Art Spitzer for four decades served as the legal director of the American Civil Liberties Union of the national capital area. Fairfax, Virginia criminal and DUI defense lawyer Jon Katz has known Art since before the time Jon served on that group's board for three years in the early 1990's, and through that experience has met such great civil libertarians as Art Spitzer, Eugene Fidell (a dean of military criminal defense lawyers), and Mary Jane DeFrank, who for years served as the affiliate's executive director. Art tells a fascinating story about how he started his post-law school career in a traditional path of serving as a federal judicial law clerk followed by doing litigation with one of the nation's most prestigious corporate law firms, except he did not personally care whether his corporate clients won or lost, even though he was professionally invested in their winning. He did enjoy the pro bono work his law firm did for such groups as the ACLU. Attending college in the 1960's, Art witnessed the political demonstrations of the time, and ultimately he learned that the D.C. ACLU was hiring a replacement legal director, a job that he loved throughout. Art won the essential Ake v. Oklahoma, 470 U.S. 68 (1984), which provides that when the defendant's sanity at the time of the alleged crime is likely to be a significant defense at trial, the government must pay for a psychiatrist to assist on the issue for an indigent defendant. Our recent previous podcast guest Stephen Bright thirty-three years later won McWilliams v. Dunn, 582 U.S. 183 (2017), which breathed further strength into Ake. Hear Art and Jon discuss the overlap between the First Amendment and criminal law, demonstrators' rights, and the ACLU's opposition to criminalizing the possession (versus production) of child pornography. When Jon asks how to beat the prosecution or any litigation opponent, Art sticks to fully preparing and fully serving clients. A housing support manager is delighted by the Government's commitment to move whānau with children out of emergency housing sooner. Under the new plan, families who've been living in emergency accommodation for at least 12 weeks will jump to the top of the social housing wait list. But the Opposition says the Government is simply planning to shift people from emergency housing into non-existent social housing. City looked likely to have to settle a replay after missing a succession of chances before Ake scored their first goal at this stadium after five successive defeats with two minutes left as Spurs keeper Guglielmo Vicario failed to hold Kevin de Bruyne's corner under pressure from Ruben Dias. It was a bitter blow to Spurs after a defiant rearguard action but just reward for City, who had been the better side only to miss the opportunities that had come their way before Ake bundled home from close range. Spurs barely registered an attack threat, while City had an early Oscar Bobb strike ruled out for offside, Vicario also saving well from Bernardo Silva. De Bruyne was uncharacteristically wasteful with a golden opportunity after Pierre-Emile Hojbjerg had gifted possession to Phil Foden. In a dramatic finale, with a replay looking certain, Ake struck to spark wild scenes of celebration among the 9,000 City fans who had made the journey to north London. In this episode, we meet Thweep Rittinaphakorn, also known as Ake, in Bangkok, and explore his collection of photographs from Myanmar during the colonial era. Ake is an expert in Myanmar textiles who ventured into collecting photography and released a photobook from a very different background. His collection is fascinating and multi-layered, as he doesn't approach his images from a pictorial point of view but rather through an examination of materiality. ASX 200 up 63 points to 7489 (0.8%) in another strong across the board rally. RBA minutes helped, BoJ staying pat helped and takeovers helped. Solid gains across the board. The Banks continue to march higher, CBA up 0.6% and WBC charging 0.8% ahead. The Big Bank Basket up to $189.23 (+0.5%)). MQG kicked and insurers firmed, QBE bouncing 3.9%, SUN up 2.2%. REITs also in demand, GMG up 2.0% and SCG better by 0.3%. Industrials grinding higher, TCL up 1.7% WES up 1.3% and ALL up 2.0%. QAN slipped slightly down 1.7% with Tech better, WTC up 1.1% and XRO rallying 1.6%. Healthcare also better, CSL up 0.6% and RMD finding buyers up 0.6%. In resources, iron ore miners hitting highs despite Singapore iron pre slipping again. BHP up 0.6% and FMG up 1.1% putting Krug on Twiggy's table. Gold miners slightly positive, NST up 1.4% with lithium stocks mixed. LTR up 11.3% as shorts worry about Gina and Albemarle teaming up perhaps. AZS up 1.7% as SQM and Gina teamed up with a $1.7bn bid. Oil and gas stocks better on Red Sea issues, WDS up 1.7% and BPT finishing 3.2% higher. In corporate news, AKE shareholders say yes, here at least, AGL up 0.6% on plans for its 500MW battery plant. GEM surged 13.6% on a marked improvement in the second half, PFP buying 3 funeral business, and ORG up 3.2% after getting its hands on another GBP280m investment in Octopus (UK). On the economic front, RBA minutes out, considered a rate rise but as we know didn't raise rates. Somewhat sidelined now, ANZ-Roy Morgan survey out, slight improvement, Japan kept policy on hold for the third or fourth decade. Tech held up on lower