What rights do parents have when public schools make decisions involving their children’s gender identity without informing them? Lisa Boothe sits down with Jim Campbell, Chief Legal Counsel at Alliance Defending Freedom (ADF), to examine the growing legal battle over parental rights in America’s public schools. Campbell discusses what ADF describes as “secret social transition” policies, including cases in which schools allegedly used different names or pronouns for students while withholding that information from their parents. Campbell also breaks down ADF’s litigation involving parental notification and religious freedom, explains what he says recent court decisions mean for families, and discusses cases ADF has pursued in states including New York, Michigan, Kansas, New Jersey, Texas, and Virginia. Lisa and Jim also tackle disputes over sexually explicit and LGBTQ-themed material in school libraries and classrooms, parents’ ability to opt their children out of certain instruction, and how families can challenge school policies through the courts and local school boards. My guest on the show today is Rogers Brubaker, professor of sociology at UCLA and author of many books, the most recent of which, Gender Identity: The Career of a Category, is our subject for discussion on this episode. If you want a really good kind of primer on this book before you listen to this episode, I recommend you pause and go read the review essay of it, by Shreeharsh Kelkar, that I published on my Substack recently. Both the book and Shreeharsh's review of it have the double virtue of taking on a really fraught topic, one that very easily tends to dysregulate people, with both analytical dispassion and also genuine consideration and compassion for the people for whom these questions of gender identity, and gender identity at variance with biological sex, are not primarily or exclusively analytical ones. I wanted that kind of access point to talking about what I would globally call “trans issues” because it's just a tough topic to address without getting sucked into the culture war binaries. As in so many things, and you will deduce this from listening to the episode, I find myself in neither camp. I'm absolutely a gung-ho defender of equal rights for trans people. I'm absolutely and consistently grossed out by the ways in which the right treats with contempt the real lives of real people for the sake of their political gain and sometimes it seems just for the sake of the kind of pleasures of sadism. I also think the “left” side of this debate (I put it in quotes because in other countries it doesn't break down as a clean left-right issue) has been profoundly illiberal in its efforts to police the discourse and to relegate to out of bounds all sorts of thorny policy questions that really do pit kind of various rights and concerns that are legitimate against each other in ways that simply can't be reduced to right bad, left good. This conversation with Rogers is really kind of prior to most of that, however. It's about what we're even talking about when we talk about this category of gender identity, which as I think Rogers demonstrates pretty persuasively wasn't until fairly recently even a way of understanding the world. Which is to say it's a social construction, which is not to say that that means that it's illegitimate, that it's not a real or authentic social construction any more than it's real or authentic for us to talk about all the other very real ways that we construct our senses of self. Even the modern idea of having a self, as Rogers and I discuss, is a constructions. At one point, Rogers chastises me a bit in our conversation when I use the term “social contagion” to get at an aspect of this idea of the social constitution of gender identity. And I take the chastisement, to a point. It's implicitly pejorative — suggestive of kind of disease, corruption. It also, inaccurately, suggests something out of the ordinary, a foreign invasion, when the much more banal truth is that how we imagine and construct ourselves is always this immensely complex negotiation between our biology, the things that are coded into our DNA, and the historically contingent ways in which our specific society at this moment in time carves that nature at its joints. Agreeing on that truth, which I think we really should, is not the end of the conversation about how we should live together with each other and treat each other with dignity and respect and balance all the competing concerns and values when it comes to policies around gender identity. It really is the beginning of that conversation, and that's where Roger's book to me is especially valuable, and that's why I'd like to believe this conversation is valuable, too. I hope you agree. Hope Giselle joins us to talk about her incredible journey to becoming a sought-after activist and speaker. Hope began her advocacy work fighting for inclusion and access for herself as an undergraduate at Alabama A&M University. Hope founded the university's first LGBTQ+ organization and later became the first openly trans woman to earn a Master of Fine Arts from the university. She has since built a decade-long career as an activist, author, speaker, and nonprofit founder (AllowMe). Hope has proven that nothing is off limits to her, and she has committed her life's work to ensuring the same for all others. During our conversation, we talked about the incredible life she's built fighting against marginalization, and how she manages to look so good doing it.During our conversation, Hope told us what it was like growing up in Miami and having others project their beliefs about her gender and sexuality onto her at five years old. We talked about how growing up surrounded by her stylish Caribbean family of Cuban and Haitian descent shaped her ideas about femininity and womanhood. She shared that her journey of defining and redefining herself was difficult, but at 19, a video of Janet Mock opened up new possibilities for her life. Hope talked about the most eye-opening aspects of her transition, especially at an HBCU that skews conservative about gender and sexuality. We have an incredible conversation about why there is sometimes a struggle among cis women, with being in community with our trans sisters, and how we might overcome those barriers. In this solo episode, I share one of my favorite metaphors for understanding how desistance actually unfolds in practice — because it rarely looks the way most parents hope it will. Many parents carry a fantasy version of desistance in their heads: a tearful moment of confession, an apology, a sudden reversal. That's almost never what happens. What actually happens is slower, messier, and far less dramatic — but still hopeful, if you know what you're looking at.The metaphor I use is the hermit crab. When a hermit crab outgrows its shell, it must find a new one before abandoning the old one. That terrifying moment of exposure between shells is something the crab instinctively avoids. For your trans-identified child, the alter ego identity is that old shell — it provides psychological structure and protection, answers the question "who am I?", and is doing real work for them even when it's causing harm. Desistance doesn't happen until a new shell exists to replace it.I walk parents through what those building blocks actually look like — moments of femininity, embodiment, taste, competence, nurturance, and authentic connection — and why it's so important not to connect those signs directly to gender. The way you respond to those building blocks either reinforces them or demolishes them. I also expand the definition of identity-building beyond gender expression to include real-world skills, relationships, experiences, and sources of self-esteem. The goal isn't just for the old shell to fall away — it's for your child to become someone who doesn't need a label to answer the question of who they are.This episode doubles as a bonus lesson in ROGD Repair. Why would a professional Canadian hockey player, who grew up as a Christian, transition from female to male, and then detransition back? How did God's word transform her life and what did she learn through the process of gender confusion, reassignment surgery and detransitioning? In this episode, Sean talks with author Kyla Gillespie about her new riveting book Transformed.Kyla Gillespie was born in BC, Canada. Being raised in a Christian home, she came to faith in Jesus Christ at a young age. As early as the age of five, she began to experience gender dysphoria. In her teens, wrestling with both same-sex attraction and gender dysphoria, life became difficult. She spent her late teens and adult years as a Professional Women's Hockey Player. After a lifelong battle with Gender Identity, in 2011 she fully transitioned from female to male. While living as a male for six years, God revealed himself to her in a powerful way. Since then she has fully de-transitioned and is now living out her God-given gender and sexuality as a woman in pursuit of Jesus.
