It's Hump Day! Sam speaks with Lisa Heinzerling, law professor at Georgetown University, to discuss the impact of the Supreme Court's upcoming rulings on Loper Bright Enterprises v. Raimondo & Relentless v. Department of Commerce, as well as the court hearing arguments yesterday regarding mifepristone and medication abortion. Then, Sam speaks with Heather Herbert, a hospice registered nurse at PeaceHealth Medical Center in Springfield, Oregon and member of the Oregon Nurses Association (ONA), to discuss the recent strike action at the hospital and the new labor complaints they've filed with the National Labor Relations Board (NLRB). First, Sam runs through updates on the US public's disapproval of Israel's genocide, the US State Department, Texas' fascist border power grab, labor action across the US, legal woes for Trump and Co., and Ronna McDaniel's brief NBC tenure, before diving into details of the collision that collapsed Francis Scott Key in Baltimore, and the profiteering that drives disasters like this one. Professor Lisa Heinzerling then joins, diving right into the context of the Alliance for Hippocratic Medicine's suit against the FDA, including their objections to the FDA's relaxation of requirements for Mifepristone, the most common abortion medication in the US, and the overwhelming scientific evidence for the efficacy and safety of the drug. Expanding on this, Professor Heinzerling looks at this case within the broader context of the Supreme Court's attack on the administrative state, fitting neatly into a pattern of cases with very vague and obscure claims of injury resulting in massive shakeups to the legal and political structure in the US, something also reflected in Loper Bright Enterprises v. Raimondo, before walking through the greater idea of the Chevron Doctrine and administrative deference. After assessing where this current iteration of the Roberts Court stands among the most extreme activist courts, Lisa and Sam wrap up the interview with a brief conversation on the reaction of legal institutions and law schools to the myriad ongoing Supreme Court scandals. Nurse Heather Herbert and Sam then dive into the context of ONA's ongoing labor action, with contract negotiations stalling for over a year as PeaceHealth attempted to force lower pay on some 125 hospice and home care workers, despite the same qualifications as hospital nurses with additionally extensive and expensive training required. After expanding on the serious hit this process took on these Nurses, Herbert dives into the hospice Nurses' difficult decision to strike, tackling the clear unfair labor practices exercised by PeaceHealth in response, and wrapping up with a conversation on the strike's support from and impact on patients and community members. And in the Fun half: Sam admires the growing protests against US complicity in the genocide of Gaza, including actions against Reps Jeffries and McGovern and President Biden, and watches the right-wing attempt to spin the Francis Scott Key Bridge disaster into a diversity issue instead of a capitalism one. Casey in DC uncovers some odd coincidences in Rep. Bill Johnson's (R-OH) post-congress career path, Bobby from Georgia explores the perception of inflation under Biden alongside rising housing costs, and Fox News hosts react to the Ronna McDaniel saga. Dylan from Ft. Collins on the slow journey out of right-wing conspiracy, Pep from Texas on Blinken's Zionism, and Stephen Crowder's workplace and domestic abuses come to the fore, plus, your calls and IMs! Joe Biden on the Vaccines and more on today's CrossPolitic Daily News Brief This is Toby Sumpter. Today is Tuesday, August 31, 2021. Oregon Law Prohibits Vaccine Mandates https://www.kgw.com/article/news/health/coronavirus/oregon-hospitals-cannot-mandate-vaccines-employees/283-1c73f5fc-ffcf-4f10-af20-7aabeb74d3c5 Hospitals in Oregon cannot require doctors, nurses or any of their employees to be vaccinated for anything from the flu to COVID-19. It's been this way since 1989, when a law was passed stating "an employee shall not be required as a condition of work to be immunized under this section." The Oregon Association of Hospitals and Health Systems (OAHHS) said it's long overdue for a rule change. "We believe that it's important for hospitals to have that tool during a pandemic. Not that they all would, but just to have that option to require staff, to be vaccinated during a pandemic, we just think it's really important to have that local option," said OAHHS spokesman Dave Northfield. "We believe that the state could write a rule that gives individual hospitals local control to institute a mandate that falls short of a statewide mandate," said Northfield. OHA said the change that would allow hospitals to decide would have to come from the legislature. OHA Communication Director Robb Cowie said the only rule they could pass would be a statewide mandate. One group against a law change is the Oregon Nurses Association (ONA). ONA Communication Director Scott Palmer released a statement that said in part: "We are not currently seeking a change in Oregon's statutes regarding workplace immunizations. We believe there is much more work corporations can do to protect workers and increase vaccination rates before they begin firing working Oregonians during a pandemic." KGW Investigates could not find any other state with a law that prohibits hospitals from requiring vaccines for their employees. https://www.kgw.com/article/news/local/hospitals-vaccine-requirements-oregon-law/283-a734746a-49d4-4c15-9e3f-904d4556f81e — Kaiser Permanente, PeaceHealth and Oregon Health & Science University (OHSU) will require employees to be vaccinated against COVID-19, despite a 1989 Oregon law that prohibits hospitals from doing so as a condition of employment. "I think that law is certainly a barrier. I think we're looking at this as a public health emergency. We're hoping to have some support from our government officials...we are calling this a requirement, there are ways for there to be a medical exemption," said Dr. Koekkoek. The deadline for employees to get vaccinated