In a decision applicable to both unionized and non-union employers, on August 2, 2023, the National Labor Relations Board (NLRB) overturned a prior 2017 decision that afforded employers flexibility in the policies and procedures they use to govern the workplace and changed its standard for assessing whether certain categories of work rules are lawful to maintain. The NLRB's new standard outlined in its Stericycle, Inc. decision requires employers to articulate a legitimate business interest in the particular policy and ensure the policy is narrowly tailored. On Saturday, February 4, 2023, pro-lifers are conducting a nationwide protest at CVS and Walgreen pharmacies for their intention to begin dispensing abortion pills. Are these protests a good idea? Will they succeed in stopping the expansion of abortion? Will the pro-life movement have the commitment to pressure these corporations over the long run? The fact is boycotts and protests against corporations are about endurance. These campaigns are also about modulating conflict and leveraging resources. We need to be wise as serpents. In the recent past, Created Equal was successful for a time in achieving a positive outcome against Stericycle with our Project Weak Link campaign. But Stericycle waited us out and interest in the pressure campaign waned amongst our pro-life troops. Unfortunately, Stericycle still hauls away dead corpses of unborn babies. Large companies are hardened targets and difficult to motivate because they are often willing to tolerate boycotts and protests until they affect their reputation and bottom line. This campaign must be able to last over months and years using few resources. If that doesn't happen – this effort will likely fail. Why? Because when pro-life advocates don't see results (a pharmacy refusing to sell the abortion pill) human nature sets in and they go home. Dogpatch Labs today unveiled the latest cohort of startups in the NDRC programme, Ireland's national startup accelerator. Six fast-growth technology companies have been selected from a pool of nearly 300 applicants to take part in the 6-month programme powered by the startup and innovation hub. Participating startups will receive an investment of €100,000 and will benefit from world class mentoring and scaling supports available via the Dogpatch network. This cohort reflects several wider trends within Irish innovation, with multiple participating founders having left successful careers in Google, Amazon & other tech leaders to spin up their companies. This shift towards entrepreneurship as a career path is a clear endorsement of the opportunities available within the Irish ecosystem and via programmes like NDRC. The selected startups also have a strong engineering skillset, with each founding team including a technical co-founder or embedded CTO. Tracworx: The Limerick-based leadership team previously founded the FarmEye agritech software, but switched focus during the pandemic to Supply Chain Tech. They developed Tracworx, the digital infrastructure for returnable packaging. Terrabyte: The engineer focused startup is a social platform where Developers show off projects and find work. Where Reddit meets GitHub, a space where developers connect with like-minded developers to show off projects, learn and hang out. The Full Stack has almost 10k users. The programme will be led by newly appointed Accelerator MD, entrepreneur & investor Ian Browne. Browne founded the successful My Surgery Website, growing it to over 4,000 customers and millions of users before it was acquired by Nasdaq-listed Stericycle. He has played a leading role in developing an Ireland-wide startup ecosystem through his work with Ignite NI over recent years helping indigineous founders raise over €75m in early stage funding. Speaking on his appointment as programme MD and commenting on the strength of this cohort, Ian Browne said: “I'm honoured to be taking on the role of accelerator MD & excited to work with the participating founders and the first-class Dogpatch team. In following the Justice Department and the Securities Exchange Commission FCPA enforcement actions, I am always reminded of the popular phrase — “reading the tea leaves.” (or “tasseography,” a fortune-telling method based on tea leave patterns in tea sediments). Despite a slow initial year in 2021, the Biden Administration's stamp and push on FCPA enforcement is becoming clear. Keep in mind, DOJ and SEC officials have promised a new, tougher approach to FCPA enforcement. Change in government enforcement policies and results take time. However, no one expected the changes to take this long. In addition, the initial enforcement push has raised some interesting questions concerning the specific steps taken by enforcement officials.In looking at the most recent FCPA enforcement actions (i.e., Stericycle, Glencore, and Tenaris), there are significant new trends and some important issues.In this Episode, Michael Volkov reviews the important trends and issues surrounding FCPA Enforcement in 2022.