rates, WTC up 0.1% with the All-Tech Index up 0.2%. Resources mixed, PLS up 1.3% and AKE running 1.7% higher ahead of the vote this week, Iron ore miners mixed, Oil and gas faltered, WDS down 0.3% and STO falling 1.6%. Gold miners flat and coal mixed. In corporate news, LNK had a bid from Mitsubishi, up 27.0%, ABC saw the Barro Group bid 320c in cash, up 31.3% and PSQ also saw a NBIO rally 18.0%. ZIP fell 2.4% on a funding package. TAH up 23.1% after saying it would keep its Victorian wagering and betting business. SGP fell 3.6% after announcing a deal to buy 12 LLC communities. Nothing substantive on the economic front. The ASX 200 rose only 4 points to 7199 (0.1%) after a promising start was ambushed by resource stocks falling. Lithium and gold stocks fell with some of the big lithium names seeing selling resume. NEM down 1,2% and NST off 2.1%. Oil and gas saw some buying, WDS/STO both slightly better with KAR up 0.5%. Banks up but off highs with the Big Bank Basket stable at $182.79. MQG fell 0.1% and insurers eased back slightly. Healthcare was better with CSL and RMD up 0.3% and REITs mixed, GMG down 0.4%. Industrials flat amidst pockets of strength, WES up 1.1% and WOW up 0.8%. Tech mixed with the All-Tech Index unchanged. In corporate news, PGH saw another bid from Kin at 84c, up 22.6%, BUB unchanged on a trading forecast update, CGC fell 3.9% as the outlook dims, SKC has settled with Macquarie over its car park stoush. ASX 200 romped ahead by 117 points to 7178 (+1.7%). All is forgiven after the losses of yesterday, even lithium staged a significant comeback. This despite falls in international lithium stocks. AKE up 3.0%, PLS up 5.6% with some large blocks traded, MIN rose 4.2% with iron ore miners not even stirred by news from RIO on Simandou, RIO up 0.7% and BHP rising 1.5%. Base metals better, Gina will be happier as LTR rose 6.1% and CHN up 10.8% on access permits. Gold miners mixed with EVN dropping 13.0% on the placement and acquisition fallout. Looks overdone. NST up 1.0%, and oil and gas stocks rallied too. WDS up 1.1%, and BPT rising 1.4%. BPH continued to backfill down 9.6%. Banks shot up, with NAB leading the way, up 1.9% and CBA up 1.6%. The Big Bank Basket up to $182.15 (+1.6%), with MQG up 1.8%. REITs kicked, GMG up 1.8% and SCG up 3.7%. 10-year yields down to 4.3%. Other financials also doing well, PPT up 6.3% and MFG up 3.6%, with its latest FUM up despite outflows. Healthcare better, CSL rallying another 1.7% with RMD up 0.9%. Industrials firmed across the board, TLS up 1.9%, TCL up 0.7% and staples rallying hard, WOW up 1.9% and COL up 2.4%. Tech sparking higher, WTC up % and XRO up %. The All-Tech Index up 1.7%. In corporate news, EVN was the standout story, Chemist Warehouse is heading for a reverse takeover listing through SIG. EDV held an update with a hotel earnings target of $150m. WDS signed a sales deal with Mexican Pacific. On the economic front, GDP expanded 0.2% in the third quarter, less than the previous quarter's 0.4% and consensus. Nathan Ake is the latest guest on the Official Man City Podcast. The Dutch international joined the Club in 2020 from Bournemouth and, over the following three years, has become a key figure in Pep Guardiola's all-conquering side. His versatility, consistency and intelligence have been of immense value to a City side consistently challenging on multiple fronts, with Ake often called upon to play in a number of defensive roles. It hasn't always been smooth sailing for the Dutch international though, and he discusses the important words of encouragement he received from Pep Guardiola after an injury-hit first season at the Etihad in 2020/21. The defender has more than repaid the manager's faith during his time at the Club and played the full 90 minutes in our historic Champions League triumph over Inter in June. The National Party says RNZ board member Jason Ake did the right thing in stepping down. Ake resigned from the board after criticism of his public commentary about former justice minister Kiri Allan by the board chairman Jim Mathers and the Prime Minister. Ake said he resigned after just a month in the job because he wanted to leave with his "principles and values firmly intact". Ake says he did not want to step back from highlighting Māori mental health and the devastating effects it has on whānau in Aoteaora. National's broadcasting spokesperson Melissa Lee spoke to Ingrid Hipkiss.

Meditation has the power to reconnect you to your breath, your life force, and it has the ability to help you stay grounded and clear about what's most important to you. In a world filled with toxic distractions, it's imperative that you maintain control of your mind if you're going to be a happy, healthy and productive member of society. Especially now as we experience rapid change to our way of life. In this episode, I share the story of a Thai soccer team who was trapped for two weeks in a flooded cave in Mai Sae, Thailand. Their coach, 25 year old, Ekkapol "Ake" Chantawong, a former Buddhist monk, taught the boys how to meditate in an effort to stay calm and conserve energy. It's a story of hope and survival. Additionally, I recommend two books that I believe will help you develop a more hopeful mindset and guide you in developing a regular meditation practice; Man's Search for Meaning by Viktor Frankl and Buddha's Brain by Rick Hanson.
