This Day in Legal History: 22nd Amendment to the US Constitution On February 27, 1951, the 22nd Amendment to the U.S. Constitution was ratified, formally limiting the president to two terms in office. This amendment was a direct response to Franklin D. Roosevelt's unprecedented four-term presidency, which spanned the Great Depression and World War II. Before Roosevelt, no president had served more than two terms, following the precedent set by George Washington. However, there was no constitutional restriction preventing a president from seeking additional terms.  Roosevelt's long tenure raised concerns about excessive executive power and the potential for an elected leader to hold office indefinitely. After his death in 1945, Congress moved to ensure that no future president could serve more than two terms. The amendment was passed by Congress in 1947 and ratified by the required number of states in 1951. It states that no person may be elected president more than twice or serve more than ten years in cases where a vice president assumes the role due to a predecessor's death or resignation.  Since its ratification, the 22nd Amendment has shaped U.S. presidential politics, preventing any leader from holding office for more than eight years. Some have argued that it protects democracy by preventing the concentration of power, while others believe it limits voter choice. Despite occasional calls for repeal, the amendment remains in effect, reinforcing the principle of regular transitions of power.A federal court is scrutinizing the role of Elon Musk and the Department of Government Efficiency (DGE) in cutting U.S. government spending, raising questions about transparency and legality. At a hearing, Judge Colleen Kollar-Kotelly repeatedly pressed a Justice Department lawyer on Musk's authority but received vague answers. Multiple lawsuits argue that DGE, which operates with secrecy, wields power beyond what is constitutionally allowed for agencies that require congressional approval or Senate confirmation.Despite Musk's public claims of leadership, the White House insists he is not an official DGE employee. Courts have been divided on the issue, with some judges refusing to block DGE's actions due to a lack of clear evidence of immediate harm. However, Judge Jeannette Vargas temporarily restricted DGE's access to Treasury Department systems over concerns about unauthorized data access.The Trump administration's shifting characterizations of DGE—sometimes calling it an agency, other times not—have further complicated legal battles. Ames alleges that in 2019, her gay supervisor promoted a less qualified gay woman and replaced her with a gay man. The case challenges a legal standard that requires plaintiffs from majority groups—such as white or heterosexual individuals—to provide extra evidence of workplace discrimination under Title VII of the Civil Rights Act of 1964.  Ames' lawyer argued that Title VII protects all individuals from discrimination, not just historically marginalized groups. The state of Ohio, her former employer, countered that Ames had not proven bias, noting that decision-makers may not have even known her sexual orientation. Some justices expressed concern that ruling for Ames could flood the courts with discrimination claims. Others questioned whether the heightened standard for majority-group plaintiffs improperly excludes valid cases.  The case comes amid increasing lawsuits from white and straight workers alleging "reverse discrimination," as well as political pushback against diversity and inclusion programs. A ruling in Ames' favor could make it easier for majority-group plaintiffs to challenge employment decisions, potentially reshaping workplace discrimination law.US Supreme Court hears straight woman's 'reverse' discrimination case | ReutersPresident Donald Trump's decision to designate Latin American drug cartels as terrorist organizations introduces new legal risks for U.S. businesses and migrants. The February 19 designation applies to groups like the Sinaloa Cartel and Tren de Aragua, allowing the Justice Department to prosecute cartel leaders for terrorism. However, legal experts warn that U.S. and foreign companies operating in cartel-controlled regions could also face prosecution if they make payments to these organizations, which could be considered material support for terrorism.  This concern is not hypothetical—similar cases have occurred before. In 2022, French cement company Lafarge pleaded guilty and paid $778 million in fines for making payments to terrorist-designated groups in Syria to keep its operations running. Given Mexico's status as the U.S.'s largest trading partner, businesses must reassess their dealings in high-risk areas.  Beyond corporate liability, migrants who pay cartels for border crossings or send money to cartel-influenced regions could also be prosecuted. Additionally, drug-related offenses linked to designated cartels could carry harsher penalties, including a 20-year mandatory minimum sentence for narcoterrorism—double the usual drug trafficking penalty. The designation thus has sweeping implications for both corporate compliance and immigration enforcement.Trump's terrorist label for cartels raises prosecution risks for companies | ReutersIn a piece I wrote for Forbes, I review the latest misguided foray into tech policy from the Trump administration. The White House has issued a memorandum condemning foreign digital services taxes (DSTs), arguing that they unfairly target American tech companies. The memo warns that unless these taxes are repealed, retaliatory tariffs will be imposed. However, this stance appears to protect Big Tech rather than uphold economic fairness, as these taxes exist to counter profit-shifting tactics that allow tech giants to avoid local taxation. The U.S. frequently applies its own extraterritorial laws, such as the Foreign Corrupt Practices Act and the CLOUD Act, yet objects when other countries enforce similar policies on American firms.The memorandum frames the issue as an attack on U.S. businesses, but