Through the separation of powers, the Founders fully intended for each branch of government to be combative with the others.  This fighting amongst the branches, they hoped, would protect our liberties and inhibit abuse of power.  Each presidential administration must deal with the judicial branch in implementing their agenda, when cases involving their agenda are brought to court. This is what we are discussing today.  To help us understand the intricacies of the current judiciary and executive relationship, we are pleased to have as our guest a veteran of all three branches.  Professor John Yoo is currently the Emanuel S. Heller Professor of Law at the University of California, Berkeley.  He previously clerked for Justice Clarence Thomas on the Supreme Court, was general counsel for the Senate Judiciary Committee and worked in the George W. Bush administration as a deputy assistant attorney general.

Over the past couple of weeks, there have been several developments in the litigation surrounding the Trump Adminsitration’s directives pausing disbursements of foreign development assistance funds.On February 25, 2025, a D.C. District judge ordered the Administration to issue a portion of the payments that it had previously sought to pause by the next day (that is, by 11:59 p.m. on February 26). The Trump Administration appealed to the Supreme Court requesting an administrative stay, which the Chief Justice granted on a temporary basis as the application was referred to the full Court. On March 5, 2025, a 5-4 Court vacated the stay granted by the Chief Justice, leaving in place the February 25 order (though it noted the deadline stated therein had passed and the lower court needed to give clarity as to the requirements that still remained for the Government) and the initial February 13 temporary restraining order which initially enjoined the Administration from enforcing its earlier directives to pause all aid payments.Join us for a litigation update on this case as we discuss the various orders, the move by the Court to vacate the stay, and what may happen next.Featuring:Erin M. The Heritage Foundation is honored to announce that Professor John Yoo, the Emanuel S. Heller Professor of Law at the University of California at Berkeley, will deliver this year's Edwin Meese III Originalism Lecture for his speech titled, “Can Originalism Be Moral?”This annual lecture seeks to honor former Attorney General Ed Meese's legacy of advancing an understanding and jurisprudence of originalism. When the Framers wrote the Constitution, “Their intention was to write a document not just for their times but for posterity,” Meese said in a 1985 speech to the D.C. Chapter of the Federalist Society Lawyers Division. Meese reiterated the theme of Original Intention in several speeches, warning of the danger of “seeing the Constitution as an empty vessel into which each generation may pour its passion and prejudice.” The Great Debate that he launched over three decades ago placed the idea of judicial originalism at the center of American jurisprudence and fundamentally altered the constitutional landscape of this nation.Today, originalism is no longer a novel concept; instead, it is now widely embraced in legal circles, including academia and the judiciary. Building on the work of Ed Meese, this lecture aims to continue the conversation he started and examine new trends and themes in originalist thought today. Please join us for our third annual lecture.Professor John Yoo: In addition to his role as the Emanuel Heller Professor of Law at the University of California at Berkeley, Professor Yoo is also a Nonresident Senior Fellow at the American Enterprise Institute and a Visiting Fellow at the Hoover Institution, Stanford University.Throughout his career, Professor Yoo served in all three branches of government. The Rich Zeoli Show- Full Episode (01/11/2024): 3:05pm- On Wednesday night during a campaign appearance in Windham, NH, former New Jersey Governor Chris Christie announced he is suspending his campaign for the Republican presidential nomination. A recently released University of New Hampshire/CNN poll indicates Haley is trailing former President Donald Trump by only seven-points in the New Hampshire Republican presidential primary—39% to 32%. Interestingly, Christie is garnering 12% support. Could Christie's absence put Haley over the top in NH? 3:15pm- Just prior to announcing the suspension of his campaign for the Republican presidential nomination, Chris Christie was caught on a hot microphone saying that Nikki Haley is going to be “smoked” in the upcoming Iowa caucus and New Hampshire primary. Does this make endorsing Haley, as many presumed he would, impossible now? 3:20pm- On Thursday, Donald Trump's team delivered its closing arguments in a civil fraud trial in which New York Attorney General Letitia James alleges that the former president inflated the value of assets controlled by the Trump Organization in past financial statements. If Trump loses the case, he could face up to $370 million in fines and penalties as well as being permanently prohibited from doing business in the state of New York. Notably, in 2018, while campaigning to become Attorney General, James vowed to “sue” Trump—providing evidence to the defense's argument that this civil suit is entirely political.   3:40pm- Jonah E. The Rich Zeoli Show- Full Episode (05/17/2023): 3:05pm- On Tuesday, former City Councilmember Cherelle Parker won the Democrat mayoral primary in Philadelphia—and is expected to win the city's general election in November. She would be the first woman to become Philadelphia Mayor. Notably, Parker campaigned on ending safe injection sites, restoring stop-and-frisk policies, and hiring more police officers to help combat crime throughout the city. With 87% of the total vote reported, Parker received 33% of the vote. Meanwhile, despite support from Senator Bernie Sanders (I-VT) and Congresswoman Alexandria Ocasio-Cortez (D-NY), progressive candidate Helen Gym earned just 21.3% of the vote. Is this the end of Gym's political career? It's unlikely. She's already rumored to be a U.S. Senate candidate in the event Bob Casey Jr. (D-PA) decides not to seek reelection in 2024. 3:25pm- On Tuesday, President Joe Biden met with Speaker of the House Kevin McCarthy (R-CA), House Minority Leader Hakeem Jeffries (D-NY), Senate Majority Leader Chuck Schumer (D-NY), and Senate Minority Leader Mitch McConnell (R-KY) in hopes of successfully negotiating a debt ceiling increase. John Yoo served as general counsel of the US Senate Judiciary Committee under its chairman, Orrin Hatch of Utah. And he has been a law clerk for Supreme Court justice Clarence Thomas and US Court of Appeals judge Laurence Silberman. Socialism vs. The American Constitutional Structure: The Advantages Of Decentralization And Federalism | John Yoo Socialism is finally getting the American honeymoon it never got in the last century. But American federalism's division of power between a national government and fifty sovereign states makes difficult, if not impossible, the unified economic planning necessary to supplant capitalism. Decentralization of power, the Constitution's Framers hoped, would not just promote government effectiveness but would also protect individual liberty by encouraging Washington and the states to check each other. Our Constitution's fundamental decentralization of power does not prevent many Americans from wishing for socialism anyway. A 2019 Gallup poll found that 43 percent of adults believed socialism to be “a good thing” and 47 percent even reported that they could vote for a socialist candidate for president. While a bare majority still opposes socialism, that view loses popularity among younger Americans. Since 2010, their attitude toward capitalism has deteriorated to the point that millennials view both capitalism and socialism with equal favor at about 50 percent. That contrasts with baby boomers, who support capitalism over socialism by 68–32 percent, and Gen Xers, whose support is 61–39 percent.
