Defamation Law in the Digital Age Main Themes: Balancing act: Defamation law seeks to protect individual reputations while upholding the First Amendment's free speech guarantees. Evolution of defamation: Traditional libel and slander laws are being challenged by the rapid evolution of online communication. Defining defamation: Understanding the elements of a defamation claim, including the distinction between fact and opinion and the varying fault standards for public and private figures. Defenses and Immunities: Exploring defenses like truth, privilege, and fair comment, as well as the implications of Section 230 immunity for online platforms. Key Ideas & Facts: Elements of Defamation: A plaintiff must prove: A false and defamatory statement of fact. Opinions are generally not actionable unless they imply a false factual assertion (Milkovich v. Lorain Journal Co.). The statement concerns the plaintiff. Publication of the statement to a third party. Fault by the defendant: Actual malice (knowledge of falsity or reckless disregard for truth) for public figures and officials (New York Times Co. v. Sullivan). Negligence for private individuals (though actual malice might be required in some cases involving matters of public concern). Damages suffered by the plaintiff. Types of Defamation: Libel: Written or published defamation, often presumed to cause damages. Slander: Spoken defamation, requiring proof of special damages unless it falls under slander per se. Slander per se includes statements alleging criminal activity, loathsome disease, professional misconduct, or sexual misconduct. Defenses to Defamation: Truth: An absolute defense. Privilege:Absolute privilege: Applies to statements in legislative debates, judicial proceedings, etc. Qualified privilege: Applies to statements made in good faith on matters of public interest, but can be defeated by actual malice. Opinion and Fair Comment: Protected speech, especially when based on true facts and related to public issues. Consent: If the plaintiff agreed to publication. Retraction Statutes: Limits liability if a timely retraction is issued. First Amendment Considerations: Public Figures & Actual Malice: Robust public discourse requires a higher burden of proof for defamation claims against public figures. Matters of Public Concern: Speech on public issues enjoys heightened protection. Hyperbole and Satire: Non-factual assertions, like parody, are generally not actionable (Hustler Magazine, Inc. v. Falwell). Challenges in the Digital Age: Online Defamation: The viral spread of defamatory content through social media presents new challenges. Section 230 Immunity: Protects online platforms from liability for content posted by third parties, but raises questions about accountability. Anti-SLAPP Statutes: Aim to discourage meritless defamation lawsuits used to silence critics on matters of public concern. Quotes: "Few areas of law occupy a more precarious balance between personal dignity and freedom of expression than defamation." "Truth is an absolute defense to defamation." "Robust debate on matters of public concern is essential to democracy." Conclusion: Defamation law is continually evolving to address the challenges posed by online communication. Understanding the intricacies of this area of law is crucial for navigating the balance between protecting reputations and upholding free speech principles. --- Support this podcast: https://podcasters.spotify.com/pod/show/law-school/support
Movie of the Year: 1996The People Vs Larry FlyntIn this episode of the Movie of the Year podcast, the hosts dive into one of the most controversial films of the 1990s: The People vs. Larry Flynt. Directed by Milos Forman and starring Woody Harrelson and Courtney Love, this 1996 biographical drama tells the story of Larry Flynt, the notorious publisher of Hustler magazine. It's more than just a courtroom drama, though—it's a deep exploration of free speech, censorship, and morality, wrapped up in a real-life story that's as outrageous as it is thought-provoking.The People vs. the Real Larry Flynt: Champion of Free Speech or Just Provocateur? The conversation kicks off with a look at the real Larry Flynt, the man who built an empire by pushing the boundaries of taste and legality. Flynt was no stranger to controversy, and the film dives headfirst into his most famous battle—his 1988 Supreme Court case, Hustler Magazine v. Falwell, which became a landmark ruling in favor of free speech. The hosts break down how the film portrays Flynt as both a larger-than-life personality and a defender of First Amendment rights. But they don't shy away from discussing Flynt's contradictions. Was he truly fighting for free speech, or was he using the legal system to justify his often offensive content? This debate adds depth to the discussion and helps paint a fuller picture of Flynt as both a cultural disruptor and a complicated figure.Woody and Courtney: A Surprising Dynamic DuoThe hosts then turn their attention to the film's two