Crypto investment scams cost Americans billions of dollars. The scammers start small with confidence or romance scams and gradually work their way up to demanding ever larger “investments.” On the latest episode of the ABA Banking Journal Podcast — sponsored by Alkami — officials from the FBI's Criminal Investigative Division and the Commodity Futures Trading Commission break down how these scams work, typologies and red flags bankers should look out for and how banks can build proactive partnerships with law enforcement. They also discuss a new educational infographic on these scams produced jointly by the ABA Foundation and several government agencies.
Scammers stole more than $3.4 billion from older Americans last year, according to an FBI report that shows a rise in losses through increasingly sophisticated criminal tactics to trick the vulnerable into giving up their life savings. Losses from scams reported by Americans over the age of 60 last year were up 11% over the year before, according to the FBI's report. Investigators are warning of a rise in brazen schemes to drain bank accounts that involve sending couriers in person to collect cash or gold from victims. “It can be a devastating impact to older Americans who lack the ability to go out and make money,” said Deputy Assistant Director James Barnacle of the FBI's Criminal Investigative Division. “People lose all their money. Some people become destitute.” The FBI received more than 100,000 complaints by victims of scams over the age of 60 last year, with nearly 6,000 people losing more than $100,000. It follows a sharp rise in reported losses by older Americans in the two years after the 2020 coronavirus pandemic when people were stuck at home and were easier for scammers to reach over the phone. Barnacle said investigators are seeing organized, transnational criminal enterprises targeting older Americans through a variety of schemes, like romance scams and investment frauds. The most commonly reported fraud among older adults last year was tech support scams, in which criminals pose over the phone as technical or customer service representatives. In one such scam authorities say is rising in popularity, criminals impersonate technology, banking and government officials to convince victims that foreign hackers have infiltrated their bank accounts and instruct them that to protect their money they should move it to a new account—one secretly controlled by the scammers. Federal investigators saw an uptick between May and December of scammers using live couriers to take money from victims duped into believing their accounts had been compromised, according to the FBI. In those cases, scammers tell victims that their bank accounts have been hacked and that they need to liquidate their assets into cash or buy gold or other precious metals to protect their funds. Then the fraudsters arrange for a courier to pick it up in person. This article was provided by The Associated Press.

In this episode, of Louisiana Unfiltered Kiran Chawla and Katherine Read bring you into the shocking case of Samrat Mukherjee, who posed as a doctor for years in Baton Rouge, Louisiana. The story came to our attention and we broke this story when a source from Acadian Ambulance reached out to us, revealing that Mukherjee had been fired. We confirmed the story and reported on it, despite Acadian's denial.Multiple employees insisted that Mukherjee had claimed to be a doctor. In fact, Kiran interviewed him herself when he was working as a paramedic, and he mentioned being a fifth-year medical student. Later, it was discovered that he had forged a letter to falsely claim acceptance to medical school.Mukherjee claimed to have attended Emory Medical School, Tulane, and LSU. This raised suspicions as it seemed like he was weaving a web of lies involving multiple entities. His audacity in deceiving others we and many others found astonishing. The investigation revealed that Mukherjee used an actual doctors information to call in prescriptions, by using the doctors National Prescription Identifier (NPI) number. Acadian Ambulance, his employer, terminated him immediately upon discovering this, though many find it concerning that someone like him could slip through the verification process at Acadian, especially considering that they provide life-saving care in various communities.Mukherjee has pleaded not guilty to the criminal charges against him. Dr. Le is seeking justice through a civil lawsuit, holding Mukherjee and Acadian Ambulance liable for their roles in the case.Throughout our investigation, we faced challenges in obtaining responses from various agencies. However, a federal grand jury indictment validated our concerns, and the Louisiana Bureau of Investigation and the Criminal Investigative Division of the Louisiana Department of Justice launched an investigation into potential medical fraud. We also interview Dallon Bush and Jamie Gontarek, who represent Dr. Le in the case. They discuss their involvement and the misuse of Dr. Le's NPI number by Mukherjee. Kieran talks with James Barnacle, Chief of the Financial Crimes Section, Criminal Investigative Division of the FBI, and Christopher Soyez, Assistant Section Chief. Jim and Chris discuss how the FBI works to recover the proceeds of scams on behalf of victims. They credit banks' suspicious activity reports with being the primary catalyst for the bureau's successful investigations into COVID-19 related scams, while also questioning a rising reluctance within the industry to aid customers in recovering the proceeds of other kinds of fraud.

Host Gregg N. Sofer is joined by Salvador Hernandez, former senior FBI official and private-sector compliance officer and current senior compliance and ethics advisor at Husch Blackwell, to discuss the recent U.S. Department of Justice settlement involving Danske Bank A/S. The settlement resolved a DOJ investigation concerning instances of bank fraud that allowed Danske Bank to move billions of dollars through the U.S. financial system from high-risk accounts for non-resident customers of the bank's Estonia-based branch. Danske Bank also settled charges brought by the U.S. Securities and Exchange Commission (SEC) in a parallel proceeding for violations of U.S. securities laws.As part of the settlement, Danske Bank pled guilty to conspiracy to commit bank fraud and agreed to forfeit $2.06 billion. In a notable development, the settlement also involved a first-of-its-kind provision whereby Danske Bank agreed to “implement evaluation criteria related to compliance in its executive review and bonus system so that each Bank executive is evaluated on what the executive has done to ensure that the executive's business or department is in compliance with the Compliance Programs and applicable laws and regulations.”Our discussion will explore how the Danske Bank settlement breaks new ground by targeting executive compensation in the context of compliance program failures. The former FBI Assistant Director for the Criminal Investigative Division describes the “seismic culture shift” happening today inside of the FBI and why it has become a lot more pronounced within the last five years.
