Benvenuti, amici Tiralinee! Bentornati e ben ritrovati. Benvenuti a tutti! (Non so effettivamente cosa centri… Media Converter 2 thks Alex Raccuglia.► Cuffie: Focusrite HP60vLe musiche sono state create con TuneyLe cover sono state create con Image Creator by Microsoft Designer Hosted on Acast. Benvenuti a tutti e ben ritrovati! Media Converter 2 thks Alex Raccuglia.► Cuffie: Focusrite HP60v https://amzn.to/46FStw2Le musiche sono state create con TuneyLe cover sono state create con Image Creator by Microsoft Designer Hosted on Acast. Rieccoci qua. Media Converter 2 thks Alex Raccuglia.► Cuffie: Focusrite HP60vLe musiche sono state create con TuneyLe cover sono state create con Image Creator by Microsoft Designer Hosted on Acast.

O malo do chat? Making the Rubble Bounce in Montana

The Cyberlaw Podcast

In this episode, Paul Stephan lays out the reasoning behind U.S. District Judge Donald W. Molloy's decision enjoining Montana's ban on TikTok. There are some plausible reasons for such an injunction, and the court adopts them. There are also less plausible and redundant grounds for an injunction, and the court adopts those as well. Asked to predict the future course of the litigation, Paul demurs. It will all depend, he thinks, on how the Supreme Court begins to sort out social media and the first amendment in the upcoming term. In the meantime, watch for bouncing rubble in the District of Montana courthouse. (Grudging credit for the graphics goes to Bing's Image Creator, which refused to create the image until I attributed the bouncing rubble to a gas explosion. Way to discredit trust and safety, Bing!) Jane Bambauer and Paul also help me make sense of the litigation between Meta and the FTC over children's privacy and previous consent decrees. A recent judicial decision opened the door for the FTC to pursue modification of a prior FTC order – on the surprising ground that the order had not been incorporated into a judicial order. But that decision simply gave Meta a chance to make an existential constitutional challenge to the FTC's fundamental organization, a challenge that Paul thinks the Supreme Court is bound to take seriously. Maury Shenk and Paul analyze an “AI security by design” set of principles drafted by the U.K. and adopted by an ad hoc group of nations that pointedly split the EU's membership and pulled in parts of the Global South. As diplomacy, it was a coup. As security policy, it's mostly unsurprising. I complain that there's little reason for special security rules to protect users of AI, since the threats are largely unformed, with Maury Pushing Back. What governments really seem to want is not security for users but  security from users, a paradigm that totally diverges from the direction of technology policy in past decades. Maury, who requested listener comments on, his recent AI research, notes Meta's divergent view on open source AI technology and offers his take on why the company's path might be different from Google's or Microsoft's. Jane and I are in accord in dissing California's aggressive new AI rules, which appear to demand public notices every time a company uses spreadsheets containing personal data to make a business decision. I call it the most toxic fount of unanticipated tech liability since Illinois's Biometric Information Privacy Act. Maury, Jane and I explore the surprisingly complicated questions raised by Meta's decision to offer an ad-free service for around $10 a month. We explore what Paul calls the decline of global trade interdependence and the rise of a new mercantilism. Two cases in point: the U.S. decision not to trust the Saudis as partners in restricting China's AI ambitions and China's weirdly self-defeating announcement that it intends to be an unreliable source of graphite exports to the United States in future. Jane and I puzzle over a rare and remarkable conservative victory in tech policy: the collapse of Biden administration efforts to warn social media about foreign election meddling.  Finally, in quick hits, I cover the latest effort to extend section 702 of FISA, if only for a short time. Jane notes the difficulty faced by: Meta in trying to boot pedophiles off its platforms. Maury and I predict that the EU's IoT vulnerability reporting requirements will raise the cost of IoT. I comment on the Canadian government's deal with Google implementing the Online News Act Download 484th Episode (mp3) You can subscribe to The Cyberlaw Podcast using iTunes, Google Play, Spotify, Pocket Casts, or our RSS feed. Anchored by Truth from Crystal Sea Books - a 30 minute show exploring the grand Biblical saga of creation, fall, and redempti

Episode 223 – Seriousness of Sin – Part 2 – Hell Welcome to Anchored by Truth brought to you by Crystal Sea Books. In John 14:6, Jesus said, “I am the way, the truth, and the life.” The goal of Anchored by Truth is to encourage everyone to grow in the Christian faith by anchoring themselves to the secure truth found in the inspired, inerrant, and infallible word of God. Script: The rich man also died and was buried. He went to hell and was suffering terribly. … he said to Abraham, “Have pity on me! … I'm suffering terribly in this fire.” Luke, Chapter 16, verse 23, Contemporary English Version ******** VK: Hello! I’m Victoria K. Welcome to Anchored by Truth brought to you by Crystal Sea Books. We’re very happy to be with you again. Today on Anchored by Truth we’re going to continue the series we began last time that we are calling this series “The Seriousness of Sin.” This may very well be the most important series that we have ever done because of the biggest challenges confronting Christianity today is a determined attempt to eradicate the concept of sin. We live in a day and time that shuns the idea that there could be a holy God who has given commands to mankind and that He will hold people accountable when they violate those commands. So, we are going to spend several episodes of Anchored by Truth reaffirming that not only does the Bible firmly teach the reality of sin, but also that our ordinary life experiences ratify that sin is a continuing plague and problem for all of us. In the studio as we continue our series we have RD Fierro who is an author and the founder of Crystal Sea Books. RD, why don’t you give us a brief overview of some of the big ideas that we discussed last time? RD: Well, one idea we covered, as you just mentioned, is there are many people today who vehemently disagree that sin even exists. Our broader culture wants to do away with the idea of sin because the concept of sin affirms the existence of God and affirms not only that God exists but also that God has established obligations to which all people are subject. And a third concept that applies to the concept of sin is that of failure – and not just failure but willful