central performances: Woody Harrelson as Larry Flynt and Courtney Love as his wife, Althea Leasure. Woody Harrelson delivers a career-defining performance, bringing a surprising amount of nuance and vulnerability to a character who could have easily been portrayed as just a crude provocateur. His portrayal of Flynt showcases both the man's relentless pursuit of personal freedom and his inner turmoil. But it's Courtney Love who really grabs the spotlight in this episode's discussion. Known more for her rock star persona than her acting, Love shocked critics and audiences alike with her emotionally raw performance as Althea. The hosts explore how Love's portrayal of Althea added a layer of tragedy to the film, grounding Flynt's often chaotic life with real human emotion. The chemistry between Harrelson and Love is another highlight, bringing a sense of authenticity to their relationship and adding emotional depth to the movie. The People vs Larry Flynt's Milos Forman: Master of MavericksOf course, none of this would have worked without the direction of Milos Forman, a master of telling stories about rebellious, complex characters. The hosts dive into how The People vs. Larry Flynt fits into Forman's body of work, particularly his fascination with figures who challenge authority, like in One Flew Over the Cuckoo's Nest and Amadeus.Forman's direction is both restrained and provocative, allowing the larger themes of free speech and censorship to play out naturally through the story without hitting the audience over the head. His unique background, having lived through censorship in his native Czechoslovakia, gives him a particular sensitivity to these issues. The hosts discuss how this outsider perspective allowed Forman to bring a balanced approach to the story, making it not just a tale about a controversial publisher but a broader commentary on American freedoms. Why The People vs. Larry Flynt Still MattersAs the episode wraps up, the hosts reflect on why The People vs. Larry Flynt remains relevant today. Free speech debates haven't gone anywhere, and in many ways, they've only become more heated. The film's portrayal of the tension between personal freedom and societal standards still...

Reflecting on all their conversations during season one, Oliver shares that he has learned that he is obsessed with money, specifically mixing sex and money. Although Oliver is a dirty free spirit, he stopped himself from starring in his own pornography for fear of professional repercussions. He has since realized that he hates wholesomeness and loves addiction and vices. Meanwhile, Teresa reveals that she has learned she was depressed from her prior toxic relationship with the cheating old man and that her depression stopped her from living a Hot Girl Summer. She talks about the steps she made to change herself, including her extreme weight loss and getting back out on the dating scene. Then Teresa and Oliver reflect on personality types and how some people are unforgettable in our minds while others can be easily forgotten. The episode wraps up with Oliver sharing his summer goals of making a short film about porn that he can submit to mainstream film festivals and making spicy content for his Onlyfans. Teresa reveals her plan is to get a summer romantic partner who adds to her life, not tries to change it. Oliver usually only hooks up and never dates, but for the first time, he tried a speed dating event, where he was shocked to meet wholesome queer people. Meeting the wholesome people made him feel weird about himself and old, because his dates were all Gen-Z who did not know any of his pop culture references. Teresa reveals that she also wants to change her romantic behavior. Instead of being a dominant independent woman, she fantasizes about being a submissive pillow princess to a manly guy–like a fireman. The talk eventually leads to Oliver sharing that he wants to act in porn himself but that he holds himself back for mainstream career possibilities, and this shocks Teresa who views Oliver as someone who does whatever he wants. The two then talk about escorts and porn stars they know whose lives are enriched by their sex work money, and this leads them to explore the question, “What's the point of saying no to something you actually want to do?”Teresa lo's Instagram: https://www.instagram.com/teresalowriter/Oliver Wong's TikTok: https://www.tiktok.com/@oliverwongcomedy?lang=enOliver Wong's Instagram: https://www.instagram.com/oliverwongcomedy/Get Intimate's Instagram: https://www.instagram.com/getintimatepodcast/About Sex & Boba PodcastIn Asian culture, it's taboo to talk about sex, but Asian women are the most fetishized and Asian men are the most dismissed in the sexual dating pool. Recently Oliver got a skin rash and thought he had syphilis. Luckily, it was just a viral infection, but the scare got him and Teresa to talk about trusting doctors, STDs, health insurance, and sex education. Teresa states that it is important who we pick to be with because they