Trump and Trump v. V.O.S. Selections, Inc.) on November 5, 2025, where they appeared skeptical of the administration’s position that IEEPA grants the president authority to impose such sweeping tariffs during declared national emergencies.  Lower courts had previously ruled against the tariffs’ legality, but they remain in effect pending the Supreme Court’s decision.    These options are drawn from existing trade laws and have been used by past administrations. Here’s a breakdown of the key alternatives: Section 232 of the Trade Expansion Act of 1962: This allows the president to impose tariffs on imports deemed a threat to national security after an investigation by the Department of Commerce. There’s no cap on duty levels or duration, making it flexible for broad application, such as on steel or autos.  Section 301 of the Trade Act of 1974: Through the U.S. Trade Representative (USTR), this permits tariffs in response to unfair or discriminatory foreign trade practices that violate international agreements or harm U.S. commerce. No rate limit exists, but it requires an investigation and findings, which could target specific countries like China.  Section 122 of the Trade Act of 1974: This enables temporary import surcharges of up to 15% (or quotas) for up to 150 days to address “large and serious” balance-of-payments deficits. It’s seen as a quick interim option while longer-term measures are pursued, but extensions need congressional approval.  Section 201 of the Trade Act of 1974: Known as “safeguard” measures, this authorizes tariffs if surging imports are causing or threatening serious injury to domestic industries. It requires a U.S. International Trade Commission investigation and recommendation, with tariffs potentially lasting up to four years (extendable to eight).  Section 338 of the Tariff Act of 1930: This allows duties up to 50% on imports from countries engaging in “unfair” practices that discriminate against U.S. exports. It’s less commonly used and could face immediate lawsuits due to its broad interpretation potential. The administration has signaled readiness to shift to these tools, potentially starting with Section 122 for rapid implementation. U.S. Trade Deficit Drops 40% in Latest Commerce Dept Report  As you review this latest data on trade, remember any drop in trade deficits has two big picture functions: First, lower trade deficits generally mean the accompanying GDP release will be stronger than anticipated because imported products are a deduction from the valuation of all goods and services created in the U.S. economy.  Lower imports mean less is deducted. Secondly, and perhaps most importantly, a drop in the trade deficit created by diminished imports means more wealth remains inside the USA. We are not spending, sending money overseas, to import foreign goods at the same rate, and that money stays inside the U.S. economy. More wealth inside the U.S. provides the fuel for expanded domestic growth, more investment gains in USA manufacturing and USA industry and the ability to pay higher USA wages. The Commerce Department is reporting today that the U.S. trade deficit for October 2025 dropped to the smallest amount in 16-years.  A significant amount of the deficit drop was because a high value of physical precious metals (gold/silver) was exported, simultaneous with big offshore pharmaceutical companies dropping the prices of imported products (policy and tariff pressure).   Some may question whether internal consumer demand has declined, causing the significant drop in imports.  However, the U.S productivity rate is still very high – which generally means domestic consumer demand is still high and all units produced have a lower overall cost per unit. Economic analysis can get weedy…. so, a simple way to look at productivity is to think about baking bread in your kitchen. If you were going to bake 4 loaves of bread it might take you 2 hrs. start to finish. However, if you were going to bake 8 loaves of bread it would not take you twice as long because most of the tasks can be accomplished with simple increases in batch size, and only minor increases in labor time. Your productivity measured in the last four loaves is higher. Economic Productivity is measured much the same way, within what's called a production probability equation. Additionally, if two hours of your time are worth $40, each of four loaves of bread costs $10 in labor; but if you make 8 loaves in the same amount of time the labor cost is only $5/per loaf.   When we see higher productivity in direct alignment with GDP increases, the increased production indicates sustainable GDP growth. Trump signed a Presidential Memorandum directing the withdrawal of the United States from 66 international organizations that no longer serve American interests. The Memorandum orders all Executive Departments and Agencies to cease participating in and funding 35 non-United Nations (UN) organizations and 31 UN entities that operate contrary to U.S. national interests, security, economic prosperity, or sovereignty. This follows a review ordered earlier this year of all international intergovernmental organizations, conventions, and treaties that the United States is a member of or party to, or that the United States funds or supports. It's like a massive network of NGOs, except the entities exist exclusively with government funding. Just like the United Nations itself, the USA always pays the dues, fees and largest portion of the operating expenses, which includes payrolls and travel benefits. Other countries participate, but it is the USA who picks up the largest portion of the financial obligations for the organization itself to exist. Like USAID, the designated “global” organizations (conventions, treaties, etc) operate as massive bureaucratic rule makers for global standards and practices. The organizations themselves employ a network of downstream entities, agencies, contractors, think-tanks, academic liaisons and internal government offices who collaborate with the goals and objectives of the parent organization.   