Ken Simeral, a prominent figure in the real estate community in Acadiana, joins Discover Lafayette to discuss his thoughts on investing in real estate when the numbers work in your favor, the importance of offering high-quality, targeted service to his clients, and his lifetime involvement in bettering our community. Ken is President-Elect of the REALTOR® Association of Acadiana (RAA). A devoted family man, he has been married to his wife, Deborah, since 1977 and they are the parents of two sons, Kyle and Jeffrey. Ken brings a seasoned voice to the industry: when he joined the former Lafayette Association of Realtors, there were 320 realtors; today there are more than 1850 members of the Realtor Association of Acadiana. Ken is owner of Magnolia Real Estate & Construction. He and his son, Kyle, operate Scott Quick Lube and Thermal Insulation Contractors. Ken, his wife, Deborah, and his sons own Simeral Properties, a company with multiple real estate holdings. And Ken enjoys the outdoors; he keeps horses and cattle on his 40-acre farm in Arnaudville where he and Deborah reside, and if you drop in, you may see him navigating his backhoe on the property. Pictured is La Maison Chatrian, a bed and breakfast home that Ken and Deborah Simeral offer to travelers visiting lovely Grand Coteau. Built circa 1835, the home sleeps 12 and is one of the oldest homes in Grand Coteau. Ken and Deborah spent seven years restoring the home. Restoration of historic properties is a passion of Ken's. Ken took his first real estate class in 1972, at a time when interest rates were 18%. By the early 80s, they had lowered a bit to 12%. With his decades of experience in residential and commercial real estate, Ken has witnessed firsthand the cyclical nature of real estate and interest rates, and he counsels homebuyers not to let the current interest rates be a controlling factor in their decision to buy. A 1969 high school graduate, Ken started college that fall. Unfortunately, his timing put him in the first draft lottery to determine military service since WWII in 1942. When he pulled #64 (based upon his birthday), he decided to enlist in the Air National Guard, and thereafter spent some time in Korea during the Vietnam War. Ken never returned to college studies, but began his lifelong journey of work, where he learned from others, benefitted from his own hard work, and the art of making smart investments. Always good with numbers, Ken bought his first home in 1972 on Garfield St. in Lafayette while in his early 20s. While managing an 18-unit apartment complex in Lafayette, he bought his second property in the McComb Veazey neighborhood, and then used equity from the first two homes to roll financing into three rentals. He soon married Deborah and started working with the Grand Paper Company, a national outfit where he was hired to be only the third salesman in the territory after 150 years in business. When he was offered a national rep position with the company, he realized he didn't want to be on the road each and every week; he wanted to be home with his family. Ken Simeral says, looking back on his rich life, "I was taught by older mentors. Everything I know I've learned from other people I could trust. The WWII generational ethics, how to do things right. Randolph Trappey was a mentor to me and I watched him build great houses. I just followed what he and others did." Ken ended up teaching the Realtor Code of Ethics ("Code of Conduct"), and served as the Chair of Professional Standards for Realtors. Ken looks back at this early period of his life with gratitude about what he learned from others. He also has advice for young homebuyers who are looking from guidance from seasoned real estate owners such as himself. Center for REALTOR® Development 056: Residential Real Estate Disclosures with Bruce Aydt   While laws on this topic vary from state to state, good disclosure by the seller helps everyone involved in the real estate transaction. In this episode, guest Bruce Aydt joins Monica to talk all things disclosure. They discuss what should or should not be disclosed when it comes to current property status, past repairs, psychologically stigmatized properties, and work done without permit. This episode is full of risk management information that REALTORS® can use to help their clients.   The purpose of disclosure laws is to ensure that the buyer knows everything that the seller knows about the property. It is also a protection to sellers, as long as they are honest in their disclosure, because they will minimize their risk of legal ramifications later. As a seller, if you’re wondering whether you should disclose something, then you should probably disclose it. A good general guideline for what to disclose is that if the issue or condition of the property affects the desirability or value of the property, then it is something that needs to be disclosed. The contract from state to state or area to area will help guide sellers.   