Our lawyers are involved in cases across the country, from British Columbia and Saskatchewan to Ontario, Quebec, and New Brunswick. Marty Moore takes us through a few of these. Donate to help us make more shows: https://www.faytene.tv/donateIn this episode we look at freedoms in Canada. As citizens of Canada, we can enjoy these freedoms because they are protected and preserved by people who fight to defend them. We can do that ourselves, however, there are times when our freedoms are challenged, and sometimes even taken away. When that happens there are lawyers who are specially trained in constitutional law who will stand up and defend us. One group in Canada that has for many years done an outstanding job of defending our freedoms is the Justice Centre for Constitutional Freedoms. In courts all across our nation they have stood up for those among us who have had their freedoms and rights violated by the government. In this episode we have a representative from the Justice Centre for Constitutional Freedoms with us, Marty Moore. Marty is the litigation director who leads a team of lawyers who are available if you need their assistance. Here, we meet Marty, someone who is out there helping us defend our freedoms as Canadians. Please like, subscribe and share! Faytene.tv is a listener-supported program. The CRTC has delayed implementation of its Online Streaming Act – the law that allows the government to control what you see on platforms such as YouTube, Netflix, and podcast databases – until “late 2025,” a postponement that more than likely kicks it to after the next federal election. True North's Andrew Lawton says this might be a bit of a reprieve for Canadians who want the governments hands off their content. Also, while healthcare is in the provincial domain, it's federal gatekeepers who are preventing Canadians (except those living in Quebec) from accessing healthcare choice. SecondStreet.org president Colin Craig says this is an opportunity for federal Conservative Leader Pierre Poilievre. He joins the show to discuss. Plus, Saskatchewan's court of appeal has upheld the government's former restriction on outdoor gatherings. This comes the same week as British Columbia's Supreme Court upheld B.C.'s vaccine mandate for healthcare workers. Charter Advocates Canada litigation director Marty Moore returns to weigh in. Lawyer Marty Moore gives us a round-up of court cases involving gender issues and parental rights across Canada. Starting in New Brunswick, the fight moved west to Saskatchewan and then into Alberta with new policy announcements by Premier Danielle Smith. Court challenges in Alberta, he believes, are inevitable. If the province opts to use the Notwithstanding Clause, as the government did in Saskatchewan, there is a potential for a sea change in how constitutional questions are settled, as more provinces move to overrule activist courts.Marty Moore on X, Feb 10, 2024: "We may be on the cusp of a sea change in constitutional law in Canada, where Canadian legislatures, outside of QC, exercise increasing authority under the notwithstanding clause..."National Post, Feb 1, 2024: Alberta's new transgender rules: From restricted treatments to pronouns and parental rightsJustice Centre, Feb 20, 2024: Quebec teacher challenges Education Minister's gender transition policyCBC, Jun 18, 2023: N.B. premier stands by changes to school LGBTQ policy, says he does not want an electionRegina Leader-Post, Sep 28, 2024: Moe vows to use notwithstanding clause after court injunction halts pronoun policyJustice Centre, Jan 10, 2024: Intervening for parental rights: UR Pride v. Beat the censors, sign-up for our newsletter: https://firstfreedoms.ca/call_to_action_pages/stay_informed/ This is part two of a two-part interview with Marty Moore and Hatim Kheir. In this discussion, these men discuss the impact of government restrictions on religious gatherings and how it took center stage. Highlighting the challenges posed by indoor and outdoor limitations, the Justice Centre for Constitutional Freedoms (JCCF) emerged as a key player in challenging these restrictions. Both participants emphasized the need to scrutinize the reasonableness of such measures, citing the duty of the courts to uphold Canadians' constitutional freedoms. The conversation went into the vital role of the courts in preventing governmental overreach and safeguarding citizens' rights. Despite a seeming “pause” in restrictions, ongoing legal battles prove the importance of organizations like JCCF, which continue to support those adversely affected. The debate over the necessity of restrictions saw government experts and opposing voices at odds. Comparisons with the United States shed light on differences in how religious freedom is treated. While the U.S. defended these freedoms robustly, some argue that Canada appears to place less value on them. The conversation probed whether our society prioritizes prosecuting religious leaders over addressing underlying issues. The lack of care and respect for individual freedoms was a recurring concern. Marty Moore and Hatim Kheir voiced a shared sentiment: Canada is a nation worth fighting for, with constitutional principles that must be upheld to ensure the well-being and freedom of