Hour 1 Gio begins the show by sharing how he found out about the news of the failed assassination attempt on former president Trump and how he called Boomer to make sure he knew. Boomer is in disbelief that someone was able to get a gun so close to a former president and is worried about our country. Gio was surprised how many people thought the news could be fake or AI when they saw it on their phones Saturday. Jerry is here for his first update of the day and starts with the Yankees falling apart in the bottom of the 9th inning, blowing a lead and costing themselves a sweep over the Orioles. The Mets gave up 6 home runs and couldn't complete the sweep of the Rockies. Jacoby Jones passed away, he was only 40 years old. The Copa America final had a security breach. Shannon Sharpe and Chad Ochocinco talked about male enhancement pills and Boomer says that's the Shannon he remembers working with. In the final segment of the hour, Boomer and Gio talk about the HR Derby. They will watch and say if you just accept it for what it is then it can be fun. Hour 4 The Yankees and Mets stumbled into the All-Star break. Gio is surprised and impressed by the Mets turnaround but still thinks the bullpen will cost them. Gio thought Paul Skenes sounded like a shy child when he found out he was starting the All-Star game and MLB probably wanted him to be more excited. Cris Collinsworth was the first person Boomer heard of having microfracture surgery, so why isn't it named after him like Tommy John? Eddie takes us down an interesting road when discussing surgeries. Las Vegas Raiders' SVP of Marketing Kristen Banks joins The Current Podcast to discuss the importance of balancing old and new fan bases alike, and not just in Las Vegas. Episode TranscriptPlease note, this transcript may contain minor inconsistencies compared to the episode audio.[00:00:00] Damian: I'm Damian [00:00:01] Illyse: And I'm Ilyse Liffering and [00:00:02] Damian: welcome to this edition of The Current [00:00:04] Illyse: This week, [00:00:05] we're delighted to talk with Kristen Banks, the SVP of Marketing for the Las Vegas Raiders, formerly known as the Oakland Raiders, and for a while the Los Angeles Raiders from 1982 to 94, [00:00:18] Damian: but since 2020, the Raiders have made their home in Las Vegas, and this year the Raiders hosted the Super Bowl at Allegiant Stadium. [00:00:26] That's the first time in NFL history that a Super Bowl was played in the state of Nevada. [00:00:31] Illyse: In fact, the match was the most streamed in history by a record setting audience. [00:00:37] Damian: Now, although the Raiders weren't playing in the match, the event marked a watershed moment for the NFL, for Las Vegas, and the game in general. [00:00:45] We started by asking Kristen what all that attention meant to the Raiders. [00:00:51] Kristen: it's incredible. Uh, you know, coming into working for a brand that's been around 60 years. So the Raiders organization is [00:01:00] been, you know, around since 1960 and they've never hosted a Super Bowl. So for the first time, you know, coming to a new stadium being built in Las Vegas in 2020, not having it open for the first two years that the stadium was in full operations because of the pandemic, And then fast forward to this year hosting the Super Bowl on a wide, really global stage. [00:01:26] was incredible. It was incredible for the brand. It was incredible for the city of Las Vegas. And I think it really represents a new chapter in sport and what's happening in this city. [00:01:40] Illyse: And you know, also thanks to streaming and probably also Taylor Swift a little bit, let's be honest, we're seeing new fans come to the NFL. [00:01:49] Kristen: What I would say is again, drafting back to the pandemic is that there's, you know, there was already a change in consumer behavior and how consumers were [00:02:00] absorbing and watching content. Certainly with the pandemic that increased that aptitude. And so you saw this incredible spike in how people are consuming content, certainly migrating away from being cord cutters or potentially Cord nevers who had a cable package and moving into streaming services. [00:02:20] Certainly you see that even more so with the younger population and Gen Z. It's about simply. Being available to every audience type that's out there, and that could be on their mobile phone, on their tablet, when they're watching the game, still on regular television, but going to social media platforms or YouTube to consume additional content that only enhances the experience. [00:02:46] Damian: That's interesting. One of the things that you said to me, Kristen, was about that streaming and second screen experiences that, in effect, there's a sort of virtual community of fans who are sharing content as the action is happening and unfolding. [00:03:00] How do you think about that and leverage that as a marketer? [00:03:02] Because that seems like a pretty exciting real time opportunity. [00:03:06] Kristen: It's such a unique world, right? Particularly for younger audiences, we'll say, under the age of 25, if they haven't documented it, then it's almost like it didn't happen. So, as a brand and as a marketer, you have to think about when someone's attending a game, when they're watching it at home, how are they engaging with the experience? [00:03:30] And how are you giving them? A opportunity to tell their story and what it means to engage and experience that activity with the brand. [00:03:40] , I'm quite new to the Raiders organization. I joined, um, six months ago, right at the start of the 2023 season. the height of Super Bowl. And so my team is deep in the throes of the strategy and planning of how do we build audiences and how do we ultimately create customer journeys long [00:04:00] term. [00:04:00] When you think about the avidity scale of the very core passionate fan who maybe is a season ticket member, buys merchandise can't get enough of the Raiders podcast that