Cyclists and pedestrians take over Latah near the railroad crossing. (Murphy Woodhouse / Boise State Public Radio )Right around noon on a bluebird September Sunday in Boise, a pack of cyclists dozens strong turned south onto Latah Street, a chorus of bike bells sounding. A large group of cyclists cruises south on Latah around noon on Sunday, Sept 22, when Boise held its first Open Streets event.(Murphy Woodhouse / Boise State Public Radio )They cruised past a barricade, where police and volunteers were turning motorists away. Several hundred yards in, the Boise Good Times Street Band welcomed riders with a jaunty rendition of Give My Regards to Broadway. Wide, business-lined Latah is soon packed with bikers, walkers, roller skaters and at least one person on stilts.Food trucks and other stands line the one-mile segment of the street, and long lines stretch out of the cafes and restaurants on the route. Long lines stretched out of the cafes and restaurants on Latah during the event.(Murphy Woodhouse)Lindsey Lind and her family – husband Eric, their two young children, and two dogs – had walked from their nearby home. They're standing in line for some birria tacos.“It's kind of weird,” she said, standing in the middle of the road. “Like, I feel like I keep needing to move over to the side.”Eric described Latah on a normal day.“It's busy, and usually people aren't doing 30 miles an hour,” he said. “It's, you know, 35, 40.”“Or more,” Lindsey interjected.They loved the vibrant sense of community surrounding them, and the promotion of green alternatives to driving.“I think it helps people slow down a little bit and see kind of what's out here as far as businesses and, you know, it kind of puts maybe some of these businesses on the map,” Eric said. Austin Clark, owner of Primal Coffee on Latah, plays fiddle with his friend Matt Hopper's band The Roman Candles in front of his cafe during the Open Streets event. "I think I knew it would be a good coordinated event, so I was happy to be a part of it and see where it goes," he said.(Murphy Woodhouse / Boise State Public Radio )“I think it's really awesome for Latah's business, this kind of exposure,” said Austin Clark, owner of Primal Coffee, located on the street. “Maybe a lot of people don't come up onto Latah ever, you know, because there's no reason to. But now they've got a reason to come.”Sending a messageThese are exactly the sorts of sentiments organizers of Boise's first Open Streets event were hoping to inspire.“All the chips fell into place. It worked out really well. And here we are today with close to, I would say like 3000 people,” said Nina Pienaar, advocacy director at the Boise Bicycle Project (BBP). Several days after the event, organizers later provided an updated figure of over 6,000. Bike racks were packed tight on Latah Street during the event.(Murphy Woodhouse / Boise State Public Radio )BBP worked closely with Ada County, Boise, and other local officials to develop location criteria, then surveyed neighborhoods to find a spot with local buy-in. They ultimately landed on Latah.Pienaar said the strong turnout “sends the message loud and clear that like, ‘Hey, the Boise community, we're out biking, we're out walking. We want to see more infrastructure. We want to be able to choose to bike and to walk rather than choosing to get into our vehicles.'”The second Open Streets event is already planned for next year, according to an official with the City of Boise, which sponsored the event. But with thousands in the street for the first event, Pienaar said there's huge potential for a more regular schedule, perhaps even biweekly during the summer, adding: “The more the better.”Social animals“The concept is really, really simple. You open streets to people and you close them to cars. And the magic happens,” said Gil Penalosa. “You get young and old and rich and poor and fat and skinny, and you get everybody.”Penalosa is an urban planner who now lives in Toronto, where he was the runner-up in the 2022 mayoral election. But as an official in the Colombian capital of Bogotá in the late 1990s, he helped dramatically expand the city's weekly ciclovía program, credited as the seed of the global Open Streets movement. Every Sunday some 1.5 million Bogotanos cruise around 80 miles of car-free roads.“Why is it spreading?” he asked. “I think because humans are social animals, and we want to be with other people.”A winged stilt walker makes their way down Latah. (Murphy Woodhouse / Boise State Public Radio )The many benefits of Open Streets are best achieved with frequent repetition, especially the health benefits, Penalosa argued. But in a time of often ugly divisiveness, he said anything that brings a diverse swath of a community together is good.“The possibility of people meeting as equals is really, really, really important,” he said.He acknowledges that some officials and businesses can blanch at shutting down significant stretches of roadways to cars, but encourages cities that haven't tried it to be gutsy.“I've seen it [be] successful … in cities of 50,000 people or 500,000 or 5 million, 20 million. It works everywhere,” Penalosa said. “I've seen it in poor cities, in wealthy cities, and it makes everybody happier and healthier. And also to keep in mind that this is low-risk, this is low-cost and has very high benefits.”Terra Reed, an organizer of the Albuquerque Open Streets event Ciclovía – now in its 10th year – similarly encouraged other cities to give it a go, saying that it doesn't have to be huge to be a success. From their experience, she said “having strong ties” with local governments is especially important to start and maintain such efforts.“Try to build those relationships early,” she advised.Just keep pedalingIn a parking lot off Latah, young kids are buzzing around a bicycle skills course. 6-and-a-half-year-old Margot Mace makes her way around a bicycle skills course.