She is Jana Utter, the Vice President of Enterprise Risk Management at Centene Corporation. In 2022, RIMS named her to the Risk Management Honor Roll. She is the former chair of the RIMS Strategic and Enterprise Risk Management Council. Jana is knowledgeable about ERM and ESG. [2:50] Since there were new SEC Climate Disclosure Rules announced, I wanted Jana to come back on the show and fill us in on what we need to know. This dialogue will dovetail with her upcoming RISKWORLD session on May 6th at 2:45 p.m. in Room AB25, Sustainability Reporting, Making ERM Transparent. It is part of the ESG track. She'll be co-presenting with Bob Hirth. [3:25] Jana Utter, welcome back to RIMScast! Jana was the 2022 RIMS Risk Management Honor Roll Inductee. Jana and Justin go back quite a few years. This is her third time as a RIMScast guest. Jana was the chair of the RIMS Strategic and Enterprise Risk Management Council. She misses it a bit but has moved on to other RIMS volunteer activities. [4:10] Jana is here to discuss the SEC Climate Disclosures in the news. The U.S. SEC proposed final rules for Sustainability Reporting Standards. Also, the EU Corporate Standard Reporting Directive (CSRD) is making headlines. [5:02] Jana thinks it is important as risk professionals to think of sustainability in the same way that we think about enterprise risk management. They are both important. Jana speaks of the 2017 COSO ERM Update, Integrating Strategy with Performance. [5:29] That COSO document says that ERM helps enhance performance by more closely linking strategy and business objectives to risk. ERM affects value strategy and is linked to the business. The COSO framework also discusses how ERM leads to better decision-making. [5:48] The International Sustainability Standards Board (ISSB) says sustainability factors are becoming part of mainstream investment decision-making. Companies are called upon to provide high-quality global comparable information on sustainability reported risks and opportunities. [6:28] As ERM professionals, we are trying to identify risks to help protect the value and future ongoing business concerns of the company. Sustainability reporting is trying to do the same thing, protect the long-term value of the company. To Jana, that seems to be a natural fit. [7:00] Justin and Jana agree that the data should support the story-telling of the organization or the risk professional. Sustainability reporting is a big part of that data, just as financial statements are. [7:17] Sustainability reporting disclosures publish additional information by a company to inform stakeholders, including investors, business partners, employees, and customers. Jana thinks about it the same way as about financial statement information, which caters to the same stakeholder audience. [8:14] Jana notes it's important to know which of the different reporting directives for sustainability reporting standards apply to your company in the jurisdictions or geographies in which your company operates. Global sustainability disclosures are not 100% consistent. In the U.S., some states have additional expectations for ESG reporting above the SEC rules. [10:10] ESG is showing up in commercials. Jana finds that interesting as her friends and family still don't know what the acronym ESG means. It's appearing in the mainstream, with DEI. [11:31] Jana says that a lot of people who are responsible for enterprise risk management, including her industry peers, are not also responsible for sustainability reporting and disclosures. How can risk professionals get connected to the sustainability reporting team? [12:23] Jana recommends risk professionals use the RACI matrix: Who's Responsible? Who's Accountable? Who's Consulted? And Who's Informed? If you're not in this matrix, ask to join it as a consultant. She lists ways to contribute by connecting to different areas of the company. [13:56] It's important to know where your company operates. U.S. companies with no operations outside the U.S. may be able to follow the IFRS SASB Sustainable Accounting Standards and the SEC Climate Disclosure rules and other SEC-related rules that cover sustainability, as well as any state rules. [14:59] If you're U.S.-based with any operations in Europe, you're going to want to monitor CSRD and make sure you understand and follow that protocol. That should cover you for the majority of any sustainability risks in the U.S. [15:42] Jana's go-tos are the International Financial Reporting Standards (IFRS), International Sustainability Standards Board (ISSB), and Sustainability Accounting Standards Board (SASB). ISSB includes the Taskforce on Climate-Related Financial Disclosure (TCFD). TCFD and CDP (formerly Carbon Disclosure Project) are closely aligned. [16:46] Jana repeats, pay attention to the IFRS and what they do. IFRS is geared to the investor community. Also watch the Global Reporting Initiative (GRI), which is focused on social and environmental impact reporting. [17:46] SASB is the Sustainability Accounting Standards Board. [23:35] Risk professionals are supposed to have a line of communication to the C-suite and the enterprise to take these announcements seriously. Jana says a risk professional has to treat sustainability reporting and disclosures like any other risk. An emerging risk can sometimes bubble up to become a noticed risk. [24:42] Jana tells of her experience in reporting what ERM saw as up-and-coming emerging risks, capturing ESG and sustainability-related risks, and reporting disclosure expectations bubbling up in emerging risks. It eventually gets the attention when the time is right. [25:40] Keep any emerging risk in the reporting to the extent possible. When the time is right, it will become important, not only to the ERM professional but to others where you've been trying to raise the flag. Risk professionals, make a note! [26:19] Jana says Scope 3 Emissions are pretty complex. It is comprised of 15 categories. Scope 1 is a company's use of natural gas. Scope 2 is its use of electricity. They're more straightforward. [27:16] The focus of Scope 3 is supply chain emissions. Most enterprise risk management professionals may not know or have had any reason to focus on how many suppliers their company has. It can be thousands or tens of thousands. It's challenging. [27:54] The Greenhouse Gas Protocol and other authoritative sources have ways to categorize types of vendors and use categorizations as a way to calculate emissions. It's still very complex and much more subjective. [28:30] To get the quality of reporting you need for financial statements, with external auditor reviews and having the same level of controls and tightness on the calculations, Scope 3 becomes quite complex. [28:56] Justin reads from the U.S. EPA guidance on Scope 3: “The result of activities from assets not owned or controlled by the reporting organization but that the organization indirectly affects in its value chain.” Scope 3 emissions include up-chain and down-chain. A risk professional has a lot of work to do dealing with Scope 3 emissions. [29:37] Jana mentions that a challenge around Scope 3 is double counting. A manufacturer uses a third party to deliver goods to a retailer. Both the manufacturer and the retailer count the third party for emissions. Communication has to occur between the manufacturer and its retailers. So Scope 3 emissions reporting is not required now. [31:04] Jana talks about possible consequences of the failure of an enterprise to comply with the rule. It will probably be similar to any other failure to report accurately. You'll get a letter with a deadline to comply. There could be levels of penalties. It could be the same as not filing your financial statements on time. Jana suggests you check with your legal counsel. [33:10] Another trend Jana sees is the rise of Artificial Intelligence. It's on everybody's mind. There are sessions at RISKWORLD on the upside and downside risks and benefits of AI. AI has the ability to bring together a lot of information for the ERM practitioner. It still needs human interaction to determine what those results might mean and play out for your company. [34:32] Jana would not limit the research to what the AI brought back for a data set. AI can't replace the human experience and reasoning ability. [35:05] Another topic Jana sees, as we get to 2025, people are looking to the end of the decade from a risk perspective, taking a little longer-term view than normal for risk professionals, looking past current and emerging risk and thinking ahead. How are the risks of today going to progress to 2030? Justin invites Jana to come back in 2030 for a look back! [36:32] Justin describes how he has eased into using AI for simple things. Generations United released our 10th annual "State of Grandfamilies" report on November 8, 2023. The report, Building Resilience: Supporting Grandfamilies' Mental Health and Wellness, outlines the reasons grandfamilies have mental health concerns yet have more trouble accessing mental health services and supports for both children and their caregivers due to lack of availability, lack of legal authority, and limited understanding of grandfamilies' needs among providers, cost, stigma, and ageism. This situation has been exacerbated by Covid-19, racial violence, and opioid use, the report found. Children who have faced traumatic loss or traumatic situations which led to them growing up in families without their parents are particularly susceptible to experiencing mental health concerns. Additionally, gaps in America's social safety net make it harder for these children to receive the care they need. This event highlighted the key facts, findings, and recommendations from the report and included poetry and spoken word from grandfamilies and a powerful conversation with members of grandfamilies and Dr. Joseph Crumbley about the importance of mental health. Small- and medium-sized medtech companies are facing challenges under the EU Medical Device Regulation. Moving on to payer news, Centene Corporation has beaten Q3 forecasts despite pressure from Medicare Advantage star ratings and redeterminations. HCA Healthcare, on the other hand, missed Q3 expectations due to costs associated with its physician staffing firm, Valesco. A report by the Robert Wood Johnson Foundation and the Urban Institute found that if the 10 remaining states expanded Medicaid, 2.3 million people would gain coverage. Prospect Medical Holdings has been given clearance to seek a buyer for its struggling four-hospital health system, Crozer Health. Kaiser Permanente imaging services workers will join an ongoing strike among pharmacy workers in Oregon and Washington. Independent pharmacies are suing Express Scripts over alleged price fixing.In the biotech world, Orbimed has raised $4.3 billion in new funds for startup investing. Novartis has delayed its FDA filing for its radiopharma drug Pluvicto due to mixed survival data. Aiolos Bio has raised $245 million for a better asthma drug targeting an inflammation-linked protein. Rampart Biosciences, an Orbimed-backed biotech, has launched with $85 million to develop a new kind of DNA medicine. Seagen's trial data at ESMO impressed, boosting stock prices for Merck and Pfizer. Today, we're excited to get to know Dr. Marketa Wills, Chief Medical Officer (CMO) of Johns Hopkins Health Plans, who focuses on optimizing clinical and quality outcomes for approximately 700,000 Johns Hopkins health plan members while efficiently managing costs of care. Marketa previously worked at several national health plans, including United Healthcare, WellCare Health Plans and Centene Corporation. She's also a McKinsey & Company alum (Cleveland Office) where she served a broad range of payer and provider clients on a variety of strategic and operational engagements. She holds an MD from the University of Pennsylvania School of Medicine and an MBA in Finance and Healthcare Management from the Wharton School of Business. She also trained in adult psychiatry at Harvard's MGH/McLean Adult Psychiatry Residency Program. In this conversation Cassandra and I explore the critical importance of emotion in the change process. We detail some of the critical places where leaders often miss opportunities to prioritize employee well-being. Then, Cassandra shares some practical steps leaders can take that will help employees better recognize signal emotions so they can eventually find opportunity and choice during the change process. Key