type of fan. is very different than a very casual fan so for a very casual fan, I'm not going to immediately try to sell them on a season ticket member because they're likely not at that stage of ready to make that commitment financially, ready to make that time commitment. [00:04:31] So how do I get them to watch a piece of content? So it's really about building out each person individually and saying, okay, this subset of fans represent this group and follow this typical pathway. [00:04:45] And these types of fans that are much more avid may follow a very different pathway. And this is what this looks like. [00:04:51] Damian: I'm very curious on the, you know, when you mentioned the coach and the teams and all that dynamic that goes on, how much access do you and [00:05:00] your marketing team have to that? How do you, how does that kind of infuse what you have to do on the, on the executive front? [00:05:06] Kristen: From week to week, you know, win or loss, you know, there's this constant narrative that's playing out on a real time stage and on social media and live on broadcast. And so then you have to say, okay, how do we ultimately take that draft quickly? If maybe a player made a stunning catch, or had a, you know, a fumble, or did something on the field that was really extraordinary, how do we then, you know, how do we dovetail off of that? [00:05:39] How do we create content? Taking those things that are really quick hits and ultimately doing a quick turn to be relevant and, you know, in that social media moment of continuing to capture that interest and intent. [00:05:55] Damian: That's really interesting. And the way that advertising now is deployed in a much more agile [00:06:00] way makes that all the more possible, I assume. [00:06:03] Kristen: Right. I would say, there's challenges with that. Yes, for sure. It's. It's easier to do nowadays. I mean, certainly you've got social media, you've got digital content. It's easy to push something out, but you also have the challenge of, as you think about customization and personalization and audience segmentation, what does that look like, right? [00:06:24] Is it five different messages? Is it three different messages? Is it one different message, but a different channel? So, you know, Even still, when you're trying to move as quickly so that you're still relevant, and it's happening, that lightning in that moment, you have to also be able to take a pause, say, what's the strategic approach here, and is this reflective of the right audience, and where do we ultimately push this to make it relevant? [00:06:52] Illyse: I feel like the NFL and sports leagues overall, There's a lot of, like storylines that you can actually, draw from, and, like, [00:07:00] personalities. , everybody has their favorite player their favorite moment in time that that player, really succeeded. [00:07:08] How do you then use these storylines to, like, infuse your marketing content as you think about, keeping things relevant and authentic? [00:07:17] Kristen: My background is sports and entertainment, which has really what I'd like to say is baked in stories and they're happening on a daily basis, right? I think it's why when we then partner with brands or we bring in partnerships and we say, okay, brand X, Y, Z, who maybe doesn't have some of those built in storylines to play from, how do they make what they're doing, you know, speak to the fan base [00:07:43] Illyse: do you think that even work with brands that don't have an obvious affinity with a sports team? Like how do you create then like extensions of the story? [00:07:54] Kristen: I'll pick on maybe a little bit of finance and insurance because maybe they're not as sexy, [00:08:00] but, in naturally partnering with a brand or a sports property helps allow that to happen. And then it creates that opportunity to say, Okay, well, that finance or that insurance brand, you know what, when there's a setback, oh, that may relate to somebody's personal life in how they're investing, right? [00:08:20] And that's easier for brands to attach to versus having to try to create something from scratch. one of the interesting narratives that came out of 2023 season was certainly with our Interim head coach, who's now the head coach, Antonio Pierce. [00:08:44] And he's an incredible figure and certainly quite the motivator and just, gives these incredible speeches and really. Kind of these amazing lines that just play really well into marketing. Um, and it was, okay, how do [00:09:00] we create a whole blackout kind of experience? It was clear they weren't going to be making the playoffs, but how do we still make it impactful to the fans that they want to show up, that they want to watch, so if you take that story of, okay, everybody's going to dress in all black in the way that he does. [00:09:17] Show up and represent, which is usually kind of one of his sayings and to see that come to life, to see many of the fans dressed in all black at the game, to see messages of encouragement posted on social media. And then, which it was incredible to see him walk off the field and have people chanting. [00:09:39] For the coach, that's that's quite unheard of. So that was a really cool. Um, it was a really cool moment to see and witness and from a marketing side, help create that, [00:09:52] Damian: yeah, so the executive side of the Las Vegas Raiders, you've got a very powerful story there too. And I know that it's a team [00:10:00] of firsts with the first female black president of an NFL team and more. [00:10:05] I wonder if you could talk a little bit about, you know, that side of the story. [00:10:09] Kristen: I think, you know, the Raiders has a really an illustrious history. , you have, you know, the first black head coach. You had the very first female president in the NFL. They all came from the Raiders. Now you have the very first female black, uh, president of the Raiders. And so, you know, it's an organization that's been in firsts. [00:10:33] Over the past 60 years, and so it's incredible to say that, you know, whether it was, , Mark Davis, our owner of the Raiders, or his father, Al Davis, they constantly said it was really always about just finding the right person for the role and really just that. And not, and diversity and inclusion becomes just part of that because you want to make sure that you're representing [00:11:00] the audience in the right way.