Joaquín Torres-García was Uruguayan-born artist who wanted to bring Constructivism and Modernism to Latin America, and worked for much of his life promoting the idea that Latin-American voices should be part of the Modernist art movement. Copy Southbound has opened doors that we never imagined, but by far, the greatest gift has been the amazing people we've come to connect with. One amazing man was Barry Grimson, who became a great mate to Bruce and I, and as we soon discovered, was admired by all who knew him. His passing last week following a long battle with cancer cut deep and as tributes flowed across social media, the values and pride Sleepy had in the transport industry resonated with every heartfelt comment. As a small tribute to Barry, we decided to go back and have another listen to the interview that was recorded back in 2021. This special episode of Copy Southbound is dedicated to mateship, pride, dedication, survival and honour, all attributes that Sleepy fought for to keep the industry alive as he knew it. Rest easy Good Buddy and thank you for making what we do so worthwhile, we'll miss you.

The vast majority of songwriters are…just…well…song writers. That is, their ability to convey emotion or tell a story is strictly restricted to lyric and melody. So while we won’t detract from those who navigate that task masterfully, we also gotta pay dues to the multidisciplinary folks who single-handedly offer a “fuller” package. Link to bioRxiv paper: http://biorxiv.org/cgi/content/short/2023.04.11.536227v1?rss=1 Authors: Campos, W., Iorii, T. A., Presti, A., Grimson, R., Vazquez, P. Abstract: Rattus norvegicus is the second most used laboratory species and the most widely used model in neuroscience. Nonetheless, there is still no agreement regarding the temporal relationship of development between humans and rats. We addressed this question by examining the time required to reach a set of homologous developmental milestones in both species. With this purpose, a database was generated with data collected through a bibliographic survey. This database was in turn compared with other databases about the same topic present in the literature. Finally, the databases were combined, covering for the first time the entire development of the rat including the prenatal, perinatal, and postnatal periods. This combined database includes 497 individual dates for both species. The developmental relationship between humans and rats was better fit by a logarithmic function than by a linear function. Also, an inflection point close to birth becomes evident after the logarithmic transformation of the data. The predictions of the proposed model were compared with other estimators historically used to calculate developmental relationships, such as growth in brain weight, finding a notorious discrepancy. As development progresses, an increase in the dispersion of the data is observed. Until now, developmental relationships have been interpreted as a univocal equivalence. In this work, is proposed an alternative interpretation where the age of one species is translated into a range of ages in the other. Copy rights belong to original authors. Eric Grimson is MIT's chancellor for academic advancement and interim vice president for Open Learning; he's also a longstanding professor of computer science and medical engineering. In this episode, Prof. Grimson shares his thoughts on in-person and online education. We learn that he rehearses each lecture one, two, or even three times before coming to the classroom, and that he often pauses in his speech when lecturing to avoid distracting his students with “um”s and “ah”s and similar disfluencies. But though some of the techniques he describes might seem to reflect a view of teaching as performance, Grimson firmly believes that education should be a dialogue rather than a monologue—that students should be engaged as partners in the exploration of the material, even in an introductory-level class. “Anybody with enough curiosity ought to be able to explore a field,” he says, “and we ought to be able to teach at a level that opens it up to them.” The same conviction underlies his commitment to sharing his expertise online, whether by publishing his course materials on MIT OpenCourseWare or through purpose-built MOOCs on MITx. My guest, Jennifer Grimson loves the term “micro empire” which is a new definition of success. It means, to be successful in life and business, you need to have a few key areas that make up your empire: • Your personal brand - This can help or hurt you in the future. • The skills needed for your industry - You need these skills even if they're not at the forefront of your job description. • The people who work with you- This includes employees, contractors, and partners. They all play an important role in building this micro empire so it's crucial to find the right ones who will advance your goals while upholding company values. Beach volleyball was the hardest sport that Jess Grimson ever tried and that struggle for mastery has driven her to a second Commonwealth Games. Initially bound for a college soccer scholarship in the USA, the Leeds star spiked for the first time aged 13 at the behest of her pioneering P.E teacher. The four-time British champion reached the quarter-finals at Gold Coast 2018 with Victoria Palmer and will competed on home sand with