The Crash: Why a Defense Attorney Says the Mackenzie Shirilla Case Is a Failure at Every Level

Defense failure. Prosecutorial overreach. Systemic rigidity. And a defendant making post-conviction choices that may be sealing her own fate. Criminal defense attorney Bob Motta says the Mackenzie Shirilla case isn't just one thing that went wrong — it's a cascade of failures that compounded at every stage.Shirilla was seventeen when the crash in Strongsville, Ohio killed Dominic Russo and Davion Flanagan. She was convicted of four counts of murder in a bench trial. Her defense raised a medical condition but never proved it. The prosecution charged murder without a confession. A post-conviction petition with expert evidence was rejected over a one-day filing miss. And then she agreed to a Netflix documentary that reignited every negative characterization and prompted a fellow inmate to publicly contradict her on-camera persona.Motta, host of the Defense Diaries podcast, sat down for a full examination of the case. He starts with what the defense should have done — the experts that were needed, the evidence that was available, and the strategy that could have challenged the prosecution's narrative. He moves into the prosecution's overreach — whether murder was the right charge and whether the bench trial format gave the state an unfair advantage. And he addresses the post-conviction reality — the documentary fallout, the families' opposition, the social media footprint, and what Mackenzie should actually be doing inside prison to have any chance at parole in 2037.The legal system processed Mackenzie Shirilla. The question is whether it processed her correctly — and whether anything she does from here can change the trajectory.Join Our SubStack For AD-FREE ADVANCE EPISODES & EXTRAS!: https://hiddenkillers.substack.com/Want to comment and watch this podcast as a video? Why Hard Work Doesn't Get You To The Top – What To Do To Get Promoted

“Work hard and you will get promoted” is a big lie.  I am covering why hard work doesn't get you to the top and what to do to get promoted.  In my career, I was promoted 13 times in as many years, from trainee all the way to board director level of a large company. I share how to be promoted as a high performer. --- ---  Firstly, there are three huge reasons why hard workers don't get promoted. Being brilliant at your current job doesn't mean you will be brilliant at the next level. If you don't demonstrate your ability (or potential) at the next level, it is so much easier for your boss to keep you where you are. This is why high performers don't get promoted just because they are good at their current job.  Why top performers don't get promoted can also be about the strength of their relationship with their boss. You need your boss's support. If you don't have it, that is a classic reason why you are not promoted. This can also be why top performers don't get promoted.  Even more important: 5 actions / tactics you should put into practice today for how to get promoted at work. These are very effective (I was promoted 13 times) and should be used at EVERY LEVEL from trainee to board director.  Hard work doesn't equal success. It is NOT the hours that you put in that count. What you do with those hours DOES count a lot. The more value (/profit) you can create for business, aligned to business goals and needs, the quicker you will get promoted. It is that simple.  I know personally, how valuable moving teams and business closer to their goals are in the eyes of bosses thinking about who should be promoted next. Communication of the value that you create is a very close second to actually creating that value. If bosses don't know about it, they can't appreciate it. Proactively and regularly communicate to bosses to put yourself in contention for promotion.  IF you have any questions on “Why Hard Work Doesn't Get You To The Top – What To Do To Get Promoted”, please email me at support@enhance.training and I will get back to you  Jess Coles enhance.training

