Today, Hunter sat with Josh Occhiogrosso-Schwartz, a Principal at the Wren Collective, to discuss their recent report on flat rate Public Defender contracts in California. Long time listeners of the show will recall that the American Bar Association discourages the use of flat rate fees because of the negative economic incentive it creates for the attorneys working under those contracts. In what will come as a surprise to no one who studies Public Defense, the Wren Collective examined the 24 counties in California who utilized flat rate contracts for their Public Defender needs, and they found a system that wholly failed to protect the right to counsel. From a lack of investigators to minimal oversight over specific attorneys, these flat rate contracts are failing the counties in California. Fortunately, there is a bill pending in the state that may see the use of these contracts come to an end. Joel David Lesses is President and Executive Director of Education Training Center, Inc. and his work experience is in education, psychology, and counseling for people marginalized by trauma, addiction, and psychological distress. He is deeply vested in addressing the effects of mental health distress and its marginalization including, incarceration, homelessness, and institutionalization. Joel is dedicated to reframing mental health distress as a potential spiritual marker and existential opportunity. He holds dual Master of Science degrees from University at Buffalo in Rehabilitation Counseling and Biomedical Sciences with a concentration in Epidemiology. Henry Cretella, M.D. studied and practiced Tibetan Buddhism for several years along with training in martial arts. He then immersed himself in the more universal Sufism of Inayat Khan, an Indian mystic, for close to twenty years. He functioned as a senior teacher in the Inayati Order and the Sufi Healing Order before pursuing his independent practice and study of mysticism. He now integrates what he has learned and experienced over these many years. He graduated from Vanderbilt Medical School and completed his psychiatric training at Strong Memorial Hospital of the University of Rochester in Rochester, NY. His professional career spanned over 40 years as a general and child and adolescent psychiatrist and included teaching, administration, clinical practice and consultation in the greater Rochester and western NY areas. This, along with his spiritual and especially mystical interests lead him to certification as a mind body practitioner through the Center for Mind Body Medicine and Dr. James Gordon. He retired several years ago from active psychiatric practice, but continues to incorporate what he has learned into his spiritual practices and offerings.
Today, Hunter spoke with Julie Ciccolini, the CEO of Techtivist. When she was working as a paralegal at the NY Legal Aid Society, Julie, like so many in a Public Defender Office, realized that there was immense amounts of data on police misconduct that was going un-used. So, Julie helped to set up a database that allowed Public Defenders to track and use this data in their cases. Realizing that this issue extended far beyond New York, Julie founded Techtivist as a way to help Public Defenders set up and utilize databases that keep track of police misconduct. Today, Hunter spoke with Heather Rogers and Caitlin Becker of the Santa Cruz County Public Defenders. In 2020, the Sixth Amendment Center put together a report detailing the severe issues with how Santa Cruz County provided Public Defense. At the time, a law firm was working a flat rate fee contract to provide public defender services in the county. As is expected, that system was deeply flawed and couldn't meet the demands of the Sixth Amendment. Fast forward five years, Heather, Caitlin, and the team at the Santa Cruz County Public Defender has transformed the office into a comprehensive holistic defender program. How did that happen? If you’re accused of a crime, having the right to an attorney - regardless of ability to pay - is one of your fundamental constitutional due process rights in the U.S. At least in theory. In reality, Oregon - like many states around the country - has long suffered from a shortage of defense attorneys. In 2018 the shortage had become so severe that the nonpartisan nonprofit Sixth Amendment Center, found the state’s system so flawed it could not provide citizens with this fundamental right. Oregon has taken steps to restructure public defense and provide more funding for more public defenders, but the shortage remains. We talk about what state lawmakers are currently considering and more with Carl MacPherson, the executive director of Metropolitan Public Defender, and Kevin Barton, district attorney for Washington County.

