A criminal defence lawyer says the Polkinghorne trial is an example of the criminal justice system working.   A jury has found eye surgeon Philip Polkinghorne not guilty of the murder or manslaughter of his wife Pauline Hanna at their Remuera home in April 2021.   The verdict —given at the High Court in Auckland yesterday— followed 10 hours of deliberations over two days.  Criminal defence lawyer Elizabeth Hall told Mike Hosking what we've seen play out is justice working.  She says both the Crown and defence have worked very hard, the verdict is what it is, and New Zealanders need to see that it's justice working.   LISTEN ABOVE See omnystudio.com/listener for privacy information.

Büyük çalkalanmaların ve transformasyonların kasıp kavurduğu 16. yüzyıl ‘'Avrupa''sında yaşayan Luther'in, “Yahudilere ve Yalanlarına Karşı” (Against the Jews and their Lies) başlıklı bir kitabı olduğunu biliyor muydunuz? Luther, 7 maddeden oluşan Yahudileri imha planını bu kitabında açıklıyor ve Avrupa'da Yahudilerin nasıl bir hayat sürdüklerine dair ilginç bilgiler veriyor. Avrupa'da Yahudilere karşı ne denli büyük bir kin, nefret ve öfkenin kolgezdiği ve Yahudilerin nasıl bir hayat sürdükleri bu kitaptan ve Luther'in Yahudileri imha planından çok net bir şekilde anlaşılabiliyor. Luther'in Yahudileri imha planı, piyanist, psikanalist, uygarlıklar ve düşünce tarihi araştırmacısı Georg Frankl'ın “Civilisation: Utopia and Tragedy” (Uygarlık: Ütopya ve Trajedi) başlıklı kitabında ayrıntılı olarak yer alıyor. (Burada, Zihnin Arkeolojisi üst başlığı ile iki cilt olarak yayımlanan Frankl'ın bu nefis kitabını Pınar Yayınları bünyesinde kurduğumuz Açılım Kitap'ın “uygarlıklar ve düşünce tarihi” dizisinin ilk kitabı olarak yayımladığımızı haber vermiş olayım). George Frankl, iki ciltlik kitabında şimdiye kadar yapılmamış bir şeyi yapıyor: İlk ciltte, insanlık tarihinin başlangıcından Antik Yunan uygarlığına kadar gelmiş geçmiş kültürlerin ve uygarlıkların bilinçaltlarının tarihini yazıyor. Yasağa uymayanları ölüm cezasıyla cezalandırın. 5-Alman İmparatorluğu'nun sınırları içinde seyahat etmelerini yasaklayın. 6-Yahudiler'in faiz peşinde koşuşturmalarını yasaklayın. Ellerinden paralarını, altınlarını, gümüşlerini ve tüm mallarını, mülklerini alın. Çünkü Yahudilerin, elde ettikleri her şey hırsızlık ve faiz yoluyla elde edilmiştir. 7-Yahudiler'in çocuklarını ve gençlerini en zor işlerde çalıştırın. Böylelikle, alınteriyle ekmek kazanmanın nasıl bir şey olduğunu öğrenmiş olsunlar. Is your faith a house of cards? If you were wrong about one belief would the whole structure just collapse? If even one injury came to you, one instance of broken trust, would the whole castle fall? If one element was seemingly inconsistent or incompatible—would you burn down the house?This depiction of the psychology of faith is quite fragile. It falls over to even the lightest breath. But what would a flexible faith be? Resilient to even the heaviest gusts of life's hurricanes. It would adapt and grow as a living, responsive faith.This metaphor isn't too far off from the Enlightenment-founding vision of Rene Descartes—whose Meditations sought to build an edifice of Christian faith on a foundation free from doubt, ambiguity, uncertainty, or falsehoods. Even the slightest of doubts had to be categorically obliterated in order to prove the existence of God and the reality of the soul. He was clear about this in the preface. This was a work of apologetics. And he thought a good offense is your best defense. So he went on a whack-a-mole style doubt-killing spree that he hoped would secure a faith built on certainty.Now, here's a question for you: Does a quest for certainty strengthen and fortify the Christian faith? Or does it leave you stranded on the top floor of a house of cards?Today, we're continuing our series on Bringing Psychology to Theology, with a closer look at what to do about doubt, uncertainty, and ambiguity, in all sorts of stakes, but especially when it comes to faith.In this series we've been exploring the tools of psychological science that might contribute to a deeper, greater, more nuanced theological understanding of the world.We began the series by establishing certain normative questions about the integration of psychology and theology—experimental psychologist Justin Barrett offered to Miroslav Volf the suggestion that to build your cathedral of theology, you need the tools of psychological sciences.Then, developmental psychologist Pamela King offered a vision of thriving that expresses the dynamic, human telos or purpose throughout our lifespan. Research psychologist Julie Exline followed with a psychological exploration of spiritual struggle and one of the most embattled and suppressed of human emotions: anger at God.In this episode, I'm joined by Elizabeth Hall of Biola University's Rosemead School of Psychology. She's both a clinically trained therapist, helping people deal with life's difficulties, as well as a psychological researcher exploring human spirituality, personality and character traits, women's mental health, and human relationships. Most recently she co-authored Relational Spirituality: A Psychological-Theological Paradigm for Transformation, and I asked her to come on the show to talk about her recent work on tolerance for ambiguity in a life of faith.Here we discuss the domains of psychology and theology and what it means for each to “stay