The Federal Trade Commission (FTC) sued PepsiCo in January, alleging that it has engaged in illegal price discrimination by giving unfair price advantages to one large retailer at the expense of other vendors and consumers. The benefiting customer wasn't named in an FTC statement about the lawsuit. But a source familiar with the case, who asked not to be named because they were not authorized to discuss it, said the retailer was Walmart. The FTC said PepsiCo's practices included making promotional payments to Walmart but not to large grocery chains or independent convenience stores. The FTC said that lets Walmart lower its prices, but forces Americans to pay inflated prices for PepsiCo products unless they shop at Walmart. “When firms like Pepsi give massive retailers a leg up, it tilts the playing field against small firms and ultimately inflates prices for American consumers,” FTC Chair Lina Khan said in the statement. “The FTC's action will help ensure all grocers and other businesses—no matter the size—can get a fair shake and compete on the merits of their skill, efficiency, and talent.” Walmart said it had “nothing to add at this time.” PepsiCo said its practices “are in line with industry norms.” “We do not favor certain customers by offering discounts or promotional support to some customers and not others,” the company said. The FTC sued PepsiCo under the rarely enforced 1936 Robinson-Patman Act. The FTC said the act prohibits companies from using promotional incentive payments to favor large customers over smaller ones. PepsiCo, based in Purchase, New York, is one of the world's largest food companies. It makes Pepsi, Mountain Dew, and Gatorade as well as snack foods like Lay's potato chips, Doritos and Fritos. It also makes Quaker Oats, breakfast cereals, and granola bars. PepsiCo's prices have been the subject of some scrutiny since the pandemic. In 2022, for example, the company acknowledged shrinking its Gatorade bottles from 32 ounces to 28 ounces, but it didn't respond when asked why it charged more for the 28-ounce bottles. I haven't watched the latest one, the Timothée Chalamet or whatever. Stephen Semple: I watched it on a flight recently because it was one of those ones where I didn't want to run the risk of spending the money and going to the theater for it. Dave Young: Sure. Yeah. Stephen Semple: So I was on a flight and it was one of the movies, and I thought, "Oh, I'll watch this." And it was actually a good rendition. It's the prequel, is how it's set. Dave Young: Oh, it's the origin story. Stephen Semple: It's the origin story, and it's good. Dave Young: Oh, cool. Stephen Semple: It's good. I enjoyed it. Dave Young: I'm going to have to watch it. Stephen Semple: I thought they did a nice job of it. Yeah. Dave Young: Well, we're actually recording these on a Saturday morning. Maybe I'll talk to Julie and see if we can watch Wonka this afternoon. Stephen Semple: I think you'd enjoy it. Dave Young: It might be kind of fun. Stephen Semple: I think you'd enjoy it. Dave Young: So what'd you find out? I'm dying to know. Was there really a golden ticket? Stephen Semple: Well, you're just going to have to wait and see. Dave Young: Did he really dress that way? Stephen Semple: It's the late 1960s, and the candy business is in a bit of a slump. There hasn't been really much innovation. It's completely controlled by Mars and Hershey at this point. Dave Young: Probably the American Dental Association had just formed. Stephen Semple: And what we've got is we've got this food executive, Kenneth Mason, who's looking to shake things up at Quaker Oats. He's an executive at Quaker Oats. And Quaker Oats is famous for oatmeal and Cap'n Crunch cereal. Dave Young: And the old Quaker dude in the hat staring at you from the box. Sure. Stephen Semple: Yeah, that's it. And Kenneth Mason sees a bigger opportunity. Now, he graduated with a degree in English from Yale before going into the food business, and he has aspirations to become president of Quaker. And he's about to head into candy. So he goes, "You know what? I really want to make a big splash in this division." Because in the 1960s, candy is boring, there's no new innovation, there's no advertising going on. Mason believes, "This is my opportunity to create the next new thing, make my mark, and become president of the company." But he needs a launching pad to create that splash. And he's read the book, Charlie and the Chocolate Factory, and it inspires him what to do. And this idea went on to become a $2.8 billion business. Wonka is a big deal. But it starts with this book that's about to become a film,
The former chairman of Columbia's Landmark Bank says Columbia's economy is much more diversified in late 2024 than it was when he moved to town in 1987. Former Landmark Bank chairman Jeff MacLellan says Columbia's three economic pillars used to be education, healthcare and insurance. He joined host Fred Parry in-studio for the hour on 939 the Eagle's "CEO Roundtable" program, telling listeners that it's now education, healthcare and finance/insurance, which includes banks. Columbia continues to see new banks every year, and Mr. MacLellan tells listeners that they want to get a piece of the good local economy. He credits growing companies like Veterans United, EquipmentShare, 3M, Kraft Heinz, Quaker Oats and Midway USA, which has a massive new distribution center. 2024 statistics from Columbia Regional Economic Development Incorporated (REDI) show that Veterans United is the largest private employer in Columbia/Boone County, with more than 2,900 employees. EquipmentShare now has 588 employees, according to the REDI numbers. Mr. MacLellan tells listeners that Columbia's job growth is modest but steady, about 1.3 percent a year with about 1,300 new jobs. Mr. Parry and Mr. MacLellan also discussed enrollment trends at Mizzou, Stephens College and Columbia College, and Mr. MacLellan talks candidly about where Columbia is most vulnerable in terms of our economy:
