Passing Judgment
Breaking Down the Biggest Supreme Court Decisions: Nationwide Injunctions and Tennessee Transgender Rights

Passing Judgment

Play Episode Listen Later Jul 1, 2025 20:03

In this episode of Passing Judgment, Jessica breaks down the Supreme Court's two most significant cases of the term. First, she examines the Court's ruling that sharply limits federal judges' ability to issue nationwide injunctions, especially in the context of challenges to executive orders like those affecting birthright citizenship. The episode then moves to the Supreme Court's decision upholding Tennessee's ban on certain gender-affirming care for minors. Jessica explains how the Court sided with state power, applying a deferential standard of review, and contrasts this with the dissent's focus on equal protection for transgender youth. Here are three key takeaways you don't want to miss:Limits on Judicial Power: The Supreme Court, in a 6–3 decision authored by Justice Amy Coney Barrett, ruled that federal judges generally cannot issue nationwide injunctions unless Congress clearly authorizes it. This shifts significant power dynamic back to individual cases and underscores the role of Congress in expanding judicial remedies.Nuanced Exceptions Remain: Despite the new limits, broad relief is still possible through class actions, certain state-led cases, and challenges under the Administrative Procedures Act. These pathways ensure there are still tools to address sweeping executive actions, though access is more restricted.Transgender Rights Under Scrutiny: In the Skrmetti case, the Court upheld Tennessee's ban on gender-affirming care for minors, framing the law as a neutral regulation based on age and medical use—not sex or transgender status. Dissenting justices warn this approach threatens protections for vulnerable groups and diminishes the judiciary's role as a check on legislative overreach.Follow Our Host: @LevinsonJessica

As July 4 approaches, Americans across the country are preparing to honor the sacrifice of our military heroes, many through donations to veterans' charities. But with billions of dollars donated each year, how many people really know where that money goes? Rick Berman, Executive Director of the RAM Foundation, will join me to discuss their new national campaign to help the public give smarter via its nonpartisan, data-driven resource — CharitiesForVets.org.With the Supreme Court upholding Tennessee's ban on medical transitions for minors, there's a critical national conversation happening right now around gender identity, mental health, and the role of parents and professionals. Dr. Kim Metcalfe, an educational psychologist with decades of experience working with children and families, joined me in discussing the topic. She approaches these issues through a child development lens, offering a respectful and science-informed insight into how we arrived at this point, what is missing from the current conversation, and how mental health professionals should approach this polarizing issue. Ron Edwards, host of the Ron Edwards American Experience, joined me to discuss the results of the NYC Democratic primary and recent rulings from the SCOTUS.Become a supporter of Tapp into the Truth: https://www.spreaker.com/podcast/tapp-into-the-truth--556114/support Tapp into the Truth on Rumble. Dr. Jennifer Roback Morse, founder of the Ruth Institute, joins Father Jack to discuss the Institute's recent involvement in a major Supreme Court case on counseling freedom. She explains the arguments behind their amicus brief challenging Colorado's ban on “conversion therapy” and highlights the broader implications for free speech, religious liberty, and therapeutic choice. Dr. Morse also takes a critical look at the Trevor Project, a well-funded LGBTQ youth organization, raising concerns about its influence, federal funding, and online platforms. Tune in for a compelling conversation about the intersection of law, culture, and the future of family advocacy. Resources Mentioned: Ruth Institute: www.ruthinstitute.org Ruth Institute YouTube Channel Key Points: 1. Supreme Court Case and Amicus Brief: Dr. Morse and the Ruth Institute filed an amicus brief in a Supreme Court case challenging a Colorado law banning so-called "conversion therapy." The brief was submitted under the title “Brief of Sexual Orientation Scholars in Support of Petitioners.” The case involves a Christian therapist claiming the law restricts her religious and professional freedom. The Ruth Institute argues that bans on such therapy suppress alternative therapeutic approaches and violate rights of both therapists and clients. Father Paul Sullins provided statistical critiques in the brief, and Morse contributed case studies and analysis questioning assumptions about sexuality, including the claim that people are “born gay.” 2. Critique of the Trevor Project: Morse criticizes the Trevor Project, a suicide prevention group for LGBTQ youth, claiming it is ideologically biased and heavily funded. She notes that YouTube links the Trevor Project to content critical of LGBTQ identities, labeling alternatives like conversion therapy as harmful. Morse supports the Trump administration's decision to withdraw federal funding from the Trevor Project, redirecting it to general suicide prevention efforts. Concerns were raised about the Trevor Project's online community features, which critics have described as vulnerable to abuse. Morse references critiques from “Gays Against Groomers” and the California Family Council. 3. Underlying Themes: The conversation strongly critiques mainstream LGBTQ support structures and what Morse and the Ruth Institute view as coercive or ideologically driven policies. Emphasis is placed on the rights of therapists and clients to explore identity and trauma without mandated affirming approaches.

