and the proposal have drawn heavy criticism from various political quarters, especially within the Kashmir Valley. “The delimitation commission has become an extension of BJP… We reject it, we have no faith in it,” Former JK chief minister Mehbooba Mufti BJP's former ally Mehboob Mufti was blunt in criticism. She said that the commission has ignored the basic parameter of population and added or removed areas as per their wishes. But what exactly is delimitation? Delimitation is the process by which the limits or boundaries of a country's territorial constituencies are rejigged to reflect changes in population. The redrawing of these boundaries is based on the recent census. In India, the number of Lok Sabha seats allocated to different states, along with the total number of seats in a state's Legislative Assembly, can change as a result of a delimitation exercise. And the body tasked with carrying out the exercise is called delimitation commission or boundary commission. Such commissions have been constituted four times in India. First was in 1952 under the Delimitation Commission Act, 1952, then in 1963 under Delimitation Commission Act, 1962, in 1973 under Delimitation Act, 1972 and in 2002 under Delimitation Act, 2002. The delimitation exercise is done for three main reasons. First, to ensure a fair division of geographical areas. Second, to ensure equal population representation from every seat. And, third, to ensure that the principle of “One Vote One Value” is maintained. Now, let us delve into the controversy in Kashmir over the delimitation commission's proposal. The report has five major takeaways. First, the five parliamentary constituencies have been re-organised so that each now has 18 assembly constituencies. Second, six assembly seats in Jammu and three in Kashmir have been reserved for Scheduled Tribes. The third is the formation of the Anantnag-Rajouri Parliamentary constituency by merging Kashmir's Anantnag area with Jammu's Rajouri and Poonch. The fourth is the addition of six new Assembly constituencies in Jammu and one in Kashmir. Last and fifth, it has been proposed that the Union Territory's Legislative Assembly should include at least 2 people from the Kashmiri migrant population. So, why the criticism and opposition? As a recent Business Standard editorial explains, the main reason for this is the seat distribution in both the Assembly and Lok Sabha. It appears that the old communal divide between Jammu and Kashmir has been maintained by allocating them 43 and 47 seats, respectively. This allocation significantly alters the vote shares in the Assembly. Jammu, with 44 per cent of the population, will get to vote for 48 per cent of the seats. Meanwhile, the Kashmir division, with 56 per cent of the population, will get to vote for 52 per cent of the seats. Under the earlier configuration, Jammu had 44.5 percent of the seats and Kashmir 55.4 per cent. And when it comes to the realignments of the parliamentary seats, critics see the influence of Kashmiri-speaking Muslim voters being reduced with the restructuring of the Jammu and Anantnag seats. No wonder there have been allegations of gerrymandering.

Chief Election Commissioner Sunil Arora announced the days in which Assam, West Bengal, Kerala, Tamil Nadu and Puducherry would go to the polls. The elections in Assam will be conducted in three phases starting on March 27. The second phase will be held on April 1 and the last phase will be April 6. After one and half years of internet restrictions in Jammu and Kashmir, last week the government ordered the restoration of 4G mobile internet in all of the Union Territory. This was the longest instance of high-speed Internet being suspended by an elected government, perhaps in the world. In this episode, we talk about how people have reacted to this, why the government decided to do this now, and how internet restrictions impact the economy. A decades-old border dispute between Maharashtra and Karnataka has caught fire again, with Maharashtra Chief Minister Uddhav Thackeray staking claims to some long-disputed territories between the states. Maharashtra, for the last 60 years or so, has been laying its claim on areas such as Belagavi, Karwar, Nippani, Vijayapura, Dharwad and Uttara-Kannada – that are currently a part of Karnataka, arguing that Marathi-speaking regions should come under Maharashtra. And recently, in a public book launch event on 27 January, as CM Thackeray revived the state governments agenda asking for the disputed areas to be made into a union territory until the problems are resolved, Karnataka Deputy Chief Minister Lakshman Savadi spat back at him saying that Mumbai should be made into a Union Territory.While Thackeray accused the Karnataka government of deliberately changing Belgaum's name to Belagavi... even threatening to take the matter to court, Savadi condemned the statements made by Shiv Sena top brass and said that Marathi people in Belgaum are like all Kannadigas in the state. Facts The Petitioner questioned the decision taken by the various States and Union