Send a textA rural county's safety net is only as strong as the deputies willing to hold the line.In Episode 128, we sit down with TMPA Regional Attorney and former Polk County District Attorney Lee Hon alongside TMPA Field Representative Robby Campbell to break down the growing controversy surrounding Polk County leadership and its impact on law enforcement.At the center of the discussion is Polk County Judge Sydney Murphy and the debate over Texas Senate Bill 22, a bill intended to help rural agencies raise salaries and remain competitive. We examine how Judge Murphy reduced the county-funded pay raise specifically for law enforcement because of SB22 funding, effectively offsetting the purpose of the state assistance.The episode follows the money from courthouse construction costs and elected officials' pay increases to a grant-funded Public Defender's Office that could exceed one million dollars annually once state funding sunsets. "We are still dealing with a system which tolerates rampant abuse of accused people." — Emily Galvin AlmanzaBack in April 2024, we interviewed Thelton Henderson, one of the first African American federal judges in America. What disturbed me about our conversation was that even though Henderson grew up in the late Jim Crow era, he didn't seem to think that America is a profoundly more just place now than it was back then. Today's guest clerked for Judge Henderson, and her new book suggests he's right.Emily Galvin Almanza is a public defender turned activist, and The Price of Mercy is her data-driven indictment of a criminal justice system that, as she puts it, "tolerates rampant abuse of accused people, tolerates the blatantly racist application of the law, and tolerates a total lack of transparency." According to Almanza, the numbers are damning: 80% of cases are misdemeanors. 80% of people prosecuted are poor enough to need a public defender. 70% of people in jail haven't been convicted—they just can't afford bail. California's gang database was 99% people of color, she says, and famously included literal babies listed as having "admitted their gang affiliation."And here's both the good and bad news: crime is actually down. If you're under 50, she notes, you're living through the safest period of your lifetime. The solutions aren't mysterious either—housing reduces arrest rates by 80%, after-school programs cut youth violent crime in half. That's all good news for us. But it remains bad for those being unjustifiably prosecuted. We just lack the political will to implement what works. And as Galvin Almanza points out, this isn't a federal issue: 87% of prisoners are in jail on state charges. Change happens at the local level—DAs, sheriffs, state legislatures. The fixes, she says, are realizable. We just need the collective political will. He is deeply vested in addressing the effects of mental health distress and its marginalization including, incarceration, homelessness, and institutionalization. Joel is dedicated to reframing mental health distress as a potential spiritual marker and existential opportunity. He holds dual Master of Science degrees from University at Buffalo in Rehabilitation Counseling and Biomedical Sciences with a concentration in Epidemiology. ------- Henry Cretella, M.D. studied and practiced Tibetan Buddhism for several years along with training in martial arts.  He then immersed himself in the more universal Sufism of Inayat Khan, an Indian mystic, for close to twenty years. He functioned as a senior teacher in the Inayati Order and the Sufi Healing Order before pursuing  his independent practice and study of mysticism. He now integrates what he has learned and experienced over these many years. Prior to his academic career, he was a criminal investigator - polygraph examiner for the Florida Office of the Public Defender and in the private sector Instructor at the Criminal Justice Institute and International Academy of Polygraph Science in Florida, and national Academic Director of the Criminal Defense Investigation Training Council. ------- Joel David Lesses is President and Executive Director of Education Training Center, Inc. and his work experience is in education, psychology, and counseling for people marginalized by trauma, addiction, and psychological distress. He is deeply vested in addressing the effects of mental health distress and its marginalization including, incarceration, homelessness, and institutionalization. Joel is dedicated to reframing mental health distress as a potential spiritual marker and existential opportunity. He holds dual Master of Science degrees from University at Buffalo in Rehabilitation Counseling and Biomedical Sciences with a concentration in Epidemiology.   ------- Henry Cretella, M.D. studied and practiced Tibetan Buddhism for several years along with training in martial arts.  He then immersed himself in the more universal Sufism of Inayat Khan, an Indian mystic, for close to twenty years. He functioned as a senior teacher in the Inayati Order and the Sufi Healing Order before pursuing  his independent practice and study of mysticism. He now integrates what he has learned and experienced over these many years. He graduated from Vanderbilt Medical School and completed his psychiatric training at Strong Memorial Hospital of the University of Rochester in Rochester, NY.  His professional career spanned over 40 years as a general and child and adolescent psychiatrist and included teaching, administration, clinical practice and consultation in the greater Rochester and western NY areas.  This, along with his spiritual and especially mystical interests lead him to certification as a mind body practitioner through the Center for Mind Body Medicine and Dr. James Gordon.  He retired several years ago from active psychiatric practice, but continues to incorporate what he has learned into his spiritual practices and offerings.