Katie Lee, 39, of Holland was arrested early Friday morning following a 911 call in which she reportedly told dispatchers she “couldn't get her son to stop breathing.” Police say Lee's 17-year-old son, identified as Austin Pikaart, died from a severe cut to his throat after mother and son purportedly attempted to overdose on medication together. Detective Sgt. Brent Sluiter told the court that Lee admitted she used a knife to cut her son's throat while he was unconscious. Investigators also noted stab wounds on the teen's arm. “The caller Katie Lee told dispatch that she couldn't get her son to stop breathing,” Sluiter testified at Lee's arraignment. “She advised her son asked her to help him stop breathing because he did not want to turn 18.” Officers with the Holland Department of Public Safety were called to an apartment in the Bay Pointe Apartment Complex at about 4:15 a.m. Lee reportedly confronted officers at the door with a knife, prompting them to deploy a Taser. After taking her into custody, investigators allege Lee told them she had hoped the officers would kill her so she could “be with her son.” Lee appeared in court via Zoom on Monday, sobbing during the nearly 10-minute hearing. Holland District Judge Bradley Knoll ordered her held without bond, noting that Lee initially refused to speak to the Public Defender's Office and a bond screener. Although hesitant, Lee eventually agreed to have a public defender assigned. Family members in the courtroom were heard saying, “We love you, Katie,” as the hearing concluded. A date for Lee's next court appearance has not yet been scheduled. She also faces a charge of resisting and obstructing an officer after allegedly threatening police at the scene. Today, Hunter spoke with Lisa Maguire and Harpreet Samra of the San Mateo County Private Defender Program. Unlike the normal contract Public Defender model, the PDP operates as a managed assigned counsel system. As the Chief Defender, Lisa, manages a group of private contractors who handle the Public Defender needs of the county. This grants here significantly more oversight than in a traditional Private Defender System. Harpreet is the lead for the PDP's Social Worker program, and she ensures attorneys connect with Social Workers in their cases. From each of their areas of expertise, Lisa and Harpreet are working to correct the issues documented with PDP over the years. Today, Hunter spoke with Travis Weiner the former Colorado Public Defender suing the State Public Defender for wrongful termination. As a Colorado Public Defender, Travis reached a point where he estimated he would need more than 4,000 hours to complete the cases assigned to him. At that point, Travis believed he had an ethical obligation to withdraw from a newly assigned case. Unfortunately, the Colorado State Public Defender did not support him. Instead, they fired him. Irene's older sister, Rhonda Campbell, shares her experience with losing Irene and how she witnessed her parents having no power within the criminal justice system. Deputy District Attorney Courtney Martin outlines the different DUI/DUID charges and potential sentences to highlight how the laws and criminal justice have changed since Irene was killed. The laws and penalties are much harsher, with the possibility of filing murder charges as the DA's Office has successfully done in many DUI/DUID cases. Rhonda talks about how her personal experience losing her sister to a DUI offender led her to become a MADD victim advocate. She explains what her role entails, different programs and services MADD offers and how she works with the DA's Office on prevention efforts. She also shares information about MADD's annual candlelight vigil and how people can get involved. Courtney speaks to the different prevention programs the DA's Office hosts and participates in with partner law enforcement agencies, the Public Defender's Office, Probation Department, the court and community organizations, including Arrive Alive, CA and MADD. The emphasis for both MADD's and DA's Office prevention efforts is on high school students and teen drivers. The episode ends with Larry, Kathy and Rhonda asking listeners not to let another family go through what their family has endured and not to drive while impaired and help others not to make that dangerous decision. In this episode of Beat the Prosecution, Bryan joins Fairfax criminal and DUI defense lawyer Jonathan Katz in discussing how to beat the prosecution both in court and through out-of-court action, action, and more action, including with strength in numbers and having a great team of lawyers and non-lawyers. Bryan is a founding member of Justice Forward Virginia , which has made huge inroads in bringing Virginia out of its capital punishment dark ages and away from its Jim Crow past, to promoting winning legislation that reduces police ability to racially profile and keeps their power better in check, and eliminates presumption of pretrial detention for certain alleged crimes; and supporting robust indigent defense and challenging mandatory minimum sentencing. He underlines how some of the greatest criminal defense lawyers start as public defender lawyers and do not have to leave their principles at the door by starting as a prosecutor instead. He is fully bilingual in English and Spanish, which is a major asset in this county with so many people who speak Spanish (and so many other non-English languages) as a first language. Bryan is a true believe in the criminal defense cause, and is not afraid to stand up to judges and everyone else in the process.