Territories to affix posters outside the residences of persons who have been tested Covid-19 positive and are required to undergo home isolation. Many arguments in this regard were advanced by the Petitioner. It was prayed by the Petitioner inter alia to issue directions to stop publishing the names of Covid-19 Positive persons/patients by the officials of the States and the Union Territories. It was further prayed to stop freely circulating their names in welfare associations of colonies and apartment complexes as the same constitutes serious violation of fundamental rights, right to privacy and dignity. Important Observations After hearing all the parties, the Court observed that the Union of India has not issued any guidelines for pasting or affixing of posters or other signage outside the residence of Covid-19 Positive persons. It was also observed that the guidelines pertaining to Covid-19 are referable to exercise of powers by the authority under the Disaster Management, 2005 and the same do not contain any requirement of pasting of posters against the houses of Covid-19 patients. Final Observations and Held In view of the above, it was finally observed by the Court that “no State or Union Territory is required to paste posters outside the residence of Covid-19 positive persons, as of now.” It was further held in unequivocal terms by the Court that the State Governments and Union Territories can resort to the exercise of posting posters against the houses of Covid-19 patients only when any direction is issued in this regard under the Disaster Management Act, 2005. Analysis The final observations of the Court are quite interesting. On the one hand, the Court made it amply clear that currently, there is no requirement of pasting posters against the houses of the Covid-19 patients and on the other hand, the Court did not close that option or did not held the pasting of posters to be a violation of fundamental rights or illegal per se. Thus, the question whether posters would be required to be affixed against the houses of Covid-19 patients or not in the future has been left wide open by the Court and in a way, the Court refused to venture into this question since in the considered opinion of the Court, it is the job of the authorities under the Disaster Management Act, 2005. Concluding Remarks The Disaster Management Act, 2005 is the main law under which the Union Government has been making endeavours to manage the Covid-19 pandemic. Everything relating to management of the Covid-19 pandemic is being handled by the Union Government under the Disaster Management Act, 2005. I concur with the methodology of the Court that when something is not required currently (pasting of posters against the houses of Covid-19 patients), then it is not necessary to venture into the question of its legality or illegality. At the present moment, it is an academic question at best. But the Court did not stop here since it very well understands the hazards of a pandemic like Covid-19. By giving this judgment, the Court acknowledged that it is not an expert on Covid-19 pandemic, and it left its manner of management to be decided by the experts and competent authorities.
Liability of the Railways in relation to Theft occurring on the Trains/Railways In the earlier post, we talked about the possible immediate steps that could be taken in case a theft occurs inside a train/railway. In the present post, we shall endeavour to under the relevant legal provisions and judicial pronouncements in this respect. Important Legal Provisions Section 100 of the Railways Act, 1989 “Responsibility as carrier of luggage - A railway administration shall not be responsible for the loss, destruction, damage, deterioration of non-delivery of any luggage unless a railway servant has booked the luggage and given a receipt therefore and in the case of luggage which is carried by the passenger in his charge, unless it is also proved that the loss, destruction, damage or deterioration was due to the negligence or misconduct on its part or on the part of any of its servants”. Duties of the TTEs and Railway Staff in relation to Theft The relevant Circular issued by the Railways can be read here. 1. In case of any theft occurring on the train, the Superintendent/TTEs on train are required to guide the passenger to the GRP Escort Party, if travelling by the Train or else make a blank FIR and submit the same to the first GRP Post (Railway Police) available at the scheduled stoppage of the train for further action. 2. TTEs are required to be presented at the allotted coach and if more than one coach is to be manned, give frequent visits to all such coaches. 3. The TTEs/Superintendents must report to their superiors about any person who is causing any trouble or is not performing his/her duties properly. He shall also be vigilant in ensuring “Customer Satisfaction.” 4. The TTEs/Superintendents shall maintain a Complaint Book and make the same available to the passengers, as and when required. 5. It is the duty of the Train Superintendents/TTEs to make sure that no unauthorized hawking and begging takes place on the Train. 