can ruin your life, and thrill-seeker Oliver shares that he has lots of sex so he tests for STDs every three months. Hopeless romantic Teresa reveals that she actually enjoys getting lovebombed, and Oliver jokes that she would've fallen for Armie Hammer. The conversation then takes a more serious turn when Oliver and Teresa talk about other dangers of sex besides disease, such as sexual assault, stealthing, and murder.Teresa lo's Instagram: https://www.instagram.com/teresalowriter/Oliver Wong's TikTok: https://www.tiktok.com/@oliverwongcomedy?lang=enOliver Wong's Instagram: https://www.instagram.com/oliverwongcomedy/Get Intimate's Instagram: https://www.instagram.com/getintimatepodcast/About Sex & Boba PodcastIn Asian culture, it's taboo to talk about sex, but Asian women are the most fetishized and Asian men are the most dismissed in the sexual dating pool. Teresa recently conquered her fear of solo traveling and took a day trip to Catalina Island where she met new friends since Oliver wouldn't go. Oliver shared that he hates outdoor activities but that he loves to travel alone, especially to places where he can explore and find men on Sniffies. The two talk about how traveling can open your mind, and Teresa recalls a trip to Texas where a man with an Asian fetish wouldn't leave her alone. The two agree that non-Asians having a sexual preference for Asians is actually great for them but there's a line between preference and objectification. All of the chatting about traveling leads to talk about their favorite gym, Equinox, which has clean locations around the country, and this eventually leads to their discussion about how it's okay to chase money. Oliver reveals he now only writes for money, and Teresa shares her life goal is to retire and travel.Teresa lo's Instagram: https://www.instagram.com/teresalowriter/Oliver Wong's TikTok: https://www.tiktok.com/@oliverwongcomedy?lang=enOliver Wong's Instagram: https://www.instagram.com/oliverwongcomedy/Get Intimate's Instagram: https://www.instagram.com/getintimatepodcast/About Sex & Boba PodcastIn Asian culture, it's taboo to talk about sex, but Asian women are the most fetishized and Asian men are the most dismissed in the sexual dating pool. Oliver starts the show by sharing his recent positive experience ingesting psilocybin mushrooms and the emotional crash afterward. Teresa talks about her own psychedelic trips and reasons why she doesn't need drugs anymore. They explore the authenticity of their sober and substance-altered selves, with Teresa preferring her sober self and Oliver leaning towards his substance-induced persona. The conversation shifts a little to the subject of Hollywood toxicity, specifically with the past hit show Lost, which makes the two question the essence of successful work created by flawed individuals. Oliver shares a saying that every filmmaker spends their entire life making one film or working on one idea. The two contemplate their own ideas and explore themes like loneliness and human connection. They also talk about their evolving attitudes towards money, negative influences, and the delicate dynamics of money in relationships. Teresa and Oliver dive into the buzzworthy topic of ChatGPT, sharing contrasting experiences with it. Teresa has tried using ChatGPT as a therapy session, comparing it with platforms like BetterHelp, and Oliver talks about a friend who turned a script into a book using AI. The two discuss the impact of AI on various aspects of life, like jobs and relationships, but they agree that it cannot replace or replicate true real-life experiences. They also bring up a podcast episode they both heard and lessons they got from it, such as the significance of being out of the home and working on their personal growth. Teresa has been seeking excitement outside of comedy by signing up for Meetups and other live events. Oliver credits Exposure Therapy as one of his reasons to pursue comedy and practice his English skills. Teresa reflects on her motivation to write while Oliver struggles with procrastination but finds an outlook to create through the writing of his autobiography. The two end the episode by stressing the need to declutter one's life and to prioritize fulfilling experiences.Teresa lo's Instagram: https://www.instagram.com/teresalowriter/Oliver Wong's TikTok: https://www.tiktok.com/@oliverwongcomedy?lang=enOliver Wong's Instagram: https://www.instagram.com/oliverwongcomedy/Get Intimate's Instagram: https://www.instagram.com/getintimatepodcast/About Sex & Boba PodcastIn Asian culture, it's taboo to talk about sex, but Asian women are the most fetishized and Asian men are the most dismissed in the sexual dating pool. Former Sugar Daddy guest Jack and Canela join us to discuss her journey into sugar dating. Canela is from the Caribbean and quite exotic. She messaged Jack because of his vibe video, so yes, those work. She reveals she worked at a few brothels in Nevada. Girls there can make over $200k per year. Then she left and started sugar dating