(Murphy Woodhouse / Boise State Public Radio )Margot Mace, who's 6-and-a-half years old, is getting frustrated trying to ride her bike over a teeter-totter obstacle.“You can do it, keep pedaling,” her mom, Beth Edwards, encouraged.“It doesn't let me do it,” Margot shouted in frustration after another failed attempt.Beth said they had ridden to Latah with dozens of others – and got a taste of the danger cyclists face in the city.“We were trying to get across Orchard (Street) and a car almost ran us down,” she recounted. “We were a big group of bikers, so we weren't just one cycling family or one person. There was 40 of us and a car still almost ran us down.”Edwards had heard of Open Streets, but didn't really know much about the idea until that Sunday. She loved its emphasis on safety for all road users.“We are just kinda constantly living with that ‘Llook out! Look out!'” she said. “Coming here and being free and seeing her just riding safely and freely is a pretty awesome feeling.”After three failed attempts, Margot backed up to give it one more go. So we called up cultural savant and 2010s historian Dean Kissick to discuss. But Witch House did not remain the central thread of our conversation. Orchard: Pioneering Digital Music DistributionScott Cohen's journey into entrepreneurship began long before The Orchard's inception. In 1997, when the online world was still in its infancy, Scott and his partner foresaw the digital revolution of music. He recalls, "We saw a world where people would be creating and consuming music digitally, both on the computer and on the mobile phone." This vision led to the creation of The Orchard on Orchard Street, despite the overwhelming odds against them at a time when dial-up modems were the norm, and online stores were non-existent.Email Marketing's Early WinsCohen reminisced about the effectiveness of early internet marketing strategies. The Orchard utilized AOL message boards to connect with music enthusiasts, leading to a staggering 100% email response rate in 1995. "It was often the first email they ever received," Scott said, "and then there was an email about music and the genre they liked." This tactic provided critical insights and laid the groundwork for the company's future strategies.Jukebox's Industry GrowthJukebox is not about disruption but transformation and addition. Scott envisions Jukebox as a platform that adds new value to the music industry without taking away from it. "I'm trying to create new value on top and expand the industry, grow the industry," Scott emphasized. He sees Jukebox as a way to enhance the music ecosystem, allowing more participants to benefit from it.Revolutionizing Music RoyaltiesScott explained Jukebox's innovative approach to transforming music royalty streams into regulated securities, a concept still awaiting SEC qualification. Although The Zero Hour went off the air in the spring of 1974, the people involved didn't stop working. Rod Serling always kept a full schedule. His final radio performance was part of Fantasy Park. A fantasy rock concert aired by nearly two-hundred stations in 1974 and 1975. Always a heavy smoker, on May 3rd, 1975, Serling had a heart attack. A second heart attack two weeks later forced doctors to agree that a risky open-heart surgery was necessary. On June 26th, Serling had a third heart attack on the operating table and died two days later at Strong Memorial Hospital in Rochester, New York. He was just fifty. His funeral and burial took place on July 2nd in Seneca, New York. Elliott Lewis would continue in Television, before again working with Mutual on radio dramas at the end of the decade. Jay Kholos continued innovating, eventually forming the theater company, Orchard Street Productions, in 2001. These days he lives in Nashville, where Kholos writes music and scripts for his own productions, while Orchard Street also licenses musicals and plays for local, regional and North American tours.

Mattel, the parent company that owns Barbie, has had their fair share of lawsuits involving Barbie, especially the use of the Barbie trademark. Evan and Tony lead things off with a lawsuit between Greiner & Hauser gMBH and Mattel (04:06) and how Mattel was originally accused of ripping off Barbie from a German doll called Bild Lilli. G&H and Mattel ended up settling but 50 years later, G&H gMBH pursued a lawsuit against Mattel, alleging their 1964 settlement agreement was no longer enforceable. Then, Tony and Evan talk about the iconic Mattel v. MCA Records case (14:55) and how a song called "Barbie Girl" was afforded protection under the First Amendment by way of the Rogers v. Julia Cathrine Monnin Ducray. Born Julia Monnin, her family was from Switzerland and they had emigrated to Pennsylvania. Living next to them in Pennsylvania, was the Ducray family. The Ducray's had boarded a steamship in France in 1839. The journey was almost fatal for 15 year old Jean-Baptiste Ducray, his parents and eight brothers and sisters. Southeast of Nova Scotia, the steamship began taking on water. The passengers and crew feared they would sink and began to throw all of their possessions overboard. The Ducray family threw overboard their wooden chest containing $2,000 in gold and everything else they had brought with them. Jean-Baptiste's mother kept only a wooden cross bearing an ivory carving of Jesus. The ship sank, and everyone from the ship was left shipwrecked on what is now known as Sable Island. They went days without food. They were starving, crazed. A passenger from the ship overheard the ship's crew planning to kill and eat Jean-Baptiste and his father. He hid them by burying them in sand. Luckily, only a day later, a passing ship rescued them. They arrived safely, settling in Pennsylvania, next to The Monnin family. Julia and Jean-Baptiste Ducray fell in love and were married. When Jean-Baptiste and his brother Jean Claude went West to