This Pride Month, Mark Radulich and Sean Comer celebrate the flamboyant, fearless, and fiercely important legacies of three trailblazing films: The Adventures of Priscilla, Queen of the Desert (1994), To Wong Foo, Thanks for Everything! Julie Newmar (1995), and Hedwig and the Angry Inch (2001). While each tells its own unique story—from a desert drag road trip across the Australian outback to a heartfelt exploration of gender identity through glam rock cabaret—they are all interconnected by the historical arc of queer visibility in cinema. These films didn't just showcase LGBTQ+ characters—they centered them, in eras where that was still an act of rebellion.Priscilla broke ground internationally, putting Australian queer cinema on the global map and normalizing drag culture long before RuPaul's Drag Race made it mainstream. Just one year later, To Wong Foo introduced Middle America to drag queens with heart, humor, and dignity—starring mainstream Hollywood actors like Patrick Swayze, Wesley Snipes, and John Leguizamo at the height of their careers. Then came Hedwig, a deeply personal indie musical about gender, trauma, and artistic expression, which has since become a cult favorite and a cornerstone of trans representation in modern film and theater. Together, these films reflect the evolution of queer and trans narratives—from coded subtext to full-throated declarations of identity and humanity.More than just products of their time, these movies pushed culture forward. They asked audiences to look beyond binary norms and embrace love, transformation, and self-expression in all forms. Whether through sequins, ballads, or beat-up buses, these stories assert—loudly and proudly—that queer people, drag performers, and trans individuals deserve joy, complexity, and a place in the cinematic canon. And as we revisit them in 2025, their messages feel just as urgent, defiant, and beautiful as ever.Disclaimer: The following may contain offensive language, adult humor, and/or content that some viewers may find offensive – The views and opinions expressed by any one speaker does not explicitly or necessarily reflect or represent those of Mark Radulich or W2M Network.Mark Radulich and his wacky podcast on all the things:https://linktr.ee/markkind76alsohttps://www.teepublic.com/user/radulich-in-broadcasting-networkFB Messenger: Mark Radulich LCSWTiktok: @markradulichtwitter: @MarkRadulichInstagram: markkind76RIBN Album Playlist: https://suno.com/playlist/91d704c9-d1ea-45a0-9ffe-5069497bad59

One of the biggest criticisms against transgender individuals that I hear is that “science” says there are only two genders and a lot of transphobic people rely on “science” to back up their transphobic views. However, the reality is that science clearly shows us that there are more than two genders and there are big differences between sex, gender and gender identity. These are important distinctions to make because as aspiring and qualified psychologists, we are scientists first and foremost. Therefore, the way that we operationalise these terms is important in our clinical work and research. As a result, in this social psychology podcast episode, you'll learn how do scientists operationalise sex, gender and gender identity. You'll learn what is sex, gender and gender identity and most importantly, why science says there are more than two genders. In conversation with Arudi Laurah In this episode, the African Rights Talk Podcast hosts Arudi Laurah, Programme Officer at the Network of African National Human Rights Institutions (NANHRI), about her work in advancing the rights of SOGIE persons and human rights defenders across Africa. Arudi shares insights from the recent NHRI training held in Pretoria in April 2025, which focused on building the capacity of national human rights institutions to implement African Commission Resolutions 275 and 552. These resolutions address the protection of LGBTQ+ individuals and intersex persons from violence and discrimination. Drawing on her experience as an HRDA alumna and her sociological background, Arudi reflects on the challenges of working in politically and culturally sensitive contexts and underscores the importance of equipping NHRIs with the tools to navigate these complexities. The episode highlights a call to action for broader stakeholder engagement, emphasising collaboration, contextual strategies, and peer learning as vital for sustainable human rights advocacy in Africa. Laurah Arudi Cori is a Kenyan interdisciplinary human rights advocate currently serving as Programmes Officer for Human Rights Defenders and SOGIESC (Sexual Orientation, Gender Identity and Expression, and Sex Characteristics) at the Network of African National Human Rights Institutions (NANHRI). In this role, she leads efforts to strengthen the capacity of national human rights institutions across Africa, with a focus on implementing key African Commission resolutions, including Resolution 275 on the protection of LGBTQ+ persons and Resolution 552 on the rights of intersex individuals. Arudi holds a Master's degree in Human Rights and Democratisation in Africa from the Centre for Human Rights at the University of Pretoria, complementing her academic background in sociology and psychology. Arudi is also a dedicated researcher and writer, with a passion for promoting gender equity, sexual diversity, and human dignity through community engagement and policy advocacy. Controversial Christianity is a five-week sermon series that addresses several BIG cultural questions and hotspots, bringing compassion, conviction, clarity, and Christ into the center of the controversy. Each topic in this series draws from the top questions regularly brought to the Pastoral Team. In this sermon, Tyler speaks about the cultural tensions surrounding gender identity. He unpacks the Church's responsibility to navigate these conflicts with a balanced posture of obedience, empathy, and belonging, recognizing that we are all image bearers in need of Jesus. At Northeast, our heart is to disciple all image bearers. We are called to be generous with our love while holding fast to biblical truth and the historic Christian ethic regarding gender and identity. *Anything less than compassionate is not Christian. *Every person is sexually broken. *We embrace our bodies as God created them at birth and learn to live faithfully within them. *Our identity begins in Christ. Furthermore, we also examine the Church's failure to reflect and lament on how we've responded to those struggling with gender dysphoria. The Church is called to be a safe place—a community that helps carry burdens. Tyler addresses the rapid cultural shifts that have intensified the conversation around transgender identity. Cultural "wars" often result in casualties. Let's be a light in the midst of it all. All truth without compassion, and all compassion without truth, fall short of the way of Jesus. In the realm of human sexuality, religious leaders have historically leaned toward shame and judgment. Yet, Jesus offered protection, moral direction that led to freedom, and the power of choice, without condemnation. We are all image bearers. There is no moral high ground. We stand equal at the foot of the cross. Let us receive Jesus.

Listen to these words from detransitioner Laura Perry Smalts in a recent Salvo Magazine article: “If I had known in 2007 that God's creation of male and female was not only good but impossible to alter, I would have saved myself a tremendous amount of pain and suffering. At the time, I would have repeated the typical cultural catchphrase that I was born this way. I believed I was a man trapped in a woman's body and that the only way I could be myself was to transition from female to male.” Laura Perry Smalts goes on to tell her story of transition, and how she came to the realization that she had been wrong, leading to a detransition. Her words are so helpful: “God said to me, “You cannot love me and yet reject my creation. Then I heard him say, Let me tell you who you are. In that moment, my whole idea of identity shifted from what I wanted to be, to who wanting to know who I was created to be.” Thank you Laura Perry Smalts, for reminding us of where to find our identity!

In this fierce and timely episode of The Scenic Route, we unpack the UK Supreme Court's ruling that redefines “woman” based solely on biological sex, excluding trans women from legal protections, political representation, and basic recognition. But this isn't just a courtroom debate. It's a culture war dressed in legal robes. We follow the funding behind the ruling, expose the billionaire feminists fueling the backlash, and dismantle the persistent myths about biology, gender, and identity. This episode asks hard questions: Who really benefits from the binary? Why do so many defend it so violently?
