Slam the Gavel welcomes Marineka Bowman to the podcast. Marineka was last on Season 3, Episodes 104, 131, 159, 160, 174 and 184, Season 4, Episodes 22, 48 and 61, Season 5, Episode 149. Last time Marineka was on the podcast we discussed Judicial Harassment, Neglect, Abuse and the Child Support Law in Delaware. Today we updated Marineka's case where Delaware Judge Natalie Haskins STILL is not going by the Child Support Law in Delaware and the opposing Attorney Laura Brooks has stepped down. The new opposing Attorney is Constance Dorsney. Apparently, her ex voluntarily stopped working for one year and is still demanding child support without providing W-2. Also, her child is on Medicare, while forcing Marineka to provide Medical care and the conference officer, Jessica Martin just sits back and allows this. Marineka only gets to see her daughter once a week on Sundays, when the father hasn't been in the child's life for four years. Now, Marineka is paying child support to her ex, via Judge Natalie Haskins (who also constantly denies Marineka's requests for ROCO), so he can use Marineka's money to provide for his whole new family. Lauren Cook and her children were last seen on September 5. An investigation was launched after Cook missed a scheduled appearance in the Franklin County Juvenile and Domestic Relations court. According to deputies, the husband says his family is safe, but he has not communicated with them. Investigators added that they're unsure whether she may have left after a dispute with her husband. Police have no records of domestic violence between the couple or any calls for help to their residence. Lauren and the children could be in a blue 2013 Chrysler van with Virginia a license plate. Few other details are known publicly. There has been no activity on Cook's bank or cell phone accounts since September 7, and the last known phone ping was in Lexington. Professor McMillian joined the Atlanta's John Marshall faculty in 2007. Before embarking on a teaching and writing career, Professor McMillian wore many different hats in the legal profession, including those of civil litigator, commercial arbitrator, and certified mediator. The focus of his practice centered primarily on complex litigation—class action prosecution and defense, business torts, constitutional torts, and discrimination. In 2002, he became a founding partner of the law firm of McMillian & Camp, LLP. Following its inception, the firm was approved as lead counsel by numerous federal and state courts in class and collective actions arising under the Telephone Consumer Protection Act and the Fair Labor Standards Act. In this role, Professor McMillian successfully negotiated several six and seven-figure settlements. As a neutral, Professor McMillian mediated and arbitrated over 100 active lawsuits. Professor McMillian's writing career is just as diverse. He is a novelist and creator of the Atlanta Murder Squad series. The first book in the series, The Murder of Sara Barton, won a prestigious B.R.A.G. Medallion and became a #1 Best Seller Legal Thriller on Amazon. His nonfiction work has appeared in such legal journals as the North Carolina Law Review, the Washington and Lee Law Review, the Wisconsin Law Review, the Alabama Law Review, the Tennessee Law Review, the Southern Cal Interdisciplinary Law Journal, and the American Journal of Trial Advocacy. He also contributed a chapter for Lawyers In Your Living Room! Law On Television, a book project from the American Bar Association that also featured essays from actors Sam Waterston and James Woods. She was elected Ohio's first woman Secretary of State on November 7, 2006, and held the office for four years. While in that office, she became the first Ohioan to receive the John F. Kennedy Profile in Courage Award from the bipartisan board of the JFK Library and Museum in Boston. Justice Brunner was a candidate for the U.S. Senate in 2010. She has 17 years of private law practice experience and has provided rule of law technical expertise to the government of the Republic of Serbia, election observation in the Arab Republic of Egypt, and rule of law instruction at the bar association of Sri Lanka through the U.S. state department (USAID), as well as provided remote technical training through the American Bar Association (ABA) to the Republic of Kazakhstan, and in August 2022, in-person assistance to the Republic of Benin's Human Rights Commission. She has gained a deep understanding of the importance of a strong and well-functioning judiciary to preserving peace and growing democracy through the rule of law. A native of Springfield, Ohio, Justice Brunner has been married to Rick Brunner since 1978. They have 3 adult children and 6 grandchildren, 3 dogs and 2 cats and spend time at their home in Columbus and at their farm in Columbiana County in Northeast Ohio. Judge Marilyn Zayas, candidate for Ohio Supreme Court Associate Justice https://judgemarilynzayas.com/ Judge Marilyn Zayas learned from an early age that everyone should be treated fairly and equally. This is a core belief and guides Marilyn in her personal and professional life. She was born in Spanish Harlem and grew up in a tough New York City neighborhood. Although she earned a college degree in computer science and moved to Cincinnati to become an IT Manager for Proctor & Gamble, Marilyn always dreamed of becoming a lawyer. After six years, in 1994, Marilyn left P&G and pursued her dream, enrolling in and then graduating with a law degree from the University of Cincinnati College of Law in 1997. In addition to realizing her dream, Marilyn also knew she had found a wonderful home in Ohio where she could raise her children. She went to work serving her community and eventually built her own law firm representing everyone from the poor to millionaires to refugees. Throughout her career, she never lost sight of her passion for justice. In 2016, Marilyn