On behalf of Taiwan in the Indo-Pacific Region and its National Security Task Force the Hoover Institution held a Taiwan Roundtable Discussion on Tuesday, February 18, 2025, from 5:00 - 6:00 pm PT. Taiwan is facing a potential constitutional crisis. In December 2024, Taiwan's opposition-controlled legislature voted to impose a 2/3 supermajority quorum for the Constitutional Court to hear new cases. The legislature then voted down all the new nominees to the Court, leaving it with only 8 of members and unable to meet the new quorum requirement. The government has appealed to the Court to meet anyway and rule that the new amendments are unconstitutional. In this discussion, three experts on Taiwan's politics and judicial system discuss the factors leading up to this confrontation, the options facing the court, and the potential for deeper reforms to strengthen judicial independence in the face of a deepening confrontation between the ruling and opposition parties. ABOUT THE PARTICIPANTS Chien-Chih Lin is an associate research professor at Institutum Iurisprudentiae, Academia Sinica and an associate professor at the Graduate Institute of National Development, National Taiwan University. He received the LLM & JSD degrees from the University of Chicago. His academic interests focus on comparative constitutional law in Asia. Lin is the coauthor ofConstitutional Convergence in East Asia (2022) and Ultimate Economic Conflict between China and Democratic Countries (2022). His articles can be found in both peer-reviewed and student-edited law journals as well as edited volumes, including Oxford Handbook of Constitutional Law in Asia, American Journal of Comparative Law, and International Journal of Constitutional Law. He is the book review editor of International Journal of Constitutional Law. Weitseng Chen is a faculty member at the National University of Singapore Faculty of Law, specializing in law and economic development, law and politics, and legal history in the context of Greater China. He has recently published several books, including Regime Type and Beyond: The Transformation of Police in Asia (CUP, 2023), Authoritarian Legality in Asia: Formation, Development and Transition (CUP, 2019), The Beijing Consensus? How China Has Changed the Western Ideas of Law and Economic Development (CUP, 2017), Property and Trust Law: Taiwan (with Yun-Chien Chang & Y. J. Wu, Kluwer, 2017), and Law and Economic Miracle: Interaction Between Taiwan's Development and Economic Laws After WWII (in Chinese, 2000). Weitseng Chen earned his JSD from Yale Law School. Prior to joining NUS, he served as a Hewlett Fellow at Stanford's Center for Democracy,Development, and the Rule of Law (CDDRL) and practiced as a corporate lawyer in the Greater China region with Davis Polk & Wardwell. Kharis Templeman is a research fellow at the Hoover Institution and part of the Project on Taiwan in the Indo-Pacific. Templeman is a political scientist (Ph.D. 2012, Michigan) with research interests in Taiwan politics, democratization, elections and election management, party system development, and politics and security issues in Pacific Asia.

Pauli Murray was the first African American to earn a JSD from Yale Law School and her legal work on the 14th Amendment provided the groundwork for Brown v. Board and inspired Ruth Bader Ginsburg's work with women's rights and the 14th Amendment. Murray also struggled with issues of identity; by today's standards, she would be considered transgender. Argentina's constitution is among the oldest democratic constitutions in the world, and in significant respects it was modeled after the constitution of the United States. But Argentine democracy hasn't always been stable. Between the 1930s and 1970s, the government was overturned by military coups six times. Even when there have been free and fair elections, some elected leaders have governed as authoritarians. This experience of dictatorship is a source of trauma for Argentinian citizens—and also a source for the rebuilding and resilience of democracy since 1983. This conversation with Roberto Saba and Steven Levitsky explores the history of Argentine democracy and some of the parallels the country shares with the United States. Roberto Saba obtained his law degree (JD) at Buenos Aires University and his Master's (LLM) and doctoral (JSD) degrees at Yale Law School. He was the cofounder of the Association for Civil Rights (an organization inspired by the American ACLU) and served as its executive director (2000-2009). He was also executive director of Citizen Power Foundation, Transparency International's Chapter in Argentina (1995-1998), and dean of Palermo University School of Law (2009-2016). Saba is currently a professor of constitutional law at Buenos Aires University and at Palermo University Law Schools. Saba has published on a wide variety of subjects, including deliberative democracy, judicial review, constitutional theory, freedom of expression, freedom of information and structural inequality. His connection with the Kettering Foundation began in 1992, when he served as an international fellow at the foundation. Since then, he has participated in numerous Kettering seminars and workshops. He is currently a board member of the Charles F. Kettering Foundation. Steven Levitsky is David Rockefeller Professor of Latin American Studies and professor of government at Harvard University, director of the David Rockefeller Center for Latin American Studies at Harvard, and a senior fellow at the Kettering Foundation. His research focuses on democracy and authoritarianism. He and Daniel Ziblatt are authors of How Democracies Die (2018) and Tyranny of the Minority: Why American Democracy Reached the Breaking Point (2023), both of which were New York Times bestsellers.