Withdrawing the support of the U.S. means cutting that entire apparatus off from receiving funding from the USA. Europe and the USA are the largest funders of each of these World Economic Forum aligned agencies. This Day in Legal History: Federal Court Strikes Down “Balanced Treatment” Law in ArkansasOn January 5, 1982, a federal district court in Arkansas issued a landmark ruling in McLean v. Arkansas Board of Education, striking down a state law that required public schools to give “balanced treatment” to both evolution and creation science. The law, known as Act 590, had been passed in 1981 and mandated that schools teach creationism—defined in the statute as a scientific model based on a literal interpretation of the Bible—alongside evolution. The law was immediately challenged by a coalition of clergy, educators, and scientists who argued that it violated the Establishment Clause of the First Amendment.Judge William Overton ruled that Act 590 was unconstitutional because it advanced a particular religious viewpoint under the guise of science. In his decision, Overton provided a clear and influential definition of what constitutes science, stating that scientific theories must be guided by natural law, testable, and subject to falsification. He found that “creation science” failed all of these criteria and was therefore religious in nature, not scientific. After returning to office in 2025, Trump secured the confirmation of 26 judicial nominees—more than in the first year of his initial term. However, only 30 new judicial seats have opened since then, compared to the 108 vacancies available when he first took office in 2017. This is largely due to aggressive judicial appointments by both Trump and former President Biden over the past decade, which filled many potential retirements with younger judges.Some judges eligible for senior status—a form of semi-retirement—have opted to remain active. Experts suggest this could be due to either personal preference or distrust among conservative judges about Trump's choices for replacements. The appellate court nominations have particularly slowed, with only three judges announcing retirements in 2025. Still, Trump managed to flip the balance of the 3rd Circuit Court of Appeals and strengthen conservative influence in district courts across states like Missouri, Florida, and Mississippi.Despite the low number of available seats—currently 49—Trump still has opportunities to make appointments, especially in Republican-led states. Esta vez, la situación es más grave: si el líder opositor no se presenta ante la Fiscalía, podría emitirse una orden de captura en su contra.En las últimas horas, un pódcast ha contactado con fuentes cercanas a González, quienes aseguran que esta advertencia de un Maduro atrincherado “busca arrinconarlo y forzarlo a abandonar el país, pero Edmundo González permanece firme, defendiendo su victoria en las urnas”. Mientras tanto, la Unión Europea insiste en la necesidad de un diálogo interno y no reconoce a Maduro ni a González como ganadores. Josep Borrell, alto representante para la Política Exterior de la Unión Europea, ha declarado que el futuro de Venezuela es solo una cuestión de tiempo. “La historia no termina aquí… Nicolás Maduro será presidente interino hasta que llegue el momento del relevo, previsto para enero”. On this edition of Parallax Views, New York University Gallatin School of Individualized Study's Prof. Alejandro Velasco, author of Barrio Rising: Urban Popular Politics and the Making of  Modern Venezuela, joins the show to discuss the controversial Venezuela elections and the ways in which analysis of the elections and the modern history of Venezuela from U.S. commentators of the Left, the Rigth, and the Center has proven facile. Prof. Velasco, argues that the picture is more complex than either those on the Right who believe Maduro is being couped by an orchestrated color revolution, those on the Right who believe Biden's easing of sanctions has led Nicolás Maduro to consolidate more power in Venezuela, and Centrists who argue all Venezuela's problems are contingent on the legacy of Hugo Chavez. The recent Venezuelan election resulted in much controversy, with even Chavistas being upset with Maduro and footage of resident of the Venezuelan barrios, the urban streets from which Chavismo have traditionally garnered much support from ordinary people, dissenting after the election results were announced. The election results which led to Maduro being declared victorious are believed by a number of different parties. The Carter Center, for example, has said that the elections "cannot be considered democratic". Protest have erupted in the streets of Venezuela's capitol, Caracas.  