was elected to the First District Court Of Appeals of Ohio. She was proud to know she was the only Latina judge on any district court of appeals in the state. Her reputation for fairness grew. So Judge Zayas was asked to sit in on cases as a visiting judge on the Second, Sixth, Eighth and Tenth District Courts of Appeals. Judge Zayas was also selected by the Ohio Supreme Court's Chief Justice to be a sitting judge on the Ohio Supreme Court for a recused justice. In 2022, Judge Zayas decided to run for the Ohio Supreme Court.Judge Marilyn Zayas's family includes her three adult children and two adopted rescue dogs, Thor and Sparkle Lou. Judge Terri Jamison, candidate for Ohio Supreme Court Associate Justice https://www.votejudgejamison.com/ Judge Terri Jamison's journey from the coal fields of West Virginia to the highest reaches of the legal profession is a testament to her strength, intelligence, perseverance, and persistence. Judge Jamison worked as one of the few women in the underground coal mines, made Columbus her home, later opened and ran her own insurance agency for over 16 years, and attended college while working full time. Terri sold her agency and enrolled in the Capital University School of Law and obtained her Juris Doctorate in 2004. As an attorney, Terri worked in the Franklin County Public Defender's Office representing indigent clients in the Municipal Court System and served as a Hearing Officer for the Ohio Unemployment Compensation Review Commission. She practiced in the US District Court, Southern District of Ohio. She opened her own law office, practicing Criminal, Juvenile, Domestic Relations, and Probate law at the trial and appellate level. She was admitted to practice at the Supreme Court of the United States in 2007. In 2012, she was elected judge of the Franklin County Court of Common Pleas, Division of Domestic Relations and Juvenile Branch. She was overwhelmingly reelected to the Common Pleas bench in 2018 and then elected to the Tenth District Court of Appeals in 2020. During her time on the bench, Judge Jamison has used her experience, perspective, talent, and knowledge to develop new strategies to empower families. She also devoted considerable time, energy, and attention to issues related to equal access to justice, diversity, inclusion, and the need to develop alternatives to detention for juveniles. In "Brown v. Board of Education", the Supreme Court ruled that "separate is not equal", thus ending school segregation. But the ruling did nothing to close the gap between African American and white students in terms of educational access, equity and participation. The coronavirus global pandemic widened the gap further as schools pivoted to virtual learning, leaving behind those without access to internet services and computers. We discuss the educational divide between Black and white students and what must be done to create equity and fairness for all. Lisa Thompson received her bachelor's degree in Government from Oberlin College and her law degree from Ohio State University. She has had a multi-faceted career in the arena of law. She has a number of licenses and certifications under her belt. Lisa is Licensed in the United States Supreme Court, The U.S. District Court for the Northern District of Ohio, The Sixth Circuit Court of Appeals and the U.S. District Court for the Southern District of Ohio. She When I asked her what stands out about her childhood as it relates to kindness, work ethic and values, Lisa quickly recalled that it was commonplace for she and her dad to read together avidly and have discussions around what they were reading. Additionally, Lisa has very clear memories of her parents working hard, managing their funds with integrity and emphasizing the importance of honoring your word and doing your best at all times. Lisa currently serves as a Juvenile Court Magistrate at Franklin County Court of Common Pleas, Domestic Relations and Juvenile Court Branch. As Magistrate, Lisa sits on the bench where she hears delinquency, abuse, neglect and dependency cases. Prior to her work as Magistrate, Lisa wasthe owner of The Thompson Legal Firm and a Partner with Thompson Steward, LLC. Lisa shared that she has had extensive experience in the practice areas of criminal defense, legal research and trial practice. When I asked Lisa what are some of the most important things that she would like to achieve in her personal development, she responded that she would like to really focus on completing the writing of a number of books that she has in the coiffures. She hopes to set aside uninterrupted time to devote to this. Lisa also shared that many of her topics come from dreams and other related avenues. If she weren't already busy enough, Lisa finds time to travel, and she is very proud that she has visited 30 countries since 2012. Her favorite country is Spain! Lisa hopes that African Americans will not overlook traveling to countries that are unfamiliar but have plenty to offer – history, beauty, great cuisine, friendly people and exciting excursions. Countries like Bosnia should not be overlooked. She enjoyed her travels there, and was amazed at the sophistication of the city. She plans to visit Georgia and Albania soon. Trigger Warning: Content in this episode involves conversations on human trafficking and trauma-based family dynamics. Lasheyl Stroud brought her expertise and authentic understating to share the work being done in and around the juvenile court system. At the time of recording, Lasheyl is growing past her role as Lead Magistrate, and running for judge of the Franklin County Court. She prepped the discussion by first explaining the difference between a judge and a magistrate. Lasheyl handled cases in Domestic Relations and Juvenile Court, which typically involve family-based issues. She also handled cases in Empowerment Court, where cases relate to human trafficking. Going