This Day in Legal History: Fundamental Laws of 1906On December 30, 1905, Tsar Nicholas II signed the “Fundamental Laws of 1906,” marking a pivotal moment in the Russian Empire's struggle between autocracy and constitutionalism. This act came in response to the Revolution of 1905, a period of mass unrest fueled by political repression, economic hardship, and a humiliating defeat in the Russo-Japanese War. The October Manifesto, issued two months earlier, had promised the establishment of a legislative Duma and the expansion of civil liberties. However, the Fundamental Laws, signed in December, revealed the Tsar's intention to retain ultimate authority despite these concessions.The document laid out a framework for governance, establishing a bicameral legislature with the Duma as its lower house, but Article 4 made clear that “the All-Russian Emperor possesses the supreme autocratic power.” This meant that, legally, any legislative progress remained subordinate to the Tsar's will. The laws also granted the Tsar control over the military, foreign policy, and the ability to dissolve the Duma at his discretion.While the Fundamental Laws introduced formal legal structures and acknowledged the existence of limited civil rights, they were largely symbolic gestures rather than meaningful reforms. Instead of curbing autocratic rule, the laws codified it, cloaking absolute monarchy in the appearance of legality. The agreement followed a federal court ruling in Boston that found the NIH acted unlawfully when it canceled grants based on their perceived ties to diversity, equity, and inclusion (DEI) initiatives. Though the Supreme Court later paused part of that ruling and shifted some aspects of the litigation to a court specializing in monetary claims, the review process for future NIH funding remained in legal limbo.Under the new agreement, the NIH will re-evaluate previously frozen or withdrawn grant applications, though it is not required to fund any specific proposals. The agency has helped return more than $21 billion to consumers since its founding. And yet, under President Trump's second term, it's being systematically dismantled—through funding cuts, legal challenges, and staffing reductions—with the administration openly declaring its intent to shut the agency down.In the absence of the CFPB, those wronged by financial institutions—like Bianca Jones, who battled a credit reporting error that nearly cost her a home, or Morgan Smith, who turned to the agency after being targeted by identity theft—may find themselves with nowhere to turn. The administration claims the CFPB promotes a political agenda, but the result is fewer protections for those already vulnerable. Rules around medical debt, overdraft fees, credit card terms, and mortgage lending have been gutted. Investigations have been shelved. Enforcement is evaporating.Critics argue that other regulators can fill the gap, but the CFPB was created because no one else was doing the job. The 9th Circuit Court of Appeals found that Amazon's case stemmed from a labor dispute and was therefore barred by the Norris-LaGuardia Act, which prohibits courts from intervening in active labor disputes. Amazon had filed the lawsuit to halt an NLRB case claiming it was a joint employer of unionized drivers working for a subcontractor and therefore obligated to bargain with their union.Amazon's broader claim—that the NLRB's structure is unconstitutional because its board members and judges are protected from at-will removal—has gained traction elsewhere. The 5th Circuit, in a recent case involving Elon Musk's SpaceX, ruled that such protections are unlawful and allowed a similar challenge to proceed. But the 9th Circuit firmly disagreed, emphasizing that courts should not interfere with labor board proceedings, regardless of the constitutional claims involved.This ruling aligns with a 3rd Circuit decision and stands in direct conflict with the 5th Circuit, setting the stage for a high-stakes resolution by the Supreme Court. Importantly, the 9th Circuit's ruling doesn't completely shut the door on such challenges—employers can still raise constitutional objections in NLRB proceedings and appeal after the fact. But for now, Amazon and