in their lane”; she introduces a distinction between implicit and explicit knowledge, and identifies the social- and self-imposed pressure to know everything with certainty; we reflect on the recent trends toward deconversion from faith in light of these pressures; and she offers psychologically grounded guidance for approaching doubt and ambiguity in a secure relational context, seeking to make the unspoken or implicit doubts explicit. I can't expect more from each discipline than what it is constructed to offer.”Ex: Psychology gets in trouble when making prescriptive statements (vs descriptive)People are seeking clinical based advice for how to live better“When someone sits down with a client to help them with whatever they're dealing with, they do have notions of human flourishing in the background that, whether they've thought through it or not, are going to come up in the course of how the therapy is steered.”Defining flourishing is not easy, so choosing criteria becomes difficult for psychologyWhat does it mean when doubt enters the mind? When we act on doubts?It is difficult to be a Christian with questions about your faith in this current moment.Social Pressure:We are continually being confronted with people who live and think differently than us, and who seem to be doing well in life, opposed to the homogenous communities we historically lived in.Intellectual pressure:We naturally want to seek truth that is certain.There is a strand of Christianity where we've reduced what faith is to an intellectual ascent to the affirmations of our faith.What is it to know something? What might psychologists be working with as definitions of knowledge that would offer alternatives to knowledge as certainty?A useful distinction from cognitive scientists has been the definition between the explicit and implicit knowingWe know important things about the world at an implicit level:Via nervous systems, without wordsEmotions and relationshipsWhat are the ways that gut knowledge comes to us, relationally or culturally?Our initial reaction to something in our environment is immediately a “push or pull” towards or against that thing. Then it becomes refined by past experiences (culture, past relationships, etc.) This then shapes what happens on the conscious level.Being aware of that psychological force between our unconscious and conscious thought becomes important when breaking down doubt in a religious context.Hall grew up in the Evangelical church, feeling certain that faith was set of propositions about Jesus and God that was very certain.Early church had more of an interpersonal dimension to faith, centering on trust and loyalty.Relying on propositions/blanket statement of Christian faith creates a “house of cards” vision of faith: If you pull one card out, all come down.This relates to an intellectual need for certainty, but there is also a social dimension to this stackGuilt by association: disgust, remorse, shame, around the association of a particular belief with Christianity, which can feed all the way back to one's experience of GodThis becomes particularly heightened when the larger culture is confronting/criticizing these beliefs or institutionsOur experienced relationship of God also has implicit foundationsStudies on deconversion show that people who turn from Christianity find that the reason is usually a perceived injury (with God, another person, the church) that sets off the processMany people say “science” is the reason, but it's not actually until the betrayal of trust comes in that most people start cognitively deconvertingMost of our shaping and life happens outside of our conscious awarenessPsychology does not understand well how the explicit knowledge systems can influence our implicit beliefsTwo kinds of doubt:Explicit: content, perceived competing claims with Christianity and (usually) scienceImplicit: betrayal of trust. God has let a person downDifferent people will encounter the same perceived discrepancy and will experience it in vastly different ways.It is difficult to be a thoughtful creature and not wonder at how things fit togetherSome people may meet a discrepancy and decide their whole life has been built on a lieThe factors that allow a person to entertain doubts with more confidence:Solid relational attachments (such as parental) early in childhoodHelps a person to be overwhelmed by a question because they know they have faced and managed similar situations beforeBeing okay with doubt: some people can live with it, intellectual resilienceIf it's very threatening, you have to do something because you can't live in a state of constant tension: deconverting is one possible solutionTension: literal physiological arousalHow to help people find their way through the doubt:Try to make what is implicit, explicit. At the sentencing of the Christchurch terrorist, survivor Wasseim Alsati delivered this powerful testimony. Wasseim and his daughter Aden, who was four at the time of the attack, suffered multiple gunshot wounds. The Christchurch gunman is now attempting to appeal his conviction and sentence. The gunman's appeal application comes two years after his conviction and sentencing - for crimes he pleaded guilty to. Usually, a defendant has to prove their guilty pleas weren't made voluntarily or they weren't of sound mind in order to appeal. A few years back, when I took a dramatic turn from helping clients with weight loss to embracing Intuitive Eating and Health at Every Size, I went head-first into anti-diet culture.   