Lee Bratcher is the President of the Texas Blockchain Council. In this interview, we discuss Bitcoin mining in Texas, the North American Blockchain Summit 2023 and the regulatory challenges miners face. We also talk about the potential impact of politicians embracing Bitcoin, the importance of mainstream media presence at the upcoming conference, and efforts to attract professionals to Bitcoin events. - - - - This podcast was made before the start of the Texas Bitcoin Summit in Fort Worth, which started yesterday and runs through until Friday. The summit is expected to be the biggest one yet, with over a thousand attendees and a focus on mining. And this year the Texas Blockchain Council has excelled at attracting some major political figures, including RFK, Vivek Ramaswamy, Ted Cruz, Cynthia Lummis, Andrew Yang and Warren Davidson. Texas seems to understand Bitcoin better than other states, which is attributable in part to the independent thinking and educational efforts in the state. The Texas Bitcoin mining industry is a catalyst for Bitcoin mining across the world, leading the way in developing use cases such as demand response grid balancing services and the incentivisation for the build-out of renewable energy. However, the path to wider acceptance of mining in Texas has not been foregone, and the future is still uncertain. The challenges the industry has faced have been significant. For example, Senate Bill 1751 in Texas sought to ban miners from the very same ancillary services that have benefitted ERCOT's grid balancing objectives. These efforts have been pushed by traditional legacy industries in Texas aided by their strategy of regulatory capture. Traditional industries such as steel mills and petrochemical refineries have been frustrated by Bitcoin miners bidding down the price for demand response services (which in turn has benefits consumers). The bill passed unanimously in the Senate. The fact the bill was ultimately killed in the House was thanks in large part to the efforts of the Texas Blockchain Council under Lee Bratcher's presidency. The issue highlights the problem of getting a political consensus on Bitcoin. Elizabeth Warren, for one, makes it difficult for Democrats to openly support Bitcoin. However, a few Democrats are showing a more practical and nuanced understanding. And, being anti-Bitcoin will become a risky position to take in the future due to generational-led shifts in opinions. A state whose motto is friendship has extended its hand to those seeking to mine and develop Bitcoin. Why is this? Texans are independent, hard-working, freedom-loving people. As our guest Lee Bratcher states on the show: “The ethos of Texas just matches up with the ethos of Bitcoin.” But, there is a more pragmatic reason why this has happened: Texas's economic history shows a state that embraces opportunity. And with Bitcoin mining, we are seeing perhaps one of the biggest opportunities to present itself to energy grids. Governments across the world are seeking to transition to more renewable and volatile energy sources. And, as we have seen, Bitcoin mining provides a range of tools to help grids in this transition. Texas's grid operator, ERCOT, has embraced Bitcoin mining, and as such, it is reaping the benefits. Bitcoin mining is making the Texas grid more resilient to peak demands, it is facilitating the build-out of stranded energy sources, and could potentially help keep energy prices low. A welcoming regulatory landscape and collaborative approach to planning are resulting in Texas working towards being the home for 20-25% of the global hashrate. But, Texas has not woken up to the utility of Bitcoin mining on its own. The fact the state has a dedicated Bitcoin advocacy group is a critical factor in this story. The Texas Blockchain Council was set up to make Texas the jurisdiction of choice for Bitcoin. To that end, it educates lawmakers, acts as a conduit between the state and Bitcoin companies, and actively defends Bitcoin against attacks from senators in DC. It's another inspiring and motivating Bitcoin story.

Steve Kinard, Director of Mining at the Texas Blockchain Council, joined Weaver's Tim Savage for a look into the bitcoin mining process. Many people may be familiar with term bitcoin mining, but not everyone understands what that process entails.“A simple explanation is that mining involves a piece of data that is difficult to find and relatively easy to verify,” Steve says. “Bitcoin is a protocol that allows peer-to-peer transactions between you and me or anybody else who is free to come into the network. The function of mining is to validate those transactions. Bitcoin transactions build up into what is called the mempool and eventually miners they form them into a block.”Operating on the Secure Hash Algorithm 256 (SHA-256) cryptographic algorithm, miners race to form new blocks on the bitcoin network by searching for a piece of encrypted data that allows a miner to mint a new block on the chain when found. The new block confirms the transactions in the mempool and the miner is rewarded with transaction fees and a block mining reward. Currently, the mining reward, excluding transaction fees, is 6.25 btc until mid-2024 when it is projected to halve, which occurs every four years and is known as the halving cycle. New blocks are minted on the bitcoin network approximately every ten minutes, averaging 144 blocks per day. Based on the number of miners participating in the network, the algorithm establishes a difficulty target to ensure the ten minute process, and miners simply run computers that perform this mathematical function.At an industrial level, the bitcoin mining process utilizes higher amounts of energy. However, Tim and Steve discuss some common misconceptions about energy consumption from mining. Tim points out, “energy conversion is not a bad thing. Use of energy is essential to the network's security and adds a real cost for someone who might want to attack the network. An attacker would need to win 51% of the computing power, meaning they would need to obtain local licenses and approvals to operate in places where power availability exists, buy a significant of mining equipment, and build the infrastructure to run it. This would cost tens of billions of dollars, and at that point the attacker would be much more monetarily incentivized to act according to the rules than to manipulate transaction data. Otherwise, people would leave the network and bitcoin could go to zero. This is the game theory that underpins the bitcoin network, and energy is a fundamental piece of the equation.” While this kind of attack is theoretically possible, Tim and Steve agree the bitcoin network has propagated to a point of decentralization where this is becoming exceedingly unlikely.In actuality, bitcoin mining helps stabilize the grid when constructed properly. Before bitcoin was invented, the world was not able to instantaneously increase or decrease load demand in such a way that bitcoin mining offers. Steve comments, “consistent power consumption provides flexibility to the grid when requests for more power come from other areas. The miners can instantly shut down power to allow the grid to divert it elsewhere as needed. The more of that we can have, the stronger our grid will be, and the better it will be able to serve all users and all citizens.”Tim and Steve also discuss how miners are seeking new energy sources in an effort to reduce energy costs. Miners are increasing demand for renewable sources such as solar, wind, and hydro, and some studies show that as much as 50% of bitcoin mining is powered from these sources. Additionally, miners are utilizing stranded sources of energy such as natural gas that would otherwise be wasted. Increasingly, miners and exploration companies are working together to reduce carbon emissions and monetize these stranded sources of energy.