[00:11:02] Kristen: And to be at the forefront of doing that is to make sure that in the back office, and on the field, and in the coaches and staff all reflect that representation as well. And so I think that's just a fabric of the Raiders DNA that's always been present. But To be here now, to be part of the leadership team, to have, a female president who's African American, to be a part of that executive group as myself being a female and being in sports, it's really trailblazing and it's an exciting, uh, time for sure [00:11:37] Illyse: Do you believe that then has an effect on the marketing? I know, there are obviously a ton of female, NFL fans out there and Raiders fans, I'm sure. And, I feel like. Often, though, football is more marketed to men. Do you feel that having more women in those, [00:12:00] power roles really speaks to the women that are fans? [00:12:04] Kristen: Yeah, I think it has to. I think it's a natural influence and that, you know, whether it's women, whether it's other ethnicities, whether it's different backgrounds, different cultures, all of that is really important because if you think about just, right, I'll just take Las Vegas because that's obviously where the Raiders, our home base is now. [00:12:28] We certainly reach a lot of other markets and audiences, but I'll talk about Las Vegas, which is. You know, naturally, just about 50 50 split in between men and women. 28 percent of the audience in Las Vegas is Hispanic. 11 percent is, is Asian Pacific Islander. Las Vegas is called the Ninth Island for a reason, a lot of Hawaiian transplants. [00:12:53] And also 10 percent is African American. So, you look at that really [00:13:00] diverse fabric of people in Las Vegas who could potentially be fans of the Raiders, and who ultimately we want to ingrain so that they feel the Raiders are their hometown team. The employee base should reflect that and I would say for sure, my background, my experience, and even my team around me, should reflect the diversity and diverse opinions of those communities for sure. [00:13:29] Illyse: One of the most interesting facts about the Las Vegas Raiders is that you're a legacy brand, but you're now in a new location how do you ensure that you're engaging those fanbases while reaching new fans? [00:13:45] Kristen: I think it's making sure that nothing that you're doing is going to, Be damaging to the core or feel not authentic. We certainly have still quite a fan base in Los [00:14:00] Angeles and Oakland [00:14:00] but then to say, okay, now we need to bring in. New fans, completely different that are not part of those generations that are introduced to the team because now we're here in Las Vegas that has never had an NFL team before that honestly never had any professional sports team up until the last. Five, 10 years, that would have been completely frowned upon in what was formerly called Sin City. [00:14:28] You never want to upset the core. But you want to make sure that you're doing something that still pushes the envelope a little bit so that you're constantly growing and adapting. [00:14:38] Illyse: And, you know, I'm curious about this too because, you know, we're living in like a digital world now. Anybody can go on and stream like a Raiders game, no matter where they are. With fan bases, especially across cities, across states, does location matter as much these days to be a fan of a particular NFL team? [00:14:59] Kristen: You know, [00:15:00] I think, think it depends. I think it depends on who you ask, and I think it depends on what type of fan and what avidity scale. And the reason I say that is, is I'll say, you know, the Raiders, we are very, proud of the fact that we have a season ticket member. In every state in some 15 countries, um, that are, that grace our stadium. [00:15:23] I mean, that's a little bit of, you know, a little panache to say that, but on top of it, you know, how fans have access, you know. Can look completely different to I mean, certainly your bread and butter are the people coming in the stadium, but the bigger appeal, the bigger growth potential are those fans watching at home. [00:15:44] And what's that experience? And to your point, at least that could be done really anywhere, right? And then to what they have access to. Um, some of that, you know, depends on live broadcast rights and where, games are aired. [00:16:00] But there's also an incredible amount of content, and for anybody under the age of 20, getting them to watch a full game sometimes is a challenge anyway, so they're going on TikTok and watching some highlights. [00:16:12] So, those really casual fans, keeping them engaged, which can be at home, on the go, in a different city, in a different country, is certainly relative and important, too, to the Raiders overall growth. [00:16:28] Damian: So, Kristen, you talked, you mentioned that Vegas is pretty new to sports, but I do know that, you know, your background, which is very interesting. You're a lead marketer for the UFC, which was one of the original sports franchises in Vegas, along with boxing. I wonder about you. [00:16:47] You know, um, learned from that experience and you, you were in, the midst of, this in, as, as the city has kind of evolved into this sports center in a way. It [00:16:56] Kristen: Yeah, for sure. I mean, I [00:17:00] moved to Las Vegas back in 2015. was with the UFC for eight years there, formerly worked in entertainment for NBCUniversal in Orlando. so I'll say I've always been, had a