failure, willful disobedience. These three elements, at a minimum, all make the notion of sin a very unpopular notion is a society that believes reality is so malleable that there are dozens of genders. As some commentators have put it, when we believe we can establish our own reality the next step is to see ourselves as God. That’s all nonsense, of course, but all we have to do is look around and we see that people are starting to buy into the nonsense. It’s dangerous and eternally deadly. VK: People have chased the idea that they can be like God ever since Satan first tempted Adam and Eve in the Garden of Eden. In Genesis, chapter 3, verse 5 we hear Satan saying to Eve, “God understands what will happen on the day you eat fruit from [the tree of the Knowledge of Good and Evil]. You will see what you have done, and you will know the difference between right and wrong, just as God does.” That’s from the Contemporary English Version. RD: Right. People, especially in the west, find the idea of obligatory standards and commands one of the most objectionable ideas possible. In previous decades people at least had a basic understanding that the universe, the created order, could not exist without a Creator. God’s necessity as the Creator formed a common starting point for just about all world views. But today we have embraced deep time, evolution, and uniformitarianism as concepts to explain the universe’s appearance as it is. We have thereby done away with the necessity to believe in God as the Creator much less in God as the ultimate lawgiver. VK: As the prominent atheist Richard Dawkins put it in his book The Blind Watchmaker, “Darwin made it possible to be an intellectually fulfilled atheist.” RD: Sadly, yes. So, do away with God as Creator and you’ve done away with God as Lawgiver. Do away with God and you do away with any transcendent moral or ethical standards that bind human behavior. Do away with standards and you’ve done away with the possibility that you might fail those standards or that anyone might judge you and assign consequences for that failure. So, in one short sequence of thought you have done away with sin. VK: This is one reason that what some term “the battle for the beginning” is so important. When God is replaced by evolutionary thought the door to all kinds of mischief swings wide open. RD: Yes. But the door that is swinging open is actually the gate to hell. The God of the Bible is a perfectly sovereign, holy, and just God. He has set standards and given commands to the creature He created in His image. The commission of the first sin by a man and woman resulted in the loss of an earthly Paradise. The commission of all subsequent sins creates the risk of people losing an eternal Paradise. That’s why we are doing this series. We have all lost that original earthly paradise. We don’t want people losing out on an eternal one also. VK: So, today we want to talk about what the Bible tells us is in store for those who do forsake their eternal paradise – who are condemned to hell as a consequence of their sin. RD: Right. There is a lot at stake –an immeasurable amount – when people don’t understand the seriousness of sin. Actually, the simple fact that Jesus had to die on the cross to atone for our sins should be all that we need to understand just how serious sin is. The eternal, almighty Son of God had to leave a throne He had occupied for all eternity, come to earth to assume a human nature, be born in humble circumstances, and then die a miserable death of the worst kind just to make our delivery from sin possible. Just thinking about that straightforward fact ought to be all that we need to say about how serious sin really is. VK: But today, it’s not. As we have mentioned many people today don’t believe in God. They don’t believe in the inspired, inerrant, and infallible Word of God, the Bible, and even many who do believe in God and the Bible don’t acknowledge the reality of sin and hell. They allegorize the parts of the Bible that plainly talk about hell or treat them as poetic moral lessons designed to teach but without any underlying substantive reality. But, we might ask, if there is no corresponding, underlying reality that is horrible then why would the so-called moral lesson have any moral value or meaning? We warn children about the consequences of making bad decisions because the consequences are real. The child who touches the hot stove knows that the lesson “don’t touch” was important. The consequence reinforces the importance of the lesson. But the child who is told not to touch the stove and touches when it’s cold learns nothing. Or worse the child forms the very dangerous false idea that the stove may be touched at any time without repercussions. If hell is not real with real suffering then of what value is a moral lesson that uses hell as a potential consequence. RD: As I sometimes say in our Life Lessons with a Laugh, “exactamundo.” A little thinking quickly tells you that there must be a real place that possesses the attributes of hell otherwise the idea of hell is of little to no value in teaching a moral lesson. So, the cynics who doubt the Bible’s descriptions of hell as being a literal place are just being silly when they say that the idea of hell was just a way of trying to convey a moral imperative. But there is another and even more serious reason that we cannot reasonably allegorize or diminish the reality of hell. VK: What is that? RD: Because the person in the Bible that talked the most about hell – from whom we get the most information about hell – is Jesus. So, we can’t dismiss the reality of hell without dismissing the sinlessness of Jesus. VK: For instance, in the Gospel of Matthew, chapter 13, verses 49 and 50 Jesus said, “That is the way it will be at the end of the world. The angels will come and separate the wicked people from the righteous, throwing the wicked into the fiery furnace, where there will be weeping and gnashing of teeth.” In the Gospel of Mark, chapter 9, verses 47 and 48 Jesus said, “It’s better to enter the Kingdom of God with only one eye than to have two eyes and be thrown into hell, ‘where the maggots never die and the fire never goes out.’” And in the Gospel of Matthew, chapter 5, verse 22 Jesus said, “But I say, if you are even angry with someone, you are subject to judgment! If you call someone an idiot, you are in danger of being brought before the court. And if you curse someone, you are in danger of the fires of hell.” These are just examples of some things that Jesus said about hell. RD: No one in the Bible talked more about hell than Jesus. That makes sense because Jesus mission on the earth was to provide the means by which sinful people could avoid hell as their eternal destiny. His mission would have made absolutely no sense if hell didn’t exist as a real