its citizens. Beat the censors, sign-up for our newsletter: https://firstfreedoms.ca/call_to_action_pages/stay_informed/ This is part one of a two-part interview with Marty Moore and Hatim Kheir. In a time of unprecedented challenges, Marty Moore and Hatim Kheir continue to be defenders of constitutional rights through their work at the Justice Centre. As the weight of restrictions imposed by the provincial health officer fell over British Columbia, Marty Moore, a constitutional lawyer, represented several churches who challenged the government's prohibition on church gatherings and protests. Moore shares with Barry the significant breaches of freedom of conscience and religion, highlighting the disheartening reality that the courts are consistently showing deference to the government. Meanwhile, in Ontario, Hatim Kheir had his own case journey dealing with similar issues as he represented the Alymer Church of God and the Bible Chapel. Challenging Ontario's gathering restrictions, Hatim Kheir faced a court of appeal's decision upholding government restrictions as constitutional. The Supreme Court of Canada refused to hear both of these cases which means the lower court decisions remain in the governments favour. While the court has historically delved into contentious public policy issues, this time, its silence has left questions unanswered. This shift poses a significant concern for the future. Marty Moore discusses a parent's right to know what is happening to their child in school. This follows a story out of Lumsden, Saskatchewan, which resulted in the education minister suspending Planned Parenthood from giving sex ed presentations in schools. "Rights and Freedoms"... in Canada and throughout COVID?... We actually Do Have them! And Justice Centre Lawyer Marty Moore brings it all to light here. This was a fun and really important conversation – and the urgency of becoming informed and aware becomes more evident as we cover such topics and issues as: – The Canadian Constitution and State of Emergency – Business Shutdowns and an Overreaching Government – People being Condemned to be Left Alone and Stripped of all Personal Choice – The Complete Dismantling of our Right to Protest, Freedom of the Press and Freedom of Expression – Lockdowns, Vaccines and growing Peer Pressure, and Medical Freedoms – Fighting for Freedom as a Canadian – And how the Government CAN actually be sued if they don't stay in their lane It seems strange to talk about having to fight for freedoms in Canada in 2021, but it seems to be a real issue, and we need to snap out of our complacent and prideful 'yes ma'am' mentality and stand up to those who should be working for us instead of overlording, silencing, reprimanding and punishing us. If you haven't heard of the Justice Centre for Constitutional Freedoms you should really take some time to visit their website at www.JCCF.ca and dig into all of their amazing resources: their 'Two Minutes with the Justice Centre' articles; their videos, podcasts, ebooks; and all the cases they're involved with across Canada. Episode #71 // Thinking about how to transition to a new company or industry when you don’t have the technical expertise? For all our listeners who are changing roles (company, industry, or job function), this episode addresses some of the key challenges. We look at the role of diversity and inclusion, how to recognise and leverage your generic skillset, and why your technical expertise becomes less critical as you move up the ladder.I also give you a guided tour of my multiple successful career transitions, and outline the core capabilities and focus areas that will help you to master any transition. The free PDF resource for this episode absolute gold, the '9 Ways to Transition into a New Industry' so head to www.yourceomentor.com/episode71 to download it!
Episode #69 // As 2019 draws to a close, Em and I thought we’d take a look back on the year of podcasts, and pick out our favourites for you to go back and listen to while you are enjoying some downtime in the New Year.Leaders, don’t just stay inside and eat pies this Christmas (and you’ll need to listen to the episode to work out what I mean)… Take a little time to improve yourselves, and get into some of these episodes from our back catalogue that we think are the pick of the bunch. All the links to the episodes and free downloadables that we speak through can be found at www.yourceomentor.com/episode69
Episode #68 // Strong leadership is rare, but incredibly valuable to people and organisations.Unfortunately, with the amount of superficial, feel-good leadership content being peddled these days, you could be forgiven for thinking quite the opposite. For many, leadership has deteriorated into a quest to ‘make people happy’.Many leaders then begin to believe their own bullish!t. They misinterpret superficial contentment as productivity, and limited achievement in an undemanding environment as high performance. This episode contrasts strong and weak leaders, exposing the high price of leadership weakness. To take your learnings on this topic even further, download the 'Strong V. Weak Leader Checklist' that I've put together at www.yourceomentor.com/episode68.Are you a strong leader, or a weak leader?