other companies must make their case through the channels Congress established for resolving labor disputes.US court says it can't hear Amazon's NLRB challenge, deepening circuit split | ReutersA Utah judge has granted the release of most of the transcript and audio from a closed hearing in the high-profile case involving the fatal shooting of conservative activist Charlie Kirk. The hearing, held in October, addressed courtroom safety measures for the accused, Tyler Robinson, who is charged with aggravated murder and other serious offenses. Prosecutors allege Robinson fired a single fatal shot from a rooftop during a university event where Kirk was speaking, and they intend to seek the death penalty.Judge Tony Graf ruled that only about one page of the 80-page transcript would remain redacted, primarily for safety and security reasons. He also clarified that media organizations do not need special legal status to cover the proceedings, rejecting a request that would have guaranteed them advance notice of any future attempts to close hearings.Graf has already decided that Robinson can appear in civilian clothing but must remain physically restrained in court. April's look at the step-up in basis revealed how death, not borrowing, remains the biggest capital gains loophole—and one Congress left untouched in the 2025 tax law. A May column on IRS immigration enforcement gains new resonance as the crackdown deepens, pushing some immigrant workers further from voluntary compliance. And October's piece on Pung v. The October Manifesto promised several liberalizing measures: the creation of a legislative Duma (parliament), expansion of civil liberties including freedom of speech, assembly, and conscience, and a commitment that no law would be enacted without the Duma's consent.Though revolutionary factions remained skeptical, the manifesto temporarily quelled widespread unrest and led to the formation of Russia's first constitutional structure. It marked the first time autocratic power in Russia was publicly limited by law, at least in theory. However, the tsarist regime maintained significant control: Nicholas retained the right to dissolve the Duma at will and manipulate election laws. The U.S. has responded with familiar threats of tariffs and trade retaliation, repeating a now well-worn pattern of diplomatic pushback without addressing the underlying issue. That issue is structural: the global tax framework was built around physical presence, but today's digital economy allows companies to generate profits in countries where they have no offices, employees, or infrastructure.As frustration builds in countries watching tech firms reap profits without corresponding local tax contributions, DSTs have become a tool to reclaim taxing rights. In response, nearly 140 countries have worked through the OECD to build a two-pillar international solution. Pillar One aims to reallocate taxing rights based on where users are located; Pillar Two introduces a global minimum tax. Yet, while other countries move forward, the U.S. continues to resist fully embracing Pillar One—out of concern for political optics and revenue loss.That resistance is counterproductive. By refusing to commit to a multilateral framework, the U.S. is guaranteeing the very outcome it opposes: a fragmented global tax landscape where each country sets its own rules. The current whac-a-mole strategy—reacting to every unilateral move with threats—offers no long-term protection for U.S. companies and only heightens global instability. Currently facing hefty tariffs from the US, he claims to be close to securing a tariff-free deal for Botswana's diamonds at least. But President Boko also has a vision of a reinvigorated Africa, a continent that works together to become a formidable economic force, where its own people reap the benefits of its rich resources. Africa, he says, is rising. Duma Boko, a human rights lawyer who was educated at Harvard, helped to create the party he leads, the Umbrella for Democratic Change. His victory in the 2024 presidential election, at his third attempt, finally ousted the Botswana Democratic Party from power after almost 60 years. Scientists are still searching for effective treatments