a new partner in Daisy Mumby. In this episode Jess discusses: Being introduced to Volleyball by her PE Teacher. The challenge of being involved in an emerging sport in the UK. The injuries and challenges she's faced over the course of her career. Having to self fund or attract sponsors where possible to fund travel and tournaments. Dealing with a hard injury in the lead up to the 2022 Games. Her experiences at the 2018 Games in the Gold Coast vs the 2022 Games in Birmingham. Being a pioneer in the sport to clear the way for future generations. What she will take away from the sport. Life beyond volleyball. You can keep up to date with jess via Instagram: @jgrim02 . About Jennifer GrimsonI was a single mother who lost everything; I found myself with no money, no job, no car, no place to live and the sole support for my two children...TWICE. I knew that I had to rebuild again. This time, instead of just looking for a job with a big paycheck, I was going to find a way to grow my money. I envisioned creating a series of income producing “micro empires” that would protect me, my family and my assets. I felt like I was running out of time; I was in my 40s, with zero retirement funds, no assets and no clue how to begin. After struggling to pay bills and stay above water, I wasn't about to follow the advice of a blogger in a coffee shop telling me to ‘quit my job' and ‘follow my dreams'. I also couldn't get what I needed from established billionaires whose advice was too broad. I needed concrete steps that I could easily follow and I didn't know where to begin or where to turn.Over the next 4 years, I took tiny, actionable steps that moved me in the direction of these goals. I surrounded myself with the right people and took calculated, educated moves. I did not quit my job. I did not win the lottery. I did not get an inheritance. I manipulated my 401k, I learned about new vehicles for investments, I used my paycheck, I used my HSA, I used the tools I had at hand at the time. I took micro-risks.At the end of these 4 years, I had over $1.4m in income producing properties, had become a hard money lender and had invested in private technology companies. I realized that I had created my own micro empire! The goal of the Micro-Empires Podcast is to provide those real life steps and tools to create and grow your micro empires. I will bring in experts, take your questions and share my experiences. This podcast is about YOU. We all have a story; whether your story is a lot like mine or totally different.

These three components are what I call "the three pillars" of any successful business model. I knew that I had to rebuild again. This time, instead of just looking for a job with a big paycheck, I was going to find a way to grow my money. I envisioned creating a series of income-producing “micro empires” that would protect me, my family, and my assets. I felt like I was running out of time; I was in my 40s, with zero retirement funds, no assets, and no clue how to begin. I surrounded myself with the right people and took calculated educated moves. I did not quit my job. I did not win the lottery. I did not get an inheritance. I manipulated my 401k, I learned about new vehicles for investments, I used my paycheck, I used my HSA, I used the tools I had at hand at the time. I took micro-risks.At the end of these 4 years, I had over $1.4m in income-producing properties, had become a hard money lender, and had invested in private technology companies. I realized that I had created my own micro empire! The goal of the Micro-Empires Podcast is to provide those real-life steps and tools to create and grow your micro empires. I will bring in experts, take your questions and share my experiences. This podcast is about YOU. We all have a story; whether your story is a lot like mine or totally different. Maybe you have a good job, but you know in your heart that you want more. Maybe you just want to expand in the work you're doing now. Maybe you want to retire early or have more financial security. Maybe you are just getting started and you're 50 and you're worried it's too late. No matter what your story is, there is a path to building your own empire. So... Welcome to the 8th episode of the Disruptors Network podcast. Jennifer Grimson is an entrepreneur who lost it all twice and built it back up into her own empire of financial independence. In 4 years, Grimson amassed over $1.4M in income-producing properties. She teaches other upcoming entrepreneurs how to build their own empires. We discuss Jennifer's story, being a life-long learner, and building generational wealth.
