Title Nerds hosts Mike O'Donnell and Bethany Abele welcome special guest Mike Ham, the “Coolest Guy in Title Insurance,” to the podcast, along with fellow Riker Danzig attorney Desiree McDonald. In the first segment, the Title Nerds hosts interview Mike Ham, who is a commercial real estate title insurance sales executive with Fidelity National Title Group and hosts a wildly popular podcast, “The Morning Spotlight Podcast,” in which he brings on interesting guests in real estate and other industries. Mike talks about how he started in the title insurance industry, what sparked his podcast, how he helps his clients, and what it takes to be a successful title insurance salesperson. Then, Riker title team associate Desiree McDonald discusses the case of U & Me Homes, LLC v. Cty. of Suffolk out of New York State (148 N.Y.S.3d 682 (N.Y. Sup. Ct. July 16, 2021)) in which the Court held that a purported restrictive covenant on the property was void and granted the property owner's motion for summary judgment. In the case, the plaintiff had purchased an undeveloped parcel of land in Southampton that was split-zoned, with both portions permitting residential development. When the plaintiff decided he wanted to build a single-family home on the property, he learned of a developmental restriction that would make his property of zero value. The deed and title search report, however, had not contained any reference to any development restrictions, and indeed, the property had been transferred numerous times previously with no reference to a restriction. The action was brought alleging that the covenant failed to run with the land and that the restriction was against public policy. The Court, very displeased with the County and Town, found no intent for the restriction to run with the land, and said the County and Town had overstepped their bounds and had reversed the role of government. The Town and County then went after the title companies for coverage, and the Court decided that if money was ever to be paid, it should be by the government, not by the insurance companies, something not seen very often in Court's opinions.

Great chat with long time Woodlands native Dr. Jesse Robinson. Jesse is a good friend of mine that I always admired and respected from a far. We would occasionally have students in common that we were both servicing in the public education sector. He was always a little different from other people that held the position of LSSP. He was warm, caring, and always seemed to suggest educational strategies that would benefit our students in a real world manner. We would sit in ARD meetings together and instead of rambling educational jargon he would get to the nuts and bolts of how we could help service the student. He briefly left that position and found his way into the traditional classroom setting which taught him a about children in general. He would take this knowledge and further his education to where he is now. Aside from his professional life he is a well respected husband, father, and coach in our Woodlands community. I am blessed to call him friend and wish him the best moving forward.

Gary currently serves as Regional Counsel for Fidelity National Title Group and has been in the title insurance industry for nearly 40 years, previously holding the role of State Counsel for FNTG. He has served as counsel for Commonwealth Land Title and Chicago Title in the 1980s and 1990s. He later joined Lawyers Title, where he served as agency manager for both Lawyers Title and Commonwealth Land Title. Gary served as president of the New Jersey Land Title Association (NJLTA) from 2002-2003. Mike and Gary take it all the way back to his childhood, growing up in Pompton Plains, attending the University of Scranton, working for IBM, then attending law school. There Gary met the love of his life and Mike's Mom, Linda, who he has been married to for almost 37 years. Gary provided some great perspective on life and working throughout this episode. In 2001 Aleks stopped in Vancouver on his way to Los Angeles with an impressive resume and ready to take on Hollywood when the most horrible event in America's recent history struck. 911 changed the way anyone could enter the states and so Aleks found himself a new home and career in busy Vancouver. Since coming to Vancouver Aleks has built an amazing resume with over 100 credits, most of which are lead and recurring roles like the one that he has on this hugely anticipated 4th season of 'Continuum'. Aleks credits three occurrences as the game-changers in his rocketing career: One was when the venerable acting coach Larry Moss called him out in front of 300 actors, telling him that he had massive talent and demanding to see his full range; another was when he respectfully declined an offer for a 4-episode-arc on a highly-rated TV series so that he could finish his run as 'Danny' in the play "Danny and the Deep Blue Sea" in a shaky old theatre to sold-out crowds. But the biggest catalyst in Aleks's career was when he fought three rounds of casting throughout all of Los Angeles and Vancouver to win the role of 'Tom', a developmentally disabled man accused of murder in 'Personal Effects' starring Ashton Kutcher, Michelle Pfieffer, and Kathy Bates. Aleks put on 65 pounds to perform the role, which was one of the most challenging and rewarding roles of his career so far. When you meet Aleks, or you watch him perform these difficult roles, you just know that with all of that leading man charisma there's star power in this man, and that you will be seeing a lot more of Aleks Paunovic.