for neurodegenerative disorders like Alzheimer's, ALS, and chronic traumatic encephalopathy (CTE). In his pioneering research, neurosurgeon Dr. Christopher Duma is testing whether stem cell therapy can effectively treat these diseases. Duma is medical director of Hoag Memorial Presbyterian Hospital's Brain Tumor Program in Newport Beach, California and president and founder of Regeneration Biomedical, which develops stem cell therapies for neurological disorders. He recently completed Phase 1 of its clinical trial, a first-in-human approach that delivers a patient's own fat-derived stem cells directly into the brain's ventricles to target neurodegenerative diseases.In this interview with Being Patient's Mark Niu, Duma discusses how the trial is progressing. He explains the approach, shares Phase 1 safety results with encouraging early signals in biomarkers and cognition, and outlines a Phase 2 trial that will test effectiveness in a larger group of participants with mild to moderate Alzheimer's disease. Ko dobimo v roke knjigo z naslovom Država, bi morda najprej pomislili na Platonovo filozofsko delo, ki v dialoško-filozofski globini raziskuje možnosti idealne države. A takšen je tudi naslov najnovejše pesniške zbirke gledališčnika, pesnika in ustvarjalca Jana Krmelja, ki pa se v temelju ukvarja z negativnimi vidiki represivnih oblik oblasti, pri čemer dobijo pesniki oziroma ustvarjalci pozitivnejšo vlogo, sploh v potencialih upora proti otopelosti, nadvladi materialistične potrošnje in »iztrošnje«, v boju proti terorju nadzornega kapitalizma in poplavi informacij. Njegovo delo se morda neposredno ne nanaša zgolj na »organizirano politično skupnost, ki ima na prostorsko omejenem ozemlju suvereno oblast«, v našem konkretnem primeru na Slovenijo, zagotovo pa usmerja svoje puščice tudi v to specifično strukturo. Na splošno gledano so v zbirki Država vzete pod drobnogled in kritizirane vse konstrukcije tako ali drugače organiziranih rigidnih in zatiralskih formacij na globalni ali lokalni ravni, v mikro ali makro perspektivi. Formalno je zbirka členjena na pet delov s pomenljivimi naslovi, z uvodno pesmijo Duma 2022, ki je hkrati dialog s Šalamunom in tudi napoved osnovnih topik in motivov v celotnem delu. Hitro seveda ugotovimo, da deli tematsko niso strogo ločeni med sabo, poetične misli in refleksije se fluidno pretakajo skozi vse razdelke. V prvem, imenovanem Otroci kapitalizma, ki ga lahko beremo kot jedko-pikri preobrat imena glasbene skupine Otroci socializma, prevladuje razgaljanje fragmentov in podob iz otroštva, zaradi česar je to tudi pesnikova do sedaj najbolj intimna zbirka. Otroštvo se v Državi večkrat kaže dvoumno, bodisi kot nekakšna utopija nasproti formam strukturnih pritiskov in dušečim normam odraslosti bodisi kot prvi, ranljivi vir poznejših travm. Travme in bolečine izvirajo pogosto iz periferije, kjer je pesniški subjekt odraščal in se soočal z omejenostjo malih krajev, z vsakodnevnim nasiljem in brezperspektivnostjo, depresijo tamkajšnjih prebivalcev in delavcev. Upodobitve teh družbenih skupin in posameznikov so mestoma sicer rahlo distancirane, pristranske, skiciran je predvsem negativni, skorajda odvraten vidik teh ljudi: »ogabni, pijani moški / jočejo v polsvetlobi«. Te pesmi so najbolje uspele tam, kjer kažejo tudi razumevanje brezizhodne situacije. Teksti prvega dela so tudi najbolj narativno orientirani, verzi se razpirajo v širino, kar je očitna razlika od prejšnjih dveh zbirk, ki sta »prisegali« na jedrnatost, krčevitost izraza. Poglavje oziroma cikel z naslovom Država se v svoji sredici najbolj zagrize v kritiko makro in mikro izkoriščevalskih sistemov, kapitalistično in tehnofevdalistično kolonizacijo in degradacijo subjekta, česar se loteva iz različnih gledišč, pri čemer je znova pomemben motiv otroštva, v že zgoraj omenjenem smislu. Preostanek zbirke skuša iskati potencialne izhode, olajšanje in rešitev v ljubezni, skupnosti, odprtosti in umetnosti, kljub vsemu pa je še vselej na delu tesnoba, negotovost vase, ontološka dekreacija sebstva in sveta, pesnik si ne dela utvar popolne subverzije oziroma transformacije. Zadnji del knjige, Vesele pesmi, je intertekstualna predelava že omenjenih problematik in refleksij, kar se zdi