place and a real possibility. And if Jesus had somehow just been threatening people with a non-existent penalty he would have been the opposite of a great teacher or a good man. And He certainly could not have been the sinless Savior if he had lied to people so many times and on such a serious subject. But since hell is real Jesus had every reason to mention it frequently during his teaching. VK: Just those few verses show how remarkable it is for anyone who claims to be a Christian to doubt that hell exists as a literal place. It is one thing for an unbeliever to doubt whether hell is real, but it is another thing for a Christian to do so. Literally, our salvation depends on whether Jesus was right about hell being a place of real terror and torment. If Jesus was mistaken about hell or He lied about it that would mean Jesus could be wrong or He sinned. But God can do neither. For Jesus to be our Savior He must be fully divine as well as fully human. God cannot be wrong or sin. Fortunately, our salvation is intact because Jesus was not wrong about hell and He was being straight when He warned His audiences to fear it. RD: Right. Some people will object to the reality of hell under the assertion that “a loving God could never send anyone to hell.” But what those people miss is that God is holy and just besides being loving. A just God cannot not punish evil and rebellion. VK: And there is plenty of evil and rebellion in this world. RD: Amen. A perfectly just God (which God is) must punish rebellion, sin, and evil. A holy God cannot tolerate unrighteousness or wickedness in His sight or presence and God does not. Even with respect to the redeemed God has already vindicated His just and holy nature by punishing someone for the sins of the redeemed. It’s just that Jesus has already borne the punishment for the sins of His people. When the Bible says that Jesus “propitiated” our sins it means He willingly accepted the punishment that was due to us and so restored our holy status in the sight of God. The American Heritage Dictionary defines “propitiation “to gain or regain the goodwill or favor of; appease.” As some commentators have phrased it, “God saved us from Himself, for Himself, by Himself.” VK: So, for the redeemed God has already punished their sin through Jesus. That’s why we can say that we possess the righteousness of Christ. Jesus accepted the punishment that we deserve so we can receive the rewards that He deserved. A righteous God cannot punish us because Jesus has already been punished for us. But the story is different for those who reject Jesus’ offer of salvation. Since they refuse to allow Jesus sacrifice to apply to them the will have to suffer for their own sins. But a finite man can never repay an infinite sin debt. So, their repayment attempt must last for all eternity. RD: So, the people who say a loving God would never send anyone to hell are correct. God is loving and God has expressed that love through the sacrifice that Jesus made for us. But to reject Jesus is to reject God’s love and mercy. Those who are unwilling to be examples of God’s mercy and grace will automatically be examples of God’s perfect justice. And that justice demands punishment for sin. VK: So, for people the stakes – the stakes of sin - really don’t get any higher than that. As we said last time, strictly speaking nothing can separate us from God’s presence. God is omnipresent. He is present at all times and all places including hell. But hell is where God’s wrath is eternally present not His goodness, His kindness. Sin separates us from God’s favor and blessing and that is the danger that we must all consider. But in a very real sense God is not sending anyone to hell. God is simply honoring the choice they are making when they reject His offer of mercy. God is willing to save everyone. 2 (second) Peter, chapter 3, verse 9 puts it this way. “The Lord isn’t really being slow about his promise, as some people think. No, he is being patient for your sake. He does not want anyone to be destroyed, but wants everyone to repent.” That’s from the New Living Translation. RD: God wants everyone to repent. All who repent and accept Christ are saved. Those who repent receive the consequences of their choice – a life for all eternity with God and Jesus where they live, which is in heaven. Those who reject Christ receive the consequences of their choice. They live for all eternity away from the blessings of heaven and with the misery of hell. C.S. Lewis famously said in his book The Problem of Pain that the “gates to hell are locked from the inside.” Said differently, hell is a consequence of our choices not a consequence of our composition. VK: You are alluding to the fact that hell was not a necessary part of our physical creation. In Genesis, chapter 1, verse 31 we hear that, “Then God looked over all he had made, and he saw that it was very good!” That’s from the New Living Translation. Well, God would not have pronounced everything “very good” if sin and death were present in the original creation. They weren’t. Sin entered the world through Satan’s temptation and death entered the world because of sin. The entrance of sin made the reality of hell an inevitable consequence for those who choose to remain in their sin. RD: So, all of this points out why we need to soberly and honestly discuss the seriousness of sin. Sin and hell are inextricably linked. Sin separates from man from God’s goodness. Those who regret that separation can seek reconciliation through Jesus. That’s why we open every show of Anchored by Truth with the quote from Jesus in John 14:6. “I am the way, the truth, and the life.” Jesus is the way to salvation and heaven. Despite the objections of the world Jesus is the only way to salvation. So, when people reject Jesus they are announcing to the world their preference to continue their separation from God and Jesus. As someone has wryly observed to force an unrepentant sinner to be in heaven in the immediate presence of God’s face would be hell for that person. As some have put it, in the end there are only two choices. There are those who say to God, “thy will be done.” And there are those to whom God says, “thy will be done.” VK: God’s will as we heard in 2 Peter 3:9 is for everyone to come to repentance and thereby go to heaven. But I suppose there are those who say “well, why doesn’t God just end the existence of anyone who rejects Him?” In other words, wouldn’t oblivion just be an alternative to consigning people to a place where, in Jesus’ words, “where the maggots never die and the fire never goes out.” RD: Well, I suppose the immediate response to someone who suggests that oblivion would be preferable to an eternity in hell would be to ask them, “how do you know?” It’s pretty obvious those recommending oblivion are still