I mean head....first.... I was emphatic about how weight loss cannot and should not ever be the goal.  I informed potential clients that I was not going to focus on weight loss.  And I told my current clients that we were shifting gears because what we were doing was harmful. And yes, I still believe in all of that. But... What I wasn't realizing was that I was just as extreme on the anti-diet side as those who were on the diet side.   I was just as emphatic about not focusing on weight loss as they were about promoting It.  I was citing research that supported my view while criticizing them for doing the same.  I thought of them as being one-sided and myopic while I was doing the exact same thing. And you know what?  Being that extreme on the anti-diet side didn't work.  Yes, they made huge strides in their relationships with food.  They weren't bingeing, their emotional eating had significantly declined, and they were feeling much more at peace with food. But they were still uncomfortable in their bodies, both physically and emotionally.  For many of my clients, it was hard to move, hard to walk, hard to be intimate with their partners.  I heard a lot of clients say, "I just don't feel good."   That's totally valid.  And for me to say "well, the research between weight and health is correlational.  It doesn't definitively show that weight causes health issues" was just downright dismissive and insulting.   And of course, we all still live in a world that's unaccepting and marginalizing of large bodies.  Of course that has an impact on all of us and leads to a desire for weight loss.  Of course it does. Thankfully, I began to realize that I couldn't stay that entrenched on the extreme anti-diet side, just as I couldn't continue to work on weight loss.  Extremes don't work.  It was time to find some kind of grey area.   And this grey is what we're talking about on this week's podcast!  In my latest episode, I'm joined by Elizabeth Hall, an ICF Certified Mind-Body Eating and Intuitive Wellness Coach who helps people recover from years of chronic dieting and emotional eating by reconnecting to their inner wisdom. Her work allows people to explore and redefine health and well-being from a place of compassion and non-judgment so they can learn to trust their bodies again. Elizabeth came onto the podcast to chat with me about the extremes of diet and anti-diet culture and the need to find what works for you, and I'm so thankful to her.  She has a long history on both sides of the issue, and talks very eloquently about how she's been working toward a middle ground.  It was such a helpful discussion to me, and I hope it will be for you too. Elizabeth also emphasizes how amazing out bodies are, and how we really just need to get out of their way.  I love this quote from her: "Your body will take care of itself.  Your body knows what to do." Elizabeth Hall is originally from Western NY although her late husbands's job took her up and down the east coast for many moves before finally settling in North Texas into their “forever home”. She has two amazing daughters from her marriage to Bryan and is now a bonus mom to a third charming little lady who also lost her mom at a young age. Together with her “chapter two” Dave and an adventurous puppy named Archie, this newly-blended family has ample amounts of grit and determination to surf the waves of grief and trauma together. Elizabeth began dealing with grief years before her fit husband suddenly passed away from a heart attack in 2019…with the death of her mother in 2015. Her mom courageously battled multiple forms of cancer for many years while Elizabeth was in high school, college and beyond. Elizabeth was able to travel back and forth to help both of her parents through this difficult time. It took a few years for Elizabeth to begin to process the death of her mother and whence was finally ready… tragedy stuck again with the death of Bryan. Now a frequent podcast guest and involved in many grief- groups, Elizabeth has found the best way for coping with her grief is through activism and advocacy of learning how to heal. She hopes her story is able to help others dig their way out of the dark times and understand there will be better days ahead. A Wellington lawyer says the Three Strikes Law did not do what we were told it would do.The Government's scrapping the law created by Act in the National-lead coalition Government 11 years ago.It meant people convicted of a third serious violent, sex or drug offence should get the maximum sentence without parole.Criminal barrister Elizabeth Hall told Nick Mills the terrible law shouldn't have passed.She says it does not keep violent offenders off the street as promised"It leads to grossly unjust and awful results that judge, lawyers and even the police acknowledge was not the intention of the legislation"Hall says that is because the legislation removed the ability for the judge to impose an appropriate sentence."Our Supreme Court has said this legislation results in punishments that are well beyond excessive, that are absurd, perverse and breech our bill of rights"National Party justice spokesman Simon Bridges is against the repeal."It will put public safety at more risk and it will result in more victimisation of victims," he said.