nekoliko odveč, kot da bi bilo nekaj napaberkovano v končni etapi sestavljanja dela, kar pa bi bilo morda lahko izhodišče za neko drugo zbirko. Kritiško oko bo v zbirki Država zaznalo tudi določene šibkosti, ki se tičejo formalnih prijemov, potez in vsebinskih vprašljivosti. Kot že omenjeno, Krmelj v zbirki vpeljuje daljše pesmi, ki so zelo pripovedne, občasno celo preveč, zaradi česar lahko delujejo suhoparno, brez pesniškega naboja in močnega ritma. Seveda bi bil takšen postopek lahko popolnoma legitimen, če bi bil naostren recimo s kristofovsko ali jelinekovsko pikrostjo, suhim humorjem, takšnim ali drugačnim suspenzom ipd.: »Morda lahko izbriše / izključenost iz pozicij moči, / vraščeno manjvrednost, morda / lahko vsak glas najde mesto zase / v prihodnosti. // Morda tudi ne: morda ostanemo ujeti / v ponavljanje te nemoči, občutka, / da nas ni, da smo svobodni / le v obsesijah in nasilju, / v ranah, ki jih dedujemo.« Nekateri verzi tukaj delujejo preveč razlagalno in interpretativno, premalo je prepuščeno govorici, implicitnemu ustroju same pesmi. Spet v drugih pesmih, ki so bolj strnjene v izrazu in operirajo tudi na ravni prispodobičnosti, metaforičnosti in figuralike, ki je je v tokratni zbirki nekoliko manj, neredko naletimo na rime, ki pa se včasih zdijo uvedene ad hoc, uporabljene za potrebe zvočnega ujemanja in besedne igre, pri čemer pa utrpi pomen, saj verzi pomensko izzvenijo v prazno ali pa se zdijo prisiljeni. Kot je bilo ugotovljeno že v nekaterih kritikah prejšnje zbirke, pesnik uvaja filozofsko, ontološko obarvane sentence, ki pa v svoji rahlosti, površinskosti pogosto ne padejo na plodno podlago. Najde se tudi kakšna pesem, ki preprosto trpa vase preveč motivno in refleksivno različnih vsebin, pri čemer so prestopi včasih premočni, suspenz med različnimi deli ni konsistentno elaboriran, ali pa končen »nauk« deluje naključno, prazno. Tem opazkam navkljub pa nikakor nočem trditi, da gre za »zgrešeno« ali slabo delo. Nasprotno, Krmeljeva zbirka Država je polna različnih obetov, tako jezikovnih kot sporočilnih, še posebej dragocene so strjene poeme, kjer se pesnikova imaginacija najbolj sprosti. Krmelj prodorno detektira nevralgične točke kaotičnega kronotopa, v katerem se nahaja, pri čemer ne ponuja enostavnih rešitev, temveč manifestira dvoumnosti in bivanjsko tesnobo, sopostavlja drobne emanacije možnih utopij, ki se vežejo na skupnost, ustvarjalnost, ljubezen in otroško »nedolžnost«, temu pa postavlja nasproti prihodnost dušeče antiutopije, ki se zarisuje že v sedanjosti. Tudi njegova pisava se vse bolj osvobaja tujih vplivov, z Državo dokazuje, da prihaja na območje svoje govorice. Konec koncev, intrigantno branje za marsikaterega bralca. Zaključimo to recenzijo s Krmeljevimi jedrnatimi, neposrednimi in za kanec upajočimi verzi: »Ljubezen je skrb, in ne boj / ali krhka spojina zavisti in želje. // Obstaja država, / v kateri preživijo / vse moje identitete.«

Since the start of the war between Israel and Hamas last year, the cry “From the River to the Sea” has been heard more and more as a pro-Palestinian slogan. But what river? What sea? And what exactly does the phrase mean? It's the subject of intense controversy. In this two-part series, reporter Tim Whewell travels from the River Jordan to the Mediterranean Sea, across a tiny stretch of land – just over an hour by car if you don't stop - that's perhaps the most argued-over in the world. Along the way, he meets shepherds and teachers, soldiers and gardeners, artists and activists - Palestinians and Israelis of many different views and backgrounds. The shortest line from the River to the Sea doesn't pass through Gaza. But everyone Tim meets on his journey across the Israeli-occupied West Bank of the River, and in Israel, is living in the terrible shadow of the October 7th Hamas attack on Israel and the war that's followed. The future of the often-beautiful, fast-changing, overcrowded region he crosses will be at the heart of any eventual solution to the Middle East conflict. In this first programme, he goes from the Jordan, through the Israeli settlement of Argaman, the Palestinian herding community of al-Farisiyah and the Palestinian village of Duma, ending up at the Israeli settlement of Shilo.
