In 1981, Wendy Rogers became one of the first 100 women pilots in today's Air Force by earning her wings at Williams AFB in Arizona. Following Air Force jet training, Wendy piloted worldwide airlift and humanitarian missions in the C-141 transport jet for several years. Wendy then served as a flight instructor for cadets at the US Air Force Academy. She finished her career with over 3,000 hours of jet time and numerous commendations, including the Defense Meritorious Service Medal. After retiring from the Air Force in 1996 after twenty years of active duty, Wendy and her husband Hal (also a retired Air Force officer) started their own home inspection business. Wendy Rogers is uniquely able to serve the needs of Legislative District 6 because she is able to pilot her own aircraft into many of the short-field runways in remote rural areas. Lt. Col. In this episode, I'm talking with Senator Steele who reveals the first time she made a dramatic stand for survivors of sexual abuse. She bravely shared her own story of incest and child sexual abuse on the Arizona State Senate Floor. Steele recounts the attacks, “My very first memory in life was being raped by my grandfather. She goes on to say that “I don't have very many memories from my childhood,” those that I do have are not good. You don't want to know them.” She fought for justice for survivors of child sexual abuse when she introduced a bill to extend the statute of limitations for victims to bring a civil case against their abuser in Arizona. Current state law barred survivors from civil action after they turned 20 years old. According to Steele, “Republican leaders, so far, have blocked the bill.” Senator Steele supports survivors of child sexual abuse and the elimination of the statute of limitations for all child sexual abuse survivors nationwide. Senator Steele is one of a growing number of survivors and women who are fighting for justice for survivors of sexual violence in State Capitols nationwide. These legislators of courage are working on behalf of women and survivors who have been beaten, raped, and even murdered by their abusers and predators. We salute Senator Steele.

  The Think Tank welcomes the return of the Think Tank “A Team,”  Attorney Tom Ryan and political consultant Chuck Coughlin to discuss several of the most pressing Arizona issues. Arizona is getting $12.2 billion of America Rescue Plan Act relief.  But there is a requirement that they money be used for the specified purposes, not to fund tax cuts.  AG Brnovich has indicted he will sue over this provision. Will his court challenge have a chance? Proposition 208, passed by the voters last November provides additional education funding paid for by a tax on ultra-high income earners.  The Voter Protection initiative, also passed by the voters, prohibits the legislature from any action whose purpose is to undermine the will of the voters. The governor and Republicans in the legislature think they can evade this provision with artful legislation. Will this survive a court challenge? The Arizona State Senate “won” the right to “audit” the Maricopa County election results. But they seem to have no idea of how to do this given that the County has already subjected the results to two independent audits.  President Fann does not appear to have a face-saving way to get out of this mess.  (Like the dog that finally catches that car: “What do I do NOW?) With Governor Ducey’s support, Native American gaming legislation is in the works that will augment the tribes’ gaming footprint, but also pour a small fortune into the hands of the billionaire owners of the four major league sports franchises (who also all benefitted from publicly financed stadiums). We conclude with a discussion of the demise of civility in our politics with a discussion of a couple of pertinent incidents this week in our own legislature. The COVID pandemic has altered all of our lives, no more so than in our schools. What is actually going on in our schools right now? How much is in-person learning, how much is remote? How are teachers and students adapting? To what extent is learning impaired? What are our children missing? We have two guests, both practicing teachers. Each has also been involved in educational policy issues in other ways. Beth Lewis, teaches in the Tempe Elementary School District in a school with a high proportion of kids who qualify for free or reduced price lunches. She has been a leader of Save our Schools, which successfully passed a Proposition in November which imposed an income tax surcharge on very high income taxpayers and earmarked the additional revenue for schools. Christine Marsh teaches in a middle school gifted program in Scottsdale. She was 2016 Arizona Teacher of the Year. In November, she was elected to the Arizona State Senate from a central Phoenix legislative district. We started out by asking these teachers about the classroom issues listed above. Income Tax Conformity – The History, The Process & Why It All Matters

Every year the Arizona State Senate and House of Representatives must consider whether or not and how to conform to the Internal Revenue Code (IRC) for the tax year that just ended. To Arizona taxpayers this is vitally important since they must use federal adjusted gross income to determine the starting point for filing state tax returns. With the legislative session convening in January and tax returns due April 15, the pressure is on to pass the conforming legislation early. Without early passage, taxpayers and tax preparers are left making assumptions and often file for extensions or have to amend returns. When conformity occurs late in the session it means higher costs to the taxpayer and more complexity and time spent on state income taxes.So why does the Arizona Legislature have to consider this bill each year? Rather than create a separate tax code with separate definitions, Arizona uses the IRC as the base for the state, making taxes less complicated for taxpayers. Since state returns use the federal definitions as the starting point, any changes at the federal level mean Arizona needs to update, or taxpayers face increased complexity and higher likelihood of amended returns or errors.It turns out the Arizona Constitution prohibits the delegation of legislative authority, meaning state legislators can’t designate the IRC as the definition for Arizona taxes on a rolling basis, automatically adopting any changes made at the federal level. Instead, the state uses fixed date conformity, which aligns Arizona taxes to the IRC as of a specific date in time and allows lawmakers the ability to assess federal changes each year. That hasn’t always been the case. Prior to 1980 Arizona did not conform to the IRC at all, and instead made its own definitions of what was taxable at the state level. That meant individuals and businesses had to keep federal and state definitions in mind when filing both returns, making the filing process a laborious one. To simplify the process and ease the burden on taxpayers, Arizona began conforming on a fixed date basis to the IRC. In most years income tax conformity is noncontroversial and viewed as a technical exercise, updating the date in Arizona Revised Statute that refers to the IRC. When Congress enacts major changes or overhauls, like with the Tax Cuts and Jobs Act of 2017, there are potential revenue impacts in Arizona. In those instances, the process of conforming can become more complex and delve more into policy considerations, often delaying legislative resolution and thereby causing uncertainty for Arizona taxpayers. ASCPA members and tax experts David Walser, Anne Cornelius, Ed Zollars and Jared Van Arsdale provide insights on income tax conformity and why it matters to Arizonans. The decision, which united the court's conservatives and liberals, makes clear that the Eighth Amendment's prohibition against "excessive fines" applies to states and localities as well as the federal government.    WHAT'S IN THE NEWS In a bad boys update, the Houston Police Department will end its use of controversial no-knock warrants in most situations, Chief Art Acevedo said during a contentious town hall meeting three weeks after a deadly Pecan Park drug raid that left two people dead and five officers injured. In government indoctrination centers news, an eleven-year-old Florida boy was arrested after refusing to recite the Pledge of Allegiance in class. In unreasonable searches news, a bill introduced in the Arizona State Senate would create the largest DNA database in the country. In another bad boys update from Houston, the Houston officer bad apple who lied about the informant that led to two people dead, Houston Police Officer Gerald Goines, had a troubling history of allegations against him. In security theater news, federal employees, including several TSA baggage screeners and security personnel, are facing 10 years to life in prison for conspiracy to possess with the intent to distribute after being indicted for using their posts to smuggle over 100 million dollars of cocaine into the U.S. from Puerto Rico.