across the state, and working with a sense of urgency, Lasheyl participated in every part of the court. The urgency comes not from a lack of time, but is sustained by clarity and passion. In her experience, she represented parents and children. From full time commitments at the Attorney General’s Office to volunteering as a Guardian Ad Litem, her focus on social justice impact exposed her to a wide range of experiences. Her passion and focus come from a profound sense of care, which explains the actions she upholds when children, children she considers as if they’re her own, are involved directly in court cases. Moving to a topic the public is less educated on, Lasheyl described the system of human trafficking from the perspective of her role in court. Unlike movies, human trafficking often begins with familiar figures in an individual’s life. Family and romantic partners are predators more often than people imagine. She revealed the name “Empowerment Court” is meant as a message to empower the victims within the court cases. Youth are showered in a love that is pure and genuine for the duration of the transition through court. Court staff, child services, and related stakeholders tend to be the first healthier examples of adults for some youth in court. Lasheyl unpacks the careful and attentive approach used to build true relationships with the youth. Lasheyl also dives into the delicate details of family dynamics. For example, removing youth from environments where the a parent is allowing the child to be trafficked by a significant other. If urged to add to the love being given to the youth, Lasheyl shared that people can donate gift cards, clothing, or other forms of service. As a step further, she also mentioned training conferences and mentoring programs can help people become more educated towards the social issue. Our discussion changed direction towards juvenile delinquency. Based on Lasheyl’s explanation, the harshest issue becomes the lingering consequence felt by youth after being engaged in the court system. Court personnel and volunteers aim to resolve this issue, with one hopeful option being restorative justice circles. In closing, Lasheyl took a deep dive into her journey through the social justice sphere that led to running for judge during COVID-19. (So, go out and vote, and vote all the way down your ticket!) At the same time, the abuses of the overseers within the child "protective" services system appear to be gearing up to expand their already enormous subjective application of the law regarding the children if the traditional lifestyle beliefs of the parents collide with the leftist direction of much of the culture. What would happen to the administration of justice if the Albemarle County Board of Supervisors chose to relocate their general district and circuit courts outside of downtown Charlottesville? That was the subject of a panel discussion held at the February 17 breakfast of the city and county Democrats. "We came up with this topic a couple of months ago as we were kicking around ideas and really felt like what was getting lost in all this discussion was the impact moving the courts might have on on access to the courts, specifically for our most-marginalized residents," said Bekah Saxon, vice chair of the Charlottesville Democratic Committee. The panelists were: Albemarle County Supervisor Liz Palmer; Charlottesville City Councilor Kathy Galvin; Mary Bauer, director of the Legal Aid Justice Center; and Palma Pustilnik of the Central Virginia Legal Aid Society. Palmer and her colleague Norman Dill have voiced their opposition to moving the courts in the past. However, in her remarks, Palmer sought to explain the motives of those on her board who have voted to study the idea. "I think I can do this pretty clearly because I share some of the same concerns," Palmer said. "I weigh them differently." Palmer said many city residents may not realize that each supervisor represents a specific district in the county. Charlottesville's five city councilors are all elected in one big district. Palmer's Samuel Miller District covers the southwest part of Albemarle including both urban and rural areas. "The courts were one of the very first things on our plate when I got on four years ago," Palmer said. "We got a presentation from our then-county executive [Tom Foley] who presented a plan for moving the courts somewhere out in the county." Palmer said one reason at the time included the possibility of lower capital costs, but a recent study has shown that not to be the case. Another reason would be to locate the courts in the county's population center. "Also given was the idea that if you're going to put $35 million of taxpayer money, is it appropriate to spend that $35 million in the city?" Palmer asked. "Or is it appropriate to spend that money in the county? That is something that supervisors were really wrestling with." In December, Council sent a letter to the Supervisors reiterating what the city is willing to do to keep Albemarle courts downtown. In response, supervisors agreed to place their process on hold until early March to allow for negotiations. "The city has already committed $6.5 million in its capital budget to make the courts reality," Galvin said. The funding would go toward building a joint General District Court on the site of the former Levy Opera house. Both localities jointly acquired the property in April 2005. Galvin said the city has also committed $10 million in its capital budget to build a new parking garage to serve the courts. In November 2016, Council agreed to spend $2.85 million on a lot at 9th Street and Market Street for this purpose. The same transaction for the Levy Opera House site also included the surface parking lot next door. "It is not typical you will see a parking garage associated with a social justice issue, but in this case it really is," Galvin