every country has the right to tax corporations operating within its borders. DSTs primarily ensure that companies pay taxes where they generate revenue rather than in low-tax havens. The U.S. position ignores the broader global tax landscape and the rationale behind these policies, opting instead to shield Silicon Valley from accountability.If the U.S. enacts tariffs in response, it could trigger a trade war that harms American farmers, manufacturers, and consumers while preserving Big Tech's profits. Lithium Universe Ltd (ASX:LU7, OTC:LUVSF) CEO Alex Hanly spoke with Proactive's Tylah Tully about the company's Memorandum of Understanding (MoU) with Lafarge Canada and its strategic focus on Aluminosilicate Secondary Product (ACSR). Lafarge, a subsidiary of global cement and concrete leader Holcim, is one of Canada's largest concrete producers. The partnership centres on ACSR, a byproduct produced during Lithium Universe's lithium carbonate refinery process. This process generates ACSR in a 1:1 ratio to spodumene, alongside sodium sulphide. Hanly explained, “Rather than incurring high disposal costs, we see a valuable opportunity to integrate ASCR into the cement and concrete industry.” Following Lithium Universe's PFS announcement last year, Lafarge expressed interest in exploring its potential applications in construction. The next step involves procuring an ASCR sample that closely resembles what the company expects to produce at its Bécancour refinery. This material will undergo rigorous quality and strength testing in collaboration with Lafarge, industry labs and Montreal-based universities to ensure it meets construction standards. Le cimentier Lafarge, fleuron de l'industrie française, est mis en cause devant les tribunaux pour avoir, dans la Syrie en guerre, maintenu coûte que coûte l'activité de son usine de Jalabiya jusqu'en septembre 2014, versant des millions de dollars à des groupes djihadistes, dont Daech, en taxes, droits de passage et rançons, exposant ses salariés syriens à la menace terroriste après avoir mis à l'abri le personnel expatrié. Jacques Neatby is a leadership team and corporate strategy expert.He began his career as a labour & litigation lawyer with one of Canada's elite international law firms.He was recruited into consulting in 1994 and soon after was hired by Canada's largest independent strategy consultancy (since acquired by KPMG). There he worked with the executive teams of industry-leading companies in North America and Europe, including Ubisoft, Sanofi, as well as Bureau Veritas, the no. 2 player in the global testing and inspection industry (currently 80 000 employees in 140 countries) who hired him to set up their corporate university and develop their flagship strategic alignment program targeting the organization's top 300 leaders.He was later asked to join Bureau Veritas full-time as a senior executive. Based in Europe and reporting to a member of the group's Executive Committee, he led a team that supported country and regional leadership teams in the USA, Europe and Asia-Pacific, notably with restructuring and strategic alignment, as well as with their post-merger integration of efforts (Note: during his time at Bureau Veritas, the company grew from 18 000 to 60 000 employees). In 2010, he returned to North America and his expertise with executive teams led Lafarge, now Holcim, the leading cement company in the world ($30 billion in revenues, 72 000 employees) to hire him as a special advisor to its executive teams in Europe, Asia and North America to address restructuring and alignment issues. Since that time, he has also been hired for strategic alignment support by many other industry-leading companies in North America and Europe including Marriott (global no. 1 in hospitality) and Randstad (global no.1 in recruitment).In addition to his consulting work, Jacques has taught at numerous business schools in North America and Europe since 2012. From 2015-2021, he taught the leadership team module in the world's no. 1 EMBA program as ranked by the Financial Times in London, where he was amongst the top-ranked professors.He also writes on executive teams and strategy, notably for the Harvard Business Review and Business Digest. Purple Group*: A Breakout Stock After months of a consistent seller at 80 cents, Purple Group's stock broke higher, reaching 98 cents before pulling back. Brown remains optimistic, particularly as trading volumes in the JSE pick up, benefiting Purple's core business. Although trading at a high PE of 45, Brown is bullish about its prospects in a rising market. Afrimat: A Tough Year, but Long-Term Potential Afrimat's trading update indicated a sharp drop in earnings (down 75-85%), partly due to the acquisition of Lafarge, which is still loss-making. While the near-term outlook is challenging, Brown remains optimistic about Afrimat's long-term potential, especially if South Africa enters a construction boom. He sees the stock as attractively priced for long-term investors. Wilson Bayly Holmes-Ovcon (WBHO): A 16-Year Breakout Brown discusses WBHO's impressive 17-year chart, finally breaking out after a long consolidation period. He suggests the stock could benefit from renewed local construction activity, while Afrimat remains his preferred pick in the sector due to its diversification into industrial metals. This week's guest is  Gonzalo Cordova, Director of Decision Science and Automation at The Home Depot.  Gonzalo has a long history of solving business and supply chain problems using sophisticated analytical methods.  After finishing his MS at GaTech in 2005, he worked for companies as varied as GE Energy, Lafarge, Coca-Cola, and The Home Depot.  His current role is leading the team that is applying AI, and other analytical methods they have in their tool belt, to solve various challenges within the company.  Gonzalo and his team's approach is a problem first rather than leading with a set methodology.  In our conversation, Gonzalo offers his definition of AI and talks through examples of its success and other areas where it was not.