around. And there is a basic category error that is present in their assertion – that nothing is better than something. Oblivion would be non-existence. Is non-existence better than existence? We can’t ask the non-existent. VK: Because they don’t exist. Fair point. RD: But there is another problem with the assertion that oblivion is a preferable alternative to hell for the rebellious. It diminishes the dignity of human beings. When God made man He made man His image bearer. With that special status came the ability to reason, understand the world around him, and make free choices. Adam and Eve made the free choice to eat from the one tree that was off limits. And if we are being honest we would all have to admit that we have all freely sinned of our own free choice. We may not like the consequences of our sin but we have all chosen to sin. Hell is one of the consequences of our sin. As dire and sad as it may be God confirms the fact that He will respect the consequences of man’s free choices. VK: God told Adam and Eve not to eat from the Tree of the Knowledge of Good and Evil. The first consequence of their rebellion fell on an innocent animal. This was a foreshadowing of the fact that one day the consequences of their sin would be borne by the innocent Lamb of God. But another consequence of their rebellion was that they were exiled from earthly paradise - Eden. That foreshadowed that one day some of their descendants would be exiled from the heavenly paradise that surrounds God’s throne. Actions have consequences. Adam and Eve found that out. Unfortunately, those who impenitently reject Jesus offer of salvation will also find out that their rejection has consequences. RD: Yes. If God had left Adam and Eve in Eden they would have rightly learned that they could ignore God’s commands without consequence. That would exhibit blatant disrespect for God. But Adam and Eve bore God’s image. Disrespect for the Image Creator also diminishes the image bearer. Just as if we have a bruise and look at ourselves in the mirror we don’t just see our image we see our bruise. Well, a perfectly holy, infinite Being can’t tolerate rebellion, disrespect, or be bruised. So, one of the consequences of Adam and Eve’s rebellion besides being cast out of Eden was to create the possibility of eternal damnation. Similarly, Adam and Eve would have been far less protected from the elements if they had not accepted God’s provision for covering their nakedness – the skin of the innocent animal. VK: I see what you’re getting at. Adam and Eve’s actions in the garden set off a chain of consequences. The skin of the innocent animal partially offset as least some of the consequence. Jesus’ death as an atonement for sin offsets the consequences of sin, one of which is hell, but only partially – only for those who accept Christ as their Savior. Jesus’ sacrifice is sufficient to offset the sins of everyone and God would like that – but many people, even today, continue to reject Jesus of their own free will. God permits free choice but as you say in your Christmas epic poem The Golden Tree: Eagle Enigma “[God] knows that if we [make the wrong choice] we'll suffer though we had good intent. For the [God] permits free choice even when it brings sad events.” RD: Yes. If God simply obliterated everyone who rebels against Him He would be treating people differently. The people in heaven would receive the consequences of their choice to accept Christ’s provision for their sin. And those consequences will go on for all eternity. But the people obliterated would not receive eternal consequences of their choice because they would go out of existence. It is absolutely true that the experiences of the two groups are going to be dramatically different but the duration of the experiences is going to be identical – all of eternity. But that’s why we do what we do on Anchored by Truth. There is no need for anyone listening to ever suffer in hell. Avoiding hell is as simple as acknowledging their sin and accepting Jesus’ offer of salvation. VK: I am always reminded of the thief on the cross next to Jesus. In the Gospel of Luke, chapter 23, verse 42 where we hear “Then [the thief] said, ‘Jesus, remember me when you come into your Kingdom.’ And Jesus replied, ‘I assure you, today you will be with me in paradise.’” Jesus didn’t tell the thief to do anything or be anything. The thief recognized that Jesus could save him and simply announced that tiny bit of faith. His faith was instantly rewarded by Jesus with the promise that the thief would be with Him that day in paradise. Eden restored for one lost sinner. RD: Yes. And Eden can be restored for all lost sinners. Hell is not just a possibility, it is a certainty for all who reject Jesus. So, why do that? Why risk eternal fire when there is no need. Jesus would happily save every person alive on the earth today, every person who has ever lived. It is the stubborn refusal to acknowledge that we have rebelled that consigns people to hell. And that alone tells us how serious sin is. Sin is so serious that the 2nd Person of the Holy Trinity left His eternal throne to remove the need for anyone to endure hell. Yet we not only treat sin lightly today, many people try to deny its existence and reality entirely. VK: So, the big idea that we wanted to introduce in this series is that sin is seriousness. Sin’s seriousness is revealed by looking at the provisions that God has made to change the consequence of our sin from eternal damnation to eternal blessing. The stakes of sin have been addressed by Jesus. The question for us is whether we will accept the provisions that He made for us or stubbornly continue to insist that sin is just an outdated concept with no relevance to our modern world. This sounds like a great time to pray. Since we have just been talking about the fact that there are many people who have yet to acknowledge the fact that they are separated from God, today let’s listen to a prayer for the spiritually lost. Peter told us that God wants everyone to come to repentance. This prayer is us setting our hearts in agreement with the Apostle that God’s gracious offer of salvation has not changed for over 2,000 years. ---- PRAYER FOR THE SPIRITUALLY LOST VK: We’d like to remind our audience that a lot of our radio episodes are linked together in series of topics so if they missed any episodes or if they just want to hear one again, all of these episodes are available on your favorite podcast app. To find them just search on “Anchored by Truth by Crystal Sea Books.” If you’d like to hear more, try out crystalseabooks.com where “We’re not perfect but our Boss is!” (Opening Bible Quote from the Contemporary English Version) Luke, Chapter 16, verse 23, Contemporary English Version

Does the government need a warrant to warn me about a cyberattack?