said. "We're committing 100 spaces -- and the county doesn't have to pay for it -- to build that parking garage to enable their project to occur." Palmer said parking is critical for the county's ultimate decision. "We feel we have to have some ownership over how that is used," Palmer said, adding that Albemarle officials want to ensure disabled have access to the courts. The two other panelists focused on how a courts move would affect low-income individuals. "We have met no one in the city or the county who is poor who thinks moving the courts is a good idea," Bauer said, adding having the two jurisdictions' facilities in the same place reduces the burden for those who are in court. "I think any lawyer that practices regularly in the General District courts in either the city and the county has sat through a docket in which somebody arrives five minutes late saying they went to the wrong court. The difference between 606 East Market Street where the city's general district court and 501 East Jefferson Street where the county court is is about two minutes." Bauer said if the courts were not close together, many people would be late and would be penalized as a result. Pustilnik said she was glad the city and county have previously decided to co-locate their Juvenile and Domestic Relations courts in the same building. "Our court system in Virginia is designed in districts and in circuits and not in city and county," Pustilnik said. "Our judges are named to a district or to a circuit so they can serve in either a city or county court." Pustilnik said separating the courts would harm her clients by forcing her to be spread geographically across the two jurisdictions. *** Albemarle County has been operating under the assumption that a referendum is not required to move its Circuit Court. That's based on legislation that passed the General Assembly in 2017 that added this provision to state code: "In the case of the removal of a county courthouse that is not located in a city or town, and that is not being relocated to a city or town, such removal shall not require a petition or approval by the voters." A bill from Delegate Rob Bell (R-Charlottesville) would update state law to add this language immediately after the above section. "However, this subsection shall not apply to the removal or relocation of any county courthouse, whether located on county or city property, that is entirely surrounded by a city, and any such courthouse shall be removed or relocated only in accordance with the provisions of [other] subsections," reads Bell's bill. HB1546 passed the House with a 100-0 vote on Feb. 13. The item is now before the Senate Committee on Local Government. This course examines the laws relating to marriage and the creation of a family, separation, and the dissolution of marriage. Community property, parental rights, child custody, dependency and neglect actions, among other miscellaneous family law issues will be addressed. Learning Outcomes: - Integrate course concepts through interaction and discussion with Learners and Mentor - Examine fundamental underpinnings of the practice and ethics of family law - Evaluate premarital, postnuptial, cohabitation, and separation agreements - Evaluate traditional marriage and alternatives to traditional marriage - Examine the termination of marriage, including divorce and annulment and issues of child custody and support - Evaluate the division and allocation of property and the tax implications of a divorce - Evaluate the process of adoption - Evaluate issues of paternity - Examine miscellaneous but important issues tied to the practice of family law such as the legal rights of women and status of children as well as the interplay between torts and family law - Integrate course concepts in the form of a paper, mid-term assignment or movie critique by evaluating and analyzing selective, relevant material(s) and resource(s) This is a course offered within the Master of Science in Law program at California Southern University. When a husband or wife finds out about a cheating spouse, divorce is an obvious next step. But many people want to know: can I sue the other woman (or man)? We will discuss the cause of action known as “alienation of affection,” in which a person can sue a spouse’s lover for ruining a marriage.
There has been much said regarding the ability of parties to mediate in cases where there has been domestic abuse. While no one believes abuse is an issue that can be mediated, the parties may have issues that can be resolved through mediation. Our program will discuss issues including the benefits of mediation in these situations, the structure of such mediations and preparation of parties, and the mediator. Christy Cumberlander Walker has over fifteen years of experience mediating family issues. She was previously a program coordinator for the Franklin county Domestic Relations and Juvenile Court. Her experience includes providing family, employment and community mediation as well as providing training in dispute resolution across the county. Christy was also a trainer for the Supreme Court of Ohio Domestic Abuse Issues for Mediators and Other Professionals. Christy was a member of the Advisory Council for the Association for Conflict Resolution’s Family Section. She is the co-chair for the annual conference “Making Peace Happen: New Normals” that will be held in Minneapolis Minnesota in October. Zena Zumeta, internationally known as both a mediator and trainer of mediators. She is president of the Mediation Training & Consultation Institute, Zena Zumeta Mediation Services, and The Collaborative Workplace in Ann Arbor, Michigan. Zena is a lawyer and a former president of the Academy of Family Mediators. She is the recipient of the the Michigan Lifetime Achievement in Mediation Award; the National Education Association/Saturn Corporation Award for Union-Management Collaboration.
