This week, Scott sat down with his Lawfare colleagues Senior Editors Molly Roberts and Eric Columbus, and Contributing Editor Renée DiResta, to talk through the week's big domestic news stories, including:“Signed, Sealed, Undelivered.” As the first mail ballots of the 2026 midterms go out this week, a fast-moving legal fight over President Trump's effort to reshape mail-in voting is racing toward the Supreme Court. At issue is a new U.S. Postal Service rule—stemming from a Trump executive order—that requires states to submit absentee voters' information to a federal portal before USPS will deliver their mail-in ballots. A federal ruling in Massachusetts blocked key parts of the rule last week, the administration is appealing, and a separate challenge is pending in Washington, D.C. Meanwhile, an anonymous whistleblower in the U.S. Postal Service has come forward and warned that the hastily built portal it intends to use to vet mailed ballots is so untested and unforgiving that a single scanning error could stop tens of thousands of ballots from reaching voters. How did we get here? And what is it likely to mean for November's election?“Meta Culpa.” Last week, Meta abruptly settled a landmark child-safety case midway through trial, agreeing to pay a bipartisan coalition of state attorneys general as much as $17 billion and to overhaul how teenagers experience Instagram and Facebook. The proposed consent judgment—which has been approved by a federal judge in California—would require a default two-hour daily time limit for users under 18, a midnight-to-6 a.m. “night mode,” hidden “like” counts, stronger age checks, and a school-hours notification cutback, most of it locked in for a decade. It's being billed as the largest big-tech settlement ever, but some children's advocates are warning that its terms don't touch the recommendation algorithms at the heart of the problem. Is this a turning point for social media regulation—or just a manageable cost of doing business?“Strictly Ballroom.” On Monday, a divided Supreme Court cleared the way for President Trump to keep building his enormous new White House ballroom, staying a lower-court injunction that had halted construction on the site of the now-demolished East Wing. But the 5-4 ruling in National Park Service v. National Trust for Historic Preservation didn't actually decide whether the project is lawful. Instead, the majority held that the challengers—led by an architectural historian who regularly walks her dog past the White House—lacked standing to sue, deeming her objection to the ballroom mere “offense” rather than a concrete aesthetic injury. In an unusual twist, Chief Justice Roberts wrote the principal dissent, joined by the Court's three Democratic appointees, arguing that the Court has left standing doctrine even murkier than it found it. So what did the Court actually decide? And what might it mean for other legal challenges to Trump's refashioning of our nation's capital, and beyond? In object lessons, the summer has left most of our crew hungry for more. Eric is eating up the tropical goodness of certain (glass-free) Outshine fruit bars. Molly is savoring the simplicity of an in-season tomato. Scott is perfecting his process for perfect pizza. And Renée stands alone snackless, squeezing out the last of her summer stress with a NeeDoh squishy. To receive ad-free podcasts, become a Lawfare Material Supporter at www.patreon.com/lawfare. In breaking news, Katie Phang's lawyers just caught the DOJ and Todd Blanche lying to a federal judge about the Epstein Files again, and particularly about continuing to hide dozens of pages of handwritten FBI interview notes about a victim who claims Trump assaulted her when she was 13, and trying to pass of a cover letter as a detailed log of each of the 200,000 pages of withheld documents and the reason for them being withheld. Popok reports on the bad things that are coming for Blanche as the Judge is in a position to appoint a special master to review ALL of the documents, produced and unproduced, and take the DOJ out of the equation. How You Actually Beat Trump

