The Rich Zeoli Show- Full Episode (02/13/2023): 3:05pm- On February 3rd, a freight train consisting of roughly fifty rail cars—ten of which were carrying hazardous materials—derailed in East Palestine near the Ohio-Pennsylvania border. According to reports, emergency crews purposefully ignited the contents of several rail cars, attempting to burn-off toxic chemicals. According to The Hill, three more hazardous chemicals have been discovered at the scene of the derailment. Meanwhile, Tom Perkins of The Guardian reports one of the chemicals released is phosgene, which “is a highly toxic gas that can cause vomiting and breathing trouble, and was used as a weapon in the first world war.” Should residents be concerned about health consequences? 3:20pm- On Sunday afternoon, United States fighter jets shot down a fourth mysterious flying object—this time flying 20,000 feet above Lake Huron, Michigan. In a news conference following the shootdown, Air Force General Glen VanHerck suggested the objects did not pose a military threat—though, he would not speculate on the origins of the objects. For eleven years the Obama Administration used a supercomputer called The Hammer to spy on American citizens. The collusion delusion is over.”With these words, President Donald Trump opened a raucous rally in front of more than 15,000 enthusiastic supporters in Grand Rapids, Michigan on March 28, celebrating the release of the report by special counsel Robert Mueller on March 22. According to the summary submitted by Attorney General William Barr, Mueller found no evidence of collusion, nor of obstruction of justice, thus vindicating Trump's repeated claim that the investigation was a “witch hunt.” In his remarks, Trump did not merely proclaim vindication. He issued a call to action, asking those at the rally to join him in defeating the anti-Trump coup plotters, who are foolishly continuing their campaign to remove him from office. He forcefully denounced leading Democrats, such as Representatives Adam Schiff and Jerrold Nadler, who are using House committees to expand the “investigation.” Trump said they “need to decide whether they will continue to defraud the public,” now that Russiagate has been exposed as a fraud. He also excoriated the media, and intelligence officials who served under President Obama, such as former CIA Director John Brennan and former Director of National Intelligence James Clapper, suggesting that both of them could be prosecuted for lying, and using their positions to illegally unleash the witch hunt.In an interview with Fox television's Sean Hannity before the rally, Trump stated that he will soon release all documents related to the attack on him, including those compiled by the FBI, which used the fictional dossier written by “former” British MI6 operative Christopher Steele, to get surveillance warrants from the secret FISA court, as well as the “302” reports on FBI interrogations, text messages and emails from the coup plotters, and more. “I have plans to declassify and release,” he said. “We must never let this happen to another president. I hope they don't get away with it….It's an investigation that should never have happened.” In particular, on the role of corrupt leading officials of the FBI who were part of the coup apparat, he said, “They wanted to do a subversion….It was treason. It was really treason.”That Trump survived the persistent and vicious assault against him is in itself quite remarkable. He had to endure years of media leaks and lies, attacks on his family, his businesses and his associates, many of whom were threatened and bullied, to get them to turn against him, as his former attorney Michael Cohen did. Mueller also secured fraudulent indictments of “Russians” for cyber meddling, which will never be tested in court, and convictions for “process crimes” unrelated to the assignment given him. Yet, in his final report, Mueller was forced to admit there was no proof that Trump colluded with foreign efforts to steal the 2016 election. This conclusion represents a harsh blow to the anti-Trump fanatics committed to his impeachment, leaving them reeling, stammering that they will “go further” than the special counsel in their hysterical resolve to overturn their defeat by Trump in the 2016 election. The Schiller Institute's Helga Zepp LaRouche, who has taken the lead in exposing the fraud behind the attempted coup, said in a webcast on March 28 that it is not surprising that Trump's opponents will continue, as the report “did not lead to the desired result,” i.e. his removal! But now is not time for complacency, she added. Instead, “Now is the time for reckoning” for those who ran the attempted coup.WHO AND WHY MUST NOW BE ANSWEREDIn her March 28 webcast, LaRouche made clear that she is not talking about revenge in pursuing the coup plotters, but of something more profound, which is a matter of war and peace. How? Because Trump now does everything he can to prove he's not a Putin puppet — even if it brings us closer to nuclear war.” Gabbard is the only true anti-war candidate among the 16 to 20 Democrats who are campaigning for their party's nomination to run in the 2020 presidential election.In the West, other than Mrs. LaRouche, Rep. To be clear, yes, globalists are a very real group with a very real agenda, and this agenda is not morally or rationally sound.The argument then arises – “If globalists are a real threat, then we should identify them one by one…”This argument is often a ruse which insinuates that if a person points out the facts surrounding a crime on the part of globalists, his position is still not valid until he names them all in succession. This is a classic Alinsky tactic; to demand that the researcher catalog every person involved in a conspiracy or present a perfect solution to the criminality which may or may not be available, otherwise they should shut up and stop talking about the problem. The intent is to get us caught up in the weeds debating the extent of who is involved or whether one solution is superior to another.Acknowledging that a specific agenda exists is the first step before anything else can be accomplished.Obviously, one cannot outline a long list of globalist names in every essay or article. This would make each article dozens of pages long and is counterproductive. And, as our social and economic structures grow more unstable, people look for easy answers and the idea is starting to gain some traction. Their claim? It's all about the Jews, all the globalists are Jewish or somehow secretly related to Jews or are married to Jewish partners, etc. This is simply false, so let's get this out of the way…The Jewish conspiracy narrative, I believe, is 4th generation warfare, a psychological operation, an attempt to mislead liberty movement activists away from a much deeper and darker issue. It also may be an attempt to attach the movement to white supremacy or white identity groups as if they are interchangeable. Frankly, I do not care what other people believe as long as they keep to themselves and leave others alone. If someone takes special pride in their pigmentation or culture, great, I wish them the best of luck. It is true that some cultures function better than others, but this has far more to do with the superior cultures being more free.Just because we have a distaste for the race baiting insanity and hatred of white people or western culture displayed by the social justice left, this does not mean we need to swing to the other extreme and become zealots ourselves. I actually think the ability to discriminate at times is highly useful, but such simplistic divisions based on bias and broad generalizations make us weak, not strong. It makes us easy to conquer, not a formidable opponent to the globalists.Here are the facts:The vast majority of globalists are not of Jewish origin and are not zionist in their political affiliations. While there are sectors of globalist institutions that have more Jewish people than others (such as the Federal Reserve), this does not indicate a majority or any sort of broad “Jewish conspiracy”. On the contrary, the directorial boards and memberships of most globalist institutions have a small minorities of Jews, and are majority Anglo in origin. One can simply look at the board of directors of groups at the top of the globalist pyramid like the International Monetary Fund, the Bank for International Settlements, or World Bank and verify that this is the case.We can also examine the attendees of past globalist summits like the Bilderberg Group, or the World Economic Forum in Davos and see that again, some Jews might be involved, but are not a majority or even in the highest positions of authority. While the Rothschild family (Jewish) gets a lot of attention as being a major power center within globalist circles, we can see they are but one influence among many.These people herald from all over the world, and are of every ethnicity and national affiliation one can imagine. So, the broad brush of white identity conspiracy becomes rather useless in helping us figure out who the globalists truly are. It actually misleads us and points us in the wrong direction, and perhaps this is its underlying purpose.The fallback argument is that they might not be majority Jewish, but they are all “zionists”; which, again, is simply not true. Zionism is definitely a globalist scheme, but more of a side venture designed to manipulate some Jews and evangelicals into zealotry, to be exploited in supporting efforts like war in the Middle East. Zionism itself actually makes Jewish centers like Israel less safe and more prone to destruction. The globalists only care about Israel or the Jewish people in general in so much as they can be used as a tool for other more important efforts.And, while I have criticized the actions of the Israeli government on many occasions (and been accused of being an anti-semite for it), this is not the same as attacking the Israeli people. Globalism threatens them just as much as it threatens others. I welcome readers to look over the rosters of many of the top globalist organizations; they will find a minority of zionists, not a majority.If it's not about the Jews or zionism, then what is globalism really all about? It is vital that we look at the intent, actions, motivations and beliefs of these people. Hyperfocusing on their genetic backgrounds will get us nowhere. How do we know when we are dealing with a globalist? Let's look at some of the real and universal elements that make globalists an organized and identifiable culture, separate, distinct and destructive…Globalism As An “Inevitable” FutureGlobalists will often claim that globalism, the centralization of all governmental and economic power, is an inevitable byproduct of “progress”. They will state, without any evidence of course, that globalism represents a pinnacle of evolution in human society. Therefore, anyone that stands in the way of globalism is standing in the way of progress, which is apparently a cardinal sin in the new world order.But centralization of power is nothing new, and dreams of global empire ruled by self appointed “elites” goes all the way back to Plato and his “Republic”. Utopia by the elites for the elites is a tale as old as mankind. It does not represent evolution, but regression to an ideology that human beings have been struggling for thousands of years to escape from.We should also make the distinction here between globalists and useful idiots. Globalists are people in a position of power adequate enough to help affect the the changes and agendas they describe. Useful idiots (socialist/communists) might espouse globalist rhetoric, but they have no power. They are exploited as a blunt weapon by globalists, but they are not globalists, and will not likely benefit from globalism in the end.End Of SovereigntyGlobalists treat the idea of sovereignty with disdain. Their attacks usually revolve around nationalism and they will incessantly pontificate on the virtues of open borders. They can also sometimes be caught criticizing the concept of individual sovereignty, but they do seem to fancy the idea that THEY are unique and superior individuals. Individuality and freedom are meant for them, but not for the rest of us.Single Economic Authority And Monetary SystemA key element of globalism is economic centralization which makes perfect sense when you understand that trade is the root of human civilization and survival. Trade is almost as important as the air we breath and the water we drink. The consistent plan presented by globalists is that the IMF in particular must become the bottleneck point for global economic management, and that all the world's major currencies will be absorbed by the IMF into their SDR basket system.This would give the IMF the ability to dictate currency exchange rates on a whim, allowing them to homogenize currency values until they are so similar that a single world currency becomes a natural next step. This final product would be a cashless society, based on a digital blockchain-based currency or cryptocurrency.Single World GovernmentGlobalists all argue that the answer to most of the world's ailments is one world governance, or the end of nation states and cultural divisions in the name of “peace”. The UN is so far the impetus of this effort, but it is shadowed by various organizations like the IMF, BIS, World Bank, as well as dozens of think tank organizations like the CFR, Tavistock, the Trilateral Commission, Bilderberg, Darpa, etc., etc. A practice model for this type of government can be seen in the European Union, which is controlled by a supranational bureaucratic machine run by mostly faceless officials who are not elected and who do not answer to the public.Globalists have different terms for the shift into a single world government or single currency system. They call it a “global reset, or a “new world order”, or a “multipolar world order”. But all of these marketing labels are basically referring to the same thing.Close AssociationAny politician that works closely with globalist institutions or think tanks is likely a globalist. Any politician or government official that associates regularly and cooperates with known globalists is probably also a globalist.Environmental Crisis As Hegelian ThreatNot all globalists hit on this topic publicly, but most do. The strategy, which was planned by the Club Of Rome along with top globalists like former UN Director Robert Muller, was to create the idea of an environmental threat so potentially devastating that the only option would be for the public to accept global governance as the solution. Global warming and “climate change” became that existential threat.It does not seem to matter how often or how brutal the climate change argument is debunked by real data; the globalists desperately push the ideology. It is a primary key to everything they hope to accomplish in terms of centralization, and their timeline is set for the year 2030. Globalists also seem to enjoy fabricating fake moral dilemmas which force people to choose between one evil solution or another. The fake moral dilemma here being that if we do not accept global centralization and elitist management of the planet, we are risking the destruction of our environment on an apocalyptic scale.Psychological Similarities Of GlobalistsProbably the most overwhelming epiphany I have come to in my 12 years of analysis into globalism and the nature of evil is that globalists are in fact tied together by a root mental illness or psychological aberration. This occurred during my research on narcissistic sociopathy, or what some circles might call “psychopathy”. Criminology indicates that not all criminals are full blown narcissistic sociopaths, but most full blown narcissistic sociopaths are criminals. Some are simply more successful criminals than others, and this usually depends on their ability to blend in and mimic or manipulate normal people.Full blown narcissistic sociopaths (or psychopaths) make up around 1% of any given population, but are responsible for the vast majority of violent crimes or criminal enterprises. The lion's share of justice system resources are used in dealing with these people, as they are four to eight times more likely than the average person to use violence in daily interactions or as a tool to gain advantage, and twenty-five times more likely to end up in prison.There is a long list of character traits that make a narcissistic sociopath, but the defining features are a complete lack of conscience and empathy, a propensity for moral relativism (the ability to rationalize any and all destructive behavior), a desperate need to be adored or admired by everyone around them, a feeling of being “more special” than most people, a feeling of superiority, delusions of grandeur or an inherent right to manage the lives of others, an obsessive need to control and manipulate, impulsive desires and deviant sexual inclinations, and elitist associations (they will only associate with people they feel are like them and are “equally superior”).A defining fact of narcissistic sociopathy is that these traits are inborn, not a product of environment. In some cases environment can play a role in activating these traits, but if a person is not born with them, they generally do not adopt them later in life because of a traumatic environment. The following documentaries linked here and hereare an excellent overview of high level narcissistic sociopaths.Narcissistic sociopaths defy all forms of treatment and cannot be reformed. They have no concrete personality beyond these traits, therefore, if you remove the traits, they are left with nothing else. They are almost anti-human; while most people are born with unique personality combinations, narcissistic sociopaths have none, so they mimic the personalities of those around them, mirroring behaviors and collecting or stealing quirks.Their primary drives are to fulfill their fantasies of superiority and godhood, as well as an endless quest to satiate their dopamine addiction. The more deviant the action, and the more successful they are at getting away with it, the more dopamine they generate and the more satisfied they feel. This leads to an endless cycle, seeking out more and more exploitation of others which becomes less and less satisfying, which leads to even greater deviance.I came to realize in my studies that these characteristics described almost exactly the observable behaviors of globalists. The difference being that globalists were so high functioning that they had actually built a society of narcissistic sociopaths that operated like a kind of cult, or a corporate entity. The only other historic example I could compare it to would be the mob, or other gangs which have blended into the surrounding normal society and operated in their midst.I do not know if a society of narcissistic sociopaths with its own tribal customs, mythologies and beliefs has ever been recorded before. While psychopathic people have been known in the past to organize into groups for mutual benefit, the globalists are something different. They are an anomaly; a well maintained culture of parasites that has blended almost seamlessly within normal society in order to feed off of non-psychopathic and empathetic people. The best fictional representation I can think of is the vampire. They are so similar I sometimes wonder if folklore creatures like vampires were based on narcissistic sociopaths as a way to warn people of their presence.Globalists are indeed a culture, a secretive and occult phenomenon that wants so badly to be recognized and worshiped, but fears public scrutiny. Their motivation at bottom is to condition or tear down normal, moral and free society until it becomes a place in which they can openly be what they really are without fear of judgment or consequences. Jim Geraghty of National Review and Greg Corombos of Radio America applaud President Trump for backing away from next month's summit with North Korean leader Kim Jong-Un, proving he is not desperate for deal and keeping Kim off balance. While denouncing kneeling during the national anthem as the time or place to make a protest, they also slam Trump for suggesting maybe NFL players who kneel for the national anthem "shouldn't be in the country." And they unload on former Director of National Intelligence James Clapper for randomly concluding that Russian efforts to meddle in the 2016 campaign definitely made the difference in Michigan, Wisconsin, and Pennsylvania and flipped the election results from Hillary Clinton to Donald Trump. Jim points out that Clapper and other Trump critics simply refuse to believe that voters made a choice they don't like.
Yeah, that last one got me too. It appears that in an attempt to make the shutdown sound as bad as humanly possible CNN may have overstepped in it's reporting when it suggested an asteroid might strike earth while NASA's program to monitor the sky was on hold. I question the need for the program at all given the fact that there's nothing you can do about it if a gigantic rock decided to crash into earth. Better to just live in blissful ignorance. ***We're also talking FISA and the memo floating around claiming widespread abuses. What I find funny is CNN again decided to refute the claims by bringing on disgraced Director of National Intelligence James Clapper to claim he knew of no abuses while serving as DNI. Luckily he's not under oath this time, so when the truth comes out, he won't be eligible for another purgery charge. ***Finally, we'll turn to California where a couple of economically illiterate assemblymen want a new 10% tax on any business that nets over a million dollars a year. You'd think people would learn from the mistakes of the past, so they don't repeat them, but most of the politicians I've known seem to live in a kind of reality denial that allows them to support and promote the most ridiculous ideas for the sake of their ideology. While traveling on Air Force One this week in Asia, President Trump lamented the fact that Russia’s Vladimir Putin is insulted by United States accusations that Russia meddled in the 2016 Presidential election. Trump contended that Putin’s bruised feelings would prevent him from making “deals” with the US concerning Syria and North Korea. The President also referred to former Director of National Intelligence James Clapper and former C.I.A. Director John O. Brennan as “political hacks” and that the investigation into Russian meddling is an “artificial Democratic hit job.” The next day, Pres. Trump adjusted his comments to say that he was not supporting the views of Putin but was instead just acknowledging his beliefs. This latest “dust-up” again brings to focus the tenuous relationship between the U.S. and Russia and the strange relationship between the country’s two leaders. To put this ongoing relationship into focus, Spectrum podcast talked with international expert and specialist in Russia/Soviet and East European history Dr. Steven Miner. He is also a professor at Ohio University. Miner says that Putin is a far better political tactician than Trump but that, overall, he has not proven to be a good strategist. Miner describes the tenuous nature of the Russian economy and its suffering from U.S. sanctions. He also notes that Russia has dedicated part of its military strategy to cyber warfare and cyber interference with other nations’ electoral processes…especially the U.S. and others in Western Europe. Putin feels that effort has been successful. This tactic costs little money but causes major upheaval – as evidenced by the current U.S. Congressional and legal inquiries. Miner also suggests that we watch for Russia to acquire more adjacent territory while the U.S. is preoccupied with N. Korea and our internal investigations into Russian meddling. Miner is an award winning author and is putting the finishing touches on his latest book called “The Furies Unleashed: The Soviet People at War, 1941-1945.”

Rosenberg NEWS ROUNDUP Defense Secretary Ashton Carter, Director of National Intelligence James Clapper, and members of the intelligence community want President Obama to fire National Security Agency Director Admiral Mike Rogers, according to Ellen Nakashima at The Washington Post. Clapper and Rogers cite numerous instances of security breaches under Rogers' watch, including one by Booz Allen Hamilton contractor Harold T. Martin III, who was arrested in August for the largest ever theft of classified government data. There was also another breach in 2015 allegedly carried out by an individual whose name has not been disclosed, but who has since been arrested. President-elect Trump is considering putting Rogers in charge of all 17 U.S. intelligence agencies, and Congressional Republican leaders have come out in support of Rogers, including California Representative David Nunes who also serves on Trump's transition team, who praised Rogers in the Washington Post. Rodgers is also the head of U.S. Cyber Command. Ash Carter has not been impressed with Rogers' performance in that role, either, as the cyber command's operations in Syria and Iraq have been largely unsuccessful, according to Carter. Further annoying Carter and Clapper is the fact that Rogers met with Trump last week unbeknownst to the White House. Further complicating matters, Clapper and Carter are also looking to split Cyber Command from the National Security Administration, a move opposed by Senate Republicans including John McCain. Meanwhile, as Mallory Shelbourne at The Hill reports, at a news conference in Peru last week, President Obama called Rogers a "patriot". In separate comments, Obama told German newspaper Der Spiegel that he had no plans to pardon Edward Snowden. The president said Snowden would first need to appear before a court. -- Mark Jamison, a member of Trump's tech policy transition team, suggested in a blog post last week that maybe the FCC shouldn't exist. Jamison wrote, "Most of the original motivations for having the FCC have gone away." He also said there are few monopolies in telecom, an assertion with which FCC Chairman Tom Wheeler has disagreed. Brian Fung has this story in the Washington Post. -- A new Stanford University report found that most students from Middle School to college are unable to tell the difference between sponsored content and real news. The study of 7,804 students found 82% could not tell what was sponsored and what was real. Seventy percent of middle schoolers also found no reason to distrust a finance article that was written by the CEO of a bank. Amar Toor has the story on The Verge. -- Downloads of the encrypted messaging app Signal have soared by 400% since Donald Trump's election, according to Signal founder Moxie Marlinspike. Governments have the ability to tap unencrypted text messages for intelligence gathering. Paresh Dave has the story in the LA Times. -- Following a successful effort to get the FCC to clear its entire November meeting agenda, House Energy and Commerce Committee Chairman Fred Upton and Senate Commerce Committee Chair John Thune have now asked Federal Trade Commission Chair Edith Ramirez and Consumer Product Safety Commission Chair Elliott Kaye not to move forward on any controversial regulations. Upton and Thune wrote that the American people decided to make a change on November 8th and that agencies should this refrain from passing new regulations. Trump, of course, lost the popular vote by over 2 million. -- Finally, FCC Commissioner Ajit Pai issued a statement last week praising Trump's Department of Justice nominee Jeff Sessions. The Washington Post reports that Sessions is widely seen as a climate change skeptic and his entire career has been dogged by accusations that Sessions is a virulent racist, which cost him a federal judgeship back in '86. Sessions has been quoted as saying that he thought the Ku Klux Klan was "okay, until he learned that they smoked marijuana." Pai is reportedly on the short list to become Trump's nominee to Chair the FCC.

Trudeau NEWS ROUNDUP A BuzzFeed analysis of news stories appearing on Facebook found fake news stories received more engagements during the final three months before the presidential election than news stories from the leading real news outlets. The difference was some 1.4 million combined likes, shares and comments. At a news conference in Germany, President Obama expressed concern about the spread of fake news saying Q“If we are not serious about facts and what's true and what's not ... if we can't discriminate between serious arguments and propaganda, then we have problems". On the Washington Post's The Intersect Blog, a fake news writer by the name of Paul Horner, who has written numerous fake news stories which have gone viral, expressed regret for the stories he wrote and said he thinks President-elect Trump won the election because of him. Facebook CEO Mark Zuckerberg was initially dismissive, saying the week before last that the notion of fake news having impacted the election in any significant way is a "pretty crazy idea". Since then, Zuckerberg has announced initiatives to identify fake news, such as through user generated reports. Meanwhile, a group of students participating in a hackathon at Princeton last week developed a Chrome plug-in that allows users to assess the veracity of news stories. -- Policymakers are increasingly concerned about the role that mobile apps play in distracted driving incidents. The National Highway Traffic Safety Administration says that between January and June of this year, highway fatalities were up 10.4% to 17,775, compared to the same period in 2015. Neal Boudette reports in The New York Times on goals set during the Obama administration to eliminate highway fatalities by 2047. -- SnapChat filed for an initial public offering last week. The IPO is expected to be valued at around $20 billion. It is the largest IPO since Facebook's in 2012. Reuters has more. -- Director of National Intelligence James Clapper has submitted his resignation after a 50- year U.S. intelligence career. In October, Clapper's office formally concluded that Russia was behind cyberattacks intended to sway the U.S. presidential election, and that Rusian President Vladimir Putin has almost certainly approved them. Clapper told the House Intelligence Committee that submitting his resignation "felt pretty good." Greg Miller has the story at the Washington Post. -- A new Federal Rule of Criminal Procedure--Rule 41--which would give federal authorities sweeping powers to search devices, is set to go into effect on December 1st. Currently, federal judges can only authorize searches within their own jurisdictions. Once Rule 41 goes into effect, judges will have the authority to issue search warrants for computers located outside their jurisdictional boundaries, potentially allowing a single judge to issue searches of millions of computers. Civil rights groups are concerned about the rule would intrude on innocents, particularly communities of color. Senator Ron Wyden has proposed legislation to scale back Rule 41, but it hasn't even gotten a committee hearing. On Thursday, Delaware Senator Chris Coons introduced legislation that would delay Rule 41's implementation. David Kravets covers this for Ars Technica. -- Twitter has suspended several accounts linked to the alt-right--super-conservative ideologues, many of whom promote white nationalism. The Southern Poverty Law Center had asked Twitter to remove about 100 accounts expressing white nationalist views for violation of Twitter's terms of service. Among the suspended accounts -- Richard Spencer, President of the National Policy Institute--an organization whose website says is "dedicated to the heritage, identity, and future of people of European descent in the United States." Spencer said Twitter's deletion of his account was akin to a "digital execution". USA Today notes that Spencer has called for removing blacks, Asians, Hispanics and Jews from the United States. Twitter CEO Jack Dorsey also apologized last week for allowing an ad promoting a white supremacist group. Jessica Guynn has the story at USA Today. -- Amar Toor at the Verge reported that China has threatened to cut iPhone sales if President-elect Trump follows through on his threat to declare China a currency manipulator and impose a 45% tariff on Chinese exports. China also threatened to limit automobile and other sales. -- It appears that the Trans-Pacific Partnership--the trade deal that would have enhanced American ties with 11 countries, counterbalancing China's influence in the region--appears to have been defeated even before President-elect Trump has taken office. The deal simply doesn't have enough votes in Congress, and President-elect Trump has stated he would oppose the deal. Elise Labott and Nicole Gaouette reported this for CNN. -- The GOP has successfully forced the FCC to cancel nearly its entire November open meeting agenda, which was supposed to take place last Thursday. Up for consideration were bulk data caps, the Mobility Fund, and a proposed rule on roaming obligations of mobile providers. One Freedom of Information Act request remained on the agenda. Senate Commerce Committee Chair John Thune had sent a letter to the FCC Tuesday warning against “complex, partisan, or otherwise controversial items.” Massachusetts Senator Markey blasted Thune's heavy-handed approach, with Thune responding that he was only referring to the most controversial items. Brendan Bordelon has the story in Morning Consult. -- Finally, the hold on Commissioner Jessica Rosenworcel's nomination has been lifted. Democrats Ron Wyden and Ed Markey had put a hold on the Commissioner's nomination following her rejection of the set-top box competition proposal. Rosenworcel will need to be confirmed before the end of the Commission in order to stay on. Some analysts are speculating that Rosenworcel might vote in favor of the set-top box rules currently on circulation. Brendan Bordelon covers the story in Morning Consult.
Last week, the Aspen Security Forum featured interviews from a host of Obama administration national security officials, some of which we provided last week. This week is part II, wherein we share edited discussions from White House Homeland Security Advisor Lisa Monaco, Director of National Intelligence James Clapper, and Attorney General Loretta Lynch. Monaco's conversation with Mike Isikoff of Yahoo News ventures into the Administration's policy on ISIS and what she calls a "generational struggle," the trials of social media as a recruitment vehicle, and most interestingly, whether Obama would act unilaterally to move Guantanamo Bay prisoners to the United States. Clapper's discussion with Andrew Mitchell of MSNBC is most notable for his comments on lone wolf attacks and going dark, a threat about which he shares much of the same concern as FBI Director Comey. Later, Clapper touches on the OPM hack and why the United States is choosing to respond much more forcefully to economic espionage than "traditional" espionage. Finally, in her interview with Andrew Mitchell, Loretta Lynch walks us through the challenges of domestic terrorism, the Justice Department's approach to intvestigating and prosecuting home grown ISIS supporters, and the legal protections afforded to Guantanamo Bay detainees should they be moved to the United States.

H.R. 2048: USA Freedom Act of 2015 Title I: FISA business records reforms The government will need to provide "a specific selection term to be used for the basis" for the data being collected The term can't be the name of a telecom, unless that telecom is under investigation The term can't be a "broad geographic region, including the United States, a city, a county, a State, a zip code, or an area code" The term must be something that "specifically identifies an individual, account, or personal device." The government will have 180 days to comply after the bill is signed into law Limits ongoing phone call record collection to 180 days unless extended Orders the telecoms to keep secret the order from the government to turn over call records The Attorney General can require records be turned over in "emergencies" if he/she informs a judge and applies for the warrant within 7 days. If the warrant is denied, nothing collected under the Attorney General's emergency power will be admissible in court, "except with the approval of the Attorney General if the information indicates a threat of death or serious bodily harm to any person." The Attorney General will be in charge of determining if the standards above are met. Eliminates a clause that lets a judge immediately dismiss a protest from a company fighting a FISA order Gives immunity to any company that hands over information under a FISA order or an emergency order from the Attorney General Companies will be paid for "expenses incurred" producing the information or assisting the government with FISA or emergency orders "Call detail record" will not include the contents of the call, the person's name, address or financial information, or the cell phone's GPS location. The bill expressly says that nothing in the USA Freedom Act will limit the government's authority to get orders from the secret FISA court, as authorized in by the Foreign Intelligence Surveillance Act of 1978 Title II: FISA pen register and trap and trace device reform The Attorney General will get to determine the privacy procedures for the use of tracing devices installed to track phone numbers dialed in monitor Internet communications. Title III: FISA acquisitions targeting person outside the United States reforms "Limits on use of unlawfully obtained information" can be waived if the government fixes whatever illegal thing they were doing, which would allow information they collected before the fix to be used in court. Within 180 days after enactment, FISA court judges will pick at least five people to serve as amicus curiae - "friends of the court" - to argue on behalf of privacy and civil liberties. FISA court judges will write the rules for the amicus curiae participation. The FISA court gets to decide if the amicus curiae's participation is appropriate The Director of National Intelligence must make publicly available "to the greatest extent practicable" any FISA court decision that includes "a significant construction or interpretation of any provision of law" The decision, order, or opinion can be released to the public in redacted form The Director of National Intelligence can waive the requirement to make FISA decisions, orders, and opinions public as long as they say it's "necessary to protect the national security of the United States or properly classified intelligence sources or methods". Title V: National Security Letter reform National Security Letter (NSL): Letters served by the FBI to telecoms that allow the FBI to secretly demand data. There is a gag order on anyone who receives these letters, guaranteeing that the public is not told and that there is no judicial review. Allows NSLs to be issued for telephone, financial, and consumer records if the order "specifically identifies a person, entity, telephone number, or account as the basis for a request". There will be a gag order, preventing companies from telling anyone that the FBI is requesting the information, as long as the order also has a notification of the telecoms right to judicial review and if the FBI says disclosure could result in: "A danger to the national security of the United States" "Interference with a criminal, counterterrorism or counterintelligence investigation" "Interference with diplomatic relations" (new) "Danger to the life or physical safety of any person" Title VI: FISA transparency and reporting requirements Orders the government to submit a bunch of new reports to Congress Allows companies served with National Security Letters to publicly report approximately how many NSLs they've received They can only report the number of FISA orders and NSLs subject to a gag order to the nearest thousand They can only report the number of FISA orders and NSLs not subject to a gag order to the nearest 500. They can report twice a year on the total number of orders, directives, and NSLs served to the nearest 250 These reports are only allowed to cover NSLs for the previous 180 days Once a year, they can report on the total number of orders, directives, and NSLs they were required to comply with to the nearest 100 The FISA court, if their ruling "includes significant construction or interpretation of any provision of law or results in a change of application of any provision of this Act", will have to submit their decision or denial of disclosure petition to Congress within 45 days Title VII: Enhanced national security provisions Emergency monitoring of a person outside the United States is limited to 72 hours without a warrant Extends PATRIOT Act and Intelligence Reform and Terrorism Prevention Act of 2004 provisions until December 15, 2019. Title VIII: Safety of Maritime Navigation and Nuclear Terrorism Conventions Implementation Allows civil forfeiture of property of people suspected of trying to harm a United States ship Gives a fine of up to $2,000,000 and possible life in prison to a person who possesses radioactive material or a device with intent to damage people or property or someone who threatens to do so. On November 17, the United States' Office of the Director of National Intelligence (James Clapper) announced a new speech recognition initiative called ASPIRE. ASPIRE stands for Automatic Speech Recognition in Reverberant Environments. The goal of the initiative is for the intelligence community to improve its speech recognition capabilities in areas where acoustic quality is not optimal. This would allow any conversation within a certain range of a “networked microphone” to be “searchable in real-time.” Watch the report as we break down this and other technology advances that are forever removing privacy from almost all areas of our lives. The US is under pressure to respond to allegations of war crimes in connection with its air strikes on Syria. But how do you assess disproportionate harm when this entire assault is disproportionate and premised on undefined threats? Local residents in the village of Kafr Deryan recently video taped bits of a Tomahawk missile at the site of a strike that they say killed at least two men two women and five kids September 23. Only the US and UK have Tomahawks so Human Rights Watch is asking the US to investigate. The group is further demanding that international law be obeyed and strikes be avoided that might have a disproportionate impact on civilians versus the expected military advantage. Now I've always been skeptical of international laws of war. They tend to coddle the conscience and imply war can be made kind. But the problem here is even more specific. Even when Barack Obama launched his bombing campaign he made no claim of self defense. At that time, remember, American intelligence had concluded that ISIS posed "no immediate threat" to the U.S. so-called "homeland." In his speech, launching the attack, the president said exactly that. The no-threat story was front page news. Many officials and terrorism experts quoted at the time believed that the actual danger of ISIS had been distorted by hours of alarmist TV. An anti-terror analyst with the Rand Corporation was quoted by the New York Times, saying “It's pretty clear that upping our involvement in Iraq and Syria makes it more likely that we will be targeted by the people we are attacking.” And still the campaign was launched. All that history's worth remember because now officials and the press are full of talk of a brand new supposed threat, dire enough to merit the US assault. The Khorasan Group: supposedly a pack of Al Quaeda veterans whom the Administration say do intend to target the US. Frankly, when it comes to threats to the so-called "homeland" the White House seems way more vulnerable to the disturbed veterans of the US's own wars. No Al Qaeda vet has so far managed to open the front door and run through the place with a knife. Still the Director of National Intelligence James Clapper made it sound scary when he said “In terms of threat to the homeland, Khorasan may pose as much of a danger as the Islamic State.” Scary, Until you remember, that that's not saying much. The point is, proof of claim doesn't seem to be required for the US to bomb and kill; nor even any evidence of military advantage. In that Syrian village, it's the reverse. There, the Department of Defense says it has no credible proof of civilian deaths, despite video and eye witness reports. They do, on the other hand, claim that several strikes have “disrupted an imminent attack against the US and Western interests.” To all those who imagined the presidency of phantom threats was over with the departure of George W. Bush, that's over. The one threat that is very real is that the US public will be terrified by all this and the killing and dying will escalate. ..... On Monday, North Korea declared the 1953 Korean War armistice nullified. On Tuesday, Director of National Intelligence James Clapper emphasized the danger posed by North Korea's nuclear weapons and missile programs, calling them, for the first time, "a serious threat to the United States." "The rhetoric, while it is propaganda-laced, is also an indicator of their attitude and perhaps their intent," Clapper said. Is it time to start to take North Korea more seriously?