Vantage Bank to offer staff Bitcoin savings plan in an effort to retain talent

Texas-based Vantage Bank announced plans to offer employees a savings plan where a portion of each paycheck can be saved in Bitcoin. Commenting on this new program, Vantage Bank's chief of human resources Eric Thompson said: “During this ‘Great Resignation,' attracting and retaining top talent has been especially challenging. Focusing on our employees and the benefits we offer help make Vantage Bank Texas an employer of choice for current and potential employees.” Any Vantage employee who wants to step away from traditional savings will be able to participate in the new Bitcoin savings plan. The New York Digital Investment Group (NYDIG), which is offering asset management, custody, and execution services for digital assets, will hold the converted Bitcoin. In addition to the new savings plan, Vantage Bank is also educating its employees about cryptocurrency. Referring to the necessity of training, Thompson said: “As part of that [the savings plan], we are also providing associates with education about Bitcoin, sharing the risks and considerations that should be evaluated before directing their post-tax dollars to a Bitcoin Savings Plan.” Despite the modern approach to diversifying its employee's savings plans, Vantage Banks does not facilitate buying, selling, or trading of crypto for its customers for now. Crypto adoption in Texas According to Thompson, the Bitcoin Savings Plan was a suggestion from one of the lender partners that had already started to apply it. In addition, the state has also been taking bold steps to increase crypto adoption. For example, in May 2022, the Governor of Texas, Gregg Abbott, signed a law that made it easier for businesses to use crypto as collateral for loans. Abbott also created the Work Group on Blockchain Matters, where industry leaders collaborate to lure crypto investors, developers, and miners to Texas. Recently, the Texas Blockchain Council wrote a draft bill to eliminate taxes on flared gas sales used to mine Bitcoins.

Lee Bratcher is the Executive Director for the Institute of Global Engagement at Dallas Baptist University as well as a faculty member teaching international relations and blockchain courses. Lee received a blockchain instructors certification from IBM and researches blockchain solutions in land administration. He is a Captain in the US Army reserves working as an instructor for ROTC cadets at DBU and UT Dallas. Lee was awarded a master's in International Relations from St. Mary's University and is in his fifth year as a Ph.D. candidate at UT Dallas writing a dissertation on blockchain for land administration. Prior to his transition to academia, Lee served in the military and as a police officer in the DFW area. He conducts the business operations of the Texas Blockchain Council and maintains strong relationships with members of the Texas Legislature and their staff. As the organization's president, Lee serves as an ex-officio member of all policy and legislative committees within the Texas Blockchain Council.

Over the past year, many of us have said "I guess all law firms are virtual law firms now." While that may technically be true, there are many firms whose business model is based on being a virtual firm. Dan Packel from The American Lawyer gives us a primer on Distributed Law Firms like Fisher Broyles, Ramon, Taylor English and Duma, and Culhane Meadows and how they operate without a physical environment. While many of these firms may fly below the radar for many biglaw firms, distributed firms like Fisher Broyles may be poised to break into the AmLaw 200. And if that happens, and it might happen this year, many big firms will start to take notice. The explosion in use of IoT devices in commercial markets, assisted in no small part by the advent of 5G, is finding its way into the defense sector with the rapidly increasing use of sensors to create situational awareness for US forces. However, an enduring problem for all electronic communications is this: how do I authenticate the identity of the person or device with which I am communicating? As my guest, Michael Lewellen, explains in this episode, when electronic communications via the Internet was developed, almost no thought was given to the serious problem of user and device authentication. Several authentication techniques have developed over time but most of them have serious limitations. This matters to everyone, but particularly for the military, because if an adversary is able spoof a sensor field or masquerade as a command authority, it can wreak havoc without needing to fire a single round of munitions. In this episode we discuss both this problem and a solution known as self sovereign identity.