background of cast of characters and rich stories to play with. But on that end, you know, when we moved back in 2015, Very different landscape. [00:17:22] One, there was no stadiums. and there certainly was no talk of baseball, basketball, or really any other national sport. and so UFC had planted a flag many years ago as already being a boxing town where you'd have, you know, big events. [00:17:40] But what I will say is, is that is good timing of having that past experience because you're trailblazing. You're saying, okay. How do we set a flag here? How do we do this? How do we make this work? How do we get fans engaged locally? To then parlay that into what I'm [00:18:00] doing now, which is working for the NFL and working for, a team locally that has such an incredible, brand recognition, brand storyline. [00:18:12] And building from that is to say, okay, well, I can take some of what I've learned from UFC trailblaze and say, how do we make that cool and relevant, to new fans here in Las Vegas? [00:18:25] Illyse: Speaking of Vegas how is the Raiders , leaning into sports betting in any way? [00:18:30] Kristen: In Las Vegas, because of naturally the betting and the gambling and maybe it feeling like, Oh, this is, this is too taboo for a sports team to come to Las Vegas. but today, you know, some of our partners are sports betting partners. Um, we have MGM bet, who's a corporate sponsor. We have DraftKings, and there are league partnerships with sports betting partners. [00:18:56] Naturally, I'd say, it's really working with the [00:19:00] teams individually to say, hey, how do we make sure that we make sure that the game stays pure, that it's really just more of a fan focal point, but that those two don't intersect. [00:19:12] Illyse: Yeah, It's definitely interesting. The Raiders are kind of, I would say different from a lot of other NFL teams and I'm curious about what you would say about why that is. For instance, like the nickname, I know Raider Nation is, is really strong and the fans are . Maybe some of the most spirited in, yes, in the league, I would say. What do you think? [00:19:38] Kristen: They really represent and tap into what the Raiders brand is, which is about individuality. [00:19:46] It's about, being yourself authentically. It's about doing it in such a way that's very different, almost cosplay esque. Playing into that it's the team for maybe the [00:20:00] non sports fan, you know, and silver and black, and how cool are those colors that everybody looks good in black. So I think there's, there's just so much fun. [00:20:12] And then I think about, you know, just where the Raiders came from to, you know, our incredible history of Al Davis being the owner, and commitment to excellence, having pride and pride and poise, those things and that and that kind of ethos, plays into everything of what we do, and I think that the fans gravitate to that because it's something they can identify with. Steve Wright played 12 years in the NFL as an offensive lineman with the Dallas Cowboys, Baltimore/Indianapolis Colts, Los Angeles Raiders and a two detour into the USFL with Oakland Invaders. His story is quire remarkable considering how he wound up a starter despite being undrafted out of the University of Northern Iowa. But his determination and persistence not only helped him make the Cowboys in 1981, but become a fixture on the O-Line. He played with and against some of the game's greatest and played under three unique coaches: Tom Landry, Frank Kush and Art Shell. His story is filled with the highs and lows you would expect. But it's also filled with magnificent stories as well, three of which are among the most historic in history. In his rookie year, he thought he was on his way to the Super Bowl until Dwight Clark caught a pass from Joe Montana to vault the 49'ers and end the dreams of Cowboy fans everywhere. He was on the field for the longest TD run in NFL history, 99 1/2 yards by Tony Dorsett and he was on the Baltimore Colts when they packed up and left overnight for Indianapolis. But Steve's exploits on the field are only a part of his story. What he did off the field while playing and after his playing days are a huge part of who Steve Wright is. Our results suggest that scaling video generation models is a promising path towards building general purpose simulators of the physical world.All of the videos are incredible, albeit only a minute or less each. My favorite is the Dogs in Snow video:Although the ‘Closeup Man in Glasses' is also wonderful.I mention this because the speed at which AI is addressing new fields is - in my opinion - mind-boggling. Skills that take humans decades to perfect are being learned in months and are capable of scaling to infinite outputs using words, code, images, video, and sound.It will take the advancement of robotics to tie these capabilities to physical work, but that seems assured to happen.When engineering, farming, transport, or production meets AI then human needs can be addressed directly.Sora winning an Oscar for Cinematography or in producing from a script or a book seems far-fetched. But it wasn't so long ago that a tech company doing so would have been laughable, and now we have Netflix, Amazon Prime, and Apple TV Plus regularly being nominated or winning awards.Production will increasingly be able to leverage AI.Some will say this is undermining human skills, but I think the opposite. It will release human skills. Take the prompt that produced the Dogs in Snow video:Prompt:A litter of golden retriever puppies playing in the snow. Their heads pop out of the snow, covered in.I can imagine that idea and write it down. But my skills would not allow me to produce it. Sora opens my imagination and enables me to act on it. I guess that many humans have creative ideas that they are unable to execute….up to now. Sora, DallE, and ChatGPT all focus on releasing human potential.Google released its Gemini 1.5 model this week (less