We open this episode of the Cyberlaw Podcast with some actual news about the debate over renewing section 702 of FISA. That's the law that allows the government to target foreigners for a national security purpose and to intercept their communications in and out of the U.S. A lot of attention has been focused on what happens to those communications after they've been intercepted and stored, and particularly whether the FBI should get a second court authorization—maybe even a warrant based on probable cause—to search for records about an American. Michael J. Ellis reports that the Office of the Director of National Intelligence has released new data on such FBI searches. Turns out, they've dropped from almost 3 million last year to nearly 120 thousand this year. In large part the drop reflects the tougher restrictions imposed by the FBI on such searches. Those restrictions were also made public this week. It has also emerged that the government is using section 702 millions of times a year to identify the victims of cyberattacks (makes sense: foreign hackers are often a national security concern, and their whole business model is to use U.S. infrastructure to communicate [in a very special way] with U.S. networks.) So it turns out that all those civil libertarians who want to make it hard for the government to search 702 for the names of Americans are proposing ways to slow down and complicate the process of warning hacking victims. Thanks a bunch, folks! Justin Sherman covers China's push to attack and even take over enemy (U.S.) satellites. This story is apparently drawn from the Discord leaks, and it has the ring of truth. I opine that the Defense Department has gotten a little too comfortable waging war against people who don't really have an army, and that the Ukraine conflict shows how much tougher things get when there's an organized military on the other side. (Again, credit for our artwork goes to Bing Image Creator.) Adam Candeub flags the next Supreme Court case to nibble away at the problem of social media and the law. We can look forward to an argument next year about the constitutionality of public officials blocking people who post mean comments on the officials' Facebook pages.  Justin and I break down a story about whether Twitter is complying with more government demands under Elon Musk. The short answer is yes. This leads me to ask why we expect social media companies to spend large sums fighting government takedown and surveillance requests when it's much cheaper just to comply. So far, the answer has been that mainstream media and Good People Everywhere will criticize companies that don't fight. But with criticism of Elon Musk's Twitter already turned up to 11, that's not likely to persuade him. Adam and I are impressed by Citizen Labs' report on search censorship in China. We'd both kind of like to see Citizen Lab do the same thing for U.S. censorship, which somehow gets less transparency. If you suspect that's because there's more censorship than U.S. companies want to admit, here's a straw in the wind: Citizen Lab reports that the one American company still providing search services in China, Microsoft Bing, is actually more aggressive about stifling political speech than China's main search engine, Baidu. This fits with my discovery that Bing's Image Creator refused to construct an image using Taiwan's flag. (It was OK using U.S. and German flags, but not China's.) I also credit Microsoft for fixing that particular bit of overreach: You can now create images with both Taiwanese and Chinese flags.  Adam covers the EU's enthusiasm for regulating other countries' companies. It has designated 19 tech giants as subject to its online content rules. Of the 19, one is a European company, and two are Chinese (counting TikTok). The rest are American companies.  I cover a case that I think could be a big problem for the Biden administration as it ramps up its campaign for cybersecurity regulation. Iowa and a couple of other states are suing to block the Environmental Protection Agency's legally questionable effort to impose cybersecurity requirements on public water systems, using an “interpretation” of a law that doesn't say much about cybersecurity into a law that never had it before. Michael Ellis and I cover the story detailing a former NSA director's business ties to Saudi Arabia—and expand it to confess our unease at the number of generals and admirals moving from command of U.S. forces to a consulting gig with the countries they were just negotiating with. Recent restrictions on the revolving door for intelligence officers gets a mention. Adam covers the Quebec decision awarding $500 thousand to a man who couldn't get Google to consistently delete a false story portraying him as a pedophile and conman. Justin and I debate whether Meta's Reels feature has what it takes to be a plausible TikTok competitor? Justin is skeptical. I'm a little less so. Meta's claims about the success of Reels aren't entirely persuasive, but perhaps it's too early to tell. The D.C. Circuit has killed off the state antitrust case trying to undo Meta's long-ago acquisition of WhatsApp and Instagram. The states waited too long, the court held. That doctrine doesn't apply the same way to the Federal Trade Commission (FTC), which will get to pursue a lonely battle against long odds for years. If the FTC is going to keep sending its lawyers into battle like conscripts in Bakhmut, I ask, when will the commission start recruiting in Russian prisons? That was fast. Adam tells us that the Brazil court order banning on Telegram because it wouldn't turn over information on neo-Nazi groups has been overturned on appeal. But Telegram isn't out of the woods. The appeal court left in place fines of $200 thousand a day for noncompliance.    And in another regulatory walkback, Italy's privacy watchdog is letting ChatGPT back into the country. I suspect the Italian government of cutting a deal to save face as it abandons its initial position on ChatGPT's scraping of public data to train the model. Finally, in policies I wish they would walk back, four U.S. regulatory agencies claimed (plausibly) that they had authority to bring bias claims against companies using AI in a discriminatory fashion. Since I don't see any way to bring those claims without arguing that any deviation from proportional representation constitutes discrimination, this feels like a surreptitious introduction of quotas into several new parts of the economy, just as the Supreme Court seems poised to cast doubt on such quotas in higher education.  Download 455th Episode (mp3) You can subscribe to The Cyberlaw Podcast using iTunes, Google Play, Spotify, Pocket Casts, or our RSS feed. Every government on the planet announced last week an ambition to regulate artificial intelligence. Nate Jones and Jamil Jaffer take us through the announcements. What's particularly discouraging is the lack of imagination, as governments dusted off their old prejudices to handle this new problem. Europe is obsessed with data protection, the Biden administration just wants to talk and wait and talk some more, while China must have asked ChatGPT to assemble every regulatory proposal for AI ever made by anyone and translate it into Chinese law.  