Being unaware of the law does not excuse you from it. In this episode, Jason A. Duprat, Entrepreneur, Healthcare Practitioner, and Host of the Healthcare Entrepreneur Academy podcast, talks about the importance of due diligence when taking advice. There are those who claim to be "experts" in their field but, ironically, spread misinformation, even illegal advice that could cost professionals their licenses. After listening to a podcast sharing such grave inaccuracies, Jason shares valuable insights on avoiding misinformation and seeking real professional advice. EPISODE HIGHLIGHTS Jason came across a podcast where the host claims to be a "Healthcare Business Expert." Ironically, pieces of advice given during the show were utterly inaccurate, even downright illegal. The consultant gave poor advice that could potentially cause people their medical licenses. One piece of advice was to work as a 1099 Contractor using your clinic's name, which risks the business entity's assets if things go wrong. It's important to work with competent consultants who've spent hours studying and are not afraid to admit what they don't know. If you don't know the rules of the Nurse Practice Act in your state, you should not be advising anybody. Read the laws word-per-word. Do not blindly follow and apply the advice you receive from anyone. Hire experienced consultants and attorneys. Invest at least five to seven thousand dollars in attorney consulting before starting your business. Thousands of dollars in consultations and legal fees are nothing considering the trouble it will save you from down the line. 3 KEY POINTS Always exercise your due diligence when absorbing information. When ingesting information, you have to be critical and analyze what does and doesn't apply to you. The book mentions a 4-Step Process geared more toward hiring employees, while the nature of Jason's business is more of working with contractors. What piqued Jason's interest the most was the "Reference Interview" portion, which he found counter-productive. Applicants will always mention references that are heavily biased in their favor. Jason recently hired a contractor who talked a big game but couldn't deliver what he promised, wasting plenty of resources in return. References wouldn't badmouth their acquaintances at the risk of burning bridges. In certain states, companies can even get sued for badmouthing past employees. Hire multiple people for small projects and choose the best person to keep working with moving forward. 3 KEY POINTS What works for others might not necessarily work for you. Reference-Checking is a waste of time as references will always be biased in the applicant's favor. Hire people on a short-term basis and gauge their performance from there. There's a great deal of joy, purpose, and personal satisfaction that can be gained from helping people. After four long years of working hard, Jason finally started to reap the rewards of being an entrepreneur. Keep persevering. If you can offer financial help to someone in need, do it. If you can fly across the country to help people in crisis, do it. OVERVIEW: Jason A. Duprat, Entrepreneur, Healthcare Practitioner, and Host of the Healthcare Entrepreneur Academy podcast, talks about the progression of an entrepreneur and how to position yourself to continue down the path of success. For entrepreneurs to scale up their businesses, they have to learn how to gain leverage, understand leverage, and utilize it to their benefit. EPISODE HIGHLIGHTS Jason watched a YouTube video and learned that to grow, you need to learn how to utilize leverage. Leverage has four components: labor, capital, digital media, and code. Labor - you have to ask and motivate employees. Collaboration with a team is necessary to create a product or service and ensure successful delivery to customers. Capital - a business cannot run without capital. Use capital to leverage marketing and have your system down pat by knowing how much to invest and what the ROI is. Digital media - you don't have to pay a cost to replicate content and this includes licensing. Code - code can do the work of labor with fewer mistakes, fewer costs, and less downtime. Think of this as a pyramid. Labor is at the bottom. Move out of the position of making money for someone else and make money for yourself. Start your progression by stepping out of the W-2 job and becoming a 1099. Next in the progression is to become a business owner. Leverage team skills and time. After this, start to create content and focus on digital content. At the top of the pyramid, you're already leveraging content and media and it's onto code. Jason is at this level right now. Jason watched another YouTube video and shared two key takeaways. One, if your business is earning 0 to $1 million, focus on selling one core product to a single ideal customer. Get good at what you do. Once you reach $1 million, you can scale your market. Determine ways to offer lifetime value to your customer. Listen to current customers and offer products/services during their journey. Upsell! Jason is learning from successful billionaires and by investing in his education. He spent $47k last year on courses, masterminds, books, etc. The game is real. Invest in your education. Shortcut your path to success and financial freedom. 3 KEY POINTS Learn, understand, and utilize leverage to your advantage. Becoming a 1099 makes you learn more business skills compared to being a W2 employee. Ensure your business offers lifetime customer value. Purchasing power is especially vital – a business cannot thrive if customers cannot afford it. Choose a market where advertising is easy and cost-effective. Make sure the chosen market is growing and not declining. Jason has spoken with other high-level entrepreneurs and they all say your choice of the market is key. Ask questions, do research, and analyze. There are five ways you can scale up or expand your market. One option is to upmarket by serving bigger players to increase your reach and improve efficiency in growing sales. The second option is to downmarket and get in front of potential clients before they need your product or service. A third option is to go to an adjacent market as they have similar needs. The fourth is to offer more services in general. Use a scorecard and include the mission of the job, six to seven detailed breakdowns of what the position will do, and when the actions should be completed. Break down interviews into three to filter top candidates for the position. The first is the screening interview. Ask applicants about career goals, skills, strengths, weaknesses, and who their last five bosses were. Next is the main interview, where references (the last five bosses) are called to probe deeper into the applicant's experience and performance. The last is the focused interview which highlights the specific skills and traits demanded by the job. Always be in a recruiting mode because you never know when rockstar employees are looking. A-players are pulled to other jobs; B and C players are pushed out the door. EPISODE HIGHLIGHTS: Paying yourself through an S Corp. is a tax-saving strategy. It's important to know your retirement goals because that's going to play into how you set your W2 income. There are two types of retirement plans. A self-employed IRA and the contribution limit is 25% of your salary. And there's a Solo 401K or Individual 401K, which is currently capped at $19,500. With the Solo 401K, you can contribute on your own and the business can also contribute, which is capped at 25%. Each type of plan has a different set of rules, regulations, and limits around it. One thing to consider is if you set up a company contribution at 25% for your own retirement goals, you'll need to do the same for your employees at the same rate. Tax savings for your business is only one side of the equation. Planning for retirement is another so be sure to hire a consultant to guide you through both areas. 3 KEY POINTS: The way you set your W2 salary is going to be the biggest driver not only in your taxes in terms of FICA, but it's also going to be a factor in how much you can contribute to your retirement accounts. If you set your W2 salary too low, you're saving some FICA tax, but at the same time, you're limiting your ability to contribute to your retirement account. You have to match how much company contribution you've set up for yourself before you had employees for all employees you hire thereafter. OVERVIEW: Jason A. He shares options for how business owners can structure their businesses and highlights which option will provide the most benefits in terms of tax savings. EPISODE HIGHLIGHTS: You have options when it comes to how you pay yourself as a business owner and subsequently, the amount of tax you pay. This is based on how you structure your business. One option is a sole proprietorship and the other is an S Corporation You can also run your business as an LLC yet if you do, you'll want to consider filing an S Corp election (Form 2553) to take advantage of tax benefits. As a sole proprietorship, you would pay taxes (income and FICA) on all of your earnings. This includes Social Security at 6.25% and Medicare at 1.45%. This is paid at the employee level and the employer level so a total of 15.4% is taken out. In 2022, a cap was placed at $147,000 in income. So you would pay taxes on this maxed amount which equals $22,000. As an S Corp, you can take advantage of huge tax benefits because you can pass-through income from the business to owners or shareholders. In this type of business structure, the owner would take a reasonable salary. What's deemed reasonable is up for debate and based on the risk the owner can take. Be sure to talk with your CPA in order to determine the salary you should pay yourself. Jason shares an example of generating $300,000 in income and taking a $100,000 salary. The tax on this at 15.4% comes to a little over $15,000 - substantially less than the sole proprietorship. Jason runs all of his businesses as S Corps to take advantage of the tax benefits. As a business owner, you have to decide for yourself how best to structure your business. However, in order to do this, you must first understand how taxes work. 3 KEY POINTS: When it comes to structuring your business, you have options and there are tax benefits associated with each option. You can file as a sole proprietor, S Corp, or an LLC with an S Corp election. Hire a CPA. If you try to do this yourself…you'll pay way more taxes. Consult with an education advisor to help you work in your best interests as a business owner. The two-tier tax system of the government works to incentivize businesses and growth because that's what supports the economy. As business owners, you can benefit from this if you understand how taxes work. You can also offer flexible work schedules and training support. Set the bar high. Anticipate growth so you can hire A Players. Be aware of your profits and losses. Hire an intrapreneur vs an entrepreneur. Intrapreneurs are intuitive and they innovate ideas and grow teams yet have a low-risk tolerance. The reason you don't want to hire an entrepreneur is that they've probably already started businesses before. And those efforts failed so they lost their mojo. If they get their mojo back, they'll likely leave you to start their own business again. 3 KEY POINTS: A Players have the skills and the talent to grow your business exponentially faster and better. When you're looking for A Players, the number one thing you can do is sell the position and sell the idea of future growth. A Players know the skills they bring to the table. They understand that if given the right environment, they can exponentially grow revenue and the role as well. The challenge didn't get traction and there were a combination of factors that played into this. From a pricing perspective, Jason didn't run online ads because costs had skyrocketed in December. Timing was off because people were busy with end of the year business planning and family activities. In addition, Jason learned cash based prospective audiences are often undecided about what clinical service to provide. When you introduce new business ideas, it's important to know your numbers and conversion rates. Jason realized his greatest challenge wasn't conversion, it was momentum. To compare is to despair. Jason is planning to try again after the new year. In order to keep things moving forward in your business, continue to expand on the services and products you offer. 