than a month after releasing Gemini Ultra 1.0). Tom's Guide has a summary and analysis by Ryan MorrisonGemini Pro 1.5 has a staggering 10 million token context length. That is the amount of content it can store in its memory for a single chat or response. This is enough for hours of video or multiple books within a single conversation, and Google says it can find any piece of information within that window with a high level of accuracy.Jeff Dean, Google DeepMind Chief Scientist wrote on X that the model also comes with advanced multimodal capabilities across code, text, image, audio and video.He wrote that this means you can “interact in sophisticated ways with entire books, very long document collections, codebases of hundreds of thousands of lines across hundreds of files, full movies, entire podcast series, and more."In “needle-in-a-haystack” testing where they look for the needle in the vast amount of data stored in the context window, they were able to find specific pieces of information with 99.7% accuracy even with 10 million tokens of data.All of this makes it easy to understand why Kate Clark at The Information penned a piece with the title: I Was Wrong. Other leading unicorn sectors in 2023 included fintech (with 14 companies), cleantech and energy (12 each), and semiconductors (nine).Based on an analysis of Crunchbase data, 41 companies joined the Unicorn Board from the U.S. and 24 from China in 2023. Other countries were in the single digits for new unicorns: Germany had four new companies, while India and the U.K. each had three.New records nonethelessDespite the slower pace of new unicorns, the Crunchbase board of current private unicorns has reached new milestones as fewer companies exited the board in 2023.The total number of global unicorns on our board reached 1,500 at the start of 2024, which takes into account the exclusion of those that have exited via an M&A or IPO transaction. Sports was the last thing holding together the cable TV bundle. Now it will be the start of the streaming bundle.That's my 5-minute reaction to the truly huge news that Disney, Warner, and Fox are launching a new sports streaming service, combining their various sports rights into one package. Well, presumably. The details are still quite thin at this point. Clearly, several entities were racing to this story, with both WSJ and Bloomberg claiming "scoops" by publishing paragraph-long stories with only the high level facts. I'm linking to Varietyabove, which at least has a few more details, including (canned) quotes from Bob Iger, Lachlan Murdoch, and David Zaslav.Fox Corp., Warner Bros. Discovery and Disney are set to launch a new streaming joint venture that will make all of their sports programming available under a single broadband roof, a move that will put content from ESPN, TNT and Fox Sports on a new standalone app and, in the process, likely shake up the world of TV sports.The three media giants are slated to launch the new service in the fall. Subscribers would get access to linear sports networks including ESPN, ESPN2, ESPNU, SECN, ACCN, ESPNEWS, ABC, Fox, FS1, FS2, BTN, TNT, TBS, truTV and ESPN+, as well as hundreds of hours from the NFL, NBA, MLB and NHL and many top college divisions. But during the broadcast on CBS, a 60-second commercial loosely inspired by a famous George Orwell novel shook up the advertising and the technology sectors without ever showing the product it promoted. Conceived by the Chiat/Day ad agency and directed by Ridley Scott, then fresh off making the seminal science-fiction noir “Blade Runner,” the Apple commercial “1984,” which was intended to introduce the new Macintosh computer, would become one of the most acclaimed commercials ever made. It also helped to kick off — pun partially intended — the Super Bowl tradition of the big game serving as an annual showcase for gilt-edged ads from Fortune 500 companies. The future will require fundamentally rethinking the press's relationship to its audience.Clare MaloneFebruary 10, 2024My first job in media was as an assistant at The American Prospect, a small political magazine in Washington, D.C., that offered a promising foothold in journalism. I helped with the print order, mailed checks to writers—after receiving lots of e-mails asking, politely, Where is my money?—and ran the intern program. This last responsibility allowed me a small joy: every couple of weeks, a respected journalist would come into the office for a brown-bag lunch in our conference room, giving our most recent group of twentysomethings a chance to ask for practical advice about “making it.” One man told us to embrace a kind of youthful workaholism, before we became encumbered by kids and families. An investigative reporter implored us to file our taxes and to keep our personal lives in order—never give the rich and powerful a way to undercut your journalism. But perhaps the most memorable piece of advice was from a late-career writer who didn't mince words. You want to make it in journalism, he said? Marry rich. We laughed. He didn't.I've thought a lot about that advice in the past year. A report that tracked layoffs in the industry in 2023 recorded twenty-six hundred and eighty-one in broadcast, print, and digital news media. NBC News, Vox Media, Vice News, Business Insider, Spotify, theSkimm, FiveThirtyEight, The Athletic, and Condé Nast—the publisher of The New Yorker—all made significant layoffs. BuzzFeed News closed, as did Gawker. The Washington Post, which lost about a hundred million dollars last year, offered buyouts to two hundred and forty employees. In just the first month of 2024, Condé Nast laid off a significant number of Pitchfork's staff and folded the outlet into GQ; the Los Angeles Times laid off at least a hundred and fifteen workers (their union called it “the big one”); Time cut fifteen per cent of its union-represented editorial staff; the Wall Street Journal slashed positions at its D.C. bureau; and Sports Illustrated, which had been weathering a scandal for publishing A.I.