Not realizing that dieting perpetually was not the way it was suppose to be and watching it escalate from restrictions to increased binging, Elizabeth began to try to heal her own relationship with food, and in so doing it led her to become an Intuative Eating Counselor.She used food to comfort and soothe herself with food as a child.  She also said she had a bigger body shape than the others in her body, and from there she went on a diet path which carried on into her 40s before she realized she had to do something about it.Why binge?  Elizabeth explains that restricting, not being connected to your emotions, being disconnected to your body and not being in touch with the reasons for discomfort could trigger the binges.  When discussing fear of foods, which is common with bulimics, their "restricted" foods, Elizabeth was asked if she had suggestions.  She says awareness first is important, that there is something underneath the fear, and getting curious about what is underneath that fear is one way to disconnect to the auto-response to it being about the food, and the food being the source of the problem.  She also states that it is important to have compassion.In that moment when the bulimic knows he/she wants to have an episode, and is reaching out, how can they resist pursuing the desire?  Elizabeth explains to have complete compassion in the moment and exclude the judgement.  It's important to stop and be okay with whatever is happening, because the body is doing something that it thinks is helping and protecting.  Reaching out, using the tools are important.  However it is important to understand it takes practice and it won't happen all at once.  We covered moments of boredom as well.  In those moments, it is beneficial is again to become curious and investigate and not to place judgement.  We also discussed that being "bored" is sometimes a way of your mind expressing the need to slow down and it's important to learn to "sit in your boredom".  "There is a notion that we should never be bored.  That is not true."Other topics were about perfection, trying to be something to everyone, and learning to focus on being "with self".   I love when she states "getting comfortable with our discomfort".You can reach Elizabeth at elizabethhallcoaching.com, on instagram @elizabethhallcoaching and on Facebook at www.facebook.com/livefreeordiet#bulimia #bulimiarecovery #bulimiaover40 #midlifebulimia #bulimiaover50 #eatingdisorder #eatingdisorders #bullimiaddict #iamthatgal #bulimiacoach #bingepurge #bingeingandpurging #throwup #deceit #hide #lie #food #overeating #bleepbulimia #podcast #itunes #apple #buzzsprout #amazonmusic #alexa #elizabethhall #intuitiveeating #comfortwithdiscomfort #elizabethhallcoaching Buzzsprout - Let's get your podcast launched! The Chief Justice was forced to suspend jury trials in March as the country braced itself for the nationwide lockdown. Jury trials restart at the end of the month but lawyers say they're now dealing with a huge log jam in the court calendar. New Zealand First has put the brakes on proposals to overhaul how rape trials are run following concerns about the impact on fair trial rights.The Sexual Violence Legislation Bill was supported by all parties at the first reading last year and was hoped to be passed into law earlier this year.But Justice Minister Andrew Little confirmed that the bill's progress has stalled until issues raised by New Zealand First can be resolved.Those issues stem from concerns raised by defence lawyers that the bill would compromise a defendant's right to a fair trial, which is enshrined in the Bill of Rights Act."The Defence Bar has started up a lobby campaign. I think it's being somewhat alarmist," Little told the Herald."But in any event those issues are being discussed between the governing parties at the moment."NZ First Cabinet Minister Tracey Martin said the caucus was "still gathering information" as her discussions with both Labour and the Greens continued.She completely rejected any speculation that NZ First had reversed its support for the bill because of Labour opposing her proposal to use internet service provider filters to ban porn websites for those under 18.The Sexual Violence Legislation Bill aims to make the court process less traumatic for complainants, but the NZ Bar Association, the Criminal Bar Association and the Auckland District Law Society have raised two main concerns.The first is the entitlement for complainants to be cross-examined via pre-recorded video, which would protect them from the potentially intimidating experience of giving evidence in front of a jury and the accused.The second is introducing a higher threshold before evidence can be used about the complainant's sexual disposition, reputation or experience, including any sexual history with the accused.NZ First MP and Cabinet