Jennifer Grimson was brand new to the podcast space when I met her two years ago at the last in-person Podcast Movement event. Fast forward and she became my spontaneous guest for Epi 34 of Insider Interviews discussing her approach to marketing the now successful Micro-Empires Podcast about her path to rebuilding wealth. And, since podcasting adds such a personal touch, she gives us insights about her very personal story from filing for Chapter 13 twice to being having million-dollar + in assets. Grimson explains how she taught herself to rebuild her wealth AND how to build a podcast starting at any point in your life. "I'm living proof of that story...I lost everything. No home, no job, no car, no money, no place to live, and two children to raise. That happened to me twice...and the second time I was 41 years old." Her A-Ha Moment: "I realized that if I wanted security and to build wealth, it wasn't just going to be through one thing," Grimson explained. "I was going to have to create little pockets, which I call 'empires'. And once I got started I was able to create $1.4 million in income producing assets in four years." Moving Past the Shame "The podcast came about because people kept asking me about how I'd done that; of course I'd kept my story a secret because I was so ashamed of it, like a lot of people who share my story. I wanted to share what I had done, but more importantly, sharing those tools and real steps for anybody to take, whether it's their mindset or literally taking steps to build wealth." Lessons Learned: "I think the first lesson is you don't abandon yourself, which is such a powerful thing. Think about it: I treat my friends and family better than I treat myself. I don't say things to other people that I say inside my head. And I think that's true all around. So finding a way, whether you believe it or not, whether you think you deserve it or not, of believing in yourself. ... I just had to put blinders on and move forward ... It's not actually rocket science. It might be hard. But it's not difficult to understand." After Grimson explained her three lessons of coming from nothing to financial resolution -- assess, ask, act -- she went on to explain how learning to be a podcaster -- or learning ANYTHING -- is to dive in. "You're going to jump in a pool with a bunch of people that are Olympic swimmers. And you're going to be in there with your floaties on just trying to keep your head above water, but there're two things that are going to happen: Number one, you cannot be in that environment and not learn. And number two, the experts are not going to let you drown. That's true about wealthy. That's true about everybody here at Podcast Movement. People who are successful, 99.9% of the time want to help." On Creating and Marketing a Podcast? Grimson did not have a media background: "I didn't even know how to plug in the microphone. I still struggle with that portion of it. But I've never really worried about that because there are those Olympic swimmers you can call. I'm never going to be the best at that. What I have to offer is my experience. So that's what I wanted to focus on. What I learned was that despite the fact that there's a million podcasts very few of them are actually successful and that they take work. They're not easy. You have to commit and be really thoughtful about who you're talking to." That is about the best lesson one can learn when diving in to podcasting. Does her story have a happy ending? You bet. Right down to her pro-hockey husband, Stu. But it's all because Grimson, who is fiercely independent, candid, and determined, keeps on swimming. Take a listen. We'll surface all kinds of tips and inspiration. And like she says, please leave a review for Insider Interviews! On 12 January 2000, the way the British military treated serving LGBT+ people changed forever. Prior to that date, anyone who was LGBT+ was banned from serving in the Royal Air Force, the Royal Navy and the British Army. Before the ban was lifted, serving members of the forces lived in fear of being outed. They lived in fear of being themselves. They kept their head down and got on with their jobs. However, not all LGBT+ people who were serving at the time were kind souls who were secretly supportive of their other LGBT+ colleagues. One person in the Royal Navy was the complete opposite. This is his story.Patreon: patreon.com/queercrime Twitter: @crime_queerInstagram: QueerCrimeWebsite: queercrime.comSupport the show (https://www.patreon.com/queercrime)

At almost 77, Barry 'Sleepy' Grimson is still behind the wheel and preaching transport and praising the industry that he loves has fought for over the years namely as one of the 6 original instigators of the now famous Razorback Blockade in 1979. His account of the blockade is as raw and as passionate as it gets. If you think Bruce wears his heart on his sleeve, wait until you listen to 'Sleepy'......

This is part 3 of the story of Cavalier County State's Attorney Gudmundur Grimson, who in 1922 prosecuted a case involving a Munich, North Dakota boy who had been flogged to death in a Florida forced-labor camp. Labor supervisor Walther Higgenbotham had done the whipping, and after Grimson's initial efforts to get him charged failed, Grimson turned to the North Dakota legislature, which called on Florida to act. Florida papers responded by telling North Dakota's “farmer legislators…to go back home and slop their hogs.”

Yesterday, we began a 3-part story on Gudmundur Grimson, the attorney for a farm family whose son died in a forced-labor camp in Florida. In 1921, young Martin Tabert of Munich, North Dakota, had been sentenced to three months in a Florida jail for vagrancy. Sheriff J. R. Jones “leased” Martin to a Lumber Company for $20, and Martin was forced to cut trees and construct a railroad bed though the swamps.
North Dakota Supreme Court Justice Gudmundur Grimson was born in Iceland in 1878. When he was four, his family of 15 emmigrated to Dakota Territory and settled north of Milton, and it was on this date in 1965 that Grimson died. Today we bring you part one of his 3-part story.