6. The Train Superintendent/TTEs should also ensure that the reserved coaches are secured and latched when on the run and the vestibule doors are bolted at night and supervised. 7. It is the responsibility of the Train Superintendent to ascertain the details of the staff working on the train and ensure that they perform their duties properly. Important Case-Laws Northern Railways v. Balbir Singh, First Appeal No. 311/2014, State Consumer Disputes Redressal Commission, Union Territory, Chandigarh In reserved coaches, it is the duty of the TTE to ensure that no intruder enters the reserved compartment of the Railways. In this case, theft of two suitcases took place from a reserved compartment and the Hon'ble Commission said that it cannot be ruled out that “some intruder must have entered the reserved compartment who committed the theft of the suitcases. Had the TTE of the Railways been vigilant and careful then the entry of the intruders/some unauthorized persons must have been prevented in the coach during the night and the complainant did not have to face the mental agony and harassment due to the theft of his suitcases.” Hence, it was held that the TTE of the train failed to perform his duties, which amounted to negligence and also deficiency in service, as per codified duties of the TTE. P.A. Narayanan v. Union of India, (1998) 3 SCC 67 The Court observed that breach of common law duty of reasonable care lies upon all carriers including the Railways. In such cases, it cannot be said that the omission on the part of the railway officials can be said to be wholly unforeseen or beyond their control. Such standard of care is strict, and fault based. Such a liability is not inconsistent with the scheme of the Railways Act of 1890. Station Master, Indian Railway & Anr. v. Sunil Kumar, 2018 SCC OnLine NCDRC 440 A person travelling on reserved berths in a reserved coach after paying the fares and purchasing the tickets is right in “agitating that the railways was responsible for safety and security of person and hand-held baggage, including from unknown persons who gained entry unauthorizedly and committed theft (the railways was undoubtedly responsible for theft of hand-held baggage from running train)….. It would undoubtedly be self-evident (to one and all) that safety and security of person and hand-held baggage in running train is a fundamental concern of each and every passenger - consumer.” It was further stated that a reasonable man would rightly assume that his person and luggage are safe and secure in running trains especially in reserved coaches. Union of India v. Ajay Kumar Agarwalla, 2015 SCC OnLine NCDRC 2956 It is the duty of the TTE to make sure that the doors of the reserved coaches are latched at night and if the same is not the case, then it is a possibility that “since the doors of the coach i.e. main entrance doors were not kept latched during night, some unauthorized person entered the coach in which the complainants were travelling, committed theft of their suitcases and then left the coach either through a main entrance door when the train stopped at a railway station or he was able to move to another compartment through the vestibule doors which had not been locked.” Union of India v. Syed Mubuddin Rizvi, 2016 SCC OnLine NCDRC 2196 When there is no evidence that the doors of the coaches have actually been closed except at the railway stations and where neither the TTE nor the Coach Conductor were present in the coach, it could be said that there is negligence on part of the railways if any theft occurs and the railways is liable to compensate for the loss sustained by the passenger. General Manager, South Central Railway v. Jagannath Mohan Shinde, 2012 SCC OnLine NCDRC 183 If any unauthorized person is permitted to be present on the reserved compartment of a train, then Section 100 of the Indian Railways Act would not be of any help to the Railways in absolving them from any liability since anyways the Railways is responsible as a carrier of luggage if it is proved that their negligence on its part. General Manager (General) Northern Railway v. Lakhanji Purwar, 2016 SCC OnLine NCDRC 2515 If a TTE is not present in a reserved coach of a train and if any theft occurs in such reserved coach, “then the theft of the articles of the complainant happened solely on account of the deficiency on the part of the Indian Railways in rendering services to him by not deputing a TTE to remain present in the coach throughout the journey.” Concluding Remarks We see that there are ample of responsibilities that have been casted upon the railway authorities not just by the Courts but also the various legal provisions. Hence, do not be afraid in telling the same to the railway authorities in case a theft occurs on a Train. It is their legal responsibility to take all the above-mentioned steps. You are paying for the ride and you have all the right to avail the reasonable services that could be expected from any carrier and assert the same to them.

