Neste episódio conversamos com Valéria Scarance, Promotora de Justiça do Ministério Público do Estado de São Paulo (MPSP), sobre o combate à violência sexual no contexto brasileiro, seus impactos e estratégias de enfrentamento e a garantia dos direitos reprodutivos. Abordamos a decisão do Supremo Tribunal Federal no Habeas Corpus número 124.306 do Rio de Janeiro que versa sobre a inconstitucionalidade da incidência do tipo penal do aborto no caso da interrupção voluntária da gestação no primeiro trimestre e também os principais desafios do Ministério Público no acolhimento das vítimas e na promoção dos direitos sexuais e reprodutivos das mulheres; apresentamos a legislação correspondente sobre o tema e a relação do assunto com os Direitos Humanos, assim como os dados que mostram o alto índice de estupro contra crianças e adolescentes e ainda apontamos que grande parte desta violência ocorre dentro de casa ou por pessoas próximas à família. A convidada explica o que é estupro de vulnerável e a dificuldade da prova em tais casos, assim como em quais situações a legislação brasileira admite a interrupção da gravidez. Por fim, o preconceito contra a mulher, a cultura do estupro no Brasil, as políticas públicas de atendimento à vítima de estupro, a discussão nos Tribunais sobre o aborto e a necessidade de mudanças normativas e culturais para um efetivo combate à violência sexual. Neste episódio conversamos com Emerson Garcia, Promotor de Justiça do MPRJ, sobre os impactos do Pacote Anticrime na realização dos acordos de não persecução cível e seus desdobramentos frente a Lei de Improbidade Administrativa. A atuação do Ministério Público no estabelecimento desses acordos, bem como seus limites e possibilidades de aplicação nos âmbitos judicial e extrajudicial são abordados no decorrer deste episódio. O entrevistado, Emerson Garcia, foi integrante de comissão de juristas na Câmara dos Deputados para revisão da Lei de Improbidade Administrativa (Lei nº 8429/92) e autor da proposta do instituto de acordo de não persecução cível (ANPC), presente na Lei 13964/19 (Pacote Anticrime). No decorrer do episódio conversamos sobre a criação do instituto do ANPC, as condições necessárias para elaboração do acordo e seus limites. Abordamos também as diferenças entre o Termo de Ajustamento de Conduta e o ANPC, a necessidade de homologação judicial do acordo ou a sua celebração em juízo. As hipóteses de uso das informações obtidas em acordos frustrados, a inserção de terceiros nos ANPCs e a criação de acordos provisórios ou parciais também são debatidos. Neste episódio conversamos com Samia Saad Gallotti Bonavides, Procuradora de Justiça do Ministério Público do Estado do Paraná (MPPR), sobre a Justiça Restaurativa e sua importância para o restabelecimento do vínculo comunitário. Em tese de doutoramento em Ciências Jurídicas defendida recentemente na UENP, nossa convidada aborda detalhadamente o assunto. Como opção à ênfase punitivista vigente em nosso sistema de justiça, debatemos as principais vertentes de atuação da prática restaurativa para a resolução de conflitos, apresentando resoluções (CNJ 225/2016 e 288/2019) e jurisprudências em que sua aplicação se efetiva. Abordamos questões como a aplicabilidade da Justiça Restaurativa em crimes de menor ou maior potencial ofensivo, as principais diferenças entre a justiça retributiva e a restaurativa e seus possíveis resultados. Também apresentamos as vantagens da Justiça Restaurativa como meio de recuperação do infrator, em especial nos casos de infância e juventude. O debate sobre a aplicação de acordos de não persecução penal ou acordos restaurativos são elucidados perante a legislação do Pacote Anticrime. Por fim, a necessidade de mudanças normativas e culturais para uma efetiva aplicação da Justiça Restaurativa encerram as reflexões deste episódio. Neste episódio conversamos com o jurista Valerio de Oliveira Mazzuoli, professor de Direito da UFMT, sobre a aplicação do controle de convencionalidade pelas nações aderentes aos Tratados Internacionais de Direitos Humanos, no âmbito da Corte Interamericana de Direitos Humanos. Consultor jurídico internacional e conferencista, Mazzuoli é autor de diversos livros jurídicos publicados, com destaque para as áreas do Direito Internacional Público e dos Direitos Humanos, sendo referência constante na jurisprudência do Supremo Tribunal Federal. O caso Gelman vs. Uruguai, referente a uma brutal e trágica violação dos Direitos Humanos ocorrida na América Latina, é trazido ao debate. A construção histórica do controle de convencionalidade diante a atuação da Corte Interamericana e seu funcionamento frente às nações aderentes aos Tratados Internacionais de Direitos Humanos são abordados no decorrer deste episódio. A harmonização entre os tratados internacionais e as constituições nacionais, seus decorrentes conflitos (a Lei de Anistia no Brasil e a lei de caducidade do Uruguai, no caso Gelman) e o cumprimento ou não das decisões da Corte Interamericana de Direitos Humanos complementam o debate. Por fim, são avaliadas as possibilidades de atuação do Ministério Público em favor do exercício do controle de convencionalidade e os avanços e retrocessos recentes das nações parte nos Tratados Internacionais de Direitos Humanos ligados à OEA. Neste episódio conversamos com Antonio do Passo Cabral, Procurador da República do Ministério Público Federal no Rio de Janeiro, sobre as possibilidades de aplicação dos acordos processuais na atuação do Ministério Público. Professor de Direito Processual Civil da UERJ, Cabral é autor do livro “Convenções Processuais - Conforme novo CPC”, que serviu de referência para a elaboração da Resolução 118 do CNMP sobre a política de Autocomposição no âmbito ministerial. No decorrer do episódio abordamos a transposição do uso das convenções processuais do âmbito do Direito Privado para o Direito Público e o entendimento sobre essa mesma convencionalidade e os negócios jurídicos processuais no contexto do Direito Processual Civil. As orientações da Resolução 118 do CNMP, as inovações do novo CPC (2015) referentes ao tema e o Pacote Anticrime também são abordadas. Conversamos sobre os possíveis impactos destas normativas na celebração de acordos pelo Ministério Público, seus limites e possibilidades frente a garantia dos direitos fundamentais das partes envolvidas, a tutela coletiva e o princípio da indisponibilidade do interesse público. Neste episódio conversamos com Edilson Vitorelli, Procurador da República no Ministério Público Federal em São Paulo, sobre a tutela coletiva nos processos estruturais e na resolução de casos complexos, como os de saúde pública, tendo como referência a decisão da Suprema Corte dos Estados Unidos no caso “Pennhurst State School and Hospital vs. Halderman, 465 U.S. 89 (1984)”. Em sua tese doutoral, que resultou na publicação do livro “Devido processo legal coletivo: dos direitos aos litígios coletivos”, Vitorelli comenta o julgado estadunidense e estabelece parâmetros de análise comparada com as tipologias dos litígios coletivos. O debate sobre a desinstitucionalização psiquiátrica, como também a questão da pandemia do COVID-19, são abordados como situações em que a resolução de casos complexos demandam também o debate sobre políticas públicas para que a intervenção judicial permita uma solução coletiva para as demandas. Para tanto discutimos como a propositura de processos coletivos é feita no Brasil e nos Estados Unidos, quais contribuições o Brasil poderia adotar do modelo de outros países e como o Ministério Público atua nessas circunstâncias, tendo por base o Código de Direito Civil. Neste episódio conversamos com Leonardo Busatto e o Hugo Urbano, Promotores de Justiça do Estado do Paraná, sobre o tema da publicidade dos atos da administração pública, tendo como referência a decisão do Supremo Tribunal Federal na Arguição de Descumprimento de Preceito Fundamental (ADPF) nº 129. No caso em questão, foi reconhecida que o art. 86, do Decreto-lei n. 200/1967, que previa o sigilo da movimentação dos créditos destinados à realização de despesas reservadas ou confidenciais não foi recepcionado pela CF/88. A transparência nas contas públicas foi reconhecida como preceito fundamental da administração pública e o sigilo previsto não é compatível com a ordem constitucional. Também foram esclarecidos pontos como o acesso às informações de instituições públicas pelo cidadão comum, os mecanismos para obtê-las quando ainda não estiverem disponíveis publicamente, a regulamentação da publicização de dados e aspectos relativos aos portais de transparência. We dedicate this episode of the podcast to Chapter 9 - Hybridism in Darwin's Origin of Species (OoS). We all agree that this chapter is one of the most challenging chapters to read in OoS. In this chapter Darwin force marches the reader through example after example of hybrids while simultaneously admitting his ignorance on why these creatures should exist.It is not inherently obvious to the reader why they are being subjected to this catalog of biological anomaly and minutiae concerning pollination of orchids and other flowers but Darwin is adamant to share his knowledge, like a proud new parent inflicting others to look at numerous photos of their newborn. Darwin , early in Chapter I of OoS, argued against the notion that new species are formed through hybridization of existing species and we expected him to make that point in this chapter, but he never really does.It seems that by the end of the chapter we are exhausted from Darwin's recounting various animal and plant hybrids and admitting his ignorance of sterility in hybrids but that does not dissuade Darwin from concluding he was right all along - “…the facts given in this chapter do not seem to me opposed to the belief that species aboriginally [emphasis added] existed as varieties”. Darwin stays on point.We started off our discussion identifying our favorite hybrids. Josh first suggested mermaids as his favorite hybrid but James required he offer up a "real" hybrid.Mermaids James grew up with in FloridaJosh introduced us to the Liger, a hybrid between a male lion and female tiger both species have 38 chromosomes which also allows for reciprocal mating. Male tigers and female lions create tigons. The hybrid nomenclature is a portmanteau word derived from using the male species as the prefix and the female as the ending of the name hence a liger and tigon being separate types of hybrids.900 lb Hercules Sarah mentioned the Zedonk, a hybrid between a zebra and a donkey. This is another one of the hybrids that are created artificially in captivity. Few people realize that there are actually three different species of zebras - Grevy's, Plains and Mountain zebras - and each species has their own number of chromosomes. Grevy's zebras zebras have 46 chromosomes, Plains zebras have 44 and the Mountain zebra has 32 chromosomes whereas the donkey has 62.Image from Carole Coleman James suggested the Grolar, a hybrid between a grizzly and polar bear, was his favorite hybrid.A grizzly bear with her grolar cubsUnlike the liger and zedonk, the grolar occur in nature when the two species of bears interact. Historically grolar bears were less common since Grizzly bear distribution was further south than Polar bears but the warming of the climate has caused both bears to extend their range, polar bears southward and grolar bears northward, such they now more commonly overlap during the breeding season. Research suggests Polar bears "recently" diverged from brown bear ancestors with the speciation event occurring only 343,000-479,000 years ago. A mere blink of time in terms of the geological record.We discussed the most famous of all hybrids, the mule and how it is formed from the male donkey breeding with a female horse. Pictured below is a horse (left) and a mule (right) showing how the mule is often much larger than either of its parents, an example of Hybrid Vigor. picture by MerleWe noted that the mule hybrid can only be formed from male donkeys and female horses and rarely rarely formed from a male horse and female donkey. Sarah suggested that the reason the mule can only be formed from a male donkey and female horse has to do with the constraints of difference in gestation times between horses and donkeys. It turns out that horse gestation is 11-12 months whereas donkey gestation period is 11-14 months. There is a lot of overlap in gestation time between the two animals but it is an intriguing idea to consider it may influence non-reciprocal successful mating. We introduced the idea of prezygotic isolating mechanisms and how they would evolve to prevent hybrids from being formed. Behavioral isolation is frequently seen in the complex displays and calls given by a variety of birds species and James mentioned the beautiful flashing patterns exhibited by the different species of fireflies. Here is just one example of the size and complexity of the male duck penis which has evolved in response to female duck vaginas. Female ducks have evolved elaborate shaped vaginas to avoid fertilization from other species of ducks.This interesting topic is covered nicely in this short article here. Sarah spent some time explaining the intricacies of pollination and how pollen is actually greatly reduced multicellular structure that produces sperm - pollen is actually plant testicles. Plants evolve complex pollen grains, much like the extreme duck penis, to create reproductive barriers between species. The forms of inter-specific (between-species) barriers to reproduction would evolve because those individuals who are more discerning in their choice of mates would waste less time/energy fertilizing and producing those hybrid offspring which are often, at best, viable but infertile but more likely enviable. Often it is the female of the species that is the one who evolves the reproductive challenge for the male because she produces fewer, and often more metabolically expensive, gametes (eggs/ova) than her male (sperm) counterpart and therefore has more to lose if she errs on who she mates with than he. Public domain image (created by the Dartmouth Electron Microscope Facility) Ultimately we conclude that hybrids exist because Darwin was correct in his model of speciation, that is new species derive from varieties of preexisting species (see Chapter 4 blog post) so they share many of the common genetic traits with their ancestral or closely related species.