Imposter syndrome gets tossed around constantly in the design world — but what if it's not a syndrome… it's just a temporary feeling (and one we can learn to move through)?   In this episode, we unpack why "imposter syndrome" might be the wrong label, how it can turn into an excuse that keeps you stuck, and what to do when those thoughts show up mid-project, mid-pivot, or mid-big-decision.   We talk about the difference between filling real knowledge gaps (skills, systems, confidence builders) and rewiring your inner dialogue (self-talk, visualization, affirmations, community support). If you've ever questioned whether you "belong" because you don't have the "right" credentials, background, or path — this one is your reminder: you're allowed to build success in a way that fits your life. Throughout his academic journey, Mitch rarely felt comfortable in the classroom. It took him seven years to graduate from college—a reflection not of ability, but of disconnection. He often experienced education as something happening around him, not something he was actively part of. That sense of isolation fueled his desire to create a different kind of learning experience. When Mitch became a teacher, he brought with him a deep empathy for students who felt unseen or overwhelmed. He quickly realized that before we can effectively teach content, we must first build the foundation for learning. That foundation is structure, consistency, and support. To meet this need, Mitch created Organized Binder—a simple, research-backed system that empowers teachers to explicitly teach executive functioning skills without sacrificing instructional time. By establishing predictable learning routines, teachers foster safer, more inclusive classrooms where students gain confidence, independence, and a sense of belonging. Ryan Castle, co-founder of Level 10 Leaders, joined The Right-Hand Roadmap to tackle this common entrepreneurial business challenge head-on. After working with over 250 organizations, Castle has identified the gap that stops companies from scaling: while visionary founders and Integrators may excel at leadership, they often struggle to develop the next layer of managers. Most businesses take their best doers, slap a manager title on them, and hope for the best, creating bottlenecks and overwhelmed Seconds-in-Command who end up co-managing departments instead of leading strategically.  You'll hear all about: 02:07 - What Level Ten Leaders does and how they help entrepreneurial companies scale leadership across the organization 03:18 - The difference between leadership (doing the right things) and management (doing things right), and why entrepreneurial founders often excel at one but not both 06:18 - The biggest mistake companies make: promoting top performers without teaching them how to lead, creating a capability gap between executives and managers 10:19 - The Peter Principle problem and why being great at a job doesn't automatically mean someone will be a great manager 13:54 - Navigating the transition from peer to manager while maintaining relationships 16:06 - Why second-in-commands and managers have the toughest jobs in organizations 19:00 - The player-coach dilemma: balancing individual contributor work with management responsibilities 20:42 - Transformation story: how Level Ten's program changed a "blame guy" into a valued team member 22:26 - Advice for second-in-commands: stop being a bottleneck and delegate to create leverage 26:16 - How to connect with Level Ten Leaders and get a free copy of "The Active Manager" book   Rate, review & follow on Apple Podcasts Click Here to Listen! The data center industry is being redefined by AI's demand for faster, denser, and more scalable infrastructure. According to McKinsey, average rack power densities have more than doubled in just two years. It went from approximately 8 kW to 17 kW, and is expected to hit 30 kW by 2027. Global data center power demand is projected to triple by 2030, reaching 170–220 gigawatts. This rapid growth is forcing a redesign of traditional infrastructure, placing unprecedented strain on utilities, manufacturers, and the skilled labor pipeline. Can infrastructure and workforce capacity scale quickly enough to meet AI's surging data center demands without breaking the system? On Straight Outta Crumpton, host Greg Crumpton welcomes Matt Caldwell, Director of AI/Cloud Data Centers at Hyper Solutions, for a candid conversation about the pressures shaping the modern data center ecosystem. They discuss how AI workloads are upending long-established design norms, why modular manufacturing may offer a more resilient solution, and how labor shortages threaten to slow the entire market. Caldwell also shares how Hyper's unique digital-first model enables scalable, repeatable quality across a distributed manufacturing network.Key Highlights:Density Rewrites the Rulebook: Traditional data centers were designed around ~4 kW racks; today's AI applications require vastly more, prompting major shifts in cooling, power, and facility planning.Hyper's Scalable Manufacturing Model: Hyper Solutions produces PDUs, RPPs, and switchboards through a network of nine UL-listed satellite facilities, all driven by a unified digital process that ensures consistency and real-time visibility.Workforce Urgency: Caldwell underscores a critical labor gap, urging the industry to recruit earlier, targeting high school and even middle school students to meet the rising demand for trades and technical expertise in construction and operations.Matt Caldwell is a seasoned data center executive with over 20 years of experience supporting hyperscale and colocation clients across AI and cloud infrastructure. He has led global account strategy and mission-critical operations at industry leaders including Schneider Electric, Siemens, Trane, and Albireo Energy. Caldwell specializes in scalable design, modular power systems, and digital-first infrastructure delivery and now serves as the Director of AI/Cloud Data Centers at Hyper Solutions.