As a school kid , I have always wondered, why are Daman & Diu grouped together as a single Union Territory inspite of being so far from each other, especially when Daman & and other Union Territory of Dadra & Nagra Haveli were just 20 kilometres apart. And Dadra & Nagar Haveli had its own one day Prime Minister in 1961. The invention of the Caravel shipping boat, proved to be an inflection point in seafaring in Europe. Vasco da Gama, the Portugese explorer successfully set sail to East Indies and landed in modern day Kozhikode on 20th May 1498, about 30 years before Babar established the Moghal Sultanate in India and a full 100 years before British set foot in Indian soil. Vasco da Gama himself made 2 more trips after that to India, the last one as the Viceroy of Portugese India. By the time Vasco da Gama made his last trip, the Portugese had moved their capital from modern day Cochin to Goa in the year 1510. In next couple of decades they had fortifications in several Indian cities on the Malabar coast - Cochin, Kannur, Quilon, Goa, Daman, Diu, Mangalore, Surat and the city of Good bay called Bom-bahia or modern day Mumbai. While several of these cities were either lost in wars with Indian kings or gifted to the British, Portugese continued to hold Diu, Daman, Dadra & Nagar Haveli and Goa - and maintained suzerainty over these colonies for 450 years! Collectively these enclaves came to be referred as Estado da India or Portugese India. Fast forward to 15th August 1947. India gained independence from the British and became a free nation. The country had several provinces administered directly by the British and 560+ princely states. By 1950, India became a republic and all princely states completely acceded to the Indian Union. Now it was the turn of the non British run colonies in the Indian sub continent to fall in line. How did Goa become part of India? After declining over 1 per cent last week, the Indian equity markets this week will be guided by global cues, domestic trend of coronavirus cases and quarterly earnings. Besides, stock-specific action, partly due to the ongoing corporate results announcements, and the announcement of WPI inflation data for May scheduled for today will also be on investors' radar. On the results front, over 200 companies, including Tata Motors, HPCL, Pidilite Industries, and, LIC Housing Finance are scheduled to report their earnings this week. Investors will also monitor other factors like the trend in rupee and crude oil prices, analysts said. India's tally of coronavirus cases has spiked to 3.33 lakh and the death toll has crossed the 9,500 mark, according to Worldometer. On Tuesday and Wednesday, Prime Minister Narendra Modi is slated to hold virtual meet with chief ministers and Union Territory representatives against the backdrop of the rising number of Covid-19 cases. Moreover, China recorded its highest spike in daily cases in two months, sparking fears of a second wave of infections in the country. That sent investors in Asia scurrying for safe-havens, leading to a weak start for the Asian markets today. MSCI’s broadest index of Asia-Pacific shares outside Japan was down 0.25 per cent with Australian shares off 0.4 per cent and South Korea slipping 0.6 per cent. Japan’s Nikkei fell 0.75 per cent. In line with these trends, the SGX Nifty is also down around 40 points and is indicating a flat to lower opening for the Indian indices. In commodities, oil prices slipped with Brent down 2 per cent at $37.95 a barrel. The partly-paid shares of Reliance Industries will make their stock market debut in today's session. These shares were issued in rights issue programme, which concluded on June 3 and garnered 1.6 times subscription. Besides, RIL will be in focus after the announcement of some more foreign investment in Reliance Jio. The conglomerate announced on Saturday that private equity firm L Catterton was making an investment of Rs 1,894.50 crore for 0.39 per cent stake in Jio Platforms while global alternative asset firm TPG would invest Rs 4,546.8 crore for 0.93 per cent equity stake in Jio Platforms. Besides, investors will also keep track of any newsflow on the Trump administration's action on the H1-B visa which will affect IT stocks. They will also keenly follow the next Supreme Court hearing on AGR scheduled for June 18 after the apex court asked the telecom companies to submit a plan of action and securities in the last hearing. A month after nationwide lockdown, the Centre has permitted all neighborhood shops in the residential zones to open if they follow specific guidelines. However, shops in market places, multi-brand, and single-brand malls, as well as market complexes. Located in municipality areas will remain closed till May 3. The Supreme Court of India on Friday ordered immediate review of internet suspension in the Union Territory of Jammu and Kashmir. Restrictions on fundamental rights cannot be done by arbitrary exercise of power, said Justice Ramana while reading out the verdict. Freedom of speech and expression includes right to internet within Article 19 of the Constitution of