and had a 2-year arrangement of $5k per month. But the arrangement soured when Canela decided to date others. The shocking part is that she still lives in her Sugar Daddy's house. Is variety really the spice of life while dating? We then discuss how a Sugar Baby is initially playing a role. Canela admits that she took a customer from the brother and made him into a Sugar Daddy. We find out she was published in Hustler Magazine 4 times. Has she ever been in love? Later we get into her tough upbringing through foster care and molestation. Finally, we discuss Sugar Daddy fetishes that are more common than people think. We're starting the year off with a civil law case involving some very uncivil language. One of our nation's most important legal battles over the First Amendment was a battle between a Nyquil-chugging preacher and an American flag diaper-wearing porn publisher. Does the right to free speech protect your right to be really, really gross? Content note: This episode is labeled explicit for graphic descriptions of fictional incest. There will also be some quotes from primary sources containing racist, sexist, homophobic, and antisemitic language. Sources and show notes at this link Support the show on Patreon
We talk about the time Jerry Falwell sued Larry Flynt and Hustler magazine.

I noticed that I'm a lot kinder to myself about certain emotions. And then I also noticed that there are other emotions where I can beat myself up still. Then I'm just noticing the judgment that's still there. And like, okay, like, this is still here. This is something that, I can still work on, but then it's almost like not judging myself for the judgment. So can be a few layers there. Thoughts on Breathing That's a good one. Because I do think breath can help us a lot with sex. Oftentimes, in bed or not, we can kind of tense up and almost be holding our breath. And a lot of people tend to do that leading to orgasm, especially if you're somebody who maybe struggles with orgasm. Try deep breathing, try relaxing your muscles a little bit, and just see how the energy flows with that. Sex and Consciousness But with me, I've done all sorts of different breathing. I've done some, like Holotropic breathwork workshops that I've attended. I've gone through periods where I do the Wim Hof YouTube video in the morning. Dr. Andrew Weil has the 4-7-8 breathing technique for relaxation. Sex I noticed when I'm stressed, my breathing is more shallow and tense. And it's like a clue to me, like a signal that I can relax a little more. Suggested Resources Book: No Bad Parts: Healing Trauma and Restoring Wholeness with the Internal Family Systems Model Dr. Andrew Weil The 4-7-8 Breathing Technique App: Dipsea Stories App: Quinn Bullying Story I've seen this more than once, where one partner is kind of pestering, coercing or manipulating their partner to have sex with them. Now that you're kind of bringing mindfulness to it. I actually think that's a huge component because one of the main reasons I got into sex therapy is because I think the way the culture is, there's a lot of shame and stigma around certain aspects of sexuality. Sex and Consciousness It could actually think male, bisexuality is one of those. I think there's a lot of men who have interest in some other men, but you know, are kind of told like, No, you're either gay or straight. There's no woman who can be bisexual. So I think that when there's an area of shame or stigma, or when someone's feeling hurt, and rejected, and maybe doesn't have the capacity, or the training or the skill set to be with that because I think mindfulness is a lot of that is being with whatever your experience is, they kind of gets more emotionally reactive. Sex and Consciousness And I think that's where sexual bullying can come in. So I think if people are able to develop the capacity to accept themselves, to not judge their own sexuality, to not take their partner's maybe lack of interest personally, and you just see that, like, that's what's going on in their mind, you know, looking away that has nothing to do with you. And to process any hurt that you have without judging it. I think that's huge. So I feel like when you do that, it really frees you up to have great sexual communication, which is, you know, another topic on my early podcast. Because it's key, it's like, if you can communicate well about sex, you're gonna probably have a pretty good sex life. Pornography...even as I'm typing this out I'm thinking about how something that was once so taboo, so risqué, perverted, has become almost common place now. I mean it's everywhere. The thing you're looking at right now, your phone or computer, yeah that's like THE gateway to Porn. Well once upon a time porn was only in print and even then it was pretty mild....until a guy named Larry Flynt took it upon himself to create Hustler Magazine, push every boundary of taste he could think of and as a result worked to create some of the freedoms of expression we still benefit from today.