Points Many leaders tend to diminish or ignore negative emotions during change. Actively doing that may prevent employees in getting to a place where they see opportunity — and eventually choice. Beware focusing too much attention on vision, roles, and responsibilities — and not enough on employee well-being and fulfillment. The change process is like driving in a car. The structure of the process is the vehicle itself and the people are their fuel. Have discussion about handling change a regular item in 1:1 agendas and team meetings. Leaders can enter into the opportunity that change provides by sharing their own emotions. One way to do this is to be explicit in conversation about what is genuinely inspiring you about the change. Topic: Using Intelligence Analysis in InfoSec: Think Globally and Act Locally In episode 48 of The Cyber5, we are joined by Rick Doten. Rick is VP of Information Security at Centene Corporation and consults as CISO for Carolina Complete Health. We discuss shifting the operating model of threat hunting and intelligence to a more collaborative model, “think globally and act locally.” We then dive deep into the intelligence analysis for collecting and analyzing the vast array of network data to prioritize network protection. Finally, Rick makes an argument for the outsourcing of an intelligence function as a viable model. 5 Topics Covered in this Episode: Security Operations Integrating with Cloud, Applications, and Mobile: (01:00 - 06:00) Security operations involve integration with key elements of the business such as the cloud, applications, and mobile team. Risks to a container are much different from a server and force security operations to integrate with many teams, especially in large enterprises. This will guide how we protect proactively with alerting and reactively with incident response. Using Intelligence Analysis with Information Security Data Collection (06:00 - 08:52) Intelligence includes tracking specific campaigns of threat actors, their intentions, and capabilities. Intelligence analysis in the disciplines of information security is linking the human to the malicious act. For example, suppose a criminal threat actor uses email phishing and credential harvesting. In that case, the data collection model and instrumentation will be different than looking at actors who use exposed RDP or take advantage of supply chain risks. It will also be very different from a nation-state actor who is known to go “low and slow” and persist in 10 different places in a network. Value of Attribution and Communicating to the Board of Directors: (08:52 - 13:26) The mindset of keeping confidentiality, integrity, and availability of information safe and not wanting to attribute the threat actors and building appropriate threat models is becoming more antiquated. Understanding the human who perpetrated the act is critical. Their job is to break into a network and collect and/or monetize. This used to be easier in the defense industrial base because there are cleared environments for information sharing; however, this is becoming more efficient with Information Sharing Analysis Centers (ISACs). Boards of Directors understand competitors stealing intellectual property, so framing cyber threats in the same vein is the most productive way to get them to understand the importance of nation-state espionage or cyber criminals. The Right Way to Do Threat Intelligence: Think Globally Act Locally (13:26-24:00) The most important threat intelligence is internal network telemetry. The wrong mentality is to buy threat intelligence feeds and load indicators of compromise (IOCs) into a security tool like a SIEM. This will result in tremendous workloads with little results as good actors change their signatures constantly. Instead, it's important to get timely, actionable, and relevant finished intelligence on actors and their campaigns, not data or information. Finished intelligence might be reviewing technical methodologies of Russian GRU (or REvil ransomware) actors and identifying behaviors that can be detected internally on the network. At the highest level of attack campaigns are assignments of individuals to attack one particular company and steal/monetize something very specific. After gaining this intelligence, a security team can “dogpile” with the different entities of the business (SOC, applications, IT, development, mobile, etc.) to hunt and defend, “think globally, act locally.” Threat intelligence could certainly be outsourced, especially for companies who do not belong in an industry with ISACs. The Hardest Part of Intelligence Analysis: Determining Targeted Attack Versus Commodity (24:00-31:00) The hardest part of intelligence is being able to quickly identify if the attack is targeted or commodity. An actor who persists on Active Directory and the domain controllers is much different from those who want to exploit a bug in a cloud application or mobile application. Security teams who have minimal visibility gaps with internal network telemetry that can quickly detect these differences separate the mature security teams from the less mature security teams.

Trevan Ross is the Chief Human Resources and Administrative officer at Community Health Choice. Trevan's career experience includes HR leadership roles in a variety of industries across the healthcare spectrum, including hospitals, managed care, and biotechnology. Prior to joining Community Health Choice, Trevan was the Vice-President, Human Resources at Superior HealthPlan (a division of Centene Corporation). While at Superior, Trevan oversaw the growth of the workforce by over 1000%, supporting the company's business expansion from two service lines to eight, including establishing a physical presence in previously-unserved geographic regions as well as supporting a number of mergers and acquisitions. Trevan led the HR team in the development and implementation of leadership development & talent assessment program, improved talent acquisition, increased retention, and led HR organizational change initiatives resulting in improved service and greater customer satisfaction. Before transitioning into managed care at Superior HealthPlan, Trevan was an HR manager at M.D. Anderson Cancer Center.
