Telemarketing calls have become both annoying and hard to avoid – but these days, that voice on the phone calling you at dinner time might not even be human. More and more, marketers, political activists, and scammers are using AI deepfakes to make their robocall messages even more convincing by simulating the voice of celebrities, politicians, and even your own family. The technology is so powerful that the messages can even integrate personal information about you, your interests, and your family that has been sourced online. Some scammers even record the calls to capture enough samples of your voice that they can train an AI to sound like you – so always be careful about how much you say to telemarketers, and never say the word ‘yes' as it can be played back to hack phone banking and other systems. Calls directed to you at work may be targeting you because of your job description, your approval powers for financial transfers, or your influence on other company executives. Don't be afraid to just hang up – and then pick up the phone to verify whether the caller was who they said they were. Earlier this year, the Federal Communications Commission declared AI voice cloning robocalls to be illegal, and the agency is in the process of formalizing rules that will force companies to tell you if their robocall is AI generated, and offer ways of protecting you from such calls. Anyone with a phone number understands how annoying it is to receive unsolicited promotional voice calls and text messages. For that reason, telemarketing and telephone sales practices in the U.S. are regulated by decades-old federal and state consumer protection laws, which permit private rights of action by consumers for minimum statutory damages that can total hundreds of dollars per violation, such as when a call or text is made to a phone number listed on the National Do-Not-Call Registry. But are these laws too harsh on legitimate businesses communicating with their customers? How well do these 1990s-era laws address emerging communication technologies?