The Justice Department ended its FCPA enforcement drought by announcing its first corporate settlement in 2022. In a parallel action, the SEC announced its settlement with Stericycle for $28 million for FCPA violations. The SEC's settlement was its second with a company for 2022 (the first was KT Corp.).Under the settlement, Stericycle resolved investigations being conducted by the Department of Justice, the Securities and Exchange Commission and Brazil. Stericycle agreed to enter into a three-year deferred prosecution agreement and pay more than $84 million. Stericycle will pay $52.5 million in criminal penalties, $28 million to the SEC in civil penalties and disgorgement, and approximately $9.3 million to Brazilian authorities. DOJ agreed credit up to one-third of the criminal penalty against fines the company pays to Brazil authorities.Significantly, the DPA requires Stericycle to obtain an independent compliance monitor for a two-year period and then submit a self-report for the rest of the DPA term. Stericycle is a global waste management company which is headquartered in Illinois. In its factual admission, Stericycle admitted a wide ranging scheme involving payment of bribes to foreign officials in Brazil, Mexico and Argentina. In total, Stericycle paid approximately $10.5 million in bribes to foreign officials in Brazil, Mexico and Argentina to secure business contracts from which Stericycle profited by at least $21.5 million.In this Episode, Michael Volkov reviews the Stericycle FCPA enforcement action.

LOSERS: Ginsberg, PP and Roe | The Mark Harrington Show | 5-30-19 Supreme Court Justice Ruth Bader Ginsberg doesn’t know what constitutes being a mother. Planned Parenthood is shuttering abortion centers everywhere and their CEO Leana Wen is a liar. And Roe is crumbling. It’s been a bad week to be pro-abortion in America! On todays show, Mark explains why he has been sending Ruth Bader Ginsberg retirement brochures, preparing for the first abortion free state, and counting the days until the SCOTUS strikes down Roe v. What we have here is the classic military pincer move. Pressure waste disposal companies to dump Planned Parenthood and the abortion cartel (our Project Weak Link) which can force abortion centers to close because they will have no way of disposing of the dead babies. The states require abortion centers to intern or cremate fetal remains in which most funeral homes will refuse to participate. This leaves them with no options. These laws forbid incineration through a company like Stericycle and require funeral homes to do their dirty work. They only long-term solution for the abortion industry to this threat is to create their own incineration facilities on-site or form and operate separate medical waste companies or funeral homes. In fact, Tara Health, who raises money for abortion clinics nation-wide, is already raising money to build such a facility. Fighting the supply side of abortion doesn’t generally get much attention or raise much money, and therefore, is fairly neglected by our own movement. Dismembering America| The Mark Harrington Show | 5-2-19 A Michigan House committee approved two bills recently to ban dismemberment abortions that tear nearly fully formed unborn babies limb from limb while their hearts are still beating. If approved by state lawmakers, the bills would add dismemberment abortions to the current state ban on partial-birth abortions. Pro-abortion Democrats serving on Michigan’s Families, Children, and Seniors committee were speechless after veteran pro-life activist Dr. Monica Miller gave an impassioned testimony against dismemberment abortion at the state capitol. Dismemberment displayed. During her four-minute-long remarks, Miller, the founder of Citizens for a Pro-life Society, told lawmakers about how she retrieved dismembered babies from a dumpster behind an abortion clinic on the state’s east side. These children “died a most horrific, torture method of extermination,” she said. To “dismember the unborn means that we actually dismember them from the human family. We sever them from inclusion into the human family.” Currently, 11 states ban dismemberment abortions: Ohio, Kansas, Oklahoma, West Virginia, Mississippi, Alabama, Louisiana, Arkansas, Texas, Kentucky and North Dakota. In April, a judge blocked Ohio from enforcing its pro-life law. In 2016, Created Equal launched #ProjectWeakLink aimed at forcing Stericycle, America’s largest medical waste hauler to cease disposing of aborted fetuses for Planned Parenthood. On June 1, 2017, Stericycle disclosed the cancellation of hundreds of contracts with abortion facilities. National Abortion Federation President Vicki Saporta--who represents hundreds of independent abortion mills across the country--spoke on NPR (National Public Radio) saying: "There are VERY FEW companies that do what Stericycle did, and when companies like Stericycle give in to the harassment of anti-choice proponents, it puts an unfair burden on abortion providers.” READ FULL NPR INTERVIEW HERE Unfair burden? Oh, what poor, maligned abortion providers that they can’t find enough people willing to clean up after their slaughtered babies. Are we supposed to feel SORRY for child-killers?! [Enter: Specific Waste Industries] Specific Waste Industries disposes of aborted children and the instruments used to kill them for EMW Women's Clinic in Louisville, KY and other abortion clinics in the region. Stericycle has FINALLY--under IMMENSE public pressure--agreed to refuse to accept and