Two Atlanta Women's Specialists' doctors failed to regulate Shannon's blood pressure, despite knowledge that pre-eclampsia patients pose a high risk of blood pressure-induced seizures, and failed to manage her fluid levels. As a result, Shannon suffered cardiopulmonary arrest, resulting in permanent brain damage and physical disabilities due to an extended period of time without oxygen. A Fulton County, Georgia jury delivered a $45.8 million verdict, including $9.8 million in economic loss and $18 million in compensatory damages for Shannon. Guest Bio: William 'Bill' Sims Stone Bill is a trial lawyer from Blakely, Georgia, who specializes in personal injury, wrongful death, professional malpractice, product liability, commercial and consumer fraud cases. June 20th, 2023, Court Leader's Advantage Podcast Episode Is there another concept in court administration that has been discussed, studied, and analyzed more often than Leadership?  For many the image of a leader that immediately comes to mind is the person who confidently says, “follow me, I know the way.”  It implies that the leader can always be relied upon to “have the answers.”   That image, however, doesn't always work.  Sometimes the outcome is being negotiated and cannot be revealed, sometimes the solution is dictated by someone else.  Examples that come to mind include how to manage flex time and remote work, how to absorb a 10% budget cut, or how to oversee diversity, equity, and inclusion in your court.  This month we're looking at leadership in the courts and how we handle day to day challenges. Today we are going to ask folks who deal with questions of leadership on a daily basis.   Today's Panelists    Stacey Fields, Court Administrator for the Municipal Court in Crestwood, Missouri. Different mindsets and thought processes working together bring value and best-in-class ideas to the table. Collaboration provides an excellent opportunity to get to know key stakeholders in other communities and become exposed to new ideas. For example, social justice and a PPA would never have been correlated before, but amazingly and effectively, they are now. Diversity focuses on connecting people in various communities so such ideas can develop and expand. Diversity in Clean Energy (DiCE) The creation of DiCE was prompted when T Mobile became one of Cheryl's strategic accounts. Amy Bond, Energy Procurement Program Manager - T Mobile, asked Cheryl how Duke Energy interacts with diverse suppliers. In response, Duke Energy held a two-day roundtable discussion about tracking diverse suppliers. They realized that corporations don't usually share contacts when they have them. The communication that did happen was limited to word of mouth. Duke's vision of DiCE is to open doors, utilize, and amplify the stories of diverse suppliers. One of DiCE's key objectives is to create a database or repository for diverse suppliers, which is being sponsored by Microsoft. They want to ensure that the energy industry has a good database without systemic barriers. While DiCE is growing, it's running on a two-year pilot in a smaller nexus with Kroger, T Mobile, Microsoft, and diverse suppliers. There is significant interest from organizations that want to join. Meanwhile, they can raise awareness and take action in their own space. Justice in the environment Environmental Justice PPAs are Volt Energy's response to ensure that rural communities aren't left behind in the transition to clean energy. Volt Energy prioritizes developing projects in economically disadvantaged rural areas, particularly where fossil fuel plants have been shut down, to help with economic revitalization. They also recognize the plight of many minority communities that haven't had access to participate in the clean energy boom. Volt Energy explains that these communities have risked their lives for the last 100 years to ensure everyone has power. They've dealt with environmental injustice in basic necessities like clean water and air. As power plants are shutting down in a transition to clean energy, it's fair to prioritize those communities. There are many great environmental justice organizations doing great work both at the national and local levels. Volt Energy invests in programs and projects conducted by these organizations to continue this good work. Volt also works with small businesses. One of the major barriers for small businesses, particularly diverse small businesses, is capital. Volt Energy is looking into providing microloans to businesses to help reduce some of the financial burdens. These loans offer an avenue for scaling diverse businesses. Watch GTP on YouTube: https://www.youtube.com/channel/UCKdeO4IodggpSLyhWVdcWKw   Episode Details: The Stone Law Group's trial team -- comprised of father Bill Stone and sons James Stone and Ryals Stone -- explain how they thoroughly investigated a fatal car accident and proved that their client, a promising 19-year-old University of Mississippi student, was not the proximate cause of his own tragic death, as law enforcement investigators initially concluded. In the early morning hours of March 29, 2013, University of Mississippi freshman Price Thornal was attempting to travel from Oxford, Mississippi to his hometown in Tallahassee, Florida to celebrate his father's birthday. Price's Honda Civic was hit head-on by the defendant, who was driving a Dodge Durango on the wrong side of the divided US Hwy 84. Trial lawyers Bill, James and Ryals Stone used the GPS system in Price's car to plot his trajectory and utilized the defendant's cell phone records as evidence of her negligence and opposing trajectory. In spite of the defendant's attempts to cast blame on Price, the Stone Law Group used basic physics as well as expert accident reconstruction to show the jury which car was traveling in the appropriate direction. In November 2021, after just 20 minutes of deliberation, an Early County, Georgia jury found the defendant's negligence to be the proximate cause of Price's death and awarded $26,141,628 in damages.  Click Here to Read/Download Trial Documents   Guest Bios: William Stone: Bill is a trial lawyer from Blakely, Georgia, who specializes in personal injury, wrongful death, professional malpractice, product liability, commercial and consumer fraud cases. The firm's predecessor was founded in 1915 by Bill's grandfather, the late Wm. Lowrey Stone. Past members of the firm include Bill's father, Lowrey S. Stone, who formerly served as Chief Judge of Superior Courts, Pataula Judicial Circuit. Bill was born in Dothan, Alabama, on August 19, 1953. He attended the public schools in Early County, Georgia and graduated from Early County High School in 1971. While many people know Kroger as the nation’s largest traditional food retailer, few know that they are effectively the fifth largest consumer packaged goods manufacturer in the nation and have more than 2800 retail food stores under a variety of banner names. In this episode, we learn that Kroger is committed to protecting people and the planet by advancing positive change in their company and communities and realizing that they could have multiple environmental and social impacts through their own operations, through the supply chain, and in other areas. Zero Hunger, Zero Waste is what Kroger named their social impact plan to end hunger in their communities and to eliminate waste in their company by 2025. This plan was launched in September of 2017 and was inspired by their purpose to feed the human spirit. They are always looking to the future and have recently announced their new, and very ambitious, 2030 ESG Goals. [43:57] Talk about the future and where things are headed Stakeholder/Investor Engagement Stakeholder engagement is a great way for Kroger to learn what their key internal and external stakeholders think about what they are doing and what they think Kroger should be doing moving forward. Kroger engages with its stakeholders through its materiality assessment early in the year. It is a great focused opportunity to get input from their various stakeholders, investors, NGOs, and any number of people outside of the company as well as inside the company. Kroger wants to hear what is most important to their leaders as well. Investors are a key audience. There is increased investor interest in how companies are managing climate risk and climate impact and how they are reducing energy usage and moving to more renewables and reducing greenhouse gas emissions. Kroger is generally always trying to increase and improve the amount of transparency that they use when they talk to their stakeholders as they know that they are trying to get more decision-useful information for their purposes of making investments in different companies. Kroger prides itself on being very in tune with what investors are looking for and being responsive to that. They also took part in a qualitative climate risk assessment late last year. Kroger assesses and manages risk as a company overall, but this assessment was a great foray into the more dedicated climate risk assessment process, which is something else investors are looking for companies to do.  Historically Driven by Expense Savings Twenty-some years ago, when Denis started with the company, they were more “Zero Energy, Zero Waste” before they were “Zero Hunger, Zero Waste.” Denis states that if they can fulfill their mission to their customers by using less energy, that is just a smart way to operate a business. They learned long ago that through energy efficiency they could achieve that very quickly and very uniformly. They have also found that one can achieve cost reduction in many other ways - through contract negotiations, better rates from utilities, items of that nature, and, as renewables continue to come on and there are more and different ways to engage in renewable energy acquisition those costs are coming down.  This is very consistent with Kroger’s desire to reduce expenses, to maintain reliable well-lit stores, keep food safe and tasty while ensuring the quality of their food, as well as to contribute to the environment. Denis comments that it is wonderful when all those goals that can sometimes seemingly conflict come together and, by doing what they have been doing with reducing the amount of energy and starting to bring on additional renewable purchases, that they are beginning to achieve a lot of the goals all at the same time.  Safety and Quality are Paramount Three of Kroger’s four drivers mentioned in this podcast come up in varying order. Cost reduction is number one nearly 80 percent of the time, followed by greening the environment, but the one most interesting point of the conversation is the notion of food safety because that is a unique and very important driver for the entire food industry. You could save a lot of money by turning everything off, but ice cream doesn’t work well in a zero-energy environment. Everyone’s been inside a grocery store and knows how much energy it uses, but milk has to maintain a certain temperature, the quality of ice cream depends on how cold you keep it - too cold is actually as bad as too warm. There are not only a lot of state, federal, and local food requirements to follow but a lot of other things Kroger wants to do to maintain freshness as well. Those are the rules by which Kroger must live that perhaps might not be needed in a clothing retail store or an auto parts place where humidity and temperature would not affect the product as much as it does fresh produce and fresh meat. Kroger must respect those guidelines and principles to sell their product to their customers in a very safe and comfortable environment. This month on Live Culture I am in conversation with Curator/Activist La Tanya S. Autry, and Artist/Activist Amanda D. King. La Tanya is Gund Curatorial Fellow at the Museum of Contemporary Art in Cleveland, where the exhibit she curated -Temporary Spaces of Joy and Freedom -is now on view. Amanda is an Artist, Activist, Founder and Creative Director of the groundbreaking art and advocacy initiative Shooting Without Bullets. We discuss a recent upheaval at moCA, where an exhibition of drawings by noted artist Shaun Leonardo, depicting police violence, was cancelled after concern over the content was voiced. This resulted in an outcry from the artist, subsequent apologies to him from the museum and the director stepping down. Both Amanda and La Tanya were involved in raising objections to showing the work in the museum, along with Miss Samaria Rice, the mother of Tamir Rice, who was the subject of one of the drawings. Much has been written about the artist being censored, but there is more to it. This is a complex story which the two help untangle as we discuss institutionalized racism, community, and the impact of images. At the center of it all is the heartbreaking issue: what rights do family members of victims of violence have over the images of their loved ones? How do we sensitively navigate the line between public and private? And more broadly, what can we do about institutionalized racism in museums and the art world? Amanda D. King is a Cleveland-based artist, activist, and educator. Her civically engaged practice utilizes arts education, cultural production, and cultural organizing to spread progressive ideas and messages of social justice. Amanda is the Founder and Creative Director of Shooting Without Bullets, a for-impact organization utilizing cultural production, artist education and development, activism and advocacy to model an alternative arts ecosystem that accelerates movement Black and Brown youth and their communities need to thrive. Amanda holds a Bachelor’s Degree in Art History from Bryn Mawr College and a Juris Doctor Degree from Case Western Reserve University where she received the Martin Luther King Jr., Diane Ethics, and Dean’s Community Service Awards. Autry centers collective care in her decolonial, abolitionist curatorial praxis. La Tanya has curated exhibitions and organized programs at moCA Cleveland, Yale University Art Gallery, Artspace New Haven, and other institutions. Through her graduate studies at the University of Delaware, where she is completing her Ph.D. In Art History, La Tanya has developed expertise in the art of the United States, photography, and museums. Her dissertation The Crossroads of Commemoration: Lynching Landscapes in America, which analyzes how individuals and communities memorialize lynching violence in the built environment, concentrates on the interplay of race, representation, memory, and public space. Judge Gray received his Juris Doctor Degree from the University of Southern California in 1971 and practiced law in both the public and private sectors until being named to the Santa Ana Municipal Court in 1983. Gray was then appointed as the presiding judge of the Superior Court of Orange County, California, by Governor George Deukmejian and served in that position from 1989 until 2009 when he retired from the bench. In 2004 Gray took a break from his duties as Judge and was the Libertarian candidate for the United States Senate in California.

This was an interview that took place March 14, 2019 after the Professional Development luncheon where we were honored to hear from Elder Larry Echo Hawk, Emeritus General Authority, current Special Counsel for Indian Affairs for the Governor and Attorney General of the State of Utah. Elder Echo Hawk will be speaking on “The Power to Change”. Larry Echo Hawk: Larry was born in Cody, Wyoming in 1948. He was raised in Farmington, New Mexico. He earned a football scholarship to Brigham Young University and graduated in 1970. He thereafter earned a Juris Doctor Degree from the University of Utah, and took graduate studies in business at Stanford University. Larry Echo Hawk served as the Assistant Secretary for Indian Affairs in the United States Department of the Interior. While serving three years in the Obama Administration he was on a leave of absence as a Professor of Law at Brigham Young University’s J. Reuben Clark Law School. Prior to joining the BYU law school faculty in 1995, Larry Echo Hawk served as the Attorney General for the State of Idaho. In 1991, he became Idaho’s 30th Attorney General and the first American Indian in U.S. history elected as a state attorney general. On March 31, 2012 Larry Echo Hawk was called to serve as a General Authority Seventy in the Church of Jesus Christ of Latter-day Saints. In 2018 Elder Echo Hawk was released from full-time church service and is now designated as an Emeritus General Authority Seventy. He presently serves as Special Counsel for Indian Affairs for the Governor and Attorney General of the State of Utah. Larry Echo Hawk is a member of the Pawnee Indian Tribe and served honorably in the U.S. Marine Corps. He and his wife, Terry, have six children, thirty grandchildren and two great-grandchildren.

We will focus on legal issues for those doing restoration after hurricanes and also get some tips for consumers dealing with restoration related issue. Pete Consigli is based in Naples/Bonita Springs area and has been driving through Florida and networking with Restoration Industry Association (RIA) members from all the areas affected by these storms, we also look forward to an update from him on how things are going on the ground after this tri-fecta of storms hit the mainland and Caribbean portions of the US.