La historia de la envenenadora Marie Lafarge se remonta a los años oscuros de la toxicología y la ciencia forense a mediados del Siglo XIX, en el que un tribunal podía sentenciar a una persona debido a indicios y sin pruebas contrastadas con “testigos” sesgados que basaban sus declaraciones en sospechas o comportamientos inadecuados. El Siglo XIX no fue nada fácil para mujeres cuyas aspiraciones eran ir más allá de un destino matrimonial forzado y no elegido. Algo que en nuestros tiempos ocurre al revés, que parece que elegir una vida de familia está demonizado. Marie Lafarge: Una Mujer en el Ojo del Huracán Judicial del Siglo XIX En la turbulenta Francia del siglo XIX, un caso criminal capturó la atención del público y de los medios de comunicación como pocos lo habían hecho antes. Marie Lafarge, una joven de origen burgués, se convirtió en el epicentro de un juicio que desató debates apasionados sobre la justicia, la ciencia forense y el papel de la mujer en la sociedad. La historia de Marie Lafarge es un testimonio de cómo las circunstancias y las percepciones sociales pueden influir en el destino de una persona, convirtiendo su vida en un verdadero misterio judicial. El Contexto Social y Personal Marie Capelle, más conocida como Marie Lafarge tras su matrimonio, nació el 15 de enero de 1816 en París. Provenía de una familia acomodada y bien relacionada, lo que le permitió recibir una educación privilegiada. Su vida dio un giro dramático cuando, en 1839, se casó con Charles Pouch-Lafarge, un hombre de negocios de provincias. Those who listened to the DERVOS recording released last week may remember Pier pitching a utility-led DER deployment model. It was a pretty interesting idea that we felt deserved its own deep dive on a pod, so we invited Pier on to make the case for what is likely a very counterintuitive DERs approach for many in the space. In the episode he envisions a world where utilities determine the best locations for DERs on the grid, design the systems, provide them via RFP, rate base them, and then use them to make tripling grid throughput cost effective. For more information, check out SGAA's website for speakers, a full schedule of events, and more about individual facets of every part of the event on the organization's conference homepage.  General Session Each year during General Session, SGAA brings together speakers from around the world to speak about restoration, conservation, public art, history, and technology in the field. It is not uncommon to have roundtables to tackle emerging issues or panels of experts to provide clarity on how industry elements are being tackled across the country. Speakers and lecturers are chosen by a panel of peers for both their content and enthusiasm. The expertise of historians, conservators, and contemporary practitioners come together in a unique way to celebrate the enormous diversity of the entire industry. In recent years, additional efforts have been made to bring notable guests and speakers to the conferences that can speak to the partnerships glass work often requires, e.g. those in adaptive reuse, metalsmithing, masonry conservation, sacred places, fundraising, and public art. There has also been a great many collaborations within the larger glass arts community as it applies to architectural art glass – kilnforming, flameworking, lamination, etc – and it is always exciting to see how connections made at the annual conference push the boundaries of new work. Classes & Workshops Conferences offer a unique opportunity to learn both beginning and advanced techniques and are often geared toward the unique strengths of that year's conference host. SGAA tailored its workshops to nearby facilities and studio resources that are unique to this year's conference location. Says McElfresh: “We have been very fortunate to work with incredible teachers from all over the globe – leaders in the field who have generously donated time to share their knowledge with our members and attendees.” Mosaic Marathon The Society of American Mosaic Artists (SAMA) is the largest nonprofit mosaic art organization in the world—a vibrant and ever-expanding group of more than 1,200 members, including mosaic artists at all levels, mosaic aficionados, collectors, materials suppliers, and art educators. SAMA has placed renewed emphasis on strengthening ties with other mosaic organizations around the globe to pursue common goals. The Mosaic Marathon brings together members for a unique opportunity to create a mosaic in a cooperative, continuous, networking experience. The Mosaic Marathon creates a lasting piece of art that is donated to a local charity in SGAA's host conference city. As a not-for-profit organization, this is an opportunity for SAMA to give back to the arts community and create a lasting reminder of its legacy and mission. Tours & Field Sessions The history and appreciation of stained glass is inseparable from both its setting as an architectural element and the very nature of the material itself. For craftsmen and artists in the field to gain exposure to the vast living museums of stained glass, they must visit stained glass all over the world whenever they can. “Installations all over the world are our museums, our laboratories, and our classrooms,” says McElfresh. “Thus, when we come together as a group, we must take advantage of our travel and our companions to go and experience installations, to discuss them with our peers, and to investigate ongoing care and restoration concerns that affect us all. This is one of the most useful ways we can learn as a group.”  