For the past 20 years, the Brazilian Supreme Court has become one of the most influential political players in the nation. In the name of democracy and the fight against misinformation, the Court has authorized a flurry of arrests and media bans that have garnered international attention. But Brazil is not alone. It belongs to a long list of nascent democracies around the world that are struggling to contend with ever-expanding judicial power. Using Brazil as our model, the question before us remains: how and why has this power arisen and what does it mean for the future of democracy? SPEAKER Chief Justice Luís Roberto Barroso studied Law at the State University of Rio de Janeiro in 1980 and received his LL.M. from Yale Law School in 1989. After receiving his LL.M., Justice Barroso was a Foreign Associate with the American law firm Arnold & Porter. He also holds a JSD degree from the State University of Rio de Janeiro (2008) and attended Harvard Law School's Visiting Scholar program in 2011. Justice Barroso practiced as a private attorney in Brazil before being appointed to the Brazilian Federal Supreme Court in 2013. This realization, combined with the maturity of the ecosystem, led to the rapid growth of retail media.[24:23] When fostering an innovative culture within an organization, simplicity and alignment are vital. Despite being initially skeptical of this approach, JSD emphasizes the value of having a beginner's mind, approaching problems with openness and a willingness to learn. He also highlights the importance of aligning as a team to drive innovation, noting that “it's hard to stop a team when they have alignment”. JSD adds that actively listening is another key to innovation—there's no point formulating a response to something someone hasn't said yet![27:49] In terms of the future of data integration. JSD believes that the next major focus will be on obtaining high-fidelity permission for data usage beyond simple consent, such as targeted advertising, analytics, and measurement. Retailers will need to ensure that they are using data in the right place at the right time and flowing permissions throughout the entire ecosystem. What's more, JSD suggests that this is a “battleground” that is imminent, rather than a future concern.[32:29] JSD, Evan, and Dan discuss the evolving relationship between brands, agencies, and retail media networks. They acknowledge that brands are now spending money with multiple retail media networks and some are bringing their advertising efforts in-house. The key focus is to enable the customer's media vision, brand vision, and sales vision in whatever capacity they choose to execute. This requires flexibility in providing managed services or allowing brands to manage their own campaigns. As democratic support for Taiwan increases, so has Beijing's message to the world about its “One China principle” and the myth of a global consensus regarding the sovereignty of Taiwan. The truth is, every country - including Taiwan - has its own “One China policy”. And that policy (according to each country) is not the same as the principle (according to the PRC).It can be confusing. In a fight about international discourse on Taiwan, Beijing's diplomats and ambassadors are proactively trying to confuse the world. And this confusion is increasingly challenging for Taiwan's participation in global affairs and organizations. It's also challenging for different countries' own One China policy. Beijing insists that its “principle” should be adhered to by every country in the world. The end goal is for the world to confuse Beijing's' “principle” with an actual international law. The PRC would later use international law to say: exactly, this is our internal affairs and we can do whatever we want to do. No such international law exists. The UN resolution 2758 doesn't say that Taiwan is a part of China (despite what China says in its recent white paper.) The One China principle is PRC's principle only - not international law. And each country has (and should) clarify their own positions on Taiwan's sovereignty. China's “trying to say to the international society, to create a confusion that Taiwan belongs to China. So when China either sends out military aircrafts or flight jets around Taiwan, it's China's international affairs that other countries should not interfere with,” says Dr. Chen Yu-Jie. Dr. CHEN offers a solution. It's very important that all countries, including Taiwan, that don't agree with the One China principle to speak up, says Dr. Chen. “It's important that countries should voice out their different opinions, because international law depends on international practice. So