You do not need to start with a ton of money to build your own real estate empire. On today's episode, we talk with Jennifer Grimson, about her journey from bankruptcy to financial independence and how she was able to move through crisis to reach her goals. Jennifer has created over $1.4 million in income producing investments while working a full- time job. We discuss how perseverance and grit helped Jennifer overcome challenges, why she ultimately chose to be a passive investor instead of an active one, and the three numbers she's always has in her head to make sure she's on the right track to financial freedom. We also talk about how success comes from being comfortable with the uncomfortable. Jennifer Grimson was a single mother who twice found herself broke and hopeless. The second time, she rebuilt by creating small “empires” for financial independence. She created over $1.4m in income producing investments with a W2 and some grit. In 2019, Jennifer created the Micro Empire Podcast to share her story and to pull back the curtain on the path to financial independence. She invests in three short term rentals, multifamily, and businesses. Our guest today is Jennifer Grimson, a coach, real estate investor, and podcaster, who created a concept called Micro Empires. In this episode, she breaks down the many ways she invests and how you can build your own micro empires too! If you are ready to diversify your income streams and set yourself free financially, then this episode is for you! Learn more about Jennifer and her journey at reiclarity.com! “My thought was if it belongs to me, it's an empire.” 03:14 Jennifer was a single mother, who lost everything in her life twice. She found herself with no money, no job, and no place to live with her two children. After the second time, she realized that she didn't want to be dependent on others anymore and instead of only looking for a job, she started to search for ways to diversify her income and build lasting wealth. This is when the concept of micro empires was born. Jennifer started to build different streams of income which included her day job as a salesperson, coaching, real estate investing, and art. “There's always something that you can do, hopefully, that you enjoy. And hopefully, that builds on what you're already doing.” 10:37 Jennifer suggests to always have at least 3 streams of income. To find these streams, look at your talents and figure out what you do so well that other people ask you for it. Then start to build businesses around these talents. Jennifer was always good at storytelling so she built her micro-empires around business coaching, high-level executive resume writing, and Linkedin networking coaching. She also invests in multifamily real estate and until earlier this year, Airbnb. She invests in broad-based index funds and paints as well. 13:47 According to Jennifer, believing that what you're doing is worth it is important and it often requires a mindset shift. Her advice on how to start charging for what you love to do: Be consistent and work towards your goal in small steps every day to move the needle. Do something every day that scares you. Be honest about what you need and don't be afraid to tell it to others as well. “I'm looking at other multifamily but really anything that creates cash flow is what I'm interested in.” 23:12 Jennifer always wanted to get into real estate investing. She started out with Airbnbs using her 401k. This turned out to be so lucrative that she was able to quit her corporate job at the end of 2018. However, the market was becoming too saturated, so Jennifer decided to sell her Airbnbs just a month before COVID hit. Jennifer has been investing in a joint venture with 67 doors and in the future, she would like to buy more multifamily. 32:25 Jennifer's advice on finding ways to make money while keeping your day job: Know your finances and use the tools and resources that are available Understand your mindset, blocks, and limiting beliefs Take action, learn and try things, and don't be afraid to ask questions Mentioned in the show: Jen Sincero - You Are a Badass Gavin de Becker - The Gift of Fear www.micro-empires.com https://micro-empires.com/coaching/ www.bakercollins.com www.shineinsurance.com/reiclarity Learn how to grow your portfolio and reach incredible success the right way! On this episode of the Leafy Show, Jennifer and Brian talk with Jennifer Grimson, host of the Micro Empires Podcast. Jennifer went bankrupt twice, lost everything - twice, and came back creating a $1.4m income producing success. Jennifer started with a short term rental in Nashville via AirBNB when it first got started. As the sole parent, Jennifer had to keep her day job and started using her retirement fund as a vehicle for investments. She slowly accumulated more short term rentals over the last 4 years, using tiny, actionable steps that moved her in the direction of her goals. She surrounded herself with the right people and took calculated, educated moves, which she called ‘micro-risks’. Jennifer then became a hard money lender and invested in private technology companies, creating a very successful company. As a consequence of her industrious investments, she was able to quit her W-2 job and run her own business. Jennifer tells us that there are so many ways to be involved in real estate and they can be small ‘micro’ decisions, they don’t have to always be huge investments to be profitable. The Work in Sports Podcast - Insider Advice for Sports Careers