Episode #67 // The reality of life in modern organisations is that resource constraints are ever present. For this reason we have to make choices, but we typically aren’t good at this. We simply try to do way too much. And if we DO manage to get good at it, there is often a Nike boss above us who says “Just do it”. The type of boss who doesn’t want to listen to why something can’t be done.Excellence in performance is generally underpinned by a philosophy of simplicity and focus.Don’t try to do too much - keep it simple, do the things the REALLY count, and do them REALLY well.
Episode #66 // It is almost expected that when you take on a new role, you are going to find ways to do things differently, and improve the team you have. Enter the “change program”.It is easy to get caught up in the hype… Consultants running around everywhere telling you what needs to be done, people drowning in PowerPoint decks that explain the change, and a whole facade of indicators to prove that what you are doing is working. But how do you know if you are really getting traction? Often we take silence as a sign that everything is going well, when actually it can be quite the opposite. In this episode we learn to interpret the noise and work out what to do with it to ensure our change initiatives actually work, rather than just believing our own bullsh!t.
Episode #65 // As leaders, we often feel as though it is our obligation to ensure that everyone in our team is happy, motivated, and succeeding. Although that would be nice, it is also incredibly unrealistic. This episode explores the line between accountabilities for the leader and their people (many of whom may also be leaders, of course). How far does your obligation extend to help someone change? And how much rope should you give them if they are clearly not turning the corner? We get really practical here, so buckle up!Now this episode is pretty dense, there's a lot to take in and remember, so I've created a free PDF downloadable for you that will help you work out what a leader's obligations are, and what your people's obligations are. Download it at www.yourceomentor.com/episode65!
Episode #64 // Restructures in large organisations are commonplace, and quite often imply that the organisation is seeking greater efficiency, which results in a number of roles being made redundant. These decisions, from the front line perspective, may seem to lack rationality and create a lot of angst, as sometimes very good people are moved on.How do you handle this emotionally and psychologically if you are caught in the firing line and, in your role as a leader, how can you help to make a redundancy and restructure process as painless as possible for your people, while giving your organisation the best chance of capturing value? This episode covers all the basics you need to manage redundancies, and provides guidance on handling the most difficult conversations.I've made a cracking free PDF downloadable for this episode, '9 Ways to Get Redundancies Right' which you can download from www.yourceomentor.com/episode64
Episode #63 // Sometimes we focus so much on developing our own leadership style that we forget to read the play. One of the most useful leadership models that I have encountered is Situational Leadership Theory. It basically states that, since every individual is different, and they often find themselves in different situations, the style of the leader should vary according to this in order to optimise results. In this episode we look at when it is appropriate to push harder, when it is appropriate to work more closely with someone, and when it is appropriate to stand back and let them get on with it!Using practical scenarios, we bring the theory to life to help you navigate changes in style, depending on the needs of your followers.
Episode #62 // In today's episode, Em and I are chatting through two really great listener questions! The first question we tackle is from Alison, who asked: “I’d be interested in a topic covering how to lead and influence people that are smarter than you! How do you keep them engaged and motivated without being permissive?"We all know that hiring people who are smarter than us is actually the object of the exercise, but being smart isn't everything, it’s just a really good start! The second question is from Jack who asked: “Holding people accountable is always difficult – I’m a “nice guy” and struggle being the “tough guy” and also struggle with how to hold people accountable without being threatening."This is something that hits us all at one point or another during our careers, so learning to step away from the need to be the "nice guy or girl" is critical to being able to drive the results you want.In this episode I recommend that you listen to:Episode 1 Respect Before Popularity: Letting go of the need to be likedEpisode 6 The Psychology of Feedback: Stop avoiding leadership workEpisode 57 Challenge, Coach, Confront: The leader's basic toolkitEpisode 41 You're Changing, So Now What?Episode 19 Execution For Results: Driving accountability in your team

Episode #61 // As leaders, we are often cast in situations where we have to say “no” to people. In this episode I give you some practical techniques for having the confidence to say “no” to virtually anyone - your team, customers, suppliers, and peers.I’ll even touch on how to say “no” to your boss without risking the relationship, or making her or him feel as though you are being insubordinate.Understanding how to say “no” without feeling as though you have let the other person down, and without carrying guilt around afterwards, is the hallmark of a strong leader.