-generated stories, laid off much of its staff as well. One journalist recently cancelled a networking phone call with me, writing, “I've decided to officially take my career in a different direction.” There wasn't much I could say to counter that conclusion; it was perfectly logical.“Publishers, brace yourselves—it's going to be a wild ride,” Matthew Goldstein, a media consultant, wrote in a January newsletter. “I see a potential extinction-level event in the future.” Some of the forces cited by Goldstein were already well known: consumers are burned out by the news, and social-media sites have moved away from promoting news articles. But Goldstein also pointed to Google's rollout of A.I.-integrated search, which answers user queries within the Google interface, rather than referring them to outside Web sites, as a major factor in this coming extinction. According to a recent Wall Street Journalanalysis, Google generates close to forty per cent of traffic across digital media. Brands with strong home-page traffic will likely be less affected, Goldstein wrote—places like Yahoo, the Wall Street Journal, the New York Times, the Daily Mail, CNN, the Washington Post, and Fox News. But Web sites that aren't as frequently typed into browsers need to “contemplate drastic measures, possibly halving their brand portfolios.”What will emerge in the wake of mass extinction, Brian Morrissey, another media analyst, recently wrote in his newsletter, “The Rebooting,” is “a different industry, leaner and diminished, often serving as a front operation to other businesses,” such as events, e-commerce, and sponsored content. How will this lawsuit play out? And, more importantly, how will the outcome affect the way we train and use large language models?There are two components to this suit. First, it was possible to get ChatGPT to reproduce some Times articles very close to verbatim. That's fairly clearly copyright infringement, though there are still important questions that could influence the outcome of the case. Reproducing the New York Times clearly isn't the intent of ChatGPT, and OpenAI appears to have modified ChatGPT's guardrails to make generating infringing content more difficult, though probably not impossible. Is this enough to limit any damages? It's not clear that anybody has used ChatGPT to avoid paying for a NYT subscription. Second, the examples in a case like this are always cherry-picked. While the Times can clearly show that OpenAI can reproduce some articles, can it reproduce any article from the Times' archive? Could I get ChatGPT to produce an article from page 37 of the September 18, 1947 issue? Or, for that matter, an article from the Chicago Tribune or the Boston Globe? Is the entire corpus available (I doubt it), or just certain random articles? I don't know, and given that OpenAI has modified GPT to reduce the possibility of infringement, it's almost certainly too late to do that experiment. The courts will have to decide whether inadvertent, inconsequential, or unpredictable reproduction meets the legal definition of copyright infringement.The more important claim is that training a model on copyrighted content is infringement, whether or not the model is capable of reproducing that training data in its output. An inept and clumsy version of this claim was made by Sarah Silverman and others in a suit that was dismissed. The Authors' Guild has its own version of this lawsuit, and it is working on a licensing model that would allow its members to opt in to a single licensing agreement. The outcome of this case could have many side-effects, since it essentially would allow publishers to charge not just for the texts they produce, but for how those texts are used.It is difficult to predict what the outcome will be, though easy enough guess. Here's mine. OpenAI will settle with the New York Times out of court, and we won't get a ruling. This settlement will have important consequences: it will set a de-facto price on training data. And that price will no doubt be high. Perhaps not as high as the Times would like (there are rumors that OpenAI has offered something in the range of $1 million to $5 million), but sufficiently high enough to deter OpenAI's competitors.$1M is not, in and of itself, a terribly high price, and the Times reportedly thinks that it's way too low; but realize that OpenAI will have to pay a similar amount to almost every major newspaper publisher worldwide in addition to organizations like the Authors Guild, technical journal publishers, magazine publishers, and many other content owners. The total bill is likely to be close to $1 billion, if not more, and as models need to be updated, at least some of it will be a recurring cost. I suspect that OpenAI would have difficulty going higher, even given Microsoft's investments—and, whatever else you may think of this strategy—OpenAI has to think about the total cost. I doubt that they are close to profitable; they appear to be running on an Uber-like business plan, in which they spend heavily to buy the market without regard for running a sustainable business. But even with that business model, billion-dollar expenses have to raise the eyebrows of partners like Microsoft.The Times, on the other hand, appears to be making a common mistake: overvaluing its data. Yes, it has a large archive—but what is the value of old news? Furthermore, in almost any application but especially in AI, the value of data isn't the data itself; it's the correlations between different datasets. The Times doesn't own those correlations any more than I own the correlations between my browsing data and Tim O'Reilly's. I figured we'd finally reached the peak of the AI venture capital frenzy when a threatened employee exodus from OpenAI risked sending the value of the $86 billion AI juggernaut almost to zero. There was plenty of other proof that the hype for generative AI was