Meanwhile, companies trying to satisfy everyone are imposing weird limits on their AI, such as Microsoft's rule that asking for an image of Taiwan's flag is a violation of its terms of service. (For the record, so is asking for China's flag but not asking for an American or German flag.) Matthew Heiman and Jamil take us through the strange case of the airman who leaked classified secrets on Discord. Jamil thinks we brought this on ourselves by not taking past leaks sufficiently seriously. Jamil and I cover the imminent Montana statewide ban on TikTok. He thinks it's a harbinger; I think it may be a distraction that, like Trump's ban, produces more hostile judicial rulings. Nate unpacks the California Court of Appeals' unpersuasive opinion on law enforcement use of geofencing warrants. Matthew and I dig into the unanimous Supreme Court decision that should have independent administrative agencies like the Federal Trade Commission and Securities and Exchange Commission trembling. The court held that litigants don't need to wend their way through years of proceedings in front of the agencies before they can go to court and challenge the agencies' constitutional status. We both think that this is just the first shoe to drop. The next will be a full-bore challenge to the constitutionality of agencies beholden neither to the executive or Congress. If the FTC loses that one, I predict, the old socialist realist statue “Man Controlling Trade” that graces its entry may be replaced by one that PETA and the Chamber of Commerce would like better. Bing's Image Creator allowed me to illustrate that possible outcome. See attached.  In quick hits:  I update listeners on the fight over renewal of Section 702 of the Foreign Intelligence Surveillance Act and the FBI's search of its 702 database for messages about Congressman Darin LaHood (R-Ill.). It's far from a scandal, and it may show that the whole effort to treat such searches as shocking privacy intrusions is bogus.  Hackers have claimed deep access to Western Digital systems. The good news is that they seem unable to encrypt it all, so they're relying on doxing threats to earn the ransom they want. The Indian government has given itself authority to “fact check and order the deletion of social media posts. Nobody thinks that's a good idea, but when I ask whether it's all that different from the CDC/social media alliance that suppressed true information during COVID times, Jamil disagrees. If you've missed our conservative catfights, this is a taste of things to come. 1. Facebook Retires ‘Instant Articles' - Originally launched in 2015, Instant Articles were designed to provide publishers with a more engaging, fast-loading way to present their articles on Facebook, helping to maximize reader engagement within the app. As reported by Axios, Meta's ending support for Instant Articles as it works to better align with user preferences, which, increasingly, see video being its most engaging content format.2. TikTok Adds Photo Mode - Now TikTok has copied Instagram (perhaps in retaliation for IG copying all of its stuff) and launched  a new ‘Photo Mode' for still images in the app. Photo Mode looks exactly like Instagram, with users able to post carousels of still images that users can scroll through in the app. Per TikTok:“Photo Mode allows you to share carousel posts of still images that automatically display one after another. You can add music to soundtrack the images, which viewers can swipe through at their own pace.”3. YouTube Launches @handles For Channels - YouTube's moving more into line with other social networks with the addition of @handles for channels, which will make it easier to drive traffic to your profile, and promote your channel in the app.“Handles are a new unique identifier (example @youtubecreators) & ALL YouTube channels will have one. Your unique @handle will help people find & interact with you & your YouTube channel. And because handles are unique (unlike channel names), it's easy to confirm if you're engaging with the right person or not.”Your @handle, which will be unique to your channel (unlike Channel names), will directly connect people to your content, like it does on Twitter, TikTok, Instagram, etc. @handles will also function as a unique channel URL, providing another branding opportunity. Up till now, custom channel URLs have only been available to creators with 100 subscriptions, but now, YouTube's making the option available to all users in the app. @handles will also make it easier and faster to mention channels in comments, community posts and video descriptions.“For example, creators can be shouted out in a mention in comments or tagged in the title of a recent collab, helping them increase visibility and reach with new audiences.”Part of the idea here is to better promote channels, in alignment with habitual trends, with a key consideration likely being Shorts and helping to maximize Shorts channel growth by making it easier to follow creators. Another element that YouTube's looking to tackle is the rise of copycat channels, where scammers create channels that look similar to popular YouTubers', often by using the same channel name. By ensuring that each channel has a unique @handle, which they can promote direct, that will make it harder to create replica channels, and trick users with uploads and scams.4. Google Data Studio Is Now Looker Studio - Google launched Data Studio in March 2016 as part of the enterprise Google Analytics 360 suite, with a free version that lets you turn your data into informative, easy-to-read, easy-to-share, and fully customizable dashboards and reports. There are easy-to-use drag-and-drop features to customize reports from various data sources, including Search Console, Google Analytics, Google Ads, and much more. Now Google has renamed the popular analytics and data platform from Google Data Studio to Looker Studio. Google wrote “starting today, Data Studio is now Looker Studio.” “With this complete enterprise business intelligence suite, we will help you go beyond dashboards and infuse your workflows and applications with the intelligence needed to help make data-driven decisions,” Google added.Google also announced a Pro, paid, version of Looker Studio named Looker Studio Pro. Google said that the Pro version will get new enterprise management features, team collaboration capabilities, and SLAs. Google said that is just the first release and the company has “developed a roadmap of capabilities, starting with Dataplex integration for data lineage and metadata visibility, that our enterprise customers have been asking for.”You can learn more about this change on the Google blog.5. Google Swaps Title Tags With Site Names For Mobile Homepage Results - Google is now only showing the generic site name in mobile search results that are for the entire website, such as for the home page. Google is using site names in order to make it easier for users to identify the specific website in the search results. Here is what Google published in the official announcement:  “Today, Search is introducing site names on mobile search results to make it easier to identify the website that's associated with each