Stu Grimson was one of the most feared men in the NHL and now he's a fixture in the boardroom. Learn more about his transition from brawler to lawyer on the Work In Sports podcast.Hey everybody, I'm Brian Clapp VP of Content and Engaged Learning for WorkInSports.com and this is the Work in Sports podcast.I love contrast. Contradictions. The unexpected. It can be as simple as a flower in the desert, a kid quietly reading a book when all of their friends are on their phones, or Tom Brady going to the Buccaneers. Alright, maybe I didn't love that last one so much. But on a grand scale, I tend to seek these things out, always on the hunt for contrasting elements - I don't know why - just one of the quirks of individuality I guess. These moments of contrast bring me great joy. I guess they remind me that the journey is not predictable, that patterns and assumptions aren't finite - nature and people are always able to change and throw you a curveball when you are looking dead red. And isn't that an incredible lesson -- doesn't it harken you back to the idea your mother drilled into your head not to “judge a book by its cover”? That we as people are all the sum of our actions, and actions themselves are individual and unpredictable?Ok, maybe I'm going to abstract here and I need to reign it in, I get it. But if you haven't noticed lately, our society is largely based on the superficial judgment of others. We see looks, and judge, we see patterns and assume. Ugh. It's so maddening. I can't say we've lost touch with compassion, empathy, and understanding for each other, because I'm not sure we ever had it. Well, I'm here to admit that I made the same mistake just last week and it was really enlightening. I assumed I knew someone based on my superficial knowledge of their past. Stu Grimson played 13 seasons in the NHL as one of the most feared enforcers in the game. 211 career fights, of which he estimates he won about 80% of them, and watch the videos, he's right. His nickname is the greatest in sports -- the Grim Reaper. I mean come on, you are a fighter with the name Grimson, and you earn the nickname Grim Reaper. It doesn't get any better. When I worked in the media during his playing days I would celebrate this man as the baddest MF'er in hockey -- and cheer on his vicious battles. I assumed he was a lug nut on skates. I born brawler with what little he had between the ears beaten out of him over years of repeated head trauma. I assumed that he may be addicted to painkillers somewhere. I assumed that he followed the predictable storyline of former player fallen on tough times. You know what I didn't assume -- that he'd be a successful lawyer. Never entered my mind. We all do this. We try to fit life into predictable channels. We try to put our own conclusions on people based on our limited information. This is wrong at its core. What follows next is one of the most enjoyable and insightful conversations I've ever had on this podcast. Stu is amazing, and I'm not just saying that because I fear for my health after assuming he was a lug nut on skates - I'm saying that because over the last few weeks I've gotten a little glimpse into the man and I respect the hell out of him. Our conversation was long… so I'm going to break this into two parts -- I'm not editing out a simple word, part 2 will air on Wednesday! Here's Stu GrimsonQuestions for Part 1 Stu Grimson, Chief Counsel ThirdHome and Former NHL Enforcer1: There are so many topics I want to speak with you about, so I'm glad we have some time to truly dive into your whole journey and story.Let's start with your playing days in the NHL - 13 seasons with 7 NHL franchises, we often talk about the glory of professional sports – the money, the fans, the winning – but as you look back what was the hardest part of being a professional athlete?2: With a nickname like “The Grim Reaper” there is no denying how you made your name in the game – you were an enforcer.
Welcome to the No Holds Barred Podcast .. In this weeks episode I chat with Barry Grimson, a man who's been on the road in the transport industry for a long time, and who was one of the leaders of the legendary Razorback Blockade in 1979. I've known Barry for a number of years, and have a great deal of respect for him as a man, and for his experience, his knowledge and his great sense of humour. I hope you enjoy this candid conversation between a couple of old truckies (and mates) as we reminisce about the past, and look into the future.
When I was introduced to Jennifer Grimson and I invited her to be on the show, it was well before we were in the middle of a pandemic. And even though her story is compelling, I think it has even more relevance for the state we find ourselves in right now. Jennifer lost everything––TWICE. Each time, she had no money, no job, no car and no place to live and she was supporting her two children. She successfully rebuilt her life from scratch and has built several of what she calls micro empires. And now, she’s sharing her story and the steps she took to dig out of the hole she was in and to build wealth. As many, many people find themselves in financial hardship right now with the coronavirus, Jennifer also shares some tangible steps people can take right now as they navigate these difficult waters. You can find some of those tips at the end of the show and I hope that this is helpful to you. Stu Grimson's new autobiography is aptly called The Grim Reaper, but the book's subtitle – The life and career of a reluctant warrior – rounds out the picture of the infamous NHL enforcer. Grimson was a serious handful, a heavyweight who knew exactly how to flatten a foe in as few punches as necessary. But he is conflicted about that role - and much more proud of his leadership in the locker room and on the bench. The fact that Grimson liked using his noggin more than his knuckles became obvious once he got his law degree and started negotiating in NHL labour disputes. Host Anastasia Bucsis gets the NHL veteran talking about the main preoccupations of a heavyweight during the height of the enforcer years.
Former NHLer Stu Grimson wrote the book, "The Grim Reaper: The Life and Career of a Reluctant Warrior." Stu says he took an unconventional path to the NHL, played a unique role while in the league & then took a different path when he retired. Stu believes the lessons he learned along the way have application over a broad range of professional areas.

