A Civil Action (1998) is based on Jonathan Harr's critically acclaimed book of the same name. Written and directed by Steve Zaillian, the film starts John Travolta, and features supporting performances by Robert Duvall (who was nominated for an Oscar), William H. Macy,  James Gandolfini, John Lithgow, Kathleen Quinlan, and Tony Shalhoub. The film tells the true the story of the court battle over environmental pollution in Woburn, MA, in the 1970s and 1980s, where trichloroethylene (TCE), a solvent used in industrial operations, contaminated the local water supply, leading to numerous fatal cases of leukemia (including in small children) and other health problem for Woburn residents. Personal injury lawyer Jan Schlichtmann, brought suit on behalf of a group of victim families against two large corporations, Beatrice Foods and W.R. Grace, to hold them responsible for the pollution (a third company previously settled). But the suit ran into dogged resistance from large and powerful law firms on the other side, including WilmerHale (then Hale and Dorr) and one of its star litigators, Jerome ("Jerry") Facher (Robert Duvall). The film offers a dark view of the U.S. legal system's ability to uncover the truth and provide justice to victims. The City of Tshwane says it is going to take civil action against the South African Municipal Workers Union for damages caused by the strike. Workers affiliated to SAMWU have been on an unprotected strike over salary increases since July. The strike turned violent with some of the city's infrastructure damaged and vandalised. Corp., No. CV 18-392-GBW, 2023 WL 346243, at *2 (D. Del. Jan. 20, 2023) (“Out-of-Circuit caselaw, while more on point, has been inconsistent. In 1987, the Ninth Circuit held that a district court did not abuse its discretion when the court quashed a subpoena under Rule 45 directed towards a corporation because it had “discovered no authority ... for the proposition that the Rule 30 standards [that permit subpoenas upon a corporation] should govern Rule 45 subpoenas of witnesses.” Donoghue v. Orange Cnty., 848 F.2d 926, 932 (9th Cir. 1987). In 2013, a California district court distinguished the Ninth Circuit's ruling as having “emphasized a trial court's discretion” and as coming prior to 1991 amendments to Rule 45. See HTC Corp. v. Tech. Properties Ltd., 2013 WL 12166376, at *2 & n.9 (N.D. Cal. Sept. 20, 2013). That case relied, in part, see id., on a 2013 case, Conyers, in which a district court also required a corporate party to “comply with [a Rule 45] subpoena by producing its corporate representative at trial[,]” Conyers v. Balboa Ins. Co., 2013 WL 2450108, at *2 (M.D. Fla. June 5, 2013). However, the Sixth Circuit, in 2015, appeared to reject the Conyers decision and stated that a party which seeks to have a corporate representative testify at trial has two options: “subpoena a corporate witness who either ‘resides, is employed, or regularly transacts business in person' in [the state]” or “take[ ] a deposition of a corporate officer during discovery for its use at trial.” Hill v. Homeward Residential, Inc., 799 F.3d 544, 553 (6th Cir. 2015) (quoting Fed.R.Civ.P. 45(c)(1)(B)). The Sixth Circuit, however, held that the “subpoena failed several aspects” of Rule 45, and concluded that “the district court did not abuse its discretion in enforcing [Rule 45] as written.” Id. at 552–53")Hill v. Nat'l R. R. Passenger Corp., No. CIV. A. 88-5277, 1989 WL 87621, at *1 (E.D. La. July 28, 1989) (“Rule 30(b)(6) specifically applies to the deposition of a corporation. Rule 45 of the Federal Rules of Civil Procedure provides the proper procedure by which a person may be compelled to testify at a trial. There is no provision allowing the use of the 30(b)(6)-type designation of areas of inquiry or allowing service on a corporation through an agent for service of process in order to compel a particular person, who may be a corporate employee outside the subpoena power of the court, to testify at the trial. Further, plaintiff has not pointed the Court to any specific authority allowing such a procedure nor has the Court found any authority supporting the plaintiff's position. Accordingly, for the above and foregoing reasons, IT IS ORDERED that the motion of Amtrak to quash the subpoena directed to the National Railroad Passenger Corporation be hereby GRANTED and the subpoena is hereby QUASHED.”)Hill v. Homeward Residential, Inc., 799 F.3d 544, 553 (6th Cir. 2015) (finding that rules must be enforced as written, and rejecting what it called an effort to take a 30(b)(6) deposition in the middle of trial; held“Hill tries to avoid these conclusions by urging us to “temper[ ]” the “technical” Rules by interpreting them “through the lens of common sense.” Appellant Br. 24. But these rules were not made to be “tempered”; they were made to be “technical”—from the specific amount of fees tendered, to the court issuing the subpoena, to the geographic scope of the request. It is not surprising, then, that Hill can point to only one case that supports his position, Conyers v. Balboa Ins. Co., No. 8:12–CV–30–T–33EAJ, 2013 WL 2450108, at *1 (M.D.Fla. June 5, 2013) (using Rule 30 to expand Rule 45). Even if that case persuaded us that the Rules should be modified by judicial fiat, the district court did not abuse its discretion in enforcing them as written”)Smith v. Royal Caribbean Cruises, Ltd., 302 F.R.D. 688, 694 (S.D. Fla. 2014) (“Here, the use of a Rule 30(b)(6) notice upon unnamed Defendant corporative representatives, for designated testimony at trial, is both improper and ultimately unnecessary. Defendant must have a corporate representative at trial and certainly Plaintiff can call on that representative as a witness in his case in chief. By doing so, Plaintiff can obtain the testimony he now seeks through this notice. But what he cannot do is use a discovery device—a Rule 30(b)(6) notice—under the guise of a trial subpoena. The mother screams at the firemen her baby has been stolen and refuses to believe her 10-day old infant perished. 