Telemarketing calls have become both annoying and hard to avoid – but these days, that voice on the phone calling you at dinner time might not even be human. More and more, marketers, political activists, and scammers are using AI deepfakes to make their robocall messages even more convincing by simulating the voice of celebrities, politicians, and even your own family. The technology is so powerful that the messages can even integrate personal information about you, your interests, and your family that has been sourced online. Some scammers even record the calls to capture enough samples of your voice that they can train an AI to sound like you – so always be careful about how much you say to telemarketers, and never say the word ‘yes' as it can be played back to hack phone banking and other systems. Calls directed to you at work may be targeting you because of your job description, your approval powers for financial transfers, or your influence on other company executives. Don't be afraid to just hang up – and then pick up the phone to verify whether the caller was who they said they were. Earlier this year, the Federal Communications Commission declared AI voice cloning robocalls to be illegal, and the agency is in the process of formalizing rules that will force companies to tell you if their robocall is AI generated, and offer ways of protecting you from such calls. Anyone with a phone number understands how annoying it is to receive unsolicited promotional voice calls and text messages. For that reason, telemarketing and telephone sales practices in the U.S. are regulated by decades-old federal and state consumer protection laws, which permit private rights of action by consumers for minimum statutory damages that can total hundreds of dollars per violation, such as when a call or text is made to a phone number listed on the National Do-Not-Call Registry. But are these laws too harsh on legitimate businesses communicating with their customers? How well do these 1990s-era laws address emerging communication technologies? In this episode, hosts Alicia Downey and Derek Jackson speak with Kelley, Drye & Warren partner Becca Wahlquist about these issues and recent developments in the law governing telemarketing to consumers. Learn about the challenges that businesses face in complying with a complex and evolving scheme of federal and state legislation and rules restricting telephone communications with consumers. As of January 1, 2024, the State of Maryland's new telemarketing law, the “Stop the Spam Calls Act of 2023,” officially became law. One key provision of the new law creates a prohibition, absent prior express written consent, against “telephone solicitation[s]” that involve “an automated system for the selection or dialing of telephone numbers.” A “telephone solicitation” is defined as “an organized activity, program, or campaign to communicate by telephone with residents of Maryland in order to: (i) sell, lease, or rent goods or services; (ii) attempt to sell, lease, or rent goods or services; (iii) offer or attempt to offer a gift or prize; (iv) conduct or attempt to conduct a poll; or (v) request or attempt to request survey information, if the results of the survey will be used directly to solicit persons to purchase, lease, or rent goods or services.” The term “communicate by telephone” suggests an intent to include both phone calls and text messages within the scope of this definition. https://www.kelleydrye.com/viewpoints/blogs/ad-law-access/marylands-new-telemarketing-law-now-in-effect Alysa Hutnik ahutnik@kelleydrye.com (202) 342-8603 www.kelleydrye.com/people/alysa-z-hutnik Jennifer Rodden Wainwright jwainwright@kelleydrye.com (202) 342-8649 www.kelleydrye.com/people/jennifer…dden-wainwright Subscribe to the Ad Law Access blog - www.kelleydrye.com/subscribe Subscribe to the Ad Law News Newsletter - www.kelleydrye.com/subscribe View the Advertising and Privacy Law Resource Center - www.kelleydrye.com/advertising-and-privacy-law Find all of our links here linktr.ee/KelleyDryeAdLaw Hosted by Simone Roach
The telephone seems to be a popular device to high strangeness. I've heard reports of conversations with the dead to correspondences with life forms from another time, or even another dimension. Telemarketing tactics aside, there are quite a few reports of these creepy calls, which might suggest that something out there is attempting to use our telecommunication systems to make contact with us. And, one of those examples is found in the peculiar case of Gary Sudbrink. In 1993, Gary was an Air Force captain assigned to medical pharmacy work in San Antonio, TX. In February of that same year, he planned an unannounced, surprise trip to visit friends and family in Long Island, NY. Even though he didn't tell anyone about his trip prior to departure, it seems that someone or something else already knew… At his parents' house in New York, Gary placed a call to his longtime friend, Mike. But Mike relayed how he had already spoken with Gary by phone the day before, describing how Gary had just flown in through LaGuardia airport (although Gary had actually come in through JFK), along with the impression that he was coming down with a cold (even though Gary was perfectly healthy at the time). As a result, Mike decided not to hang out with him, which left Gary quite confused. As the two of them conversed, another call came in through call waiting. With his parents still present in the room, Gary picked up the other line and a deep, mechanical voice greeted him with some bizarre dialogue. Instinctively for whatever reason, Gary pressed record on the nearby answering machine in an attempt to document it.

Telemarketing Scheme Indictments Surface Warnings On Safe Donation Practices On Thursday, federal officials arrested Richard Zeitlin and Robert Piaro for allegedly defrauding donors of tens of millions of dollars that were meant for political nonprofit groups supporting causes like aid to military veterans and breast cancer research, according to reporting from The New York Times. Zeitlin, who ran telemarketing call centers, is charged with fraud, obstruction of justice, and conspiracy. Piaro, who served as the treasurer of several political nonprofit groups, is charged with wire fraud and mail fraud. Both individuals could face significant prison sentences if convicted. The indictment says that Zeitlin instructed employees at his call centers to mislead donors. It also says that Piaro made fraudulent claims about how donations would be spent. About $22 million of the $28 million raised went to companies providing telemarketing services. Piaro paid himself about $526,000 from the money raised. Investigations into Zeitlin and Piaro revealed that a significant portion of the money they raised for groups was kept by their companies or spent on fundraising vendors. This story underscores the necessity for transparency, accountability, and vigilance in nonprofit fundraising and management.