mine gold in California, it was barely a year into the gold rush. He was 25 and Jean Claude was 16. They took the Isthmus of Panama route. This is the same trip made by Belle Cora, detailed in my book. The route saved thousands of miles and avoided the trip around the southern tip of South America's Cape Horn. Starting in New York, they made a 2,000 mile voyage by ship to the Port of Chagres on the eastern Caribbean coast of Panama at the mouth of the Chagres river. They took a bungo, a type of Panamanian canoe for $5 (just under 200 bucks today) for a 4 day river journey through the crocodile and jaguar bearing jungle. That was the easy part. The men rode a 50-mile trail on mules through the steaming malaria, yellow fever, and cholera ridden jungle to the small outpost in Panama City. They waited there and caught a ship to San Francisco. Many forty-niners did not make this journey. The brothers had now survived two deadly passages together. Upon arrival, like many immigrants of the time, the brothers Americanized their names. John B, and John C. Ducray. The brothers traveled to Nevada City and set up camp along the Oregon Ravine on Oregon Hill. Julia arrived soon, making the journey by wagon. The couple invested in mining and bought properties. In the spring of 1866 on a claim bought for $36 (almost $1300 today) and while cleaning up an old mudslide on the property, Julia's husband found 265 ounces of gold. Equalling over $5000, equivalent to almost $179k in 2023. Julia's husband Jean Baptiste, or John B, was a descendent of one of the Ducray Nine brothers, known for saving the life of the French King "Henry the Great" in the late 1590's. These nine brothers were knighted and awarded with villages besides the Jura Mountains in France. Their new villages contained hills, forests, orchards and beautiful meadows with flocks. John B was born in a medieval chateau at one of these family villages. It had a fountain, a Roman aqueduct and a mill, powered by the creek that ran through the village. He lived there until he was fifteen and learned about engineering the water flow and studied the geology of the nearby caves and quarry. His knowledge helped him later design wing dams and sluices for gold mining and irrigation on his own property. And his interest in geology and hydrology led to consulting on the first reservoir built for Nevada City's municipal water system. On 35 acres of mining-stripped bedrock in Nevada City, the couple built a fourteen room, two-story home with five bedrooms and large parlors upstairs and downstairs on Orchard and upper broad streets and re-created the nearly self-sufficient French farm that John B had grown up on. They planted vineyards and orchards of walnut, apple, pear, and almond trees. They had a single milk cow for providing milk, butter, and cheese. They kept honey bees and maintained four acres planted in clover for the cow and bees. They had a huge basement beneath the house that was useful for storing their produce and John B.'s wines and brandies. Julie planted large "cabbage roses" around the home. It is said that the 150-year-old pear tree John B. planted there continues to bear delicious, giant Bartlett pears. John B. and Julia's home and orchards on Orchard Street are included in the first map of Nevada City, which was hand-drawn in 1869. Orchard Street was in fact named for John B.'s orchards. For decades the couple would exhibit wines, brandies, honey in comb, peaches, pears, grapes, walnuts, almonds, buckwheat, string beans and potatoes at the local and State Fairs. They bartered or paid in gold for everything that they could not produce themselves. Julia and John B. were fast friends with the French pioneer nurseryman, horticulturist Felix Gillet upon his arrival in town. Felix had opened the town's first barber shop which sold French fineries including pens, stationery, and toys on Commercial Street, just below Pine Street. The couple inspired Felix to plant orchards, and he eventually established a world-renowned 20 acre nursery on Aristocracy Hill. (Barren Hill Nursery) Nursery Street in Nevada City was named for Felix's nursery there. Julia and John B. adopted niece Theresa and raised her as their own. The three of them led a happy life. They attended Saint Canice Catholic Church that was recently built and often went to the state fairs, often accompanied by Felix Gillet, who wrote about the events. Gillet often wrote magazine articles glorifying the Ducray's farm, orchards and produce. So did many newspapers of the time. John B passed away after a battle with pneumonia. Penicillin had not yet been developed. Julia was so heartbroken by his loss, she passed away four months later. They were laid to rest in Pioneer Cemetery, across Orchard Street from their home. They left all their properties to 21 year old adopted daughter Theresa Julia. Felix Gillet and Theresa Julia grew a bond through grief and sorrow and were married. The couple did not mind their difference in age, Felix was 32 years older than Julia Theresa, or height, Theresa Julia was taller. Theresa Julia took her middle name, perhaps in homage to her beloved Aunt. After they married, Felix added the second-story addition to his established Barren Hill Nursery on Nursery Street (named for his nursery) on Aristocracy Hill. Felix and Julia Theresa remained married for 17 years until Felix passed away in 1908. He also left his properties to Julia Theresa. She ran his Barren Hill Nursery (also known as Felix Gillet Nursery), with the help of head nurseryman George Dulac. Dulac was the son of the Ducrays' and Felix's good friends, Nevada City pioneers Louis and Manuela Dulac. She and George grew up in school together. They had been childhood friends since her arrival in Nevada City. They were married a year after Gillet's death. Theresa are laid to rest in Pioneer Cemetery, beside Jean-Baptiste, Julia Catherine and Felix.