varies by organization. PeaceHealth is requiring all caregivers to be fully vaccinated by Aug. 31. OHSU is targeting Sept. 1 for its staff and students and Kaiser Permanente hopes to have its workforce fully vaccinated by Sept. 30. It's unclear what action, if any, hospitals will take against employees who are not vaccinated or exempt by the proposed deadlines. High School in Washington State Using Ankle Monitors https://www.iheart.com/content/2021-08-25-high-school-uses-ankle-monitors-to-track-social-distancing-of-athletes/ A high school in Washington state is facing criticism after equipping student-athletes with ankle monitors to track social distancing during practices. The students only have to wear them during practice and leave them in the locker room when they go home. [They are only prisoners when they are playing the game.] The monitors are being used as part of the district's contact tracing program. They record how close students get to each other and for how long. In the event of a positive COVID-19 test among students, health officials can quickly identify who had close contact with the infected individual. Officials with the Eatonville School District have defended using the "proximity monitors" against backlash from parents and other people online. "The monitors are for both staff (coaches) and students on the field, regardless if they are vaccinated or unvaccinated. If a student or coach tests positive, we will have immediate information regarding athletes' and coaches' contacts, so we can more tightly determine who might need to quarantine," the district said in a statement. [This is called Totalitarian grooming, people. Getting you used to be monitored at all times.] One parent said he was reluctant about letting the school put an ankle monitor on his son but didn't want to keep him from playing football. [Reluctant?!!] "I was notified if I didn't sign it, they couldn't play," Jason Ostendorf told the Tacoma News Tribune. "My son has played football since he was in third grade. He's passionate about the sport. ... I signed it reluctantly. It's either that or he doesn't play. ... It's not optional. If you don't sign the waiver, they don't get to play. You have no choice in the matter." "It's just one more thing they're doing to the kids through this whole covid thing," he added. "The vaccine, now be tracked when you're at practice. Where does this end? I feel like this is an experiment on our kids to see how much we can put them through before they start breaking." Another parent said he had no problem with the school using the ankle monitors. "It's a continuation of doing what we have to do to let the boys play a sport that they love," Jason Lewis told KCPQ. "If my son would have told me, "Dad, I don't want to wear it. I'm not going to wear it,' He wouldn't be playing football. That's his choice. I mean, but he wanted to play football. He would have worn three of them if you asked him to." And… there are your gods, America. Doing what we have to do to let the boys play a sport they love…. Ah, but what is a boy anyway? What is sport? And what is love? The marketing department of a typical for-profit organization has a huge role to play in the success of the company. Its job is to spread the word the products or services that the company brings to the world. Philanthropic marketing, on the other hand, is a whole different ball game. It is about telling stories of impact that donors have had and putting those stories in a way that compels other donors. Fundraising is all about relationships. You can't build a truly authentic and sincere relationship with donors through mass communication. In this episode, Penny Cowden talks about how to engage in compelling conversations, how to market philanthropy, and writing case statements. Here's a glimpse of what you'll learn: [01:25] How to communicate effectively [04:10] Positioning donors as heroes of stories [05:35] How to find compelling stories [07:40] Formal writing doesn't work in philanthropy [09:15] Creating opportunities for donors to participate Resources Mentioned in this episode Philanthropy212 Connect with Penny Penny on Facebook Penny on LinkedIn About Me Sponsor for this episode This episode is brought to you by Philanthropy212, a fundraising consulting company focusing on helping not-for-profit organizations to build sustainable practices and programs that raise more money. The culture of an organization is very important in philanthropy. It is also important that the entire organization gets involved in building that culture and not get too bogged down in the business of philanthropy. Culture eats strategy every time, meaning that if you don't pay attention to your culture, your strategies are not going to be as effective or even effective at all. In this episode, Penny Cowden talks about building a culture of Philanthropy, how to get the entire foundation involved, and examples of organizations that encourage giving back to society. As a Chief Development Officer in a fundraising organization, it is not ideal to be an obstacle to the Chief Executive Officer. There's nothing more important than a good CEO-CDO relationship to deliver service. It's not just about raising money; it's about the partnerships you have in leadership. Ed Flynn is the Principal of Flynn Consulting. He has over 30 years of experience in the not-for-profit sector and his background includes 501(c) (3) formations, governance, board recruitment, and strategic planning. Ed has raised in excess of $280 million over the course of his philanthropy career. He has consulted with numerous organizations throughout the country and represents both sides of the Chief Executive Officer (CEO) and Chief Development Officer (CDO) relationships. Staying true to your donors is the commitment you make when you agree to be a fundraiser. But the organization's leadership and metrics don't always operate harmoniously with those ideals. Donors don't have the same priorities or needs as those who operate behind the scenes of the philanthropic organization. So how do you get the most out of donor relationships?