6 years later she finds out what actually that evening of the fire and it is shocking. 1945 in West Virgina a family wakes up to their home filled with smoke and flames. It takes 7 hours for help to arrive. By 8 a.m the Sodder family's home has been reduced to ashes. Not everyone made it. 5 children who were assumed to be dead in the fire were not. Mark discusses with us the unintended consequences a PFA can create in many areas of the law. Mark practices in the area of civil litigation with a particular emphasis on family law. He has lectured throughout the Commonwealth and has written extensively on family law. After serving as judicial clerk to the Honorable Mason Avrigian on the Montgomery County Court of Common Pleas, Mark was associated with Abrahams and Loewenstein, and later chaired the Domestic Relations Group at Riley, Riper, Hollin & Colagreco. "Tender Mercies" (1983) is about a former successful musician named Mac Sledge (Robert Duvall) who lost everything good in his life due to alcohol. When the film opens, he and a friend are staying in a motel, getting drunk and fighting while the proprietor, Rosa Lee (Tess Harper), and her young son, Carl (known as Sonny, played by Allan Hubbard), watch from their porch. When the friend skips out before paying the bill the next day, Mac offers to work for Rosa Lee in order to compensate for the room. She agrees, but tells him that he can't drink while he's working there. Thus begins Mac's slow streak of improving his life. He sticks with sobriety, marries Rosa Lee, and starts writing music again. It's the kind of movie that's not really plot-driven … more slice of life, at arm's length, character study about Mac's quiet redemption. Other highlights are Betty Buckley, who plays Mac's successful country star ex-wife, Dixie, and Ellen Barkin as Mac's estranged teen daughter, Sue Ann. The screenplay is written by Horton Foote, who won the best adapted screenplay Oscar for “To Kill a Mockingbird” in 1962. He also won a best original screenplay Oscar for “Tender Mercies” in 1983 and has a Pulitzer Prize for drama for his play, “The Young Man From Atlanta” and an Emmy for a TV adaptation of William Faulkner's “Old Man.” The director, Bruce Beresford (who we completely forgot to mention by name — sorry, Bruce), is probably best known for “Driving Miss Daisy” (1989), although my personal favorite film of his is “Double Jeopardy” (1999). Here are some things we mentioned during the episode and/or that we think you should check out: Norman K. Denzin's article in The Sociological Quarterly that provides a feminist close-reading of the film. Unfortunately, you need access to JSTOR to read it, but if you email me (lindsay@womaninrevolt.com), I can send you a copy. 1991 Robert Duvall interview on "Later with Bob Costas" 2002 Horton Foote interview at the Austin Film Festival Tess Harper presenting an award to Bruce Beresford at the 2010 Woodstock Film Festival Some interesting trivia: Duvall's only Oscar is for this film. He had been nominated for the following films (but did not win): “The Godfather” (1972), “Apocalypse Now” (1979), “The Great Santini” (1979), “The Apostle” (1997), “A Civil Action” (1998), and “The Judge” (2014). Duvall's contract stipulated that all of the songs had to be sung by him. “Over You,” the song Dixie performs at the Opry, was also nominated for an Oscar. Duvall wrote two of Mac's songs, "Fool's Waltz" and "I've Decided to Leave Here Forever.” Others were country classics and not written for the film. Universal Studio lost faith in the film after it performed poorly at test screenings. They also sort of ignored Willie Nelson's offers to promote the film. David Lynch was a contender for director at one point. Can you imagine this film with him at the helm? Actually, it probably would have been like “The Straight Story" (1999). The film was selected to screen in competition for the prestigious Palme d'Or (Golden Palm) Award at the Cannes Film Festival in 1983. Robert Duvall made his official cinema movie debut as Arthur "Boo" Radley in “To Kill a Mockingbird” (1962), whose screenplay was written by Horton Foote. Horton Foote and Duvall worked together on five projects: “TKAM,” William Faulkner's “Tomorrow” (1972), “Tender Mercies,” “The Midnight Caller” (play, 1958 debut), and “The Chase” (1966, based on his 1956 novel). Tess Harper and Bruce Beresford worked together on three films: “Tender Mercies,” “Crime of the Heart” (1986), and “Alibi” (1989).  Jeannine Oppewall was hired as art director. Beresford praised her as "absolutely brilliant," especially for her attention to very small details, "going from the curtains to the color of the quilts on the floors." It was Oppewall who named the motel Mariposa, Spanish for "butterfly," which symbolizes the spiritual resurrection Mac Sledge would experience there. Oppewall has four academy award nominations for best art direction:  "Seabiscuit" (2003), "LA Confidential" (1997), "Pleasantville" (1998), and "The Good Shepherd" (2006).

