How to Split a Toaster And Other Divorce Law Truths with Seth Nelson

The Divorce Survival Guide Podcast

Play Episode Listen Later Sep 3, 2021 57:51

Joining me this week is Seth Nelson, family lawyer and host of the podcast, How to Split a Toaster. He is going to help us break down divorce law in the United States - because not only can it be overwhelming, it can be confusing, and frustrating. The good news is that there are some universal truths to divorce law that can help you maneuver through the court system and work with your lawyer with ease. After law school, Seth found that he could do the greatest good by helping people through one of the most difficult times of their lives - divorce.  Being a divorcee himself, as well as a father, he understands what you're going through. I am thrilled to welcome him to the show. Show Highlights How to know when you should hire or consult with a lawyer for your divorce. (8:39) All of the items you should consider (and prepare) for your first legal consultation. (10:51) Seth takes us through his PEACE acronym: Parenting plan, Equitable distribution, Alimony analysis, Child support, and Everything else. (11:21) Some state laws require couples to be legally separated for one year before they can divorce. So, what does that actually mean? Seth explains. (20:36) The best way to communicate with your lawyer. (25:02) How to ensure you are receiving copies of all documents that get filed with the court system (and why you should have copies too). (32:38) How to know if you have a really shitty attorney. (34:13) Your primary legal goal: to have great representation, have someone help you through the process as economically feasible, and get a great outcome. (38:20) Learn More About Seth: Seth Nelson is a Tampa-based family lawyer known for devising creative solutions to difficult problems. “I have been through a divorce and have a young child. As difficult as the divorce process can be, especially when there are kids involved, things will get better,” he said when asked about the divorce process.  At Nelson Koster, the motto is “Helping good people through difficult times.” This is Seth's aim in every case, though how he works to achieve it varies greatly with each family's unique situation.  From an early age, he has always wanted to help people. After law school, he found that he could do the greatest good by helping people through one of the most difficult times of their lives.  Being a divorcee himself, as well as a father, he understands what you're going through.  Seth focuses on Florida divorce law, Florida family law, and Florida family law mediation. He earned his Juris Doctorate from the University of Florida's College of Law. After law school, he clerked for the Honorable John C. Godbold, Senior Circuit Judge for the United States Eleventh Circuit Court of Appeals. Returning home to Tampa, he then worked for other Florida law firms before establishing his own practice in South Tampa. Since 2008, he has been the sole shareholder of Nelson Koster.  Seth is a registered mediator with the Florida Supreme Court Family Mediator Association and is currently a Member of the Executive Council for the Stann Givens Family Law Inns of Court. He also served as the Chair of the Family Law Section of the Hillsborough County Bar Association and continues to serve on its Executive Council. He has been given excellent ratings by Superlawyers and Avvo Ratings and has been honored to receive Super Lawyer's2012 Rising Star award and 2014, 2015 2016, 2017, and 2018 Super Lawyer awards.  In How to Split a Toaster: A Divorce Podcast About Saving Your Relationships, Nelson and co-host Pete Wright take on the challenge of divorce with a central objective — saving your most important relationships with your family, your former spouse, and yourself.  Resources & Links:For show notes and links, also visit: https://kateanthony.com/podcast/how-to-split-a-toaster-and-other-divorce-law-truths-with-seth-nelson How to Split a Toaster Podcast Kate's Interview on How to Split a Toaster Seth's Firm on Facebook Seth's Firm on Instagram Seth on Twitter Seth's Firm on LinkedIn Seth on LinkedIn Andrea on The Divorce Survival Guide Should I Stay or Should I Go (Kate's Program)

Sam Goldman interviews writer Paul Mason about his new book: How To Stop Fascism: History, Ideology, Resistance. From the publisher: The far right is on the rise across the world. From Modi's India to Bolsonaro's Brazil and Erdogan's Turkey, fascism is not a horror that we have left in the past; it is a recurring nightmare that is happening again - and we need to find a better way to fight it. In How to Stop Fascism, Paul Mason offers a radical, hopeful blueprint for resisting and defeating the new far right. The book is both a chilling portrait of contemporary fascism, and a compelling history of the fascist phenomenon: its psychological roots, political theories and genocidal logic. Fascism, Mason powerfully argues, is a symptom of capitalist failure, one that has haunted us throughout the twentieth century and into the twenty-first. History shows us the conditions that breed fascism, and how it can be successfully overcome. But it is up to us in the present to challenge it, and time is running out. From the ashes of Covid-19, we have an opportunity to create a fairer, more equal society. To do so, we must ask ourselves: what kind of world do we want to live in? And what are we going to do about it? Follow Paul Mason on Twitter at @paulmasonnews and read more of his writings at paulmasonnews.medium.com. As teachers we spend a lot of time teaching new skills, but students often don't have enough time to rehearse these skills in real contexts. Practice should make up the majority of a lesson. So, what does high impact practice look like? Firstly we use the MINI LESSON to have our students practise WITH us as we continue our demonstration. The active art of student practice begins right here, with the teacher, trying it out for themselves along with their peers, checking on how it's working for them and being aware of what they are doing. This MINI LESSON is what sets the learner up to know what to practise, what it will feel like to be doing it for themselves as they pursue individual learning. The MINI LESSON should allow an entry point to take the next step, because the teacher has explained and demonstrated what they have noticed in conferring or roving sessions during INDEPENDENT PRACTICE time.So during INDEPENDENT PRACTICE, students have the majority of the lesson time to rehearse a specific strategy or skill, whilst teachers have their ears and eyes on how they are managing what has been explained and demonstrated in the MINI LESSON. They give pointed, differentiated feedback to each student and set goals together. In this episode, Sharon and Phil cover this and much more, including:How to implement INDEPENDENT PRACTICE consistently in classroomsThe importance of gathering feedback and how to do itHow to balance out and maximise INDEPENDENT PRACTICE timeHow it applies to Reading, Writing and Word WorkThe way the Share/Reflection time fits inHow to keep the same thread of learning throughout all workshop components of the lessonHow rich texts are central to teaching, as well as being used effectively used for student practiceThe pitfalls to be aware ofMuch more!Enjoy the episode, and let us know thoughts and feedback in our Facebook Group. Subscribe on Apple Podcasts, Spotify, or your favourite podcast player. JOIN SHARON CALLEN'S NEXT WEBINAR!'Reading Like a Writer: Teaching Information Writing' - Yrs 2-6, with Sharon Callen14 August 2021, 10-11.30am Adelaide time (One 1.5 hour workshop)Find our more and register here.Missed it? I know that you were born perfectly perfect. Your life “kit” was equipped with everything you need to live the life you want to live and to harness whatever you need to make things happen. But your kit didn't come with instructions. So, this CEO tool allows you to use what you have without dictating to you who you're supposed to be. It leads to wisdom, and once you have wisdom, you can handle anything! What you'll learn from this episode: We were all designed perfectly, as was the “kit” we were given. What's missing from our kit – the “what's included” sheet, directions for assembling and a picture of what an assembled kit is supposed to look like. Many people get hung up looking at what other people's assembled kits look like, and they think theirs should look the same – but we don't all have the same kit. Mimicking, copying, or duplicating other people doesn't help you develop what's in your kit. The Remarkable allows me to use what I have, and then it follows me instead of it dictating to me who I'm supposed to be. It's a reflection of me. I don't have to fit into it. In How to CEO, we give you all of the tools and the perspective and the support. Then you have knowledge. We then coach you so that you apply that knowledge to who you are and who you're designed to be. Then you have wisdom. And once you have wisdom, when it comes to leadership and management and the team part of your company, you can handle anything. I'd really appreciate it if you would click the like button above and leave a review if your favorite podcast app has that ability. Thank you! Today’s episode is for your highest good, and there's something in here for you.Sarah said:“So we can even just remove the labelling of the fear completely and just look at the frequency itself and say, I need to trust that the earth provides for me. I need to trust that I will survive. I need to just get outside, let the frequency of the earth come up into my body and shift my energy. And that starts to shift away from that heavier frequency of these fears so that sometimes we don't even have to go deeper into them.”“And one of those shifts is the overthinking that we start to do right within this need to have these answers a big reason why we struggled to find them is that we're overthinking and we're overthinking from a very human-based place. If you want to achieve the impossible, connect with the most powerful people in the world, achieve the next level in your business, strengthen your relationships, lead your community, and make an impact… listen in, because we're talking with Steve Sims. https://www.youtube.com/watch?v=oHXpuecDrjM Quoted as “The Real Life Wizard of Oz" by Forbes and Entrepreneur Magazine, Steve Sims is the best-selling Author of BLUEFISHING—The Art of Making Things Happen, a sought-after coach, and a speaker at a variety of networks, groups and associations, as well as the Pentagon and Harvard—twice!  So if you want to transform your life, attract influencers and high net worth clients… tune in below! Table of contentsSteve SimsThe Number One Mindset Tip“You Are the Room You're In”How to GrowEntering with a SolutionSteve Sims' Millionaire PartiesA Note to EntrepreneursLinks MentionedBook A Strategy Call Steve Sims Steve Sims is a master at helping people achieve the impossible with the most powerful people in the world. Or, if you ask him, he'd say he's good at achieving the stupid, or the unexplained. That's because, as Steve shares, once you label something as impossible, you've created a mental barrier for yourself. So if one thing is clear, Steve knows how to transcend the unthinkable, and impact the world.  Steve has had many paths in life, all of which hae led him to where he is now. For the last 25 years, he's been in what is technically the concierge and spa business. In his own words: [2:27] “One of the famous stories everyone knows was I had a client who wanted to have a meal in Italy, and he wanted it to be unforgettable. And so I closed down the Academia, the Galleria in Florence, that houses Michel Angelo's David. Set up a table of six at the feet of David. And halfway through the pasta I had Andrea Bocelli come in and serenade them. And so I'm basically the Make-A-Wish foundation for people with really, really, really big checkbooks.” Now, Steve acts as a mindset coach to help people get the clients that they deserve and want, rather than the clients they get.  The Number One Mindset Tip When asked what his number one mindset tip is, Steve answered to not identify the problem. Which at first may seem completely counterintuitive. That is because in his experience, people spend the bulk of their energy telling you why they can't do something. Either they don't have the money, or the time, or the resources.  The trick is to shift to how you can do something. The answer may be to set aside thirty minutes a day to reach your goal, or write grants to fund your project, or build more cash flow with a side hustle. Maybe, the solutions are far more creative than that, as Steve Sims shares with us in the interview. There's an infinite number of solutions for an infinite amount of ideas—it just takes work and a vision.  As Steve says: [5:02] “Have you ever noticed that when you get into a room full of entrepreneurs, you're at home?” That's because the entrepreneurial mindset is energizing—it's about innovation, creativity, and finding solutions. It's the exact opposite of the—"Here's why I can't”—mindset.  “You Are the Room You're In” You've likely heard the statement before—you're a combination of the five people you spend the most time with. One of Steve Sims' strategies, regardless of his position, has been to surround himself with wealthy people. This could be people of intellectual wealth or monetary wealth. This strategy has allowed him to grow, and to be the person with all the solutions, instantly making him one of the most valuable assets in a room of wealthy people. How to Grow [10:38] “Sometimes the greatest growth comes from the most devastating problems and mistakes and issues." Later in our conversation, Steve shares a personal story of how he was flown to China for work, then fired. What seemed like a dark situation turned out to be a phenomenal opportu...

Brett Kahr has done it again! He has given us a marvelous book, helpful, yet challenging, fun to read, yet digging deep. In How to Flourish as a Psychotherapist (Phoenix Publishing House, 2018) he takes us on a journey through the life cycle of the psychoanalyst – from first thoughts about training and the basic personal requirements for a life in the mental health professions to thriving inside and outside of the consulting room to packing up your practice at the end of your career. In his typical lucid and accessible style, he gives generous examples from his own path to show us how we can make the most of our life in the field. But this trip is not for the faint of heart: Professor Kahr is a demanding tour guide, urging us to dive deep into the work and taking seriously our scholastic history, a paternal voice that tells us about the amazing things we can do with our specialized knowledge – if we apply ourselves and work hard. As any paternal voice ought to in this day and age, the book will surely provoke strong reactions in many readers and listeners. Join us for an in-depth discussion of the book and the profession. This interview was conducted in front of an online live audience as part of a new series of events hosted by the Free Association, a group of psychoanalysts based in the beautiful city of Lisbon, Portugal, creating innovative opportunities of continuous learning in the field of psychodynamic psychotherapy and psychoanalysis. This conversation is part of a new format titled „Forward“, in which I interview exciting psychoanalytic scholars about their work. I'm not sharing as many of my own solo cleaning business updates as my own personal goals are beginning to shift. I am following my own ISO Model System. I am almost through the Stabilizer Phase of the plan, which focuses on growth and earning enough profit and experience to remove ALL financial stress from your family. In 2021, I'll be optimizing my company to $6,000 per month profit on 2 cleaning days per week without employees. Here are a few updates from the past week. One of my new 2020 clients hired me to replace an amateur cleaner during the pandemic for peace of mind and optics with their staff and clients. They hired me at $800 per month with the intention of dropping to my 3rd proposal price option of $650 per month. Well, they just dropped it for January as they still don't have their full staff back in the office. Plus, I spent the second half of 2020 deep cleaning, disinfecting, and maintaining this office. They are very happy and I am glad to drop the price to serve the company and owner! It builds trust and I'm more concerned with the long-term. In "How to Do a COVID Clean", I shared my strategy for cleaning a house or office after a positive test. Well, that was put to the test recently. One of my clients (a vet hospital) had a positive test of a vet tech. I changed my cleaning for that week and focused on deep cleaning & disinfecting the high-touch points around the hospital. They were very thankful that I offer this service. I only charged them $100 extra as well. Before I get to the meat of this episode, here are a few more updates. I met with my good friend and client, Dennis Gehman for breakfast this week. Dennis is the founder and owner of Gehman Design Remodeling in Harleysville, PA. Dennis is a Master Builder (like a real one, not the Lego Movie) and his company is a home design & remodeling leader in Montgomery & Bucks Counties of Pennsylvania. It's always great to connect with Dennis. He is like a dad to me and always has wise counsel on being a better dad, leader, and business owner. I so appreciate our time together. I also checked in with Matt & Laura this week. They were the perfect new house cleaning client from "An Optimizer's Website". However, I found out sad news from Matt this week and pray that things will get better with their family. In the meantime, they cannot add cleaning to their to-do list. I added Matt to my newsletter so he could stay informed on cleaning tips I send out twice per month.Read the rest of this article at the Solo Cleaning School website

Whenever we worry about what to eat, how to love, or simply how to be happy, we are worrying about how to lead a good life. No goal is more elusive. Stoicism is a pragmatic philosophy that focuses our attention on what is possible and gives us perspective on what is unimportant. By understanding Stoicism, we can learn to answer crucial questions: Should we get married or divorced? How should we handle our money in a world nearly destroyed by a financial crisis? How can we survive great personal tragedy? Whoever we are, Stoicism has something for us–and How to Be a Stoic is the essential guide.Prof. Pigliucci has a PhD in Evolutionary Biology from the University of Connecticut and a PhD in Philosophy from the University of Tennessee. As social beings, we all compare ourselves to others. However, how can we stop comparing ourselves to others in a way that is destructive. It all comes down to knowing your intrinsic self-worth and building positive self-esteem. In today's episode, I come to this topic as a seeker or explorer myself. I decided to tackle this topic because I've had several requests from readers of my blog and others. It's a common issue that can hold people back from being their best selves and living the life of their dreams. So, I'm diving in. In How to Stop Comparing Yourself to Others: Know Your Self-Worth, I draw upon some prior research and I share some key themes from the book, 10 Simple Solutions for Building Self-Esteem: How to End Self-Doubt, Gain Confidence, and Create a Positive Self-Image (Glenn R. Schiraldi, 2007). There are so many gold nuggets in this book. The point that resonated most with me is the importance of Unconditional Worth - a building block to healthy self-esteem. Knowing that you have an intrinsic worth that is equal, immeasurable, and unchanging is a game-changer when comparing yourself to another. Listen in as I share why you compare yourself to others, the good that comes from it, and how you can make reasonable comparisons without going down a downward spiral and damaging your sense of self.