What if every hard-earned lesson in your business came with a simple mandate: how dare you do nothing with what's been given to you? In this episode, Bill Sherman talks with serial entrepreneur and systems strategist Apple Levy, author of "The Apple Effect". Apple has spent decades in construction, manufacturing, home flipping, and retail. She combines operational grit with financial discipline to help entrepreneurs stop firefighting and start scaling with intention. Her core belief is simple and provocative: if you know something that works, you have a duty to share it. Apple walks through how she turned years of wins and failures into a repeatable framework for growth. She explains why she began capturing notes, call recordings, and data from every client, and how that archive became The Apple Effect—a practical playbook for owners running businesses from $1M to $40M in revenue. The book distills what actually moves margin, cash flow, and culture, and she uses it as the backbone for her firm, Obsidian Thorne, when helping companies scale. You'll hear the real problems that keep owners up at night. Not just cash flow and margin, but rework that kills profit, weak follow-up on sales, and the emotional landmine of hiring family you can't hold accountable. Apple shows how to move from "leading by personality" to "leading by systems," so the process becomes the bad cop—not you. That shift frees leaders to exit someday, build a legacy, or simply step out of daily chaos. Apple and Bill also explore the mindset required to grow. Apple challenges entrepreneurs to ask, "How badly do I want this?" and to accept that scaling may mean dismantling what no longer serves the business—including long-standing people, habits, and assumptions. She shares how she applies her own advice inside Obsidian Thorne, using automation, hiring a business development lead early, and treating every pain point in her firm as data she can use to better serve clients. Finally, Apple looks ahead. She talks about taking her message to bigger stages—through construction trade shows like Build Expo, her growing calendar of workshops, and future events she plans to host herself. She's already filling the next scratch pad with insights for future books and building a team of people who share her attitude: hungry, accountable, and obsessed with helping entrepreneurs go from $1M to $10M and beyond. If you're an owner who's tired of firefighting, wrestling with family in the business, or worried about what you're leaving to the next generation, this conversation—and The Apple Effect—offers both a wake-up call and a roadmap. Three Key Takeaways: • Systemize your expertise. Turning real-world lessons into a documented framework is the foundation for scaling any business. • Measure what matters. KPIs and process discipline reduce rework, protect margin, and move the company out of constant firefighting. • Use your book as a strategic tool. A well-structured book can double as a thought leadership platform and an operating guide for clients and teams. If this episode has you thinking about systems, scale, and getting out of firefighting, the next step is to focus on your leaders. Pair this conversation with the episode "Scaling Leadership: Making Coaching Accessible at Every Level" with Kristin Lytle and you'll see the other side of the equation: how to build repeatable, scalable ways to grow people, not just processes. Both episodes explore how to move from one-off heroics to structured, repeatable solutions—whether that's tightening operations and KPIs, or creating blended coaching and learning programs that reach leaders at every level. Listen to them together and you'll walk away with a more complete roadmap: how to systemize the business and build a culture of high integrity, accountability, and leadership growth across the organization.

A study found that alcohol raises dementia risk at every level of drinking, overturning decades of claims that moderate use protects your brain Even light drinking damages neurons, disrupts mitochondrial energy production, and accelerates brain aging, showing there is no safe dose for cognitive health Genetic data revealed that for every measurable increase in alcohol consumption, dementia risk rose by about 15%, with the danger extending across all age and ancestry groups Alcohol and linoleic acid (LA) from seed oils follow the same toxic pathway in your liver, creating harmful aldehydes that cause mitochondrial damage and fatty liver disease, both of which impair brain function Reducing or eliminating alcohol and cutting seed oils to under 5 grams per day — ideally 2 grams — support liver recovery, restore mitochondrial function, and protect long-term brain health