fading. Investors were openly saying they planned to be a lot tougher on valuation negotiations and would ask startups harder questions about governance. Some companies had begun to consider selling themselves due to the high costs of developing AI software. And an early darling of the AI boom, AI-powered writing tool Jasper, had become the butt of jokes when it slashed internal revenue projections and cut its internal valuation after having won a $1.5 billion valuation in 2022. I forgot that everyone in Silicon Valley suffers from short-term memory loss. After a week sipping boxed water with venture capitalists from South Park to Sand Hill Road, I'm convinced I called the end of the AI frenzy far too soon. In fact, I expect this year will deliver more cash into the hands of U.S. AI startups than last year, when those companies raised a total of $63 billion, according to PitchBook data. Altman's fundraising ambitions will surely boost the total. A recent report from The Wall Street Journal said Altman plans to raise trillions of dollars to develop the AI chips needed to create artificial general intelligence, software that can reason the way humans do. Even if that number is actually much smaller, talk of such goals lifts the ceiling for other startup founders, who are likely to think even bigger and to be more aggressive in their fundraising. Investor appetite for AI companies is still growing, too. And then there's the fact that the Quest 3 is, as Zuck says, “like seven times less expensive.”I currently own both headsets and while I'm very excited about the potential in the Vision Pro, I actually find it hard to fully disagree with Zuck on this one. I think a lot of people have only used the Vision Pro would be surprised how well the Quest 3 does some things in comparison.For example, the pass-through mode is definitely not quite as good as the Vision Pro's, but it's closer than you might expect. And while people are rightly impressed with how well the Vision Pro has windows locked in 3D space, honestly the Quest 3 is just as good at this in my experience. When it comes to comfort, I do think the Vision Pro is easier to wear for longer periods, but I find it more finicky to get in just the right spot in front of my eyes, while the Quest 3 seems to have a larger sweet spot. And let's not even talk about the field of view, which is way wider on the Quest to the point of being unnoticeable basically all the time. I kinda think field of view will be similar to phone bezels in that you get used to what you have and anything more seems huge — you can get used to the Vision Pro's narrower field of view, but once you're used to wider, it's hard to not notice when going back.The Vision Pro has some hardware features that help it rise above (the massively higher resolution screen jumps to mind), but I'm just saying that if you're looking for everything to be 7x better to match the price difference, I don't think that's there.Beyond this, the products are quite different, though. As Zuckerberg says, the Quest 3 is more focused on fully immersive VR experiences, and while the Vision Pro has a little of that right now, it's not really doing the same things. And when it comes to gaming it's not even close. The Quest 3 has a large library of games available and that expands to almost every VR game ever made with Steam Link.On the other hand, the Vision Pro is much for a “computer” than the Quest ever was. If you can do it on a Mac or an iPad, you can probably already do it on the Vision Pro. And I'm not talking about finding some weird alternate version of your task manager or web browser that doesn't sync with anything else in your life, I'm talking about the apps you already know and love. This is huge and it's Apple leveraging its ecosystem to make sure you can seamlessly move from Mac to iPhone to iPad to Vision Pro. And if you can't install something from the App Store, the web browser is just as capable as Safari on the iPad. If all else fails, you can always just bring your full Mac into your space as well. These numbers were particularly strong, well above consensus for both the current and guided quarters. Arm stock rallied strongly on the results up ~30% for the week. These numbers were important as they go a long way to establishing the company's credibility with the Street in a way their prior results did not.That being said, we saw things we both liked and disliked in their numbers. Here are our highlights of those:Positive: Growing Value Capture. One of our chief concerns with the company since IPO has been the low value they capture per licensed chip shipped – roughly $0.11 per chip at the IPO. That figure continued to inch higher in the latest results, but critically they pointed out that their royalty rate doubles with the latest version of their IP (v9). This does not mean that all of their royalty rates are going to double any time soon, but it does point very much in the right direction. Critically, they noted this rate increase applies to architectural licenses as well.Negative: The Model is Complex. Judging from the number of questions management fielded on the call about this rate increase no one really knows how to model Arm. The company has a lot of moving parts in its revenue mix, and they have limits to their ability to communicate some very important parts of their model. We think that at some point the company would be well served by providing some clearer guide posts on how to build these models or they risk the Street always playing catch up with a wide swing of expectations each quarter.Positive: Premium Plan Conversion. The company said three companies converted from their AFA plan to the ATA model. We will not get into the details of those here, but these can best be thought of in software terms with customers on low priced subscription plans converting to Premium subscription plans. This is a good trend, and management expressed a high degree of confidence that they