Among the exceptions: Sean Penn and co-director/producer Aaron Kaufman, who were on the ground in Kyiv when Russia invaded Ukraine on Feb. 24. The pair had been filming a documentary for Vice centered on the comedian-voice actor-turned-politician. In the early days of the war, Zelensky shared with Kaufman one of Zelensky's plans for resisting the Russian onslaught, which Kaufman then passed on to Ankler Editor at Large and Ankler Hot Seat podcast host Tatiana Siegel in the hopes it would be shared. The campaign, conceived by Zelensky and his leadership, is called “Your Business Smells Russian” and its objective is to limit the activities of international businesses in Russia and thus financially choke and pressure Russian leader Vladimir Putin.On the podcast, Siegel talks about her text exchanges last week with Kaufman, who told her that “Zelensky was hoping to get [a series of talking points] out to the world.”Here's the memo Kaufman says Zelensky asked him to share. Kaufman delivered the memo through a series of texts:The “Your Business Smells Russian” campaignInsight: At a time when states are banding together and making significant efforts to create sanctions for Putin's Russia, most Western companies continue to do business in Russia, following business as usual policies. They continue to bring in significant revenues to the budget, perform an important public function of "universal approval" in society, while declaring the importance of values for modern life.There is a policy of double standards, instead of support by actions, they close activities in Ukraine, (Coca Cola, Uber, McDonalds) motivated by military actions, they close in Ukraine, but not in Russia.Task:1) To show that this policy, just business, does not work in the modern business, in which values should be above all.2) To show global consumers that money earned in Russia is “bloody and toxic money”.Objective:To limit the activities of businesses in Russia, the outflow of finance/capital.Campaign:Your Business Smells RussianActions:1) Use well-known celebrities (e.g. Richard Branson) who could denounce double standards. Generate a large number (assault) of inquiries to companies in different countries about the ethics of doing business in Russia;2) Consumer reactions/boycotts to goods/services in their countries.3) Requesting ethic[al behavior] through national company forums.Examples of the depth of the problem:McDo - made $2.5 billion in Ru(ssia) last year;Coke - made $2.6 billion in profits for the quarterWhile it is unclear if Hollywood power brokers also received the memo, it appears that they got the message. A number of studios announced that they are “pausing” films scheduled for release in Russia including The Batman, Lost City and the Michael Bay action pic Ambulance. Similarly, Netflix put the kibosh on four series scheduled to shoot in Russia. “We're not talking China numbers, but you can have sizable box office performances in Russia,” Siegel noted during the podcast. “For example, Joker made $37.2 million in Russia, and something like The Batman, which has been paused, would likely be comparable.”In this episode, Siegel talks with co-hosts Janice Min and Richard Rushfield about Hollywood's big reaction to the ongoing crisis and contrasts that with its continued silence on Russia's ally, China, in addition to other entertainment headlines of the day. Western diplomats in South Sudan have said the government should respect freedom of expression, including the right to peaceful protest.Their joint statement follows the arrest of a number of activists in the wake of a call by a group calling itself People's Coalition for Civil Action, which is allegedly planning an anti-government protest on Sunday.The diplomats said freedom of expression was needed in parliament and in society at large, adding that freedom of assembly must also be protected.They pointed out that these were universal rights enshrined in South Sudan's transitional constitution.

South Sudan's government has vowed to foil anti-government protests called for by a group of activists on Monday.The People's Coalition for Civil Action wants the president and his first vice-president to step down.They accused President Salva Kiir and First Vice-President Riek Machar of frustrating the people of South Sudan.Juba Mayor Kalisto Lado Faustino says his administration will restrict any gathering of two or more people in the city on Monday.Mr Lado described the group calling for the protests as people who are against the implementation of the revitalised peace agreement.