result…”This new feature is available in the English, French, Japanese, and German languages and will begin showing up in other languages over the next few months. Google is recommending the use of the WebSite structured data type because Google is using the WebSite structured data type, specifically the “name” property, to understand what the site name of a website is. So it is best that your site has the following: WebSite structured data Title tag Headings (H1, H2, etc.) Open Graph Protocol meta data, specifically the og:site_name You can read the official announcement here and the Search Central Documentation here. 6. Google Renames Webmaster Guidelines To Search Essentials & Some Changes - Google has renamed the Google Webmaster Guidelines to Google Search Essentials. The name change is Google's ongoing efforts to remove the term "webmaster" so that these tools and documentation do not narrow the focus to just "webmasters," but expands it to publishers, site owners, developers, creators, and so on. Google also changed the overall format, added clearer terms and examples and also tried to simplify them for easier consumption. Google explained they updated the: Technical requirements: It is a new section to help people understand how to publish content in a format that Google can index and access.  Spam policies: Google updated its guidance for its policies against spam, to help site owners avoid creating content that isn't helpful for people using Google Search. Google explained that most of the content in these spam policies has already existed on Google Search Central in the "Quality Guidelines", Google did make a few additions to provide clearer guidance and concrete examples for issues like deceptive behavior, link spam, online harassment, and scam and fraud.  Key best practices: Google published new guidance with key best practices that people can consider when creating sites, to create content that serves people and will help a site be more easily found through Google Search. 7. Google Announces Search Central Live Conference - Google announced live conference series called Search Central Live previously known as Webmaster Conference. The conference is scheduled for November 24, 2022 in Singapore. Registration for a limited amount of seats is currently open until November 15th, with ticket confirmation set to begin on November 17. Admission to the event is free. Per Google:“Before you buy your transcontinental plane ticket, keep in mind that we do plan to have more of these events in the future, and some might be closer to your base. Stay tuned for these updates on the Search Central Live event page or on Twitter.”Here is the official announcement.8. Microsoft Bing Launches Image Creator - An AI Image Generator - Microsoft has launched Image Creator - an AI image generator to its Bing search engine, which enables users to create digital art from text input. Let's say a picture of a Shiba Inu as an astronaut would go perfectly with a blog post you're writing. You turn to the search engines for a free-to-use image, but you can't find one that matches your criteria. With the new Image Creator tool coming to Microsoft Bing, you can generate the exact image you need by inputting descriptive text.Image Creator is powered by DALL-E 2 image generator technology developed by OpenAI. Microsoft says Image Creator can assist searchers with creating images that don't exist yet.9. Google's Stance On The Use Of AI Images - Google's John Mueller and Lizzi Sassman discussed the topic of using AI Images on your site in Episode 48 of the Search Off The Record podcast. Although autogenerated text content is prohibited/limited for ranking in Google Search, surprisingly there was no similar prohibition or caveat discussed about AI generated images and ranking in Google Images.10. Google Updates Image Structured Data - Google has added three new structured data properties to be used with the ImageObject type in order to add support for credit, copyright and image creator information via structured data. Google's developer support changelog states:“Added support for image credits to the Image Metadata structured data documentation. Previously, you could only provide image credit information with IPTC photo metadata. When you specify image metadata, Google Images can show more details about the image, such as who the creator is, how people can use an image, and credit information. ”This is what the new structured data types are for, according to Schema.org: creditText - Text that can be used to credit person(s) and/or organization(s) associated with a published Creative Work. creator - The creator/author of this CreativeWork. This is the same as the Author property for CreativeWork. copyrightNotice - Text of a notice appropriate for describing the copyright aspects of this Creative Work, ideally indicating the owner of the copyright for the Work.” 11. Google's Advice On How to Write Good Alt Text - The purpose of alternative text (alt text) in images is to provide audiences with screen readers a way to understand the images. In Episode 48 of the Search Off The Record podcast, John Muller and Lizzi Sassman gave the following advice on how to write Good Alt text:“Imagine that you're reading the web page aloud over the phone to someone who needs to understand the page. This should help you decide what (if any) information or function the images have. If they appear to have no informative value and aren't links or buttons, it's probably safe to treat them as decorative. From an SEO point of view, my recommendation is always to provide context for the image as well in the alt text. So if you have a picture of a beach, don't just be like, ‘Oh, this is a photo of a beach.' But rather like, ‘This is the beach before the chemical spill happened.' And… Because it's very different context if someone is searching for a beach for a holiday, it's like, ‘Oh, I want to see a beautiful beach. I'll go there on vacation.' And if you notice, well actually, this is before the chemical spill happened, then it's like, ‘Well, maybe like that would lend itself to different kinds of Search queries.'Because ultimately, when you're talking about Image Search, it's not that people want an image, but rather they want information which is attached to that image. They want kind of to understand a specific topic to find some information. And that additional context is something that you can provide in the alt text. And that's something that they might be searching for. And if they're searching for it, then make it easy for them to find that.”12. 