Heading into the midterms, what actually beats Trumpism — and is the two-party establishment even capable of it? Chris Cuomo brings together three of the sharpest and most different voices in American politics to argue over what's really broken and what actually wins. Marjorie Taylor Greene (former U.S. Representative for Georgia's 14th Congressional District) details the falling-out that ended her alliance with Donald Trump — the White House phone call in which she says he warned her "friends are going to get hurt" if the Epstein files came out, the death threats against her family, and the loyalty demands that led her to conclude the movement had become a cult and the whole system is broken. James Carville (Democratic strategist and political commentator) makes the case that Trump is an existential threat that calls for scorched-earth tactics, and spars with Cuomo over the better path to a majority — hammering Trump as the most destructive figure in the country, or winning back voters by telling them "you're right about what's wrong, and here's who actually fixes it." Brian Tyler Cohen (YouTube and podcast host, "No Lie with Brian Tyler Cohen," and author, "The Day After: How to Wield Power in a Post-Trump World") argues Democrats are institutionalists to a fault — too precious about the filibuster and the norms while the other side barrels through them — and that the only way to beat the fear-mongering is to seize power and actually deliver for people. Today's Headlines: Iran accused the US of a war crime after strikes hit a wedding killing four civilians, the US denied targeting civilians, Iran responded by launching missiles at US bases in Jordan, Kuwait, Iraq, and Bahrain — so the ceasefire is going great. The USS Abraham Lincoln's 5,000-person crew finally docked in Thailand after nearly nine months at sea, were told by the military not to speak to journalists about the conditions they endured, and local authorities in Pattaya preemptively cracked down on prostitution ahead of their arrival. And to absolutely no one's surprise, Apple caved to Trump and changed Lake Ontario to Lake America on Apple Maps following his personal request, which is a remarkable display of corporate spine from a company worth $3 trillion. It's been a while but on the Epstein beat, Congressman Thomas Massie proposed the Epstein Files Transparency Act II, reading the names of 14 Epstein associates he believes need to be investigated — notably not mentioning the one person referenced in the files more than anyone else. In tech, GoPro is pivoting to AI, defense, and national security after merging with an optical company, its stock shot up 40%, and Dyson announced a $499 AI toothbrush with a built-in camera that can livestream your brushing to an app, which no one asked for. Google avoided being broken up despite being found guilty of antitrust violations, getting instead a vague requirement to make unspecified changes to its ad business. Meanwhile, a new study from San Diego State found that fewer women are creating TV shows for streamers than a decade ago, female directors of broadcast programs have declined, and the majority of speaking roles for women skew toward their 20s and 30s while men's roles don't drop off until their 50s. And finally, Milo Yiannopoulos told Piers Morgan that being detained and deported by ICE was humiliating and frightening, and that if he'd known this was possible he would never have supported Trump. In this searing book, Robert P. Jones names our moment for what it is: a great Backslide. White Christianity's devotion to Donald Trump and Christian nationalism is not only a regression into authoritarian politics but a profound act of apostasy—a betrayal of the best of the Christian tradition. Through reflections on history, his upbringing in the white evangelical South, and decades of social science research, Jones lays bare the roots of this collapse and the dangers it poses for our future. He takes us inside a faith tradition marked by an impoverished relationship to the Bible, a rejection of a genuine search for truth, and an upside-down world where empathy is considered a vice. Yet amid the wreckage, Jones finds signs of hope in efforts to remake our national holiday rituals and recover a Christianity that remains committed to democracy. Timely and unflinching, Backslide is essential reading for anyone unwilling to surrender the soul of faith or the promise of democracy. A prophetic summons to moral responsibility, it reminds us that time is short for deciding which Christianity, and which America, will prevail. Robert P. Jones is the award-winning author of the New York Times bestselling The Hidden Roots of White Supremacy and the Path to a Shared American Future; White Too Long; and The End of White Christian America. The president and founder of the Public Religion Research Institute (PRRI), Jones has written for TIME, The Atlantic, Religion News Service, and more. President Trump and the GOP are in a growing panic over ICE. Trump's advisers are sinking into recriminations. Republican officials are publicly admitting that his immigration agenda “seems to be not working” and that the GOP is “losing” the political battle over it. Others are suggesting that Alex Pretti's killing was “murder” and that it's time to “recalibrate.” Yet MAGA figures are pulling in the other direction. Media Matters has a good roundup: Many are urging Trump to escalate, with white supremacist Nick Fuentes labeling Pretti a “race traitor.” MAGA doesn't want to let the GOP even appear to moderate. We talked to Jennifer Rubin, editor-in-chief of The Contrarian, who has a new piece urging Democrats to seize this moment. We discuss how MAGA's white nationalism has landed “moderate” Republicans in a trap, why this provides an opening to divide the Trump coalition, and what Democrats can do to demonstrate that they side with the American people against Trump-MAGA's violent lawlessness.  Looking for More from the DSR Network? Popok reports on new direct messaging from Canada's Prime Minister Mark Carney who has told Trump to his face that Canadians won't take his bait; won't accept his trolling and insults of the Canadian military or sovereignty, and he should stop "posting memes" and get back to the bargaining table as Canada continues to win the trade war! September 1, 2026The US Supreme Court allowed Trump to continue to build his ballroom, Chief Justice Roberts wrote that the project is likely unlawful, but the project will likely be completed before that question is resolved, Trump's behavior is a logical outcome of the theory of the “unitary executive,” In 2024, the Supreme Court overturned the commitment to the idea that no one is above the law, Trump is convinced that he can do whatever he wishes, including rigging elections so that he cannot lose, The US Postal Service is putting in place a new system for handling federal election ballot mail, in a hasty, chaotic, and flawed process, A whistleblower says that the administration has hidden the likelihood that there will be major disruptions in getting ballots delivered to voters, Work on this system has continued despite an injunction from a federal court ordering it to stop, The USPS has never played a gatekeeping function and Sen Richard Blumenthal called on the Postmaster General to abandon the plan and ensure that all Americans can vote without interference by the USPS, He told reporters that it appears the system is designed to disenfranchise millions of Americans, And Trump seems largely unaware of what is going on in his administration.Watch today's recording here: https://www.youtube.com/live/g9TUa1Rwd6U?si=T8_KKcHQZElhpnZ-Get full, free access to Letters from an American here: https://heathercoxrichardson.substack.com/subscribeYou can also find me:Bluesky: https://bsky.app/profile/hcrichardson.bsky.socialInstagram: https://www.instagram.com/heathercoxrichardson/?hl=enFacebook: https://www.facebook.com/heathercoxrichardson/YouTube: https://www.youtube.com/@heathercoxrichardson Get full access to Letters from an American at heathercoxrichardson.substack.com/subscribe