3 KEY POINTS: The most important thing you can do when you take a swing and a miss is keep on moving, try and evaluate what happened, reflect on what you can do differently next time, and keep on moving. It doesn't matter how many misses you have. Eventually, you'll find something that gets a lot of traction and will score a home run for your business. This is particularly true if you're working with dozens of contractors, freelancers, and staff. Asana alleviates this chaos by centralizing the work and communications associated with team projects. Asana can be used to organize personal tasks as well, which is something Jason does. When you log in to the dashboard, you can easily see your to-do list for the day. 3 KEY POINTS: Making mental to-do lists, using sticky notes, or keeping track of tasks through a calendar is fine but having a systematized way to handle everything that needs to get done for your business is an absolute must. Jason also suggests leveraging your license to provide services for patients or other businesses remotely. This saves commute time which you can put towards working on your business. You will have to pay your dues. Don't quit your job to start a business. Instead, start lean and part-time to get the kinks worked out. And when your business is making good money, then take the leap. In the end, the choices are yours to make. You are in complete control. Finally, the last reason for starting a cash-based practice is employers are looking to save money. Employee premiums are rising 6-7% annually and employers are eating this expense. It’s too easy to get into a financial hole if you go all-in by purchasing a large space and hiring a big team. Jason is an advocate for the Lean Startup method. He opened his first practice with an 800 square foot space and a short-term lease. Smaller practices can be lucrative, especially if they offer self-pay services such as direct primary care or ketamine infusion. You don’t have to accept insurance when you open a practice. Reimbursement costs average 85% plus you can pay 3-7% on gross receipts to billing companies. If you choose self-pay services, you’ll need to market yourself and your practice. Be clear on scope of practice, create a baseline business plan, forecast revenue and track expenses. Visit your state’s Board of Nursing website to access scope of practice regulations. Over the last 30 years or so, there’s been a big move to expand scope of practice and increase autonomy for nurses in the US. When it comes to owning a practice, there are several levels of physician involvement. Only a few states require having a physician present for direct supervision. Following direct supervision, the next level is physician supervision where the physician directs the work and has overview responsibilities to ensure appropriate treatment is provided. Next is physician collaboration which means a physician isn’t required to be onsite yet he/she is available for consultation. Protocols at this level can be in a written format yet it’s not required. Lastly, a physician isn’t required to be onsite for the independent practice level and these protocols can be verbal. Independent prescribing is an area that falls into this level. If you need to find a collaborating physician, NPs can go to the Collaborating Docs website (see link in the Resource section). If regulations limit your scope of practice to a certain area, hire another NP or you can change your specialty by obtaining a post-master’s graduate certificate. 3 KEY POINTS: You can start a practice in any state, but the best states allow nurses to practice independently of a physician and to prescribe—no collaboration required. Understand the level of autonomy allowed by your state’s regulations and then structure your practice so staff members remain within their scope of practice. If you choose to have one, he provides tips on how to use the card wisely. EPISODE HIGHLIGHTS: Jason shares an example of someone who funded their startup with a business credit. He changed his mind on the business and presumed he wouldn’t be held personally responsible for the debt. He was wrong. To open a business credit card, an officer is required to sign a personal guarantee which makes him/her liable for business expenses. There’s a clause in the contract stating this. Jason explains the differences between a small business credit card and a corporate credit card. A corporate credit card is more difficult to set up but it holds only the business liable for expenses versus the person. There are revenue requirements to set up a corporate credit card - $4million in gross revenue. Only C corps and S corps can apply - not LLCs. The great value business credit cards provide is their point system. Jason’s Chase Preferred card offers 3 points for every $1.00 he spends. For example, if he spends 10k in a year, using the 3-point system, that’s 30k points or $300 in cash value. Divide your credit card points by a hundred to get an estimate of its value in gift cards or if you were to cash it out. Set up reminders for your credit card payments to avoid paying interest. Jason advises not to trade interest for points. 3 KEY POINTS: You’re personally liable for your business credit card transactions even if you’ve shut down your business. Pay off your credit card payments in full and on time to avoid getting hit with interest charges. There are benefits to using credit cards. For example, you can cash out accumulated points or use them for gift cards or travel expenses.