For the business-immigration side of my practice, this occurs regularly in EB-1 Extraordinary Talent cases when the client presents some good evidence of national and international awards and acclaim in their field but falls short of the stringent requirements for this visa. For me this mostly happens for athletes, but also for those in the entertainment field and other areas. This typically is the case for older clients, where they present great documents showing success and awards…but those document being from 10 years earlier. Some of them have transitioned from playing the sport as an athlete to becoming a coach/trainer or sports broadcaster, or sometimes a musician has changed from a performing artist to producer or teacher. The transition could mean that although they were once able to obtain Lawful Permanent Residency in the U.S. through the EB-1 program, their current facts may give them difficulties. The first time I ran into this problem was when I first started practicing immigration law and I wasn't aware of the issues presented when a client had not sustained their ability in a particular field after having moved on or evolving into other areas of that field. In this instance, I submitted the case for a former award winning martial art athlete that was now a full-time trainer. On the Form I-140, I simply stated that the job title was “Martial Artist” but provided evidence of both athletic success and coaching success. The USCIS sent me back a very polite Request for Evidence (or RFE) saying that I needed to choose: either the Beneficiary was an athlete or a coach. He could not be both for these purposes. Luckily in that case my client had established himself as a stronger coach than he ever was as a player and I dodged a bullet in this nuanced area of Employment-Based Immigrant Visas. I most recently dealt with this issue during a case consultation I had was with a former athlete that won his last international award in 2007, but had not had noteworthy success as an athlete from that time until his retirement in 2012. After retiring from playing, he made the transition to coaching. He was in the process of working his way up to the top of that field, recently becoming the national coach for his team. But he wasn't happy when I told him that I didn't think he could use his history as a player, and that his current coaching was probably not enough yet to show sustained success to the level needed to be a strong EB-1 candidate. Today I am going to analyze some case history to help practitioners through this murky area. This issue must be coming up a lot since I see it so many times in AAO decisions and when other immigration attorneys come to me for consultations and guidance about their cases. This information will also help your judgment of which cases to take on based on case history. I will begin by doing a general overview of the pertinent regulation, going over two recent AAO decisions touching upon this issue and then providing guidance and tips on the three important areas of the 2nd part of the two part analysis of an EB-1 case. The Regulation The basic regulations for what I call EB-1a (also known as the E11 category or EB1-3) can be found under INA Section 203(b)(1)(A) and 8 CFR 204.5(h). Further guidance was given in the famous (or infamous) EB-1a case of Kazarian v. USCIS,[1] creating a two-part analysis for an adjudicator of an EB-1a petition[2]: The First part of the analysis is to show that the alien has extraordinary ability in the sciences, arts, education, business, or athletics through extensive documentation. Showing evidence of one great award like an Olympic medal does this, or satisfying 3 of the 10 criteria listed in the regulation. In Part Two of the analysis, you must consider all of the evidence to make a final merit determination of whether or not the petitioner, by a preponderance of the evidence, has demonstrated that the alien has: (i) A level of expertise indicating that the individual is "one of that small percentage who have risen to the very top of the field of endeavor”, and (ii) They have sustained national or international acclaim and that his or her achievements have been recognized in the field of expertise. Also it must be shown that the Beneficiary (or Petitioner, if self-petitioning) is seeking to enter the U.S. to continue work in the area of extraordinary ability, and that the alien's entry in the U.S. will substantially benefit prospectively the U.S. My analysis today will be focused of this second prong of the Kazarian analysis. Case law I want to first get into the recent AAO decision in Matter of K-S-Y-.[3] This case discussed how an individual could demonstrate EB-1eligibility during a career transition from competing as an athlete to coaching the next generation of athletes. In this case the Beneficiary had once had great success as a Judo athlete and competitor but was now a coach. The case was still approved despite the transition.[4] In the final merits determination, the totality of the evidence was considered. The AAO said that the Beneficiary has demonstrated a long, successful, and recent career as a professional judo athlete at the highest level of national and international competition. But defining the cognizable area of extraordinary ability or expertise was complicated when the Beneficiary is transitioning to another phase of his or her career. Though the Beneficiary demonstrated extraordinary ability as a judo athlete in this case, the Petitioner listed on the Form I-140, that his proposed employment in the United States was as judo coach. In a personal statement, it was indicated that he planed to open a judo academy, train promising young players, and eventually coach an American judo team in the Olympics.[5] The question presented in this case was whether - and if so, how - a petitioner's area of extraordinary ability or expertise may properly encompass both athletic competition as well as coaching other athletes. In its decision, the AAO cited the USCIS Adjudicator's Field Manual (AFM), saying it provided an analytical footpath by which a petitioner may transition from athlete to coach and yet remain within his or her area of expertise as such: In general, if a beneficiary has clearly achieved recent national or international acclaim as an athlete and has sustained that acclaim in the field of coaching/managing at a national level, adjudicators can consider the totality of the evidence as establishing an overall pattern of sustained acclaim and extraordinary ability such that it can conclude that coaching is within the beneficiary's area of expertise.