Hakeem Jeffries has been put on notice by the Marxist Dems. Last night, eight Democrats disobeyed him and voted with the Republicans for the Save America Act and to disavow socialism. Hakeem is now at a crossroads with the Democrat Socialists of America, and it's very well possible that if the Democrats take the House, he will not be the Speaker of the House. New data out today proves the Covid vaccine hoax was far worse than originally expected. Wednesday, September 2nd, 2026 - Bond Markets Tank, SCOTUS Clears Ballroom Bunker, USPS Whistleblower Warns of Potential Voter Suppression

    Morning Announcements

Play Episode Listen Later Sep 2, 2026 6:13

Today's Headlines: The US launched strikes in the Strait of Hormuz for the second day in a row without saying what they were targeting, two more oil tankers got attacked, and JD Vance's Yale buddy Dan Driscoll quit as Army Secretary after Hegseth got paranoid about their friendship and blocked Driscoll's plans to modernize the Army for drone warfare — so the guy who wanted to prepare for the future of war got pushed out by the guy who built himself a salon at the Pentagon. On the financial beat, Global bond markets are selling off, US interest rates just hit a 20-year high, and what that means for you personally is that your credit card, mortgage, and car loan just got more expensive — thanks in part to the Iran war, oil prices, and everyone powerful being addicted to borrowing money. In other disturbing news, the Supreme Court ruled 5-4 that Trump can keep building his ballroom-bunker, with Roberts writing in his dissent that it's probably illegal but the lawsuit didn't have standing. A USPS whistleblower came forward saying the Post Office defied court orders while building Trump's mail ballot system, the voter list portal states need to use doesn't exist yet, and tens of thousands of ballots could get rejected as a result — Democrats responded with a strongly worded letter to the Post Office, yep, the Post Office. In things we can no longer safely ingest news, Horizon Organic chocolate milk was recalled across Walmart, Target, and Whole Foods for early spoilage, which is annoying but at least it's not glass. And finally, Republicans invented a "midterm convention" in Dallas where a photo with Trump costs $88,000 and a photo with JD Vance costs $35,000.  Resources/Articles mentioned: Axios: Why Army Secretary Dan Driscoll resigned NYT: Bond Sell-Off Threatens to Squeeze Borrowers Around the World WSJ: Trump Says Communities That Oppose Data Centers Risk Becoming ‘Backwards and Poor' Axios: Supreme Court allows Trump's ballroom construction to proceed Axios: USPS whistleblower warns new ballot system could fail USA Today: Nearly 54K cases of chocolate milk recalled.