Minister Tracey Martin says the party is gathering information about the potential impacts of the Sexual Violence Legislation Bill on fair trial rights. Photo / Mark MitchellThe National Party, in its minority view in the select committee report on the bill, said the former issue defeated the purpose of the bill; if new evidence emerged after the pre-recorded video and the complainant had to give evidence a second time, it could be a doubly traumatic experience.National also opposed the higher threshold for evidence about the sexual history between a complainant and a defendant.In submissions on the bill, defence lawyers argued that this sexual history was often central to the defence's case, but under the bill it would be assumed to be irrelevant.The defence could apply for a judge to review the intended evidence, but in trying to prove its importance, the defence would have to "show its hand" by telling the judge and the prosecution the nature and scope of its questions.The bill is in part based on recommendations from the Law Commission, which said the higher threshold was appropriate because it put the focus on the relevancy of the evidence rather than the relationships of those involved.Previously granted consent does not mean future consent should be assumed, the commission said.National's courts spokesman Chris Penk said the caucus is yet to make a decision on how the party would vote on the bill if its concerns were not addressed.In the meantime, lawyers vehemently opposed to the bill are lobbying politicians of all stripes.A letter signed by 20 Wellington women criminal defence lawyers has been sent to the Green Party, urging the bill to be changed to reflect National's proposed changes.Top of the list of signatures was Elizabeth Hall, vice president of the Criminal Bar Association, whose submission on the bill said that it "crushes defendants' rights to offer an effective defence".Little rejected this, saying the bill balanced fair trial rights with making the process less hostile for complainants, who often don't come forward at all because of a lack of trust in the system."I think the bill...

I am excited to introduce you to Dr. Joshua Eckroth, Assistant Professor of Computer Science and Heyley Gatewood, A Jr. majoring in Math and Computer Science at Stetson University in nearby Deland. Heyley, in addition to attending classes has an extremely active role in leading the Campus Hacker Club as well as presiding over this years 4th annual Greater Central Florida Tech Faire + Hatter Hacks which takes place April 5-7 2019 on the Deland Campus. The event targets high school and college students but is open to all. You need no experience to attend, in fact the event kicks off Friday with a full day of learning featuring workshops in web and app development among others. The Greater Central Florida Tech Faire + HatterHacks at Stetson University, hosted by Stetson HackerSpace, the university’s official computer science club, is planting a technology-building seed by providing high school and college students with an opportunity to collaborate in computer science challenges and workshops, tech talks, a code competition, gaming tournament and other activities during its fourth annual spring hackathon. No coding experience is required for the free, three-day event, April 5-7, on the Stetson University DeLand campus. Participants will need to register and bring their own laptops. Complimentary food, drinks and parking will be provided. The fun starts with a 12-hour Day of Learning on Friday, April 5, 7 p.m., at Elizabeth Hall, 421 N. Woodland Blvd., DeLand, 32723. The Day of Learning will be preparing hackers or builders for the hackathon by providing them with educational information during workshops and crash courses. Next is a 24-hour HatterHacks hackathon, beginning at 9 a.m. on Saturday, April 6, at the Edmunds Center, 143 E. Pennsylvania Ave., DeLand, 32720. The hackathon concludes at 2 p.m. on Sunday, April 7. Next they head down the road to follow up on an unlikely legend in the park before heading out to Oviedo to experience the Oviedo Lights, one the most infamous ghost stories in all of Florida. The East Village streets of Lynne Tillman's No Lease on Life are overrun with crooked cops, drug addicts, pimps and prostitutes. Garbage piles up along the sidewalks amid the blaring soundtrack of car stereos. Confrontations are supercharged by the summer heat wave. This merciless noise has left Elizabeth Hall an insomniac. Junkies roam her building and overturn trashcans, but the mean-spirited landlord refuses to help clean or repair the decrepit conditions. Live-in boyfriend Roy is good-natured but too avoidant to soothe the sores of city life. Though Elizabeth fights on for normalcy and sanity in this apathetic metropolis, violent fantasies threaten to push her over the edge.