When it comes to past repairs, Bruce’s general rule for risk management is to disclose the history of all major repairs, including anything significant in terms of repairs or replacements. If it’s not disclosed, this could put the seller in a position where they think something is fixed but it isn’t really fixed. When preparing a seller disclosure statement, it is important to disclose in very specific terms. Just like any work done to our cars, try to keep track of any receipts or paperwork for any work done on the property.   Monica and Bruce discuss the concept of “should have known” — it exists in some states, but not in others. If the seller has evidence or information that would indicate to a reasonable person that the condition existed, that’s the “should have known” standard. What the average person would know is an indication of a problem that should be disclosed.   When it comes to prior information that you may have gotten from the previous seller disclosure or something you learned from living in the house, relevant information should be shared. Anything that affects the current property should be shared. Neighbors, real estate agents, flippers, and heirs could all know information about a listing. Whether a seller is exempt will depend upon your state property disclosure law.   Another aspect of disclosure to consider goes beyond the physical appearance or integrity of the property. Many states have laws about psychologically stigmatized properties — these laws hold real estate agents not liable for the failure to disclose the psychological impact on the property (murder, suicide, or other felonies). While most real estate agents do not have an obligation to disclose these things, there are other factors to consider: determining whether the information is fact or fiction, checking state laws, determining relevance, and discussing disclosure with the seller.   Another element of disclosure is any work or additions done on the property without permits. This has been an evolutionary area, and the power of local governments is pretty strong in the enforcement of these laws. Even if your seller disclosure statement doesn’t have this on it, it should be disclosed, especially for electrical and plumbing projects.   What happens when a buyer does an inspection and doesn’t want to purchase the property? Your contractual documents should be your main reference for navigating these conversations, primarily on how much of the disclosure and inspection reports should be included. There can be legal consequences if prior inspection items aren’t disclosed. As a real estate agent, you can’t give legal advice to your clients, but you can decide if you want to continue forward with a listing.   The easiest, most practical risk management rules are two things: disclose any major defects in the property that exist currently, and also disclose the history of any major repairs. After his time selling, Nobu moved to Chicago and he accepted a role at the National Association of Realtors. He was most recently the director of industry outreach and engagement strategy there at the same time, while in Chicago, Nobu's wife, Shea became a Realtor and built an incredibly successful team where she still sells Nobu has traveled all around the U S and even around the world to various speaking engagements. And so we're very lucky to have him on the show today. So Nate Nobu thank you very much for joining us. Thanks for having me, Eric. I'm excited to dig in a, as a friend of mine and be in your new role as the CEO of of DMR. And so I want to kick it off and ask you a little bit about your past. So what originally got you into real estate? I, you know, I think it, I think it's just like most people yeah. We'll get into real estate, like get, get into it by accident. I started out working for my father who was a former Xerox guy owned a, like a Kinko's before it was a Kinko's right. And one day I had gotten into a fight with my brothers. And my my, my dad went to me and said, you need to use your powers for some good. Why don't you go work for this brokerage there, everything's starting to go online. And I think you can at least make some money this summer doing it. And man, everything just kind of rolled from there. I did a lot of design work and then I got into the sales end of things and it was just, the rest is history. So, you know, you said the rest is history. What what's kept you in the business this long? What is it about real estate that just keeps drawing you back into it? Oh man. You know, I think other than the fact that it's like the mob, once you're in you're you can never really leave. I think the big thing is I've never. I've never been a part of, of a business where the more good you do for people, the more profitable you're going to be. And, and, and when you think about, especially now with the way businesses in general there really isn't the case, right? But here in real estate, man, you, you, you, you serve people. Well, you differentiate. You make them happy and you, and you make relationships. God, you know, it, it, it just keeps snowballing from there. So it's, you know, try to get out once it didn't really work. That's how I got back into mint into real estate Minneapolis, but man, it was, it's one of those things where I think it's just, it's it feel good thing. And I don't think I'm unemployable outside of real estate anyways. That's you know, Rob Hahn our, our friend, Rob once once said the concept that we're part of this unemployables group and you know, we only work in real estate

I have here an announcement by the National Association of Realtors that Real Estate agents who are a member called REALTORS, can no longer market homes “coming soon” after January 1… why is that?1) It’s a trade organization for real estate agents, that while not mandatory, in this market you cannot put homes in the MLS if you are not a member. Not sure if that is really legal. The same is not true for the Denver MLS – RE Colorado 2) How does this ruling benefit home sellers?a. It does not. My experience has been many buyers are left out of the perfect homes because agents try to get them sold too fast before the buying public has a chance to know its there…3) How will this affect what you do?a. Some MLS systems in the country have already mandated a $5000 violation and charges of “discrimination!” I think the libs took over NAR, they play the discrimination card to intimidate people to conform.b. I think for me, I may have to get very creative. At the end of the day, its what the seller wants me to do. 4) Why do most agents have to operate this waya. The disappointing story is the agents share the commission that the listing agent negotiates. It has become almost an “entitlement” that they have the rights to get access to homes we are selling at their becken call. In this market, the agents seem to feel “entitled” to receive half of what we negotiate.i. But the agents act as a fiduciary for their buyers, trying to extract concessions out of the sellers from offer to close.ii. There is even a class action lawsuit going on about that now.iii. When I ask the sellers how much they want to pay “opposing counsel” the number is typically much less than what most agents offer and usually zero. 5) What do you think the solution is?a. I think there will come a day when buyers and sellers will pay their own respective commissions. But not because of national association control, because agents will offer service that the buyers and seller’s value.b. Everybody is tuned in to the radio station…WIFM..whats in it for me.c. Companies like Zillow and Open Door who offer to buy homes are going to break up these entrenched organizations by giving service people want.d. We don’t operate like them Zillow and Open Door typically are trying to get homes sellers the least amount of money so they can flip homes and make a profit on their need to sell.e. It was during these positions that I perfected my talent for listening to others’ objectives and presenting effective and efficient solutions – skills that I continue to use today with my real estate clientele. “I enjoy bringing people together in situations that can  benefit everyone involved.  When I represent a client, I make the extra effort to completely and fully analyze their needs. This allows me to not only meet their expectations and protect their best interests, but also identify the best-possible properties that may exist through the right kinds of connections. Originally from Bogota, Colombia, I been living in South Florida for a long-time where I am a resident and in the Miami area. My current focus is on residential properties throughout Miami-Dade and Broward and Orlando counties with a concentration on “great opportunities and deals that offer the best return, value, or match for each individual client.” I hold a Bachelor’s degree in International Business and Global Management from Florida International University (FIU) and is a member of the Realtor Association of Miami, the Florida Association of Realtors, and the National Association of Realtors. Whenever possible, I make it a point of supporting the local community through various non-profit organizations as well as local PTA’s for his children’s schools.

As part of my Professional Development Committee duties I volunteer to monitor some of the classes that are offered at our local Realtor Association. Last week I had the pleasure to sit in on 2 days of GRI 100 classes being taught by Ms Patti Ketchum who is a Florida Realtors Instructor out of Tallahassee and someone with great experiences that really made the class fun.While I was in class and we were discussing the Code of Ethics, the document that separates us from common real estate agents, I began thinking..."How many Realtors have actually read the code of ethics, start to finish? Of those how many understand it? Of those how many have a solid handle on how it should be interpreted in our new social market?As we discussed the 17 articles and all of their Standards of Practice (SOP) I realized that Article 12 which deals mostly with the marketing side of things, when explained to the class there was no mention of social media, or online marketing. The examples were mostly about signs and postcards.So if it isn't being brought up in classes....are our agents, new and seasoned being made aware of the pitfalls and potentially harmful situations that may arise when using new systems.Are we taking the time to learn the contract and addenda being used in our markets? I mean really taking the time to learn the contracts?