Audio of the 1988 unanimous opinion of the Supreme Court in Hustler Magazine, Inc. v. Falwell. Hustler is a pornographic magazine whose founder, Larry Flint, wasn't one to shy away from tucking a little social and political commentary in-between photo layouts. In 1983, the magazine's lead story included a parody of a political ad claiming that the very politically-active, conservative, Christian Fundamentalist minister Jerry Falwell committed incest with his mother in an outhouse (gross, I know). Reverend Falwell sued Hustler magazine to recover damages for libel, emotional distress, and for invading his privacy. On the emotional stress claim, a jury awarded him damages of $150,000 and Hustler Magazine appealed and the case found its way to the Supreme Court. The constitutional question before them was whether patently offensive statements regarding public figures are protected under the First Amendment's free speech clause. In a unanimous decision, the Court said yes. This isn't just a provocative, high-profile case that's more than just a little interesting (if we're being honest); rather, it established important precedent about parody as it relates to the First Amendment right to free speech. This case has been on my mind recently after learning about an Ohio man who filed a petition for certiorari after he had been arrested and subsequently acquitted for creating a parody Facebook page that made fun of his local police department. If this case sounds familiar to you, it's likely because of all the public attention it received when the famous parody publication, The Onion, recently filed a very real amicus brief with the Court in support of the petitioner explaining, in-between bits of its own parody, why parody is an essential form of expression in our democracy - perhaps now more than ever before. Sheldon Zoldan has been producing Song of the Day since about 2020. He describes it as part history, part trivia, and all music. In it, he tells a short story every day that ties into music history or historical events and features a song. Born in Youngstown, Ohio, Sheldon graduated with a degree in journalism from Ohio State University. In the late 1970s he worked as an editor at Ohio Magazine, which was founded and operated by the infamous Larry Flynt, publisher of Hustler Magazine. Sheldon also worked at an experimental cable station called Qube that was kind of like interactive TV before its time. He returned to print journalism and wound up at the News-Press as a business writer in 1986. He ended up a metro editor and retired from the paper in 2019.
Adam opens the show by welcoming comedian Jodi Miller who's sitting in for Gina today. He asks about her recently deceased cat who was just cremated. This leads Adam to play an old Crank Yankers clip where Mr. Birchum calls into a boat rental company to arrange the scattering of his uncle's ashes. Adam then remembers the unique rating system Hustler Magazine used to judge pornos. Before the break, the gang plays a futuristic-themed round of The Rotten Tomatoes Game. This week's Stinker is such a goofball that instead of wrecking his meat to Hustler Magazine, he decided to shoot its publisher. Unfortunately, that was just the tip of the creep iceberg with this weirdo, who also blew up a beagle and extended his reign of terror to Taco Bell, Pizza Hut and Burger King.
