SPEAKERS Wayne Stacy, Abby Parsons, Jim Brogan 00:00 Welcome, everyone to the Berkeley Center for Law and Technology's Expert Series podcast. I'm Wayne Stacy, your host, the Executive Director for BCLT. And today we're gonna talk about an unusual case that came out bio fronteira. And we have two of the nation's leading biopharma and medical device patent litigators with Jim Brogan and Abby Parsons, both from King & Spalding. So, just want to get right into this case on the bio fronteira issues. Why Why is this case interesting? Jim Brogan 00:38 And well, in some ways, it's not interesting because it's a rejection of summary judgment due to factual issues. But at another level, when you look at what's at play, I think it is interesting, because you're looking at section 101 attacks on what I think before Alice, people would have looked at as pretty clearly patent eligible subject matter where you have multiple light sources connected to a controller that performing a function. But now that we're in this Alice age, you look at the light sources, they output uniform light, people say, hey, lights, a naturally occurring phenomenon. So one on one attack is is fair game here. And so that I think is interesting, I think, also, you know, the interplay of the claims with written description and enablement is interesting. Wayne Stacy 01:26 Well, I mean, the last case that they kind of had this kind of physical structure was, I guess, maybe easy to understand you had Axles. But this one didn't quite get as much attention outside of the medical device field. And I guess my question for you is, for those that are drafting medical device patents, is this a case that should be studied a little more closely? Jim Brogan 01:50 I think I take a look at this case. And I'd also look at the EU versus Apple case that came out of the Federal Circuit. Because there you had, again, something that looked very much like physical structure, the camera with multiple images, sensors, lenses, processors, memory, etc. And what you were doing was using one image to improve or two images together to improve the output. And court said, that's abstract. And therefore out under eligibility, I think if that case was available here to these folks, when they file their summary judgments, you might have seen a little bit different approach, we say, here, what you're doing is you're using multiple light sources to generate uniform light. Although the court did know that, there was no evidence that that was just common, and well known, at least in the record. Wayne Stacy 02:47 So when you when you read the briefing, you can pull out a lot of frustration from bio fronteira. What are they, what are they really complaining about here? Jim Brogan 02:58 You want to run with that one, Abby? Abby Parsons 03:01 Sure. I mean, I think I think the idea is, it's a common thread among several different aspects of patent law that you see, you know, 101, 112 enablement, written description is, is they've got these broad functional claims that cover a universe of things. And, you know, the disclosure just doesn't meet what what the patent office gave them

The electric future has arrived, with several major OEMs making battery electric trucks available now, some that will be available soon, and even a growing push toward hydrogen fuel cell power.So what will the role of suppliers be in this electric future? To answer that question, I talked with Jeremy Frenznick, senior director of CV engineering at Dana. Dana is providing e-axles and/or power systems for electric trucks from Peterbilt, Kenworth and Hyliion.
In my attempt to make the LMT a bulletproof freestyle truck, I've bought the Treal 7075 Billet Aluminum axle housings. Yes it adds a little weight, but it's not as significant as you might think. It's about 6-7oz heavier, but tons stronger. I've already bashed with it and know that it will transfer the break point, but that break point is much higher now. I'm ok with that trade off. NOTE: I mentioned the front axle installation problem...it's not 5 degree toe in on the front axle...it 5 degrees of Castor. I'm an idiot sometimes...most of the time actually.

After consolidating in the range of 11,100-11,350 in the last few sessions, Nifty continued its positive momentum on Tuesday as bulls took the charge, getting support from private banks, auto and cement stocks. On the derivative front, call writers at 11,300 strikes triggered short-covering while put writers added hefty open interest at the same strike with nearly 33 lakh shares. On the higher side now 11,400 strike holds a maximum open interest in calls which should act as an immediate hurdle for Nifty. On the technical front, Bank Nifty is facing a strong hurdle in the zone of 22,300 to 22,500, above which follow-up buying can be seen in the index which will support the next up-move in Nifty also towards 11,500 levels in the coming sessions.

Cooler Trailers Superior Design- Small refrigerated trailers
Superior built refrigerated trailers yep right down to the axles. To the untrained eye an axle is an axle but to those that know the importance it’s a huge part of the total package. For example in my industry everyone else uses 3500 lbs axles while we use 5200 lbs drop axles. What that simply means is that Cooler Trailers can literally haul a ton and a half (or 3000 lbs.) more product than other trailers. We use drop axles to give us easy ground entry into trailer in fact 19″ up into our cooler trailers just like a step of stairs at home. We also put electric brakes on both axles to ensure that when you need to stop with all that product you can stop, it’s that simple. Axles play an important role in what and how much you can ultimately haul in your freezer or refrigerated trailer and should also play a role in your decision as to how you plan to use yours. For example, Our 7×12 trailers can haul up to 8000 lbs with the appropriate vehicle. Although any 1/2 ton vehicle can pull our trailers to maximize the load capacity we recommend a 3/4 ton vehicle or more. Most 1/2 ton vehicles can still haul around 2500 lbs plus the trailer weight.