Episode #60 // Leading when you don’t have physical proximity to your people can be tricky. The good news is that doing this well is no different from leading any team well. However, any cracks in your leadership will be more obvious in this scenario. In this episode I explore the nuances of leading remote teams (or remote employees, as flexible working arrangements become more prevalent).I'll talk about why world leading safety organisation, DuPont, always put one of their own leaders into a newly acquired operation, and will cover how making your expectations clear can prevent little fiefdoms from springing up.As Ronald Reagan said: “Trust, but verify”.Download the free PDF cheatsheet for this episode '10 Way to Improve Outcomes with Remote Teams' at www.yourceomentor.com/episode60
Episode #59 // Great leaders are great communicators - and for the most part, they are also excellent presenters.Although it has never been easier to put together a great presentation to win over and influence an audience, many leaders still miss the mark. You don’t want to be the presenter whose audience has only one thought: “How do I get out of this room?".In this episode, we explore why presentations are so often excruciatingly painful to sit through, and how to avoid the common pitfalls. Whether you’re speaking to your own team, the board of directors, or a stadium of 10,000 people, my five guiding principles will help you put together a winning presentation for every context! To download the free PDF 'Five Ways to Avoid an Epic Presentation Fail' (you might want to hand this out to your entire team and set a new standard for presenting!) head to www.yourceomentor.com/episode59
Episode #58 // This week, Em and I take on a few great questions that appear to keep coming up regularly for our listeners!(0:55) The first question we tackle is from Stephanie, who is about to inherit a team member that is known company wide as an under performer (and quite frankly, pisses a lot of people off!), but her boss really likes this team member and doesn’t seem to see her faults. We help Stephanie work out what to do and how to manage both the under performer AND her boss.(6:35) Secondly, we answer Mike’s question which is an absolute cracker - how to deal with imposter syndrome. I get pretty deep in this one, and it’s a topic I haven’t spoken about very much, so I really hope it’s valuable.(12:50) We end with a great question from Pete, who asks us to address how to implement initiatives that have been agreed on in strategic planning sessions. So often great ideas come out of planning sessions, but then 6 months down the track no movement has been made because everyone is getting on with their standard day to day activities. If this resonates with you, you’ll get a lot of value out of my answer. If you’ve got a question that you’d like us to cover in the podcast, email it through to us at emma@yourceomentor.com, we’d love to hear from you!We also mention the ‘Six Steps to Creating a Strong Accountability Culture’, which you can download at www.yourceomentor.com/episode58. We also mention Episode 7 Work at the Right Level: What got you to here won’t get you to there which you can listen to here and Episode 19 Execution for Results: Driving accountability in your team which you can listen to here.
Episode #57 // I often talk about the hard work of leadership as being the process of challenging, coaching and confronting your people. I had quite a few questions from our last Leadership Beyond the Theory cohort asking to explore this in more depth, so this episode takes a closer look at how it works. If you want to learn how to set up each phase, and use this approach to get the best results possible from your people, you need to understand a few of the basic concepts in this framework. The ability to challenge, coach, and confront - confidently and competently - has a huge impact on individual and team performance. You’ll need to master this if you have any aspirations of being a great leader.
Episode #56 // For a leader, trying to shift a culture, improve performance, or lift the standard of a team is fraught with danger. Ideally, everyone would recognise the necessity for change, the benefits to be gained, and the logic of the plan. They would then get behind you with their unequivocal support. In reality, this is not how the world works. So what do you do when the change management frameworks and theories cease to work, due to the entrenched change resistance of a handful of your people? I have chosen a rather graphic expression for this - shoot a hostage (not literally, of course!) - because I need to get your attention. If you can’t shut down the passive aggressive resistance that some people deploy, all the change experts and process frameworks in the world won’t help you.Remember, not changing is NOT an option!
Episode #55 // We often take for granted that when people join our team, they will intuitively know what to do, and will seamlessly assimilate into the culture, becoming productive almost immediately. This, of course, builds on the burgeoning love affair that developed during the recruitment and selection process. And then, reality sets in…This week we take a look at some of the myths around bringing new people on board, and talk about the psychological contract you have with your people. How do you protect the integrity of that contract from day one?You can pick up the free downloadable PDF 'Onboarding Traps for Young Players' from www.yourceomentor.com/episode55

Episode #52 // Today is our first birthday! Episode 52 marks one year of weekly No Bullsh!t Leadership podcasts. So Em and I wanted to take the opportunity this week to reflect on the year, and give our listeners a little insight into the origins of the podcast, and where we are taking it.In this episode we have an informal chat to expose some of the key decisions that led to the establishment of Your CEO Mentor, and the creation of the podcast. In lessons for any business, big or small, we talk about the role that purpose plays for us, we explore the way consumption of information is changing in a digital world, and we let you in on some of the key growth trends of the podcast. And all of this has only been possible thanks to you, our loyal listeners. THANK YOU for supporting our podcast and sharing the episodes with your network! If you've been listening for a while I'd love to hear what your favourite episode has been over the past year, so connect with me on LinkedIn and let me know what's really resonated with you.
Episode #49 // When a new boss comes into an organisation and identifies that there is a need to make major changes, should she listen to her people, or push ahead regardless?Changing fundamentals like the organisational values can be tricky, but sometimes necessary. The so-called ‘Captain’s Call’ is used to at least some extent by all leaders, with varying degrees of success. This episode explores the question from one of our listeners Greg: when is it OK to make a decision without the support of (or even in the face of concerted opposition from) your people? We examine potential repercussions, and cover some simple rules of thumb that will help you to think about how you are using the power of your position to get results.
Episode #48 // This week, Em and I take on a few great questions that appear to keep coming up regularly for our listeners! The first question we tackle is from Sam, who wants to know how to build credibility quickly in a team he has inherited. (1:40)Secondly, we answer Blake’s question which is quite a complex one. He wants to know how to deal with those people in his team who really struggle with change, and how to work out when it’s right to just keep moving forward with the change, even when people are anxious or resistant to it. (7:30)We end with Laura’s question about using informal communication channels and cliques to communicate and incite change. (12:55)If you’ve got a question that you’d like us to cover in the podcast, email it through to us at emma@yourceomentor.com, we’d love to hear from you!
Episode #46 // When you are brought into an organisation to deliver a turnaround, or when the CEO says it’s time to make major performance and culture change, it isn’t going to happen by expecting the same people to do things radically differently. The trick is to blend the best of the existing capability and culture with new ways of thinking, behaving, and performing. What role do we, as leaders, play in that?In this episode we are going to learn why the people who built the house (the incumbent leadership) absolutely cannot renovate it; why you need to set different standards of behaviour and performance. We’ll talk about the white blood cells that are there to protect the organisation from change, and even cover off on how to spot the subversive elements that will do their utmost to covertly derail your efforts (with all the best intent, of course)!
Episode #45 // You have probably heard me say before that ‘leaders are learners’ (well, it’s hardly an original saying, is it)?Today, we step away from the purely business and organisational context to share a few very personal examples of how some of my greatest leadership learnings have come from everyday life - not from the world of business. So why was my trip to Japan in 2012 so valuable in developing my perspective on different cultures, even though I had travelled through much of Asia previously? And what skills and capabilities did I really acquire while neglecting my law degree to work in the bars of Sydney’s Kings Cross in the early ‘80s?Opportunities are in front of us every day, if we just choose to open ourselves up to the lessons.Download the free PDF 'MARTY'S PRINCIPLES FOR SUCCESS (AND HAPPINESS)' at www.yourceomentor.com/episode45
Episode #43 // I have seen many leaders who are good under pressure, but just as many who really struggle in stress situations.Resilience is a core ingredient of success for leaders, regardless of the type of organisation they work for.If you can handle the inevitable setbacks that come with a level of calm, rational confidence it will help you to lead people through the toughest crises. This episode gives tips for keeping your cool, not just at work, but also the critical ability to not let the stress and pressure bleed into your personal life.If you haven't registered for our free webinar 'Creating a High Performance Culture with Marty Moore' you can do it right now, right here: https://app.livestorm.co/your-ceo-mentor/culture

The San Quentin Correction Facility is one of North America's most notorious prisons. It has held convicts like Charles Manson, and today it houses the largest death row population in the USA. Sporting Witness… The Australian, Dawn Fraser, is one of the greatest swimmers of all time - a three-time Olympic champion for the 100-metres freestyle and the first woman to break 60 seconds for 100 metres. But Fraser is equally well-known in Australia for her rebellious behaviour - including a notorious incident at the Tokyo Olympics in 1964 when she was accused of stealing an Olympic flag from outside the Emperor Hirohito's Palace.
