Caroline felt as though her pleas were falling on deaf ears, but then Don from Yorkey's Knob suggested she call the John MacKenzie Show to get some answers. Long story short, Telstra was listening and issued this statement: "Good afternoon. We heard your caller to Macca from Wonga Beach, who was concerned about communication after Jasper crosses tomorrow. Just wanting to confirm we recently upgraded our battery backup at Wonga Beach, which should keep services online for a lot longer if/when the power goes down. It's also on our priority list if services do go down. We also have a fleet of generators and our technicians ready to roll as soon as it is safe to do so to restore power or begin repairs to any affected sites." The power of radio lives on!

P said the $10m was owed by D1, trustee of a family trust, as a loan to be repaid: [2], [17] P also sought leave to proceed against D2 and D3 for breaching their duties to Co: [3] P said the loans were made where D1 had doubtful capacity to repay, and where interest was not charged: [4], [5] At a 2021 meeting, the Co's dirs (including an independent dir) considered the loan from D1 and resolved not to seek repayment at that time: [10], [21] P gave an undertaking to pay Co's costs if leave was granted, despite not having much money: [11] A dispute regarding D3's removal as trustee of a family trust lead to a far reaching settlement deed being entered into in 2019. That established Co's corporate governance structure, including the independent director: [18] There are a number of related pieces of litigation on foot between the parties: [24] It was accepted by all that Co was not going to bring proceedings seeking repayment, or alleging breaches of duty: [27] Whether P was acting in good faith in pressing a claim against D1 was considered in the context of P being a shareholder in Co, there being inconsistencies in P's claim, and P's offering of an indemnity of dubious value: [33], [34] Whether P was acting in food faith in pressing the claims against D2 and D3 was assumed to be so but, later, found to be irrelevant as the claims raised no serious question to be tried: [39] The Court was not satisfied that the claim was in the Co's best interests. No financial evidence comparing alternatives was tendered, and the Court was reluctant to disturb the commercial judgement of the Co's directors: [46], [47] The Court noted the established corporate governance principle that directors could legitimately make decisions against the wishes of a majority of shareholders: [50] It was found to be contrary to the Co's best interests to “sidestep” or “outflank” the decision of Co's board not to pursue the debt now, especially as no challenge was raised to the decision making process used: [53], [54] Was it in the best interests of the Co *for P* to bring the claim? No, due to the existing family tensions and possible inability of P to separate P's interests from his own, and the fact P did not propose instructing independent lawyers if leave was granted: [56] As the claim was not brought in good faith or in the Co's best interests, P was not granted leave to pursue Co's claim against D1: [63] Nor were the claims against D2 and D3 seriously arguable. P's claim was poorly pleaded and contradictory in part - whether the loan would or would not be repaid, whether it was currently statute-barred or not: [64], [65], [71], [72] P's application was dismissed: [83]

After dropping out of school with no qualifications aged 16, Daniel Hegarty got signed to the same label as Boy George and went touring with his punk band for just £100 a week. He then spent the next ten years carving out a career as a working musician in LA, writing for and performing with the likes of S Club 7, Robbie Williams and the Sugababes, before returning to the UK to be one of the first employees at Wonga, where he became fully immersed in the world of tech startups. Dan became frustrated with the whole property buying process after almost losing the house he was trying to buy due to mistakes made by his solicitors. He realised there was huge potential for change in the mortgage and property market, and in 2016, Habito was born. Habito is a tech startup that is dedicated to ending ‘mortgage hell' and aims to streamline the whole process, cutting down the average transaction time from 21 days to just 10. Since its founding six years ago, Habito has seen rapid growth, from sorting just 245 mortgages in 2016 to a whopping £4 billion worth of mortgages in 2020. With £80 million of funding raised so far, Habito had recently expanded into lending their own mortgages, streamlining the process even further. The State government’s Protection Plan for Binjareb Djilba, Peel-Harvey Estuary, was published four months ago as a beautiful collaborative production between Noongar and western ways. It also chronicles the ecological collapse of this precious Estuarine System. Understorey went along to the recent WA Wetlands Conference in Mandurah to learn more about this special place from Bindjareb elder and educator George Walley. George welcomed us all to country, guided us in the storytelling about the importance of wetlands, of culture, and of holding strong to our shared living heritage, and hosted delegates on an estuarine tour of part of his homeland, the Djilba. George kindly gave permission for us to use his song "Raining on Djilba" - and we were especially pleased that RTRFM and WAM were able to track down a copy of the lost 2003 version which won George Walley a WAMI Award, and return it to him. PLANT OF THE WEEK Sweet Morinda You most probably know Australian climbing plants and would immediately think of Bower or Wonga wonga vine, either Pandorea jasminoides or Pandorea pandorana,  Very tropical looking climbers that suit all sorts of conditions around Australia. But there’s some many more Australian native climbers that would suit our backyards and here’s one of them. Common Name: Sweet Morinda Scientific name: Gynochthodes jasminoides syn. Morinda jasminoides Family: Rubiaceae Habit: scrambling climber to 6m. Adrian uses it to screen some ugly buildings. What's in a name? Morinda    Latin morus = mulberry and indicus = indian (referring to it being like an Indian Mulberry) jasminoides   From the plant being Jasmine-likeThis pant is a native creeper found in eucalypt and rainforests along the east coast, across to Western Australia. I'm talking with Adrian O’Malley, qualified horticulturist and native plant expert. .Let’s find out… Let’s just call it sweet Morinda or Morinda jasminoides. Not overly floriferous but the flowers resemble those of jasmine with dense thick foliage that works well as a screen ugly buildings or scenery.   Flowers: Small clusters of 3-20 heads, but in Adrian's garden, it's not a prolific flowerer. There is some jasmine like scent but it's not overpowering. Mid spring to mid summer flowering.   Fruits: The main attraction some say because they're lumpy bright orange, 2cm in diameter.     Leaves: have an interesting bump in the centre called a "domatia."   the bumps are a symbiotic relationship with an insect that lives in the pits.The mite-habitat pits are so large that they make conspicuous bumps on the upperside of the leaves, making the plant easy to identify when it's not flowering or fruiting.