if countries don't object to something that's being said, in the long run when it becomes a practice it might become a norm.” Our guest today is Yu-Jie CHEN, a key legal expert on international law and diplomacy in the context of China-Taiwan relations. CHEN has a JSD from the New York University School of Law. She is an assistant research professor at Taiwan's prestigious Academia Sinica. In addition to publishing and academic journals in the US, Taiwan, Hong Kong, and the UK, CHEN also writes op-eds and takes part in public facing discussions. Academics and policymakers alike draw a significant correlation between some of today's biggest problems - such as economic inequality - with rising corporate concentration and the ever-decreasing lack of antitrust enforcement. How did this narrative come to be? Is it necessarily correct, and how has it persisted over time? A new paper provides just this data, and it's co-authored by our very own co-host Luigi Zingales, along with Filippo Lancieri, JSD alum, and Eric Posner, Professor, both from the University of Chicago Law School. Using data around public demand, Supreme Court nominations, State of the Union speeches, and more, Luigi and his co-authors reveal that the key driver behind declining enforcement wasn't the Chicago School of Economics, but rather, special interests. In this episode, Luigi and Bethany chart this story right from the beginning, its lessons for today, ways to change the current state of affairs, and most importantly, why antitrust matters. Aos 18 anos foi candidato pelo PPD (Partido Popular Democrático) à autarquia de Fafe e foi eleito vereador. Mudou-se de armas e bagagens para Lisboa quando Aníbal Cavaco Silva o convidou para ser seu secretário de Estado e, mais tarde, seu Ministro. Também foi Ministro de Durão Barroso. Na sua já longa carreira política, foi deputado, líder do PSD, mas a liderança do Grupo Parlamentar do seu partido foi o cargo que mais saudades lhe deixou. Dreams of Black Wall Street (Formerly Black Wall Street 1921)
Not only was Pauli Murray was one of the most important Civil Rights leaders that Black Durham ever produced, she was also one of the most important Civil rights leaders of the 20th century. Murray was a jurist and activist who contributed some of the legal groundwork to the civil rights movement. Pauli gained national attention during her failed attempt to study at the all-white University of North Carolina, which is when Murray developed a life-long friendship with the first lady at the time, Eleanor Roosevelt. Murray was a member of the Fellowship of Reconciliation (FOR) and helped form the nonviolence-focused Congress of Racial Equality (CORE). Murray went to the University of California Boalt School of Law where s/he received an LLM (Master of Laws) degree. In 1951 Murray published the book, States' Laws on Race and Color. Thurgood Marshall, head of the legal department at the (NAACP) at the time, described it as the “Bible” for civil rights litigators. Shortly after her book Proud Shoes: The Story of an American Family, came out in 1956, Murray took a job in the litigation department at the law firm, Paul, Weiss, Rifkin, Wharton, and Garrison. In 1965, Pauli became the first African-American to receive a JSD degree from Yale Law School. The accolades go on and on. So why isn't Murray a household name? Murray never sought a public profile. Though experts surmise that her gender non-conformity must have been a factor. Nevertheless, recent efforts to give Murray the recognition she deserves have shined a brighter light on her incredible life.

As the result of a broad societal shift recognizing the injuries of violence, it's been said that we live in an “age of trauma.” Emotional trauma has fueled legal and policy social justice reforms in the three key social justice movements of our time: #BlackLivesMatter, #MeToo, and climate change. However, trauma-centered advocacy and social justice can have negative implications. Noa Ben-Asher, LLB, LLM, JSD, has taught torts; family law; and gender, sexuality and the law at Pace University in New York since 2009. They hold the 2021-2023 James D. Hopkins Professorship, which recognizes a faculty member for outstanding scholarship and teaching. In this episode, Professor Ben-Asher warns that, even as we have advanced our understanding of trauma as a modern characteristic of our times, we are in danger of overlooking structural solutions to broader social injustice. They suggest that litigators and laymen alike should take caution in using trauma as the framework for justice as it perpetuates wounded identities and limits our legal and social imagination.