Nearly every SGAA conference includes at least one full day of site visits and installation tours. In addition, the organization has been known to schedule and participate in special travel opportunities both in the United States and abroad to experience as much stained glass as possible. The tours are almost always stand-alone events, which can be attended outside of General Session participation and are often open to the public. Auction & Scholarships At each conference, members have the opportunity to browse through tables laden with books, sample sets, vendor products, tools, and artwork from members. SGAA's annual silent and live auction at the summer conference is a major source of funding for scholarship assistance. Donations directly fund scholarships for professional stained glass instruction all over the country and beyond.  On exhibition years, work is donated to SGAA's live auction, which is an opportunity to collect autonomous work by any number of the group's talented members. On the Shoulders of Giants: Innovation in Stained Glass at The Buffalo History Museum, Portico Gallery, September 15, 2023 – January 14, 2024 This anniversary exhibition pays homage to skills honed over generations that have facilitated innovation in past and present-day Buffalo. Just as LaFarge and Tiffany pushed the boundaries of the medium in the 1880s, today's community continues to move forward, fostering innovation and creativity. This trifecta of exhibits brings together Buffalo's unique history and legacy with future architectural endeavors. Conference attendees have the opportunity to experience how glass is a part of the city's built environment, building momentum for the art of the future. Viewing opportunities include: The new Gundlach building at Buffalo AKG Art Museum and multiple new glass-related commissions being unveiled there this summer; Brilliance: The Stanford Lipsey Art Glass Collection at the Burchfield Penney Art Center; and On the Shoulders of Giants at the Buffalo History Museum. States David Judson, Judson Studios: “The world of stained glass is constantly evolving with the advancements in technology. Despite being an ancient craft, new and innovative methods are being discovered every day. These advancements present exciting opportunities for the future of this beautiful medium. We are thrilled to witness the endless possibilities that lie ahead.”  Camaraderie, Networking & Celebration Says McElfresh: “Year after year, SGAA builds on the shoulders of giants, sharing cumulative knowledge with one another. This magic is the result of providing space for the unplanned to occur: the intermingling of artist, craftsmen, business people and suppliers. They exchange ideas, have impromptu demonstrations, and socialize. It is the chemistry created by our shared passion for the glass material that keeps bringing us back together.” She continues: “At our business meetings, we not only attend to the business of the day, we recognize those who have achieved professional recognition in the field. We seek to learn what challenges may face us next. We are just as eager to hear from emerging professionals as we are to hear from the recognized experts.” Each annual conference ends with an award banquet where SGAA celebrates Lifetime Achievements as well as up-and-coming voices.  The Stained Glass Association of America is one of our nation's oldest trade associations. Now 120 years old, the organization is proud to produce one of the oldest continuously published art journals in the United States, in addition to providing over 1,500 professionals across the country including manufacturers, suppliers, and educators with programs, scholarships, accreditation, public education and services for stewards.  Says McElfresh: “SGAA is the advocate and ambassador for monumental stained glass art in the United States.”

Local CPI 6.3% for May (lowest since April 2022) from 6.8% in April and vs expected 6.5%. A very good number and we should see June below 6% as June last year was the first +7% in this cycle at 7.4%. Simple base effect should put some serious pressure on inflation over the next few months. So is inflation largely over locally? Probably. Can we start talking about when the MPC starts cutting rates? The next MPC rate announcement is July, the day after we get June inflation and we'll see that the governor says. But cuts are maybe fourth quarter fo this year, at soonest. Standard Bank thinks another 0.25% hike later this year and consensus is cuts only starting next year. Simon Shares UK core inflation rises from 6.8% to 7.1% and CPI 8.7%. They are in trouble. Standard Bank (JSE code: SBK) trading update. Very much two parts, bad debts are ugly and profts are lookign great. They also expect a 0.25% rate increase in the second half of the year? Afrimat (JSE code: AFT) deal to buy Lafarge for ±R1billion. String vertical intergration and potential to boost profits to essentially be paying around a 3x PE. They also say that it looks lie constructions has bottomed in 2022. Omnia (JSE code: OMN) results. Agri struggling with margin pressure, ining booming while chemicals slips. But overall good and stock si cheap. Transaction Capital (JSE code: TCP) secures funding for Gomo. Securing the capital was a major market concern and now they have a bak using their balance sheet and they earn a margin. Good deal but market still selling.