3 New Examples From Google On How To Write Product Reviews - There has been a lot of confusion about the types of sites that may be impacted by the product reviews algorithm updates. This algorithm was designed to look at sites that offer product reviews, not necessarily e-commerce sites that have reviews on the product listing pages. So Google has added three new examples to the top of the “how to write product reviews” help document, clarifying more types of sites that may be impacted by the product reviews algorithm updates. The 3 example are: An expert staff member of a merchant that guides shoppers between competing products. A blogger that provides independent opinions of products. An editorial staff member at a news or other publishing site. These examples provide additional guidance on what types of sites may be impacted by this set of algorithm updates. In short, it is about content where someone is doing a review of a product, either as a comparison or a deeper dive into a specific product. This can include merchant sites, shopper guides, bloggers that share their opinion, news or publishing sites doing reviews, and more.As Alan Kent of Google recently said on Twitter “a merchant's product page with user reviews is not considered a “product review page” in this context.”Google also recently clarified that structured data may help Google identify product review-type content, but it is one of many ways Google identifies such content. Danny Sullivan wrote, “as for structured data, it might help us better identify if something is a product review, but we do not solely depend on it.”13. Google Still Does Not Use HTML Lang Attribute - Google's John Mueller https://twitter.com/JohnMu/status/1577945097693532166re-confirmed that Google Search does not use the HTML lang attribute. He said many screen readers do and Microsoft Bing might use it as well, but Google Search still does not. This is a similar statement to what he said several years ago in a video response - “We don't use that at all. So we use the hreflang links if you have that if you have different language versions. But the language attribute within the HTML markup is something we don't use at all. We've found that this language markup is something that is almost always wrong. So we tend to ignore that.”14. Google: SEO Is A Long Game - We all know that ranking well for competitive terms in Google Search is not as easy, or even a fraction as easy, as it was two decades ago. This is because of many variables including but not limited to Google's algorithms getting better and there being a lot more competition.John Mueller of Google responded to a complaint about SEO being too hard for news businesses to even bother trying. The question was "is SEO dead? I mean, starting with a new website these days it is basically impossible to outrank high authority websites. So many high DA showing up in the SERP. What can we do with a new website?"John's response was solid, he said "If you mean it should be trivial to out-rank long-existing, legitimate businesses with some SEO tricks, then yes, that kind of SEO is long dead. It's not enough to throw some keywords on a page to make it useful to users."But that does not mean SEO is dead or you should give up and not try to start a competing business with others. You just need to take the time and effort to compete. The same logic applies to offline success as it does with online success. You can't just start a new brand of soda and expect to compete with Pepsi or Cola overnight, it takes time, resources, marketing and a good product.15. Google: Do This To Get New Content Indexed Quickly - Google's John Mueller said that pinging Google that your sitemap file has been updated can help Google index your new content quickly. He said it is simply Google practice to ping Google with when your sitemap file is updated.Of course, this does not guarantee indexing. Google still does not index everything, so just because you might ping Google about a new URL, it does not mean Google will index it.John Mueller wrote on Twitter "Pinging a sitemap is a bit different than just providing it in the robots.txt -- by pinging, you're actively flagging a change in the sitemap file. If you're keen on having new content indexed quickly, that's a good practice."According to Google developers guide "Google doesn't check a sitemap every time a site is crawled; a sitemap is checked only the first time that we notice it, and thereafter only when you ping us to let us know that it's changed. Alert Google about a sitemap only when it's new or updated; don't submit or ping unchanged sitemaps multiple times."To use the ping tool, send a GET request in your browser or the command line to google.com, specifying the full URL of the sitemap. Make sure that the sitemap file is accessible. E.g: https://www.google.com/ping?sitemap=FULL_URL_OF_SITEMAP16. Google Ads Launches Content Suitability Center - Google has launched a new content suitability center in Google Ads where you can manage your suitability settings for all campaigns on YouTube and the Google Display Network.Google wrote, “previously, managing suitability settings was done in multiple, segregated sections of Google Ads and the experience differed across Google platforms.” “This led to a time-consuming and cumbersome implementation process, along with misconceptions and misuse of the controls. While exclusions can be helpful tools, brands also want to be mindful of the types of content they choose to exclude. Over-exclusion can negatively impact your cost and reach. It can also unintentionally exclude great, brand-safe content or content relevant to diverse communities,” Google added. When you enter the new suitability center in Google Ads, you can now select one of the three inventory modes. Inventory modes “cater to your preferences for various sensitive themes, such as profanity, sexual suggestiveness and violence,” Google explained. You can fine-tune additional exclusions from that point. Once you have designated your preferences at the account level, Google Ads will now automatically apply these settings to your future campaigns.17. Google Ads Will Remove Some Content Targeting In YouTube Conversion Campaigns In 2023 - A major benefit of YouTube ads has been the powerful targeting options, many of which will now be removed early next year according to a Google Ads help article. The help article, “Optimize your Video campaign for more conversions” contains a content targeting section that recommends avoiding the addition of content targeting (by keywords, topics or placements) in campaigns. These content targeting options are beloved by many advertisers due to the granularity they provide. Placements could target YouTube Channels, specific videos, video lineups, URLs, Apps, or collections. With the current targeting, advertisers could match ads to channels/videos to deliver more customized messages to audiences. This change will effectively put an end to the hyper-targeting that made YouTube so appealing for ad dollars.Another major blow is the loss of keyword targeting on the self-proclaimed 2nd largest search engine in the world. The removal of query targeting on a (video) search engine hurts. While keywords on YouTube haven't historically been as powerful as traditional search, it has been a way for advertisers to help answer queries with their video content. There is no doubt that advertisers will need to get more creative in order to hit their target audience.Advertisers running YouTube content targeting campaigns that leverage keywords, topics or placements will have the targeting removed. If you are running ads using content targeting options, you should stay tuned to updates as those targeting settings will be automatically removed from your campaigns. With less targeting, you'll reach a larger audience and may spend more on less qualified users.
