A full-on showdown between the Trump administration and the out-of-control federal courts.   It has gotten clearer by the day that a conspiracy of biased federal judges and left-wing nonprofits with teams of white-shoe lawyers has been operating to cripple the executive branch of government. The unprecedented use of judicial orders to hamstring and micromanage President Donald Trump's exercise of presidential power has created a constitutional crisis — amounting to a coup d'etat by unelected judges. Try to imagine if GOP-appointed judges had conspired to kneecap Barack Obama while he was in office. The nation would have been treated to earsplitting banshee cries of “racism,” judicial impeachment hearings, and well-funded riots in blue cities.   Don't believe me?   Remember the threats by members of Congress against Supreme Court justices when the decision overturning Roe v. Wade got leaked? (By whom, we'll never know). Think of the protests outside conservative justices' homes, and the near-miss assassination attempt on Justice Brett Kavanaugh. The Democrats tried to pack the court with new, preprogrammed leftist justices and talked about imposing term limits on SCOTUS. None on the left were warbling about the sanctity of “judicial independence” and “the rule of law” then. They only believe in the System when they can game it, like some bratty child demanding “do-overs” whenever he strikes out at bat.   No One's Above the Law Democrats were chanting “No one's above the law” when they invented fake crimes to try to imprison Donald Trump in New York, an effort led by Chief Justice John Roberts' crony Norm Eisen. The same Democrats are now suffering conniption fits as Attorney General Pam Bondi takes action against judges who committed genuine offenses. Let's look at the first two arrests, and pray that more follow wherever judges are flouting the law and undermining our democracy. CNBC reports:   Federal authorities have arrested a Wisconsin judge and a former New Mexico judge in two separate cases, accusing them of interfering with Trump administration immigration enforcement efforts.   Milwaukee Circuit Court Judge Hannah Dugan was arrested Friday morning and charged with obstruction. She is accused of helping an undocumented immigrant evade arrest by U.S. Immigration and Customs Enforcement officers after he appeared in her courtroom April 18.   Dugan's arrest came one day after federal authorities arrested a former New Mexico judge, Joel Cano, and his wife on charges related to the Canos' reported harboring of an undocumented immigrant with alleged ties to the notorious gang Tren de Aragua.   It's hard to decide which of these arrests is more satisfying.   Before she became a judge who would help smuggle illegal aliens out of her courtroom to evade arrest by ICE, Dugan was formerly the executive director of Catholic Charities of southeastern Wisconsin. As The Stream has reported, that particular wealthy, taxpayer-funded nonprofit has been credibly accused of colluding with Mexican cartels to traffic immigrants into the country. Elon Musk's DOGE investigations have largely cut off government funds to Catholic Charities, which served as the main conduit for some $3 billion sluiced into the U.S. Catholic bishops' coffers over the past 15 years — reimbursing them, almost dollar for dollar, for sex-abuse settlements those bishops racked up.   Fool around, find out, indeed. Next there's the case of former judge Joel Cano, who was keeping an accused Tren de Aragua gang member at his house. Feast your eyes on this servant of the court and the rescue gangster he adopted:   On Fox News Pam Bondi explained just how far Cano had gone to help Lopez evade prosecution:   He took one of the TDA members' cellphones, beat it with a hammer, and destroyed it. Then he walked the pieces to a city dumpster to dispose of them to protect himself. … The judge and his wife gave [Lopez] assault rifles that belonged to their daughter. He goes to the shooting range with these assault rifles, with a suppressor, with other known TDA members, and they are shooting. This is the LAST person we want in our country. Nor will we ever tolerate a judge or anyone else harboring them.   The Biden regime intentionally engineered this perfect storm of lawlessness by refusing to enforce our just, democratically enacted immigration laws. The 10 million-plus illegals Biden imported are counted toward congressional representation, providing the Democrats with 20 seats in the House of Representatives they otherwise wouldn't hold, as Musk has estimated. And as we reported Friday, leftist judges are making it easy for those illegal aliens to vote in federal elections by striking down Trump's executive order requiring proof of citizenship.   