Two Atlanta Women's Specialists' doctors failed to regulate Shannon's blood pressure, despite knowledge that pre-eclampsia patients pose a high risk of blood pressure-induced seizures, and failed to manage her fluid levels. As a result, Shannon suffered cardiopulmonary arrest, resulting in permanent brain damage and physical disabilities due to an extended period of time without oxygen. A Fulton County, Georgia jury delivered a $45.8 million verdict, including $9.8 million in economic loss and $18 million in compensatory damages for Shannon. bankruptcy. In the United States, bankruptcy is largely governed by federal law, commonly referred to as the "Bankruptcy Code" ("Code"). The United States Constitution (Article 1, Section 8, Clause 4) authorizes Congress to enact "uniform Laws on the subject of Bankruptcies throughout the United States". Congress has exercised this authority several times since 1801, including through adoption of the Bankruptcy Reform Act of 1978, as amended, codified in Title 11 of the United States Code and the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005. Some laws relevant to bankruptcy are found in other parts of the United States Code. For example, bankruptcy crimes are found in Title 18 of the United States Code (Crimes). Tax implications of bankruptcy are found in Title 26 of the United States Code (Internal Revenue Code), and the creation and jurisdiction of bankruptcy courts are found in Title 28 of the United States Code (Judiciary and Judicial procedure). Bankruptcy cases are filed in United States bankruptcy court (units of the United States District Courts), and federal law governs procedure in bankruptcy cases. However, state laws are often applied to determine how bankruptcy affects the property rights of debtors. For example, laws governing the validity of liens or rules protecting certain property from creditors (known as exemptions), may derive from state law or federal law. Because state law plays a major role in many bankruptcy cases, it is often unwise to generalize some bankruptcy issues across state lines. History. Originally, bankruptcy in the United States, as nearly all matters directly concerning individual citizens, was a subject of state law. However, there were several short-lived federal bankruptcy laws before the Act of 1898: the Bankruptcy Act of 1800, which was repealed in 1803; the Act of 1841, which was repealed in 1843; and the Act of 1867, which was amended in 1874 and repealed in 1878. The first more lasting federal bankruptcy law, sometimes called the "Nelson Act", initially entered into force in 1898. The current Bankruptcy Code was enacted in 1978 by § 101 of the Bankruptcy Reform Act of 1978, and generally became effective on October 1, 1979; it completely replaced the former bankruptcy law, the "Chandler Act" of 1938, which had given unprecedented power to the Securities and Exchange Commission for the regulation of bankruptcy filings. The current code has been amended numerous times since 1978. See also the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005. Chapters of the Bankruptcy Code. Entities seeking relief under the Bankruptcy Code may file a petition for relief under a number of different chapters of the Code, depending on circumstances. Title 11 contains nine chapters, six of which provide for the filing of a petition. The other three chapters provide rules governing bankruptcy cases in general. A case is typically referred to by the chapter under which the petition is filed. These chapters are described below. Chapter 7: Liquidation. Liquidation under a Chapter 7 filing is the most common form of bankruptcy. Liquidation involves the appointment of a trustee who collects the non-exempt property of the debtor, sells it and distributes the proceeds to the creditors. Because all states allow for debtors to keep essential property, Chapter 7 cases are often "no asset" cases, meaning that the bankrupt estate has no non-exempt assets to fund a distribution to creditors. Chapter 7 bankruptcy remains on a bankruptcy filer's credit report for 10 years. Watch GTP on YouTube: https://www.youtube.com/channel/UCKdeO4IodggpSLyhWVdcWKw Episode Details: The Stone Law Group's trial team -- comprised of father Bill Stone and sons James Stone and Ryals Stone -- explain how they thoroughly investigated a fatal car accident and proved that their client, a promising 19-year-old University of Mississippi student, was not the proximate cause of his own tragic death, as law enforcement investigators initially concluded. In the early morning hours of March 29, 2013, University of Mississippi freshman Price Thornal was attempting to travel from Oxford, Mississippi to his hometown in Tallahassee, Florida to celebrate his father's birthday. Price's Honda Civic was hit head-on by the defendant, who was driving a Dodge Durango on the wrong side of the divided US Hwy 84. Trial lawyers Bill, James and Ryals Stone used the GPS system in Price's car to plot his trajectory and utilized the defendant's cell phone records as evidence of her negligence and opposing trajectory. In spite of the defendant's attempts to cast blame on Price, the Stone Law Group used basic physics as well as expert accident reconstruction to show the jury which car was traveling in the appropriate direction. In November 2021, after just 20 minutes of deliberation, an Early County, Georgia jury found the defendant's negligence to be the proximate cause of Price's death and awarded $26,141,628 in damages. On July 3, 2012, William Waite, a U.S. Army veteran and retired president of an architectural products company with vision in only his left eye, tripped and fell face-first over a single step in the sidewalk at a shopping center owned by Argento Family Partnership. After the fall, William was immediately blinded in his one good eye and has been unable to see ever since, despite undergoing four surgeries, including a corneal transplant. Despite the fact that the primary defendant John Argento is an award-winning civil defense litigator, trial lawyer Craig Milsten secured justice on his client's behalf, citing experts and pointing out to the jury how much money John Argento was willing to spend on legal fees, but not the nominal fee it would have cost to paint the step a different color or to display a warning sign for customers. In this episode, we are featuring Sheriff Bob Gualtieri, Pinellas County Sheriff's Office. Bob Gualtieri began his law enforcement and public service career as a detention deputy working in the Pinellas County jail in 1982. After attending the police academy, he joined the Dunedin Police Department as a patrol officer and later rejoined the Pinellas County Sheriff’s Office as a law enforcement deputy. Over the next 15 years Sheriff Gualtieri served in many different components of the agency, including several years conducting domestic and international drug trafficking investigations as part of a DEA task force. Sheriff Gualtieri earned his bachelor’s degree from Eckerd College in St. Petersburg and his law degree from Stetson University College of Law. After graduating from Stetson and being admitted to the Florida Bar, Sheriff Gualtieri entered private practice in Tampa, specializing in labor and employment defense. Sheriff Gualtieri is admitted to practice law in all Florida courts, before the United States Supreme Court, as well as the United States Court of Appeals for the Eleventh Circuit and the United States District Courts in the Northern, Middle, and Southern Districts of Florida. Sheriff Gualtieri returned to the Pinellas County Sheriff’s Office in 2006 as its general counsel and was appointed chief deputy (second in command) in 2008. Sheriff Gualtieri served in the dual role of general counsel and chief deputy until the governor appointed him sheriff in 2011. Sheriff Gualtieri is active in many community organizations and serves on the Pinellas County Homeless Leadership Board, and the boards of directors for the Boys and Girls Clubs of the Suncoast and the Pinellas Sheriff’s Police Athletic League. Small's father's branch of the family descended directly from John Endicott, the first Governor of the Massachusetts Bay Colony. On his mother's side of the family, he descended from,related to Ralph Waldo Emerson. He is admitted to practice before Indiana's state courts, Indiana's two United States District Courts, four circuits of the United States Court of Appeals (D.C., Federal, Seventh, and Ninth), and the United States Supreme Court. Kirstin Elaine Martin spearheaded this Revote effort in around November 2016 at which time it gained much momentum. She began her career as a Coordinator for International Relations in the Prefecture Government of Yamanashi, Japan, working along side Japanese civil servants to foster mutual exchange and understanding between that country and the US. Amy is an author, publisher, holistic therapist, environmental & multi-cultural activist, lecturer, wife, mother, grandmother and gardener.
