Welcome to Sacred Restorations, a limited series on the SSPX Podcast that highlights the beautiful work being done across the U.S. District. In this episode, we travel to Walton, Kentucky, where Assumption Academy is building the future of Catholic education. Fr. Stephen Stanich and Mr. Sean Cooper walk us through the remarkable growth of this chapel, from the original SSPX church and school in Cincinnati, to the move to Walton in 2010, to the arrival of the Dominican Sisters and the flourishing of both the boys' and girls' schools. What began with a small chapel and just a few dozen students has grown into a thriving Catholic community of nearly 1,500 faithful, nine priests, and hundreds of students. Now, with the boys' school outgrowing its space, Assumption Academy is raising a new building with classrooms, offices, a full kitchen, and a hall large enough to serve the whole community. It is an ambitious project, but one meant to last for generations. Paul Evans is the CEO of Solutions Leisure, one of the most recognised hospitality brands in the UAE with 23 venues across the region. But that is not the reason we brought him in. He grew up dyslexic and spent years being told he wasn't enough, and the decisions he made in his early twenties landed him in a UK prison cell at 21. What followed was years of searching for something he couldn't name, until his body made the decision for him. While building a business in Egypt, acute pancreatitis brought on by years of serious alcohol abuse put Paul in a coma for 77 days. He woke up with a different set of priorities and the kind of clarity that only comes when you have had to earn the right to still be here. This is the start of a series into enforcing orders; this part focuses on enforcing financial remedy orders. We are joined by Christopher Stirling (Field Court Chambers) and Kara Swift (Family Law in Partnership) who breathe life into this topic. Chris starts with telling us that recitals that deal with the payment of money are enforceable: Austin v Haynes [2021] EWCA Civ 1919 per Moylan LJ. However, be careful about how you are drafting the recital to make sure that they are not conditional or incapable of definition. In respect of property adjustment orders, Chris reminds us that they take effect immediately in equity once DA/Final Order is made: Mountenay v Treharne [2003] Ch 135. He also reminds us of the ability of the Court at the time of the final hearing to provide for deadlines for executing documents in default of which an application can be made ex parte to direct that a conveyancing solicitor or Judge should sign in the place of the defaulting party. Kara then reminds us that orders for sale pursuant to S.24A of the MCA allows for orders for sale to be made at any time on or after the making of a financial remedy order making it useful standalone relief. She reminds us that a lump sum is a simple debt. It doesn't take priority over any other debt, unless it is supported by a default order for sale. Kara and Chris move on to discuss charging orders. Note, there are no formal time limits for making charging order – see Lowsley v Forbes [1999] 1 AC 329 – though any interest claimed on sums charged is limited to 6 years – s.24(1) LA 1980 – nor is there need to seek any permission after 6 years like some other forms of execution: see Frankl-Rietti v Cheltenham & Gloucester plc [2011] EWCA Civ 524 per Rimer LJ @ [21] – and once obtained have an indefinite “shelf life” – CA refused to set aside charging order made 16 years previously in Yorkshire Bank Finance v Mulhall [2008] EWCA Civ 1156 They are made via a 2 stage process – interim and final order – interim order usually an ex parte process – though can be made immediately at time of judgment/order – see Mostyn J in Green v Adams [2017] 2 FLR 1413 (though if lump sum may be more practical to make default order for sale). Can get charging order where judgment debtor has some interest in charged asset and it is not necessary to establish the extent of that interest at stage of charging order - Walton v Alman [2017] 1 FLR 927 . Kara tells us that 3rd party debt order – interim and final - is a mechanism to secure funds ahead of enforcing the direct payment of them to the applicant by the third party holding the funds. Note, A v Z (No 2) (Interim Third Party Debt Order), where an interim order was made against a party's solicitors' client account. Enforcing costs orders is like any other lump sum, but it must be liquidated to be enforceable i.e. you need to have agreed the amount or had it assessed after on detailed or summary basis. You do not have to wait for the final order of the divorce. Periodical payments order can be enforced by an attachment of earnings order. They can be made as part of the original final order, if someone has been defaulting or diverting income. Generally, there is no provision for interest - TW v TM (Minors). They then talk us through:Warrants of control – the bailiffs/ Enforcement OfficersJudgment summons see Barclay v Barclay [2022] EWHC 2026 (Fam) in respect of the burden of proof;Receivers – as a last resort if there are no other methods and proportionate. Blight v Brewster Orders – compelling a party to draw from a private pension;Thwaite jurisdiction – the power to vary executory orders where unjust not to do so
Bowie Kuhn landed on the cover of the June 28, 1976 issue of Sports Illustrated because he had just done something nobody in baseball had done quite so boldly — voided three of the biggest player sales in the history of the sport. When Charlie Finley sold Vida Blue to the Yankees and Joe Rudi and Rollie Fingers to the Red Sox all in a single afternoon, Kuhn stepped in and nullified every transaction, invoking his power to act in baseball's "best interests." Finley called him the village idiot, Billy Martin joked about pitching him, and the entire baseball world stopped to ask one question — just how much power does a commissioner actually have? That was enough to put Bowie Kuhn on the cover of Sports Illustrated. That same week two other seismic sports stories were playing out inside that June 28th issue. In boxing, George Foreman demolished Joe Frazier in five rounds, knocking him down twice before the referee stopped it — and Smokin' Joe announced his retirement on the spot with a perfect line: "It's time to put it on the wall and go boogie, boogie, boogie." And in basketball, after years of financial chaos and a 44-minute vote, the ABA officially ceased to exist — four franchises surviving into the NBA while the rest quietly disappeared, ending a nine-year experiment that gave the world Julius Erving, the three-point line, and a red, white and blue ball nobody took seriously until it was too late. Swen Nater's journey is one of the most unlikely in sports history. He grew up in the Netherlands, never played a high school game, and arrived at UCLA with almost no formal experience — spending two seasons as Bill Walton's practice player on back-to-back undefeated championship teams without ever starting. Yet the Milwaukee Bucks drafted him in the first round in 1973, making him the only player ever drafted that high without a college start. He chose the ABA instead, and after the Virginia Squires sold him off he landed with San Antonio and won ABA Rookie of the Year. When the merger came, Nater transitioned seamlessly, eventually becoming the only player in history to lead both the ABA and NBA in rebounding. Swen tells us what it was like to backup Walton, how Kareem kept him from signing with Milwaukee, and how Wilt Chamberlain taught him to become a ferocious rebounder. He tells us how John Wooden prepared him for the pros, how Don Nelson made him a better shooter, and the story of the time he and Lonnie Shelton got into it — and his wife's 80-year-old grandmother came onto the court to give him some assistance. He was walked two and a half miles on foot through Liverpool to a railway embankment in Walton, where his abductors beat him to death and laid his body across the tracks. He was found two days later. Roughly thirty-eight people had seen the three children together along the route; none intervened. Six days after the abduction, a woman recognized one of the boys from enhanced CCTV stills broadcast on national television and called Marsh Lane police station with two names — Robert Thompson and Jon Venables, both ten years old, both flagged on a truancy list that investigators had set aside on the assumption that the perpetrators were teenagers. The pair were arrested the same day and convicted at Preston Crown Court on November 24, 1993, making them the youngest convicted murderers in modern British history. Both were released on life licence with new identities at age eighteen in June 2001 under a court order granting them lifelong anonymity. Robert Thompson has not reoffended.
