Police referred felony murder charges in the case of a Black man who died after being held down by security guards outside a Milwaukee hotel. Video shows four individuals restraining D'Vontaye Mitchell while he was on the concrete and shouting for help. Mitchell was unresponsive when police arrived and was later pronounced dead. My future was always a confusing arc. There was no way to predict where my next step was going to take me. [12:13] I took some nosedives along the way, got mixed up in drugs and alcohol for several years, and it destroyed a lot of my character and my will to live. It took me a long time, maybe 20 years to recover from just a couple of years of severe drug abuse. [13:23] God stepped in at a point where I was so desperate, 38 cents in my pocket, about ready to die and didn't care if I did. And he changed everything. That story is one that it would take another few episodes of our podcast to explain, but ultimately God healed me nearly overnight. [22:13] I don't remember where I read it somewhere about an old man, he fears no one. He lives his life day to day with his heart on his sleeve, and will say whatever is on his mind, because there's nothing to lose, because when you get to be old, you start realizing that every minute of every day is just, it's all borrowed time. About Christian Dorr: Boston-Born and Maine-raised, Christian Dorr worked his dad's commercial blueberry farm until joining the US Navy, which took him to exotic places as well as naval combat in Desert Storm aboard an aircraft carrier in 1991. After the Navy, Chris worked on a commercial scallop dragger off the coast of Maine. Chris claims to be the fastest scallop shucker on the East Coast, but substance abuse and a troubled marriage forced changes in Chris' life. He accepted Christian principles in 1995 and listens to God's direction to this day. As a field service engineer for Intel, Chris traveled to Japan, Korea, Ireland, Israel and many more. Today, Chris supports and shares Toby's vision to end wrongful and indiscriminate imprisonment imposed by an archaic law known as Felony Murder. Charged with felony murder after being involved in a police chase which would end in disaster as an innocent women is killed when Gerald collided with her vehicle. Gerald was accused of carrying a firearm at the time of the crash and this fact alone would see him charged with Felony Murder. We recently told the story of Zach Peterson, a man found guilty of 2nd degree murder even though the jury not only believed him not to be the shooter but also that he wasn't even near the crime when it occurred. He was found guilty using the 'Felony Murder Rule'. Today I sit down with OMR's voice of reason and defense attorney Michael Leonard to discuss the case and the Felony Murder Rule.On Tuesday January 18th 2011 just after 2pm police get a call about gun shots and a man lying in a pool of blood at the Sunset Trailer Park off Lenoir Street in South Columbia. The following day at 1:30pm police would say that Zach Peterson was their main suspect in the death of 31 year old James Leon Porter, killed during a suspected drug deal gone bad. Zach has never denied setting up the deal and driving James Porter to the location, however he says that was the extent of what he knows from that day as he would leave Mr. Porter at the trailer park and drive across town and would later find out things went bad and James had been shot. At trial Zach's defence would bring strong evidence to help prove he was not in fact the shooter in this crime. Break 1 : M.O.G. Story 1. 2 Peachtree Corner Gwinnett County police have identified 21-year-old Jay Dante Crump as the suspect in a murder that occurred at a hotel on Jimmy Carter Boulevard. Crump has been charged with Aggravated Assault, Felony Murder, and Possession of a Firearm During a Felony in connection with the death of 28-year-old Dareese Ellis, both of whom were staying at the hotel where the shooting took place. Ellis was shot and killed on Tuesday afternoon, and witnesses reported seeing a possible suspect fleeing the scene. Homicide detectives are investigating an altercation that may have occurred between the victim and the suspect prior to the shooting. Authorities are seeking information about Crump's whereabouts and encourage anyone with information to contact them...………….. read more at gwinnettdailypost.com STORY 2: Lake Lanier Gwinnett County police investigators have identified two suspects, Manuel Lorenzo Sanchez (41) and Ricardo Lorenzo Montes (24), in connection with the murders of a brother and sister, Maria Rosaria Montes Dorantes and Juan Angel Montes. Sanchez faces charges including felony murder, aggravated assault, and possession of a firearm or knife during certain crimes. Montes has been charged with tampering with evidence. The victims' bodies were discovered on the side of Interstate 85 near the I-985 split on August 27. Police have not yet released information about a potential motive for the killings, and the whereabouts of the suspects are currently unknown. Authorities are seeking information from the public to assist in their apprehension. Story 3: Death on side of I-85 Gwinnett County transportation officials are planning to expand microtransit services with the creation of a third microtransit zone in northwest Gwinnett, serving residents in Sugar Hill, Buford, and Suwanee. The budget request for this expansion was presented, aiming for capital funds in 2024 and operational funds in 2026. Microtransit, offered through the Ride Gwinnett app, provides on-demand rides within specific zones. Gwinnett has secured $2 million in grant funding for this project, contingent on a $500,000 local match, which is part of the 2024 budget request. We'll be right back Break 2: Slappey- Tom Wages - Obits Story 4: McGinnis Ferry The Georgia Department of Transportation (GDOT) has awarded a $24.8 million construction contract to CMES Inc. for the construction of a new interchange on Interstate 85 at McGinnis Ferry Road in Suwanee, Gwinnett County. This long-planned interchange is seen as crucial for addressing traffic congestion in the Lawrenceville-Suwanee road interchange area. The project includes the construction of a bridge and approaches over I-85/SR 403. GDOT expects the new interchange to reduce congestion on Lawrenceville-Suwanee Road, decrease northbound traffic backups on I-85's auxiliary lane, and improve safety by reducing accidents at Lawrenceville-Suwanee Road and I-85. The project is scheduled to open in the spring of 2026. Story 5: Gwinnet Veterans HOF Two military veterans from Gwinnett County, Georgia, will be among the 15 inductees into the Georgia Military Veterans Hall of Fame for 2023. Air Force Lt. Col. James Wesley Williams, a Vietnam veteran and former prisoner of war, and Army Sgt. Carvis Pittman Williams, a World War II veteran who will be honored posthumously, are set to be recognized. Lt. Col. Williams, currently residing in Norcross, served in the Vietnam War and was a prisoner of war in the Hanoi Hilton camp. Sgt. Carvis Williams, born in Snellville in 1919, served during World War II and earned the Silver Star for his gallantry. The induction ceremony will take place in Columbus on November 4, honoring a total of 177 Georgia veterans since the Hall of Fame's inception in 2013. Story 6: GCP Aaron Lupuloff, Director of the GCPS Foundation, and Mike Cammack, Director of Norcross Community School, collaborated with Hope thru Soap and community partners to host an event providing support and community engagement to local families. The event aimed to assist families in need, particularly those with students in Gwinnett County Public Schools (GCPS). With over half of GCPS students qualifying for free or reduced lunch, the event addressed pressing needs. Given its success, the GCPS Foundation and Office Depot Office Max plan to organize another event at Summerour Middle School on September 23, further emphasizing the importance of community support in improving students' lives. There are two programs available for application: the SOTA Conservatory Program (requiring an audition/portfolio) and the SOTA Fellows Program (with no admissions criteria). Students entering grades 10-12 for the next school year may apply, subject to availability, and transportation is provided for Central Gwinnett Cluster students, while students from other clusters must be eligible for permissive transfer and arrange their own transportation. The application deadline for the Conservatory Program is November 26, and auditions will be held on January 2 and 3, with acceptance notifications sent out in mid-January 2024. SOTA offers a specialized arts-focused education with a wide range of fine arts courses and opportunities for collaboration with professional arts organizations. Story 8: Yellow Daisy Festival he 55th annual Yellow Daisy Festival is taking place at Stone Mountain Park this weekend. Originally starting as a small crafts show in 1986, the festival has grown to become one of the top arts and crafts shows in the country, recognized by Sunshine Artist Magazine and the Southeast Tourism Society. The event began yesterday and will be open 9 a.m. to 6 p.m. on today, Saturday, and Sunday. Over 400 artists and crafters, including 100 new artists, will showcase their creations, featuring jewelry, pottery, woodworking, baked goods, and more. The festival will also offer crafter demonstrations, activities for children, live music, and a beer garden. Story 8: Buford Edges Wesleyan Buford, the reigning Class 7A state champion in fastpitch softball, faced off against Wesleyan, the 2022 state champion in 3A, in a thrilling 12-inning game. The game was tied 1-1 through the 12th inning, with both teams putting up an incredible defensive effort. Buford's pitchers, Addie Rackey and Caroline Stanton, combined for 21 strikeouts, while Wesleyan's Macey Cintron had an outstanding performance as well, striking out 10 batters.In the 12th inning, Buford managed to break the tie with four runs, securing a 5-1 victory. Mackenzie Pickens, Madison Pickens, Stanton, and Tavye Borders contributed with key hits, and Rackley added a sacrifice fly. Stanton closed out the game with a dominant performance in the bottom of the 12th, striking out the side.Buford improved to 11-0 on the season, while Wesleyan's 10-game winning streak came to an end. It was a classic matchup between two of Georgia's top softball programs. We continue to lift up the case of Jacob Harris who was murdered by the Phoenix Police Department four years ago at age 19, as he ran away from them. But Jacob and his family were not the only victims in this tragedy. Jacob's friends, Johnny Reed and Jeremiah Triplett were in the car with him, witnessed their friend being killed by the police, and then were arrested, charged, and convicted for the murder of their friend under a Felony Murder law, which gives prosecutors the ability to charge people completely uninvolved in a murder as long as they had committed a crime together. In this case, a small robbery led to the killing by police of Jacob Harris, and Jacob's friends were charged with Jacob's murder even without any allegations that they participated in violence of any kind. In 2015, a police officer shot and killed LaKeith Smith's friend, A'Donte Washington, during a burglary gone wrong. But years later, LaKeith is the one behind bars for murder. LaKeith was originally given a sentence of 65-years, after beingc onvicted of burglary, theft, and something called felony murder. In certain criminal cases, the felony murder rule allows a person to be charged with murder even if they're not the one who did the killing. Experts say it's a legal charge that disproportionately hurts young, Black and brown men. In a March resentencing hearing, a judge ruled that LaKeith's sentences could be served concurrently, thus reducing his overall time; but LaKeith's family and supporters were still left heartbroken, because even with this reduction, he's facing a 30-year sentence.Trymaine Lee spoke to LaKeith's mother, Tina Smith, about her family's continued fight for justice. This week on Everyday Injustice we talk with Joanne Scheer, whose son's incarceration on felony murder, special circumstances led her to create the Felony Murder Elimination Project. Under the felony murder law, if someone committee a felony and a person died during the commission of that crime, all individuals are held accountable for that death and are legally guilty of murder. Even if they were minor participants and the death occurred at the hand of another and was not foreseeable. Under reforms like SB 1437, that has changed and going forward, people who were not major participants and not the actual killer are only guilty of the underlying crime and those who previously were convicted, can petition the court for resentencing. But that doesn't impact Joanne Scheer's son. There have been attempts to change the law, such as Dave Cortese, who was previously a guest on Everyday Injustice, who have attempted to reach the high bar and pass SB 300 which would have allowed for people sentenced to LWOP who were not the actual killers to have a chance at parole. Peace Radicals Episode 68 - Khalil Rashdan Organizing Director for the ACLU of Arizona. Khalil Rushdan is the Organizing Director for the ACLU of Arizona. Khalil served 15 years before his conviction for Felony Murder was overturned for vindictive prosecution. Since his exoneration, Khalil has been an advocate and a mentor for formerly incarcerated Arizonans. While previously serving as the Community Partnerships Coordinator for the organization, Rushdan worked with community groups with a special emphasis on organizations that work directly with those directly impacted by the criminal justice system and communities traditionally not involved in criminal justice work. As Organizing Director, Rushdan oversees the organizing components of the ACLU of Arizona's criminal justice reform and education equity campaigns. pro-active multi-year advocacy campaigns to reduce the Arizona prison population and keep kids in school by limiting school suspensions and expulsions. In addition to leading both of those pro-active campaigns, Rushdan is responsible for developing organizing strategies around other priority issues such as immigrants' rights and LGBTQ equality.
The rule of felony murder is a legal doctrine in some common law jurisdictions that broadens the crime of murder: when an offender kills (regardless of intent to kill) in the commission of a dangerous or enumerated crime (called a felony in some jurisdictions), the offender, and also the offender's accomplices or co-conspirators, may be found guilty of murder. The concept of felony murder originates in the rule of transferred intent, which is older than the limit of legal memory. In its original form, the malicious intent inherent in the commission of any crime, however trivial, was considered to apply to any consequences of that crime regardless of intent. History. While there is debate about the original scope of the rule, modern interpretations typically require that the offense be an inherently dangerous one, or one committed in an obviously dangerous manner. For this reason, the felony murder rule is often justified by its supporters as a means of deterring dangerous felonies. According to some commentators, the common law rule dates to the twelfth century and took its modern form in the eighteenth century. The modern conception of the felony murder rule arose in 1716, with William Hawkins' Treatise of Pleas of the Crown, during his work on English criminal law. Hawkins reasoned that malice was implicit in a crime that "necessarily tends to raise Tumults and Quarrels, and consequently cannot but be attended with the danger of personal hurt." Thus, "this rule should extend to killings in the course of felonies à fortiori." Elements. In most jurisdictions, to qualify as an underlying offense for a felony murder charge, the underlying offense must present a foreseeable danger to life, and the link between the offense and the death must not be too remote. For example, if the recipient of a forged check has a fatal allergic reaction to the ink, most courts will not hold the forger guilty of murder, as the cause of death is too remote from the criminal act. There are two schools of thought concerning whose actions can cause the defendant to be guilty of felony murder. Jurisdictions that hold to the "agency theory" admit only deaths caused by the agents of the crime. Jurisdictions that use the "proximate cause theory" include any death, even if caused by a bystander or the police, provided that it meets one of several proximate cause tests to determine if the chain of events between the offense and the death was short enough to have legally caused the death. The merger doctrine excludes from the offenses that qualify as underlying offenses any felony that is presupposed by a murder charge. For example, nearly all murders involve some type of assault, but so do many cases of manslaughter. To count any death that occurred during the course of an assault as felony murder would obliterate a distinction that is carefully set by the legislature. However, merger may not apply when an assault against one person results in the death of a different person. Welcome to The Prison Post. Our guest on Episode #7 is Adnan Khan. Adnan is the Executive Director and Co-Founder of Re:Store Justice which he co-founded while incarcerated. Adnan was sentenced to 25 years to life under the Felony/Murder rule at the age of 18. While in prison, he inspired, launched and worked on the Felony/Murder rule legislation, aka, (Senate Bill 1437) with his organization, Re:Store Justice. The bill passed and after serving 16 years, in January 2019, Adnan was the first person re-sentenced under the bill he helped create. During his incarceration, he created FIRSTWATCH, a media filmmaking project produced entirely by incarcerated men at San Quentin State Prison that still produces short films today.