Given the history of coup attempts in Venezuela, many Leftists in the U.S. and internationally the controversy around this election is actually just U.S.-directed dirty tricks. Prof. Velasco offers a different analysis while also directly addressing the problems with the virulently anti-Chavista elements that lay the blame for all of this on the deceased Chavez. Estrategicamente localizado, o busto do ex-presidente Hugo Chávez evidencia que a Cidade Tiuna é um território socialista com regras próprias e estrutura comunitária. Este conjunto residencial ao lado do principal forte de Caracas é o endereço de mais de 20 mil pessoas – a maioria chavistas. Às vésperas de uma crucial eleição, líderes locais buscam somar votos para que Nicolás Maduro possa continuar na presidência da Venezuela até 2030. Elianah Jorge, correspondente da RFI na Venezuela Leonardo Granados mora há dez anos na Cidade Tiuna, complexo criado pela Missão Vivenda, o ousado plano anunciado por Hugo Chávez, em 2011, para extinguir o déficit habitacional do país. Em entrevista à RFI, este professor de História explica como é divido o complexo comunitário, que tem como vizinho o estratégico Forte Tiuna, o Ministério da Defesa e a Academia Militar, onde o ex-presidente foi velado em 2013. “O condomínio é composto por vários setores. Este é o setor Simón Bolívar. (...) As pessoas (que moram aqui) o dividiram conforme quem o construiu. Este foi feito por construtoras chinesas. Então, todo mundo chama este setor de chinês", conta Granados. O venezuelano acrescenta que na área onde estão Las Mayas, um bairro popular da capital, há um setor erguido por uma construtora bielorrussa e outras empresas russas, o que faz com que aquelas unidades habitacionais sejam conhecidas como "os russos e os bielorrussos”. Neste amplo complexo residencial, até 2015 foram construídos cerca de 6.400 apartamentos. Outros prédios ainda estão inacabados, aguardando investimentos estatais. Os primeiros moradores pagaram a moradia em bolívares, em parcelas acessíveis. Segundo Granados, hoje um apartamento de três dormitórios na Cidade Tiuna pode custar até US$ 25 mil, ou seja, são necessários mais de sete mil salários mínimos venezuelanos para comprar uma unidade.  Às vésperas da eleição mais importante da história recente do país, na Cidade Tiuna quase não se vê propaganda política. Apenas um toldo com galhardetes de Nicolás Maduro aparece na avenida principal. Pelo complexo residencial circula uma linha exclusiva de ônibus que exibe a a imagem do Super Bigode – personagem que representa o atual presidente como um super-herói de ficção. Durante meses, os moradores penaram sem transporte público até a instalação desta linha própria. Há poucas referências visíveis a temas políticos. Porém, pelo menos 80% dos moradores da Cidade Tiuna são chavistas.Cidadela chavistaLorenzo Ribas, morador do complexo, é um líder comunitário afiliado ao Partido Socialista Unido da Venezuela. Ele explica como o PSUV, fundado por Chávez em 2007, está espalhado pelo país e pela cidadela.  “O Partido Socialista Unido da Venezuela está presente em todas as comunidades, em todos os centros de votação e estará presente em todas as mesas como testemunha. Completamos agora todo o cenário eleitoral. Fizemos as previsões, cuidamos da logística e dos aspectos humanos. Acho que temos muita vantagem eleitoral”, diz o militante.Lorenzo se refere à estrutura estabelecida pelo partido para as eleições deste domingo. Na Cidade Tiuna, inspirados em estruturas comunitárias socialistas, cada setor e torre (edifício) estão organizados para seguir uma orientação determinada pelo partido. Agusmervis Castillo, moradora no complexo, é membro do PSUV e atua como chefe da Unidade de Batalha Bolívar Chávez (UBCH) em um dos colégios eleitorais da Cidade Tiuna. “A UBCH dirige a seção eleitoral, procura testemunhas e mesários, proporciona a logística, e trabalha a estrutura com a sua equipe, com os líderes comunitários e de rua. Além disso, fazemos atividades ao longo do ano”, explica.Pirâmide eleitoralEmbora as últimas pesquisas de intenção de voto apontem o diplomata e líder da oposição Edmundo González Urrutia como o favorito para assumir o Palácio do Miraflores em janeiro de 2025, o PSUV conta com um esquema piramidal chamado de "1 por 10", em que cada eleitor deve trazer outros dez para votar no candidato governista e assim por diante. "Nos quatro centros eleitorais que temos aqui e mais dois novos que abriram, temos 15 mil eleitores”, afirma Agusmervis.Por meio dessa estrutura, o PSUV busca emplacar o maior número de votantes na eleição que vai mudar o país. A militante chavista deu outros detalhes sobre o esquema previsto para o dia da votação: “A autoridade única que está aqui, que é um militar, um general, empresta dois ônibus para transporte até centros de votação distantes daqui. Eles levam e trazem (eleitores) dos centros”.  