dispose of abortion remains as part of its services. In 2016, Created Equal launched #ProjectWeakLink aimed at forcing Stericycle, America’s largest medical waste hauler, to cease disposing of aborted fetuses for Planned Parenthood. Stericycle, either by neglect or intent, did not strictly enforce their medical waste protocol which was meant to refuse fetal remains. Therefore, in practice, Stericycle had been providing services to abortion clinics to dispose of aborted babies. Stericycle has taken a vital first step in the process of ceasing its involvement with the abortion cartel. We will “Trust but Verify” Stericycle’s claims regarding their refusal to dispose of fetal remains from abortion companies. They are still providing other waste services to a small number of abortion centers and therefore will remain, an enabler of Planned Parenthood and child-killing. We remain committed to persuading Stericycle to dump Planned Parenthood and the abortion industry altogether. Paul Spiegelman founded BerylHealth and eventually sold to Stericycle, a global services organization with 25,000+ employees. He was able to take his most favorite part of his job and transition into the role of Chief Culture Officer at Stericycle in hopes of scaling the culture he built and cherished at his first company. Within a year of starting the company, a hospital contacted the brothers in need of someone to handle physician referrals and their core business changed. They ultimately became an outsourced provider of call-center services for hospitals across the country taking calls and tracking patients into hospital systems. A call-center operation can easily become a commodity business but Paul wanted to create value for their customers. They ended up building a great brand around their unique internal culture that drove customer loyalty and profitability. This created extreme value when they eventually decided to exit the company in 2012. Organizations Are a Reflection of the Leader Paul explains a few different definitions of culture. “Culture is the extent to which team members or employees will do work beyond what is expected of them as well as the vibe that you feel when you walk through the doors of that business.” “Culture and leadership are really the same thing and as leaders we have to make choices on how we lead. Culture and treating people well is not only the right thing to do, it is good for business. There is an ROI to it. It is as important of a process in our business than any other process we have. Not every company works this way,” explains Paul. Paul helped create a brand around their culture that not only drove employee loyalty, but that drove customer loyalty. The culture allowed them to sustain and grow. A call-center is a tough place to work but they made it fun for their employees who they cared about, rewarded, and let them be themselves. Scaling Culture Paul and his brother that was still involved in the business didn't have any intention of selling but knew it would come at some point. “All I wanted to do was build a great business and sustain it for as long as possible.” An offer for the business did come up in 2010 and during due diligence, they walked away from the deal to protect their team members. It just wasn't the right fit. A year later they were approached by Stericycle to become a part of their family, and it was a better fit for their company and culture. Paul was curious to determine if his current company culture could scale to a bigger company like Stericycle which had been around for 25 years with 25,000 employees in 18 countries. Though Created Equal does not support or oppose Donald Trump for President, Mark Harrington discusses Donald Trump's statements made to MSNBC's Chris Matthews regarding the punishment if abortion were made illegal. Trump's position of punishing women who have illegal abortions is generally unrepresentative of most of the anti-abortion movement. Women who abort their children ALREADY suffer the adverse natural consequences of abortion, and in order to add a legal penalty to these women's lives, we would have to prove a "meeting of the minds" between the abortionist and woman (which rarely exists) among other things that would prove a level of culpability. Women have never been punished for committing illegal abortions for a variety of reasons, and that would likely be the case if it were banned in the future. Created Equal believes strongly in exposing abortionists and their enablers so that their monstrosities don't slip past the eyes of the public. Fortunately, Republican Senate Majority Leader Mitch McConnell is holding the line against Obama's pressure to fill the vacant seat. He accurately argues that the Senate's constitutional duty is simply "to provide advice and consent," and that it is not their duty to approve of anyone the President nominates. McConnell has also gone on the offensive against the hypocrisy of pro-abortion Democrats, citing the "Biden Rule," an instance in the 1990's where Biden directly contradicted what is being said now by his administration regarding nominations during political campaigns. According to the abortion industry's own experts, medical waste companies such as Stericycle are the abortion industry's Achilles' Heel. Question: What if Stericycle were to stop doing the dirty work of Planned Parenthood? Answer: Planned Parenthood would be unable to dispose of the babies they kill, and the murder of millions of innocent children by Planned Parenthood would LIKELY HALT.