When faced with such orchestrated chaos, the Trump administration has no choice but to take drastic action to reimpose order and the genuine rule of law. Trump Meets Zelensky at Impromptu Summit at Pope Francis's Funeral The petulant, demanding president of Ukraine, Volodomyr Zelenksyy, has been frustrating Donald Trump's peace-making efforts, making impossible demands such as the return of Crimea — which Russia seized in 2014, with hardly a protest from the Obama administration and no organized resistance by Ukraine. Secretary of State Marco Rubio expressed the Trump team's impatience last week, threatening to walk away from talks altogether. It's good to see that communications are still open, as evidenced by this hastily arranged meeting of Trump with Zelenskyy and French President Emanuel Macron at St. Peter's Basilica, which will host the funeral of Pope Francis.   Pray for an end to the futile, fratricidal conflict the Biden administration's bungling help to spark, which has claimed more than a million casualties from two historically Christian countries.   Our Diversity Is Our … Strength? Our out-of-control borders haven't just been flooding the country with foreign gang members and high school dropouts who compete with our least privileged fellow citizens for jobs. We're also importing aggressive, intolerant Islam — the religion that's fueling terrorism and the persecution of Christians all across the world. Take a look at this little video, which shows how Dallas, Texas, is being islamicized.   The First Amendment was written to prevent intra-Christian conflict and religious persecution. The Founders never intended it as a charter for the mass influx of religions entirely alien to our traditions. No Need to Prove Citizenship to Vote By John Zmirak Published on April 25, 2025 John Zmirak If you want Exhibit #108 proving that President Donald Trump has no choice but to defy judicial orders from lawless, biased jurists, check out the latest. The Daily Wire reports: A federal judge on Thursday blocked President Donald Trump from implementing an executive order that requires voters to show documentation proving their U.S. citizenship to cast a ballot in federal elections. U.S. District Judge Colleen Kollar-Kotelly, a Bill Clinton appointee, granted a preliminary injunction stopping the Trump administration from going forward with the proof-of-citizenship requirements as a lawsuit plays out, the Associated Press reported. The lawsuit, filed by the Democratic National Committee and leftist voting rights groups, claims that Trump's order is “an unlawful action that threatens to uproot our tried-and-tested election systems and silence potentially millions of Americans.” … The judge's move means that yet another Trump action will be tied up in the courts and prevented from taking effect. Federal judges have blocked numerous Trump orders, including on cuts to federal agency staff, deportations, and birthright citizenship. As of Thursday, 108 different rulings have blocked or temporarily frozen Trump's attempts to carry out his agenda, according to The New York Times. There you go. The Democratic National Committee wants non-citizens voting. Or else it thinks that its voters are so clueless and unqualified that they don't have any ID. No drivers licenses, nothing they'd need to show in order to cash a check at a local bank. Check out this classic 2017 video whose host asks white liberals whether non-white Americans carry ID … then asks a series of non-white Americans whether they do. “Why would they think we don't have ID?” one of the questioners asks the host. He doesn't answer. He doesn't have to. Now consider what motive the Biden administration had for importing more than 10 million illegal aliens and sending them to swing states. Foreign Voters and Foreign Money Help the Left Grab Power While some in MAGA world are frustrated at the Trump administration's pace of progress, one man can only do so much. He is taking aim at some of the most important targets, the key players in corrupting American politics. He's going after Act Blue, for instance, as Politico reports: In a shot at ActBlue, the left's major online donation platform, President Donald Trump plans to sign a presidential memorandum on Thursday that he will cast as cracking down on foreign contributions in American elections, according to a person familiar with the policy and granted anonymity to discuss not-yet-public details. Attorney General Pam Bondi's office is expected to be involved in the effort, the person said. The order is expected to specifically target ActBlue. Republicans have long claimed the platform could be exploited by foreign actors, while Democrats have warned the action is an example of Trump baselessly targeting political opponents. … The memo will direct Bