Non-competes: A tale of two lawsuits. Yesterday, in case no. 24-CV-01743, a US District Court for the Eastern District of Pennsylvania denied a motion for preliminary injunction thereby paving the way for the FTC's ban on noncompetes. In a nutshell, the court believes that the FTC's rule banning noncompetes is enforceable. So noncompetes are done, right? Not so fast. Remember that on July 3rd, 2024, in case no 24-CV-00986, a US District Court for the Northern District of Texas reached the exact opposite conclusion. Instead, that court issued the injunction that prevents the rule from going into effect. In a nutshell, the court believes that the FTC's rule banning noncompetes is unenforceable. Sidebar, does it surprise you the learn that the judge in the Texas case was appointed by Trump & the judge in the Pennsylvania case was appointed by Biden? So what happens when federal district courts disagree? We're about to find out. Now it's important to note that the appellate courts, in this case the 3rd Circuit & the 5th Circuit have not examined the FTC's final rule or these two cases. Nor have they examined how the removal of Chevron Deference will impact their thinking. What is clear, is that we are just getting started.I have no doubt that more litigation against the FTC's rule will happen across the country. These lawsuits will find their way to the appellate courts. Those courts will issue opinions that will bind only the states within their jurisdiction. We could actually see noncompetes legal in some states at the federal level & illegal in others. This would be a truly wild outcome.Unless SCOTUS opines, we can expect a very fragmented labor market as it relates to noncompetes. If SCOTUS eventually does take the case, it will be among the most important labor decisions in our lifetimes. I'm Roberto Diaz. I'm the coordinator editor for Democracy Watch News Latin America with a new report about the upcoming Mexican election on June 2nd of 2024 that will elect for the first time a female president of Mexico. This is something without precedent and can help to develop what is going to be the Mexican internal and external policy during the coming six years. So this is something great. This is something good. We have to understand that 2024 will be a definitive year for Mexico's political life. 2024 Mexican general election       The first candidate comes from the Morena party. It is the party that was launched by the current president Andres Manuel Obrador or AMLO, as he is famously known here in Mexico. She is Claudia Sheinbaum Pardo, who became the first female governor of Mexico City. She is a physicist with a specialization in green energy development and the founder of social justice efforts, especially crimes against women. She recently won Morena's internal poll to become their next candidate. If the USA wants to keep the New Green Deal, she is the best for the Democrats in Washington. Claudia Sheinbaum has developed a close relationship with the Energy Secretary of Mexico, Rocío Nález. to strengthen the position of green energies in Mexicano. She shows herself as a progressivist, a social democrat, and part of Mexico's  left wing. Claudia Sheinbaum started in  2000 as the Secretary of Environment of the Federal District during the government of Lopez Obrador and as the Mexico City mayor. From there, in 2015, she became the delegation chief of Tlalpan, a city of neighborhoods in Mexico City. It's similar to the mayoralty down in the US. Then, unfortunately, in 2017, a private school collapsed during the Mexico City earthquake, killing 26 people in total. 19 of them were children. As a member of the Tlalpan delegation,Sheinbaum was accused of being responsible for this incident. Although the school director was sent to prison, after it was revealed that the school didn't have permission to build more floors. Nonetheless, Claudia Sheinbaum won the election for the Mexico City Regency in 2018. During her administration, the Mexico City Cable Bus was built and launched for Mexico City citizens. Also in close work with the governor of Mexico state, Alfredo del Mazo-Mazza, they created a strategy to put COVID-19 detection centers in every delegation and neighborhood. Unfortunately, in 2021, the Mexico City light train Linea 12 collapsed. The political opposition blamed Claudia for that, although a thorough investigation showed that the problems of the line weren't because of lack of maintenance, as the media pointed out, but because of construction deficiencies. The line was built in 2012 by a series of construction companies owned by Mexico's rich man, Carlos Slim Tesis. Twenty-two people died in the event, and the millionaire decided to make reparations to the families and rebuild the old structure for free. The investigations are still in process. During the presidential visit to a welfare bank branch in Mexico City, AMLO was seen with Claudia. And to the eyes of all watchers, the president raises her hand into the sky. Political analysts like Denis Dresdner and Sergio Sarmiento still believe that was the definitive moment in which Claudia Sheinbaum was picked by AMLO to be his successor. In 2021, Claudia started to walk Mexico City streets in what was expected to be, what we call here in Mexico, an advanced campaign act. These are illegal, I have to say. In 2022 and 2023, she started to support Morena candidates for the governor election. And so she visited those states, building support from the Morena party members, at the same time she painted walls with the legend "Es Claudia" in several states, as well as plenty of banners.   The other candidate is Berta Xochiti Galvez Ruiz, or Xochiti Galvez as she likes to be known, labeling herself as an indigenous heritage, well, she has indigenous heritage candidate. She's an indigenous heritage candidate. Xochiti has become a recent social media phenomenon. Her simple speech tries to appeal to major sectors of the Mexican population, although with some elitist remarks, as she quotes, for example, infamously, that southern Mexicans don't like to work eight hours shift because it isn't part of their culture, as well as putting an end to some of the welfare programs, like the for young students. So, she'll appear as the reaction of the Mexican political opposition bloc, an alliance of three different parties. The National Action Party, or FAN in Spanish. This party is conservative and right-wing. And then we have the Institutional Revolution Party, or PRI in Spanish. The PRI used to be a center party or a nationality. Nationalist Party, but right now it's a neoliberal party, and the Revolutionary Institution Party, or PRD in Spanish. This is a center-left party. She came from a poor municipality in the State of Hidalgo. Her grandfather was an Ottoman speaker native. She tells the story of how she used to sell jellies to pay for her studies in computational systems engineering in the UNAM. This is one of the most renowned, let's say the most famous university in Mexico. She was an active member of the Mexican Communist Party and labeled herself as a trustee. Although, she had a 180 degree ideological shift when she was picked by Mexico's president in the year 2000. During her time working in the delegation for development in indigenous settlements, Xochiti used her connections to give some public contracts to her husband. This is illegal in Mexico. We are talking about 17 contracts. In 2015, she became the Miguel Hidalgo delegate in Mexico City. In her administration, the crime in the delegation increased by 30%. She ended the scholarship to young students and sports players. She used her position in the Miguel Hidalgo to once again give public contracts to her company during Enrique Peña Nieto's presidential administration. And then during the first years of the AMLO administration, she reprimanded the president for canceling her contract. He dismissed Opposition Leader Peter Dutton's demand for more detail on the voice as culture wars. It was revealed that mandatory testing of travelers from China was against health advice. Chinese residents after successful protests last year have overturned a police car in Henan that attempted to enforce a new year fireworks ban. The media pushing a new covid scariant XBB1.5 or the Kraken as alarmists have nicknamed it. Victoria Police is experiencing a recruitment drought coupled with early retirements. It would appear that many existing Victoria Police officers and prospective officers don't want to pepper spray grannies, stomp on people's heads and choke women as some officers did during lockdowns. Republican House leader Kevin McCarthy won the House Speakership on the 15th vote after winning over enough MAGA Republicans. He has promised a new Church Committee to further investigate political interference by the FBI and the intel agencies that have been exposed in the Twitter Files. The January 6 lies continued on the two-year anniversary with Trump supporter Ashli Babbitt's mother the only person killed that day was arrested in Washington DC trying to pay tribute to her daughter. Supporters of former Brazilian President Jair Bolsonaro have stormed the nation's Congress, Supreme Court, and Presidential Palace. Federal District authorities arrested 400 people. Brazil's new old President Lula da Silva has vowed to punish those arrested and those who have funded the protests against the close Presidential election result last year. Footage of the piss pants President of South Sudan 71-year-old Salva Kiir Mayardit from a December 13 road project press conference has now flooded the internet. 6 local journalists have been detained on suspicion of leaking the President's leak. He could use some adult nappies for men which former AFL player Dane Swan thought were male tampons. The public figure who embarrassed themselves the most this week was former Prince Harry with his ghostwritten autobiography Spare released tomorrow. Brazil's democratic journey has been one of great hopes and progress, yet also one of disappointments and distrust in democratic institutions. Brazil is a vast country of 214 million people, organized in a federation of 26 states and the Federal District of Brasilia. Using a bicameral system, the Chamber of Deputies represents the people, while the Senate represents the states. The president is elected in a two-round electoral system. With José Antonio Cheibub I discuss some of the principal democratic institutions of Brazil. He shares with us his insights based on 30 years of research. Yet, a peculiar coalition rule, that was the main cause of the fragmentation, has recently been removed, which already led to reshuffles in the party landscape.   5G Broadband Beyond Faster Speeds with Lauren McCarty (Ep. 194) Nokia's Lauren McCarty joined Joe Miller to discuss the potential for 5G beyond faster speeds on Ep. 194 of the WashingTECH Tech Policy Podcast.   News Roundup    FaceApp Terms of Service Prompt Angst Among Lawmakers   FaceApp, a viral app created by Russian firm Wireless Lab sparked privacy concerns and angst among law makers last week. Faceapp allows users to upload selfies and lets users see what they’d look like if they swapped genders or what they’re likely to look like 50 years from now.   The app’s terms of service, though, which few of us actually reads, leaves it within Faceapp’s sole discretion to terminate your access to its services, even if losing access causes you loss or harm. The terms also reserve FaceApp’s right to store your pictures, even after you remove them, to “including and without limitation” comply with certain U.S. and foreign regulations, which could be those of any government in the world, including the Russian government.  The terms acknowledge that Faceapp uses an artificial intelligence algorithm that enables its ability to alter your photos.   Senator Chuck Schumer called for the FBI and FTC to investigate, saying in a letter to the agencies that the app could pose “national security and privacy risks for millions of U.S. citizens”.   Senate passes bill to criminalize voting systems hacking   Partially in response to the domestic hacking of election systems, and partially in response to Russia’s hacking of the 2016 presidential election that was alleged in the Mueller report, the Senate has passed a bill which would criminalize the hacking of voter machines to gain access to voter data. The Defending the Integrity of Voting Systems Act passed by unanimous consent on Wednesday night. Senators Whitehouse,  Blumenthal, and Graham introduced the legislation earlier this year.       President’s plea to Trump supporters on the fence: download the app   The Washington Post reported last week that Trump’s re-election campaign is trying to shore up support via a new app that campaign officials say will be released in the coming weeks. The mobile will allow Trump supports to organize in their local communities and register to vote.   Feinstein targets social media bots spreading misinformation Social media bots are widely seen to have played a decisive role in spreading misinformation in advance of the 2016 U.S. presidential election. In fact Symantec released a report in June showing that Russia’s propaganda program in that election cycle was even more extensive than was originally thought. So Senator Dianne Feinstein has introduced legislation to prohibit campaigns from using these spam bots to “subvert future elections”.  It’s called the Bot Disclosure and Accountability Act.   Maxine Waters, Senate Banking Committee, Trump, Mnuchin all highly skeptical of Facebook’s Libra Powerful lawmakers including Maxine Waters and most of the Senate Banking Committee, as well as administration officials including the president and Treasury Secretary Steven Mnuchin, are all highly skeptical of Facebook’s new cryptocurrency, Libra. Senator Sherrod Brown on the Senate Banking Committee was especially vocal in his opposition to the currency during a hearing in which Facebook’s lead for the project, David Marcus, testified. Brown was incredulous that after Facebook which “moved fast and broke our political discourse … broke journalism,  helped incite a genocide and … undermin[ed] our democracy” now wants to have a global cryptocurrency available to its 2 billion+ users that would be a global, commercial version of the Federal Reserve. Republicans on the panel also expressed opposition including Banking Commission Chairman Mike Crapo, who suggested the creation of a separate regulatory agency to deal with cryptocurrency.   In the House, Maxine Waters announced that she will be calling Facebook CEO Mark Zuckerberg in to testify.   Amazon hires Trump ally to bolster lobbying on Pentagon contract Amazon has hired Trump ally Jeff Miller to lobby on behalf of the company to win approval to work on a $10 billion “war cloud” contract for the Pentagon. Earlier in the week, Trump had expressed opposition to the contract. Republicans are also urging the president not to thwart the contract.   Sanders, Omar urge investigation into working conditions at Amazon warehouse   Vermont Senator Bernie Sanders and Minnesota Representative Ilhan Omar were joined by 10 other members of Congress in a letter to the Department of Labor asking the agency to investigate working conditions at an Amazon warehouse in Minnesota where workers protested about working conditions.   Real Estate Agent Tanya Gersh scores $14m victory against Daily Stormer Founder Andrew Anglin A magistrate judge in the Federal District of Montana, Missoula Division recommended that Chief Judge Dana Christensen enter a default judgement of $14 million in damages against the founder of a neo-Nazi website. Daily Stormer founder Andrew Anglin had twice failed to appear for his deposition in the case brought by the Southern Poverty Law Center on behalf of Ms. Gersh back in 2017. The suit contends that Anglin initiated a “troll storm” against real estate agent Tanya Gersh after Gersh advised the mother of alt-right figure Richard Spencer to denounce her sons views in order to sell her property. A federal district judge issued a long-awaited decision late Friday night on federal unions' legal challenges to the president's executive orders on official time, collective bargaining and employee removals. The decision is a win for the unions: The judge declared nine key provisions of the three EOs invalid and told agencies to begin revoking them. Nikolai DiPippa, Clinton School Director of Public Programs, sat down with Jim Schultz. Jim Schultz is an American lawyer, political pundit, and was an Associate White House Counsel for U.S. President Donald J. Trump until November 2017. Schultz was part of the legal team at the 2016 Republican National Convention in Cleveland and the Trump Transition Team. Schultz previously worked as general counsel to Pennsylvania Gov. Tom Corbett and as a top aide to Rep. Patrick Meehan (R-Pa.), when he was a U.S. attorney. He earned his undergraduate degree from Temple University before attending law school at Widener University. In addition to having provided legal counsel to the President of the United States and his senior staff, Schultz has provided legal counsel to the Governor of Pennsylvania and his senior staff and cabinet, a number of federal and state elected officials and has handled high profile matters for private sector clients. In his role as Special Assistant to the President and Senior Associate Counsel to the President, Schultz provided counsel to the White House on matters involving government contracting, procurement, trade, and transportation and infrastructure. Schlutz had liaison responsibilities to the Department of Transportation and the General Services Administration. He played a significant role in the drafting and review of Executive Orders and was involved in the interview and selection process for United States Attorneys and Federal District and Circuit Court Judges. Schultz also served as counsel to the Presidential Transition and was as a member of the legal team during the 2016 Republican National Convention. Throughout the 2016 election cycle, Jim was a frequent contributor on NBC 10 Philadelphia and currently serves as a contributor to CNN.

Darrell reviews the Supreme Court's decision reinstating President Trump's travel ban on people from Muslim countries. Transcript TRAVEL BAN REINSTATED—WELL SORT OF Hello this is Darrell Castle with today's pod cast. Today is Friday June 30, 2017 and on today's pod cast we will be talking about this week's Supreme Court's per Curiam, which means unsigned, decision in what is commonly known as the travel ban case. The Court unanimously stayed or scaled back most of the relief granted by the lower courts in this case. The case involves an executive order from President Trump to ban new travel visas for travel to the United States for people from six countries—Libya, Iran, Somalia, Sudan, Syria, and Yemen. The Court halted the stay imposed on the President's order temporally and agreed to hear the full case in the October 2017 session of the Court. The Justices stated that the President has a high interest in enforcing issues of national security. “The Government's interest in enforcing, and the Executive's authority to do so, are undoubtedly at their peak when there is no tie between the foreign national and the United States.” The lower courts seemed to find some kind of U.S. Constitutional right that supposedly exists in foreign nationals but the Supreme Court basically said that such a right can be stayed by executive order when the foreign national has no legitimate tie to the United States. The first circuit to hear this case was the 9th Circuit from an appeal of a Federal District judge in Hawaii. That Judge, who was appointed to the position by former President Obama issued an order in effect countermanding the President's executive order and the 9th Circuit upheld the Judge's decision. The 9th is the most overturned circuit in the country. It is based in San Francisco but also sits in other western cities. This case was an easy one for the Supreme Court as the 9th circuit denied the President's right and duty to protect the interests of the United States and its people and it tried to find or establish rights in foreign nationals where none existed. Let's look for a minute at what this decision really means and what its limitations are. President Trump called the ruling “a clear victory for our national security”. “As President I cannot allow people into the country who want to do us harm.” The decision was a unanimous 9-0 but there are various opinions as to its effect. The American Civil Liberties Union suggested that the decision would allow for “only the narrowest implementation of the travel ban that would “tear families apart”. Justices Thomas, Alito, and Gorsuch would have let the ban take effect without restriction just as the President signed it. Justice Thomas said the government made a strong showing of a likelihood of success when the full case is heard in October. The court permitted the administration to impose a 90 day ban on travelers from Libya, Iran, Somalia, Sudan, Syria, and Yemen and a 120 day ban on all refugees entering the United States with the following exception:  the ban may not be enforced against foreign nationals who have a credible claim of a bona fide relationship with a person or entity in the United States. The exception is very important. The purpose of the ban is to keep out people who hate the United States and its people and who want to do them harm. It might not be all that difficult for those desiring to enter the United States to assert a “credible claim of a bona fide relationship with a person or entity in the United States.”  Plenty of wannabe terrorists probably have business interests or family members already here. Justices Thomas, Gorsuch, and Alito dissented from the portion of the order imposing the restriction. They said the restriction would burden officials with deciding “on peril of contempt” whither those desiring to enter had a credible claim.  So that is the threat then. Officials would be held in contempt for violating the restriction, I suppose,

Started out as settlements from many countries like Roanoke and Jamestown that eventually developed into the 13 colonies, who were loosely bound together, though they had many differences. The colonies fought a war for independence against Great Britain and won, eventually becoming the United States of America. Gradually, new territories were admitted to the “Union” and the United States grew. For a short while, the United States was split into two countries: the United States of America and the Confederate States of America during the period of the Civil War. At the end of the war, the two countries rejoined. Many believed in the “manifest destiny” of the United States, which meant that the country should expand from one coast to the other. This is the case today, with the country being split into 50 states, with two states, Alaska and Hawaii, being not attached to the other 50. The United States also has control over a variety of territories around the world, including Puerto Rico, the Virgin Island, Guam and American Samoa. There are also U.S. military installations throughout the world, with many in Europe and Asia. The largest river in the United States is the Mississippi, which branches out into many tributaries. There are two main mountain ranges: the Rocky Mountains and the Appalachian Mountains. • Canada Canada is the second largest country in the world land wise after Russia, though most of its population lives close to its border with the United States. About 75 percent of Canadians (out of around 33 million citizens) live within 100 miles of the U.S. borders. It has more coastline than any other country, because it is bordered by the Atlantic, Pacific, and Arctic Oceans. Many parts of Canada were settled by French explorers and the influence of French language and culture continues to this day. Other parts of Canada were controlled by Great Britain. Today, both English and French are official languages in Canada. Instead of states, Canada is divided into provinces and territories. There are ten provinces, such as Ontario, Quebec, Alberta, and British Columbia, and three territories: The Northwest Territories, Nunavut, and Yukon. Canada includes many different islands as part of its territory including Prince Edward Island. • Mexico Mexico was the site of many powerful civilizations including the Olmec and the Maya. Spain conquered the region in the 16th century and turned it into a colony, but it achieved its own independence in the 19th century. Today, it is a country that is bordered by the United States in the north and the countries of Central America in the south. It is bordered by the Pacific Ocean in the west and the Gulf of Mexico in the east. It includes a long peninsula that is south of the U.S. state of California called “Baja California”. In terms of land area, it is just about three times the size of the state of Texas, though its population is around 120 million. Mexico has 31 different states that are all self governed, and there is a special Federal District that belongs to the entire federation at a whole instead of to a specific state. • Central America Central America is considered part of North America, and is a narrow bridge of land that connects North America with South America. On the north, it is bordered by Mexico, on the south by the South American country of Columbia. On the east, is the Caribbean Sea, and on the west is the Pacific Ocean. Central America includes the countries of Belize, Guatemala, Honduras, Nicaragua, Costa Rica, and Panama. Also in the region are the islands of Cuba, Haiti, the Dominican Republic,