Voto controladoCom essa organização, Agusmervis estima que cerca de três mil residentes da Cidade Tiuna serão transportados para outros centros de votação em Caracas. Há também uma lista com o nome dos moradores usada no dia da eleição para registrar os votantes e os que decidiram não votar. Agusmervis e Lorenzo afirmam que respeitam a decisão dos que preferem não votar e também a dos cerca de 20% de opositores que vivem na Cidade Tiuna. “Nós funcionamos por estrutura. Por exemplo, cada torre (edifício) tem um chefe e ele monitora toda pessoa que vai sair (para votar) ou já votou. Temos um ponto onde eles passam e se registram. É como uma checagem. É a checagem do 1 por 10 que nós fazemos”, detalha Agusmervis.Homenagens à revoluçãoDe acordo com os entrevistados, durante o ano, seja ou não período eleitoral, há atividades organizadas para todas as idades. As crianças participam das chamadas "colmeias", enquanto adultos e pessoas da terceira idade podem fazer cursos, entre outras propostas, de acordo com o programa aplicado pela comuna.O funcionamento da Cidade Tiuna foi pensado para a construção e manutenção da identidade socialista, por meio da ação dos chamados conselhos comunitários. Cada edifício faz referência a Hugo Chávez ou à revolução à sua maneira, segundo relato da militante Agusmervis. “Essas três torres formam um conselho comunal que se chama 28 de julho. Esse nome foi adotado pela comunidade, pelo chefe da comunidade e chefes de cada torre. Em homenagem ao comandante (Hugo Chávez) que aniversariava no dia 28 de julho. Os nomes são muito bonitos. O setor deles se chama Gigantes da Pátria, composto por seis torres. O setor J se chama Patriotas de Bolívar. Onde ele mora se chama Cidade Socialista de Tiuna. Há uma torre que se chama Sonhos de Chávez. Outra, Marcas do Comandante, Herdeiros de Chávez. E de onde viemos se chama Orvalhos da Revolução.”Guerra civilQuestionado sobre a possibilidade de que Nicolás Maduro, no poder desde 2013, venha a perder a eleição, Lorenzo não descarta um conflito civil entre os venezuelanos e a ação dos demais poderes do Estado diante de um presidente opositor. “Caso isso aconteça, estamos preparados para as consequências que virão, porque isso terá consequências graves. Não só a questão de uma possível guerra civil, mas pela pretensão de acabar com o estado bolivariano, acabar com a Constituição, acabar com os cinco poderes do Estado, desconhecer os outros quatro poderes. Se eles (opositores) chegarem à presidência, terão que enfrentar um poder eleitoral e um poder judicial que vai se opor a tudo que vai contra a Constituição. Eles vão ter uma Assembleia Nacional que também vai se opor a qualquer loucura que vá contra a Constituição”, diz o militante chavista.Desafio econômicoNa Cidade Tiuna, a maioria dos moradores aposta na reeleição de Maduro. Caso ganhe, o presidente, que está há onze anos no poder, comandaria o país até 2030. No entanto, a economia ainda é o calcanhar de Aquiles do chavismo. O custo de vida no país é bastante alto. Atualmente, são necessários cerca de 170 salários mínimos em bolívares para a compra de uma cesta básica. Os entrevistados concordam que a economia precisa melhorar ou será difícil Maduro se manter no poder, se vier a ser reeleito.“Eu acho que o principal aspecto que devemos abordar como revolução nos próximos anos tem que ser recuperar o salário, recuperar as reivindicações trabalhistas, as contratações coletivas. Mas se a médio prazo o tema salarial não for resolvido, acho que vamos ter muita dificuldade para nos manter no poder”, prevê o líder comunitário Leonardo Granados.

O juiz Manuel García-Castellón, do Tribunal Central de Instrução da Espanha, autorizou a Unidade de Crimes Econômicos e Fiscais (UDEF) da Polícia a rastrear as contas bancárias de Juan Carlos Monedero e Carolina Bescansa, cofundadores do partido de esquerda Podemos. Eles foram delatados por Hugo Carvajal, ex-chefe da Inteligência de Hugo Chávez. Segundo o jornal "Ok Diário", o ex-general chavista relatou, em delação premiada, que entregou a Monedero milhares de dólares, em malas diplomáticas e através de empresas de fachada venezuelanas sediadas em território espanhol. Em 2018, Monedero visitou Lula na cela da Polícia Federal, em Curitiba, e depois deu uma rápida entrevista, alegando condições precárias da prisão -- o petista foi acomodado numa cela com frigobar, TV e esteira ergométrica -- e acusando os EUA de minarem a democracia na América Latina."A democracia no Brasil se chama Lula", disse. Como a Crusoé publicou, em outubro do ano passado, Carvajal contou em sua colaboração que o governo venezuelano também teria financiado outros políticos da esquerda latino-americana, inclusive Lula. Até o momento, porém, não foram divulgados mais detalhes da acusação. A PGR de Augusto Aras tampouco solicitou cooperação internacional para apurar a denúncia. Na Espanha, o esquema criminoso de financiamento político, delatado por Carvajal, quase foi para o arquivo, após decisão da procuradora-geral Dolores Delgado, nomeada pelo atual presidente, Pedro Sánchez, com quem Lula se reuniu logo após a denúncia vir à tona. Sánchez é do PSOE, de centro-esquerda e aliado do Podemos, de Monedero. Segundo relato de Carvajal, Monedero era uma espécie de arrecadador do Podemos junto à ditadura venezuelana. Para sustentar suas alegações, o ex-militar chavista entregou provas, como ordens de pagamento realizadas pela petroleira PDVSA a empresas de fachada venezuelanas sediadas em território espanhol -- método semelhante ao usado no petrolão.