expect to see it continue. They have spent a few years putting these programs in place and seem to have thought them through. This matters particularly because these programs are well suited for smaller, earlier-stage companies. The old Arm struggled to attract new customers in large part because of the high upfront costs of Arm licenses. Programs like AFA and ATA could go a long way to redressing those past wrongs.Negative: China remains a black box. Arm China is of course a constant source of speculation. In the latest quarter it looks like a large portion of growth came from China which does not exactly square with other data coming from China right now. It is still unclear to us how much of Arm's revenues from China's handset companies gets booked through Arm China as a related party transaction and how much is direct. Investors are confused too. There is no easy solution to this problem, digging too hard into Arm China's numbers is unlikely to make anyone happy with the answers, but hopefully over time it all settles down.Positive: Growing Complexity of Compute. Management repeatedly mentioned this factor, noting that this leads to more chips and more Arm cores shipping in the marketplace. Some of this is tied to AI, but we think the story is broader than that. It is going to be tempting to see much of Arm's growth as riding the AI wave, but this does not fully capture the situation. The AI story is largely about GPUs, which are not particularly heavy with Arm cores. But those GPUs still need some CPU attach, and AI accelerators can sometimes be good Arm targets.Negative: Diversification. Arm remains heavily dependent on smartphones, and we suspect the return to inventory stocking by handset makers is playing a big role in their guidance. When asked about segmentation of their results the company declined to update the model provided during the IPO. We hope to see some diversification here when they do update their figures later in the year.Overall, the company did a good job in the quarter. That's not actually all that Earth-shattering, but the company claims that it's much more than that, with its software going beyond being an extension of a FAQ page and actually taking actions on behalf of the customer.“Sierra agents can do so much more than just answer questions. They take action using your systems, from upgrading a subscription in your customer database to managing the complexities of a furniture delivery in your order management system. Agents can reason, problem solve and make decisions,” the company claimed in a blog post.Having worked with large enterprise customers at Salesforce, Taylor certainly understands that issues like hallucinations, where a large language model sometimes makes up an answer when it lacks the information to answer accurately, is a serious problem. That's especially true for large companies, whose brand reputation is at stake. How does Giancarlo Stanton not play when Aaron Judge is already out of the lineup? Sal wonders if Pete Alonso was aware of Evan's ‘pieces of crap' quote about Scherzer and Verlander while they were at the comedy show last night. Sal also had to drive down to Englishtown NJ to watch his kid play. It was 2 ½ hours each way. Sal wants to live a life of convenience and does not want to do anything he doesn't want to do anymore. Jerry wants Sal to choose between heartbreaking sports team losses or doing inconvenient things in life. Sal said he is taking his independence back. Hour 4: The Subway Series gets underway tonight in Queens. Sal doesn't like the 2-game series instead of a 3-game series. Unless there's a 2-game sweep, it takes away from it because there's no winner or loser. The Yankees have not played terribly, they are a number of games over .500, but they play in a very competitive division. Sal said the game still means something to the fans even though Judge and Alonso are not playing. Peter returns for an update and starts with the Nuggets winning their first NBA championship. The Subway Series gets underway tonight in Queens. In the final segment of the show, Jerry goes through some concerts at MSG and he's surprised at what's sold out and what tickets are available. Tim Brown (@81timbrown) is an American former professional football player who was a wide receiver in the NFL. He played college football for the Notre Dame Fighting Irish, where he won the Heisman Trophy, becoming the first wide receiver to do so. He spent sixteen years with the Los Angeles Raiders, during which he established himself as one of the NFL's greatest wide receivers of all time. Brown has also played for the Tampa Bay Buccaneers. In 2015, he was inducted into the Pro Football Hall of Fame. Brown was named first-team All-Pro and to the Pro Bowl after leading the NFL in kickoff returns (41 for 1,098 yards, 26.8 average, and 1 TD) and setting a rookie record for combined net yards. He was also named first-team All-AFC six times – once as a kick returner, once as a punt returner, and four times at wide receiver. He was also named to the NFL's All-Decade Team of the 1990s. Jerry has the radio calls from Vikings/Bills. Gio says he is fully activated as a Vikings fan again. The Packers came back to beat the Cowboys in OT. Derek Carr was emotional after the Raiders lost to the Colts. Tom Brady talked about how much he loved playing in Germany. The Niners beat the Charges on SNF. The Knicks scored 48 points in the first quarter and lost. In the final segment of the hour, we talked about the Giants and Jets both being in great shape after 10 weeks. Willie Gault is a former football wide receiver and Olympic athlete. Gault played in the NFL for 11 seasons for the Chicago Bears and Los Angeles Raiders. He was a member of the Bears team that won Super Bowl XX, and was also a member of the U.S. Olympic team that boycotted the 1980 Olympics. Gault is considered one of the fastest NFL players of all-time. He is currently pursuing a career as an actor.