Today:Rickey McGee was sentenced to life in prison without parole for the shooting death of a convenience store clerk who was killed during a robbery in the Fenway. For 28 years, McGee maintained his innocence. Behind bars, he co-founded the Harriet Tubman Project in 2021, which brings together incarcerated people fighting wrongful convictions.In October he was released from prison, and thanks to McGee's own advocacy and the Innocence Program at the Public Defender's Office, prosecutors officially dropped the murder case after new evidence weakened the testimony of the prosecution's main witness. McGee joined Jim and Margery in Studio 3 on Monday with his partner Jacqueline Fonseca, who works for the New England Innocence Project.

Speakers: Judge Sandra Engel retired from the bench in September of 2022. She served as a Bernalillo County Metropolitan Court Judge for over 16 years. She currently sits on the bench as a senior judge. She received her B.S. in Marketing from the University of Alabama and received her J.D. from the University of Alabama School of Law in 1993.  After moving to New Mexico, she spent a few years in private practice handling both civil and criminal cases, acting as a guardian ad litem, CASA and respondent's attorney in child abuse cases. She was an Assistant City Attorney for the City of Rio Rancho, handling primarily DWI cases, and served as Assistant District Attorney for the Second Judicial District, Bernalillo County for 10 years prosecuting misdemeanor and felony cases.As a judge, she presided over a large misdemeanor criminal docket.  In addition to the duties of her regular criminal docket, she also had been heavily involved in specialty courts. She created, implemented, and presided over the Community Veterans Court; a specialty treatment court designed to help effectuate treatment for Veterans coming through Metropolitan Court.  She created and implemented the Courts to School Program where Defendants are sentenced in front of high school and college students with the purpose of educating and deterring the students from drinking and driving.  She also served as Presiding Judge of the Domestic Violence Early Intervention Program (EIP). She served as presiding judge over the criminal division of the Metropolitan Court and served as chief judge as well, managing a C-Suite and staff of over 300 employees.  In 2021, Judge Engel became an executive leadership coach, working with law students, judges, attorneys, and business leaders. She completed her coach training and received her certification from ICF as an Associate Certified Coach (ACC) and is currently pursuing her PCC. She has completed the Train the Trainer Program through the Justice Coaching Center and now trains and supports the implementation of coaching programs in judiciaries around the nation. She specializes in leadership/ performance coaching and transformational transition coaching. She regularly presents at legal conferences in the areas of leadership and well-being.Pamela Moore, LPCC, CCTP currently serves as a Licensed Professional Clinical Counselor, Certified Clinical Trauma Professional and Director of the State Bar of New Mexico's Legal Well Being Department where she educates the legal community on positive health and well-being and assists in providing resources and services to any legal professional struggling with mental, emotional or behavioral issues.  Ms. Moore served as an advisory member to the National Commission on Lawyer Assistance Programs in 2019, 2020, and again in 2026 and is the current New Mexico representative for the Institute for Well Being In Law. Eduardo Ramirez is an Assistant Public Defender with the Law Offices of the Public Defender in the Hobbs Office. Eduardo joined the LOPD family in February of 2021 after relocating to New Mexico at the end of 2020. Eduardo earned his law school degree from the University of Colorado Law School, graduating in May 2019. He is the first in his family to not only graduate from college, but also law school. Since as far back as he can remember, Eduardo has always had a passion for helping individuals who are underprivileged and impoverished. Growing up in poverty himself, he saw many people struggle with the criminal justice system and just how important effective representation is. As an adult, Eduardo has learned the importance of self-care, to continue representing clients to the best of his ability. He helps with their criminal case but also makes efforts to better their lives. Eduardo is a zealous advocate, and his goal is to eventually rid the notion of a “public pretender.” Luckily, he has amazing mentorship and colleagues down in Hobbs who help him, and he would not be the attorney he is, without them!