India, said the apex court. But, Internet shutdowns are more than merely an inconvenience, they are also having an economic impact on the country. A new study says that India lost over $1.3 billion in internet shutdowns across the country — lasting 4,196 hours in 2019 — making it the third-most economically affected country after Iraq and Sudan, among 21 countries where major internet shutdowns happened last year. This is a result of internet shutdowns in regions like Jammu & Kashmir, Arunachal Pradesh, Assam, Meghalaya, Rajasthan, Tripura, and Uttar Pradesh. The report, titled The Global Cost of Internet Shutdowns, in 2019 by internet research firm Top10VPN, worked on calculating the data in major regions of the world using the COST tool. The total cost of internet shutdowns across the world, according to the report, stood at $8.05 billion in 2019, an increase of 235 per cent since 2015-16. Its internet shutdown tracker for India calculated 106 shutdowns in 2019. India imposes internet restrictions more often than any other country, with over 100 shutdowns documented in 2019. An April 2018 report by the Indian Council for Research on International Economic Relations (Icrier) estimated the economic impact of internet shutdowns in India from 2012-17 at $3.04 billion, and the overall number of hours of shutdown worked to 16,315 hours. It has been reported globally that the internet shutdown in Kashmir, which was imposed on 4 August, is the longest-ever internet block imposed by any country. People here have been without the internet for around five months, when Article 370, the constitutional provision granting it special status was nullified. It has now been over 158 days and counting, since internet access was cut off in Kashmir. Most recently, shutdowns have been imposed in the northeast in relation to the Citizenship Amendment Act resulted in around $102 million of economic impact Iraq — which suffered the highest economic impact from internet shutdowns, was hit by $2.3 billion and 209 hours of blackouts. The most significant internet blackouts were in October amid anti-government protests due to rising unemployment, failing public services and corruption, the Top10VPN report said. Sudan suffered the second highest impact at $1.87 billion, and 864 hours of blackouts. Countries across the world also put blocks selectively on specific online platforms. WhatsApp was the platform that saw the highest number of shutdowns globally at 6,236 hours. Facebook was second, blocked globally for 6,208 hours, followed by Instagram (6,193 hours), Twitter (5,860 hours) and YouTube (684 hours). Today, SC also ordered restoration of internet services in all institutions providing essential services like hospitals, educational centres. All restrictive orders in Jammu and Kashmir over the past five months following the scrapping of Article 370 are to be made public so they can be challenged legally, the court said.

Tensions in the northern state of Jammu and Kashmir coupled with simmering trade war concerns between the United States and China led to broad-based sell-off at D-street on Monday as benchmark indices plunged up to 675 points at the S&P BSE Sensex and 215 points at the Nifty50 intra-day. Benign corporate earnings and sluggih economic activity furter contributed to fresh-five month lows during the volatile trade. The Sensex ended 418 points, or 1.13 per cent, lower at 36,700 levels dragged by selling across public sector banks and metal counters. YES Bank, Tata Motors, Power Grid, and Reliance Industries were the top laggards while Bharti Airtel, Tech Mahindra, TCS and Bajaj Auto gained the most during the day. The Nifty50, too, slipped 135 points, or 1.23 per cent, to settle at 10,863 mark. India VIX, the volatility index, rose 15 per cent intra-day. The Narendra Modi government on Monday moved to scrap provisions under Article 370 of the Indian Constitution, which grants a special status to the state of Jammu & Kashmir in the Union of India. It has decided that Jammu and Kashmir would be turned into a Union Territory with a legislature, similar to Delhi and Puducherry, and the Ladakh division would be made a separate Union Territory without legislature, akin to Chandigarh and most other Union Territories. In the broader-market, S&P BSE Mid-cap dipped to 13,376 level, down 170 points, or 1.26 per cent. The S&P BSE Small-cap closed at 12,285 level, down 212 points, or 1.7 per cent. Sectorally, all but Nifty IT index ended with cuts. Nifty auto, metal, PSU bank, realty, private bank, and financial services indices ended between 1.4 to 2 per cent lower. NIfty IT index settled 0.63 per cent higher at close. Shares of Nestle India rallied 4 per cent intra-day to Rs 11,912 apiece, in an otherwise weak market, on the BSE on Monday after the company reported a good April-June quarter (Q2CY19) results. The fast moving consumer goods (FMCG) company also declared a dividend of Rs 203 per share, including a special dividend of Rs 180 per share. The stock was trading close to its record high level of Rs 12,026 touched on July 1, 2019 on the BSE in the intra-day deal.