[6] Also, note that where the beneficiary has had an extended period of time to establish his or her reputation as a coach beyond the years in which he or she had sustained national or international acclaim as an athlete, depending on the specific facts of the case, adjudicators may place heavier, or exclusive, weight on the evidence of the beneficiary's acclaim as a coach or a manager. The success of this case was because the athlete (here a Judo expert) obviously had a great career as an athlete, but the AAO though that the Beneficiary's athletic acclaim was recent enough. Less than a year before submitting this Petition, the Beneficiary had placed second in national competitions and was a member of his country's national team. He filed the petition in this case within seven months of his last major competitive achievement. So the closeness of filing and last competition was a key factor in its approval. To support his top-coaching claim, the petitioner provided evidence that he trained judo athletes preparing for the 2014 Asian Games and Commonwealth Games, the 2016 Olympic games, and other international competitions soon after retiring as a player. These considerations supported a finding that the beneficiary's extraordinary ability and sustained acclaim as a judo athlete extended to his work as a judo coach. The beneficiary also had educational degrees in coaching, licensing for coaching, wrote about his field, and coached a university team. These preparatory steps taken by the Beneficiary throughout his career as an athlete further supported a finding that coaching was within his area of expertise. Importantly, the case does not make clear how long the time between fields can be. In this case the official coaching position was short-term, but the Beneficiary was able to provide documentations supporting his build up to a top coaching position. Importantly, note that the AAO said: “We do not purport to establish a particular timeframe within which the transition from competing to coaching is deemed sufficiently recent.” Alternatively, in the recent EB-1 case of Matter of H-W-, a Table Tennis Coach's appeal was dismissed.[7] Here, the petitioner had left the proposed “area of employment box” on Form I-140 as blank, but within the brief had listed his area of expertise simply as “table tennis.” The RFE by the Director said that coaching and competing were not the same thing.[8] The Director's denial said that the Beneficiary's coaching history was weak, but the Beneficiary did show a one-time major achievement award as an athlete, satisfying the first prong of an EB-1 adjudication. But the Petitioner's most recent accomplishment as an athlete predated the filing of the petition by approximately 10 years. Thus the evidence did not confirm that the Petitioner sustained his acclaim as an athlete through the date of filing. Analysis & Tips: Case law and regulations have established that competitive athletics and coaches rely on different sets of skills and in general are not in the same area of expertise. The AAO has recognized the existence of a nexus between competing and coaching or training. But that it would be too speculative to assume that every extraordinary athlete's area of expertise includes coaching. To resolve this issue, the following vague balance is sometimes appropriate. In a case where an alien has clearly achieved recent national or international acclaim as a competitor and has sustained that acclaim as a trainer at a national level, they can consider the totality of the evidence as establishing an overall pattern of sustained acclaim and extraordinary ability such that it can conclude that training is within the petitioner's area of expertise. Here are some tips to keep in mind when planning an EB-1 case with a client that has transitioned to a new specialty within their field: 1) Creating an Exact Job Title for Their Current Field of Expertise: The first thing to do in these cases is to control the narrative of the job title within their field of sustained achievement (and what that job will be after entering the U.S.) by choosing the right position title on Form I-140 and in the cover letter. According to the case of Lee v. INS.,[9] viewing competitive athletics and coaching or training as separate areas of expertise has been upheld in Federal Court. For example, in the principal case of Lee v. Ziglar[10], the court held that a very successful Korean baseball player could not get an approved EB-1 since his success was not through coaching. The Beneficiary in that case was a lower level baseball coach for a major professional U.S. team at the time of filing the Petition, but was still denied despite massive success as an athlete in his home country. So it is key that practitioners pick a job title within the field of expertise that the person is best known for and is still doing. But note that the USCIS Director had been called out for using semantics about the language used when defining a job position, as in the approved 2005 AAO decision, where the Petitioner listed his position as a Squash “professional”.[11] The Director said the facts showed success as a player and as a coach, but not as a “Professional.” The AAO found that making a distinction based on this terminology was inappropriate and the case was approved. However (in my opinion), the Beneficiary's coaching experience was weak: The Beneficiary had coached students that won national and international tournaments. But these were junior teams and he was not the head coach. Other students he coached competed in under 17 championships, or national women's over 30 competitions, not professionals at their prime. But there was some other work history and experience that helped push this case towards an approval. Another dispute about the job title and how specific it should be was in GRIMSON v. I.N.S.[12] The Director had rejected a hockey player that received acclaim for playing the specific hockey position of an “enforcer.” The case made its way to the District Court, which found that the Director simply rejected the notion that a hockey enforcer can have extraordinary ability. The court found that the Petitioner had presented evidence sufficient to demonstrate that he is currently among the top players in the world at what he does and had reached the very top of his field of endeavor. The court concluded that the decision to reject plaintiff's role and unquestioned ability as an enforcer was without rational explanation. 2) Showing Sustained Ability in the Field of Acclaim If the proper and narrow job title is chosen for someone that has transitioned his or her job, it is important to show sustained acclaim in that new area: As discussed earlier, in Matter of H-W-, the coach had won a worthy one-time award as an athlete, but that award was won 10 years before the filing that petition. The decision said that even if it was found that the Petitioner established eligibility as an athlete, because the Petitioner intends to work in the US as a coach or trainer, he must demonstrate that his area of expertise includes coaching. In 2012, the AAO released a denial of a Karate Practitioner and Coach[13] where it found that the Petitioner's most significant accomplishments predated the filing of his petition by 15 or more years.[14] As discussed in the most recent AAO decision of the Judo player, a particular timeframe within which the transition from competing to coaching being deemed sufficiently recent to allow evidence of previous athletic acclaim has not been established. But in that case they approved a mixed athlete/coach petition that was filed only 7 months after the Beneficiary's last competition as an athlete. 3) Continuing Work in the US in the Field of Extraordinary Talent In Russell v. INS[15] a petitioner met the "extraordinary ability" standard as a hockey athlete but was now retired. He had not indicated any plans to continue working in the area of professional hockey in the United States. The case was denied since the Petitioner was no longer playing in his field. In another important EB-1a case, the Director on its own narrowed the possible field of future work related to the alien's approved area of extraordinary talent. The Federal District Court decision of Buletini v. INS[16], overruled the “AAU,” in its decision to deny a distinguished doctor, concluded that [e]ven if the petitioner (here a doctor) could be said to have risen to the very top of his field based on these accomplishments, the petitioner has not explained how these accomplishments are related to the future practice of medicine at a clinic in Detroit. It was found that it couldn't be concluded that the petitioner has provided clear evidence that he has the prospect of continuing work in the United States related to the particular area in which he claims to have extraordinary ability. However, the District Court found that the AAU's concern that plaintiff will not continue work in the sciences is irrational in light of the clear evidence that plaintiff intends to continue working in the medical profession. The AAU acknowledged that the petitioner intended and expected to "practice medicine at a clinic in Detroit." But the court held that the regulation does not require the alien to continue work on the specific topic or topics of research for which the alien has previously gained notoriety. The court found that the AAU abused its discretion by limiting the characterization of plaintiff's field to the narrow topics on which plaintiff has previously done research. Conclusion These were some key tips a practitioner should note when thinking about a filing a petition that has these types of issues. Unfortunately parts of the EB-1 regulation in this area are still vague. However, each case is different, as is the USCIS officer reviewing that case. As such, cases that have discrepancy or weaknesses in some areas, can overcome that through the totality of the case. The Petitioner was a member of the Korean national judo team in 2000, 2004, 2005, 2006, 2007, 2008, 2011, and 2012. Letters from Olympic medalists and refer to training with the Petitioner at the national training center. In addition, the record shows that the Petitioner placed first, second, or third in selection matches that determine who would be on the national team. Only those with the highest level of performance made the team, and that selection was performed by judo judges at the national level. [5] SIDE NOTE While 8 C.F.R. § 204.5(h)(3)(ii) expressly references a plurality of "associations in the field which require outstanding achievements of their members," we construe this criterion broadly as inclusive of a singular "association." A narrower interpretation could preclude individuals, who in fact clearly have extraordinary ability in their field, from establishing eligibility if their field is one in which only a single such association, no matter how distinguished, exists. See, e.g., Buletini v. INS, 860 F. Supp. 1222, 1230-31 (E.D. Mich. 1994) (single award satisfies "prizes or awards" criterion at 8 C.F.R. § 204.5(h)(3)(i)). [6] AFM Ch. 22.2(i)(1)(C). Tanja Bastia (University of Manchester) In a number of cities in the Global South, cross-border migrants have played a major role in shaping the urban landscape. This is definitely the case in Argentina, where Bolivian and Paraguayan migration have become increasingly visible over the last few decades (Grimson 2006) and have been directly linked to increasing informality, whether at work or in housing. However, as with most studies of migration, most research to date is influenced by methodological nationalism, and fails to take into account the relationship between migration and space, either in terms of how the particularities of locales shape migrants’ experiences, or the multiple ways in which migrants contribute to the making of these places (Glick Schiller and Çaglar 2009). In this paper we report on preliminary findings from a pilot project carried out in informal settlements in Buenos Aires. The project focuses on place-based political organising by migrants and non-migrants alike in three informal neighbourhoods and includes interviews with grassroots organisations and city authorities. On the basis of the varied and multiple claims made through largely informal political organising around issues of ethnic identity, religion, work or housing, we explore how these claims might contribute to the construction of different visions of the city. Given that visions of cities are the basis on which cities develop, in this paper we explore some of these visions, particularly those put forward by migrant and mixed place-based organisations in urban informal settlements. The driving questions this paper seeks to address therefore include: What visions of justice do place-based organisations articulate in their strategies? Whose needs and interests do place-based organisations in neighbourhoods with high levels of cross-border migrants represent? How do city authorities perceive these different organisations?