Pauli Murray lived one of the most remarkable lives of the twentieth century. She was the first Black person to earn a JSD degree from Yale Law School, a founder of the National Organization for Women and the first Black woman to be ordained an Episcopal priest. Pauli Murray's legal arguments and interpretation of the US Constitution were winning strategies for public school desegregation, women's rights in the workplace, and an extension of rights to LGBTQ+ people based on Title VII of the 1964 Civil Rights Act. The American Writers Museum presents this podcast as a small preview of its upcoming exhibit and content initiative, Dark Testament: A Century of Black Writers on Justice. This initiative will launch in stages across 2022 and takes its name from Pauli Murray's amazing poem, Dark Testament as both her work and her story are fundamental example of the continual resonance of the powerful writing from black writers from the Civil War through the Civil Rights Era that still reflect and shape the world today. Speaker: Angela Zhang, Director of the Center for Chinese Law and Associate Professor, The University of Hong Kong In this webinar, Angela Zhang will discuss her new book Chinese Antitrust Exceptionalism: How the Rise of China Challenges Global Regulation (Oxford University Press). This book examines the unique ways in which China regulates and is regulated by foreign countries, revealing a ‘Chinese exceptionalism’ that is reshaping global antitrust regulation. Angela will provide a deep dive into Chinese bureaucratic politics while analyzing the power imbalances between businesses and the government in China. In addition to examining the challenges foreign multinationals have faced in complying with Chinese antitrust law, she will also explore the difficulties Chinese firms have encountered as U.S. and E.U. antitrust regulators tighten their scrutiny over Chinese businesses. Angela will conclude with her book’s implications for future Sino-American relations, as well as the recent events surrounding Ant Group’s IPO debacle and the Chinese regulation of big tech. Angela Zhang is an associate professor of law and the director of the Centre for Chinese Law at the University of Hong Kong. An award-winning legal scholar, Angela is a highly sought-after commentator on Chinese antitrust issues. Before joining the University of Hong Kong, Angela taught at King’s College London and practiced law for six years in the United States, Europe, and Asia. Listen NowIn late June, Professor Philip Alston, the UN's Special Rapporteur on Extreme Poverty and Human Rights, published "Climate Change and Poverty." The 20-page report is unsparing in its criticism of the response, or lack thereof, by corporations, governments, NGOs and the human rights community to the climate crisis, moreover their response concerning the effect the crisis will have on the poor - whom will disproportionately bear the burden of climate emergency. "Government, and too many in the human rights community," he wrote, "have failed to seriously address climate change for decades." "Most human rights bodies have barely begun," he stated, "to grapple with what climate change portends for human rights." "There is no recognition of the need for seep social and economic transformation." As a result, "Climate change threatens to undo the last 50 years of progress in development, global health and poverty reduction." Professor Alston concludes his report by writing, "The human rights community, with a few notable exceptions, has been every bit as complacent as most governments in the face of the ultimate challenge to mankind represented by climate change. The steps taken by most United Nations human rights bodies have been patently inadequate and premised on forms of incremental managerialism and proceduralism which are entirely disproportionate to the urgency and magnitude of the threat. Ticking boxes will not save humanity or the planet from impending disaster." (This discussion is my 10th concerning the climate crisis over the past 2 plus years.) During this 27 minute conversation Professor Alston describes the role of the Special Rapporteur on Extreme Poverty and Human Rights, discusses the genesis of his report and provides an overview of its findings. He comments what he terms the "patently inadequate" response to date by the human rights community including the UN's Human Rights Council, in response to the climate crisis. He also discusses how the growing climate crisis refugee crisis is being addressed, as an international criminal law professor his view regarding prosecuting corporations and their CEOs for having devastated the environment, the Juliana and related court cases seeking climate justice, and the upcoming UM climate summit this September 23rd. Philip Alston has served as the United Nations' Special Rapporteur on Extreme Poverty and Human Rights since 2014. In forwarding his work he has reported on Chile, China, Mauritania, Romania, Saudi Arabia and the US. He was previously UN Special Rapporteur on extrajudicial, summary, or arbitrary executions from 2004 to 2010. He was a member of the Group of Experts on Darfur appointed in 2007 and served as special adviser to the UN High Commissioner for Human Rights on the Millennium Development Goals. He has also served as UNICEF's legal adviser. In the field of international law, Professor Alston was editor-in-chief of the European Journal of International Law from 1996 through 2007. He was a co-founder of both the European Society of International Law and the Australian and New Zealand Society of International Law. As a UN, he worked in Geneva on human rights issues from 1978 to 1984. He has worked as a consultant to the ILO, the UNDP Human Development Report, the Office of the UN High Commissioner for Human Rights, UNESCO, OECD, UNICEF, and many other inter-governmental and non-governmental organizations. Professor Alston is also presently the John Norton Pomeroy Professor of Law at New York University's Law School where his teaching focus is on international law, human rights law, and international criminal law. He also co-chairs the NYU Center for Human Rights and Global Justice. During the 1980s Professor Alston taught at the Fletcher School of Law and Diplomacy and at Harvard Law School. Afterward, he became Professor of Law and Foundation Director of the Center for International and Public Law at the Australian National University, a post he held until 1995. From 1996 to 2001 he was Professor of International Law at the European University Institute (EUI) in Florence, Italy, where he was also head of department and co-director of the Academy of European Law. Professor Alston received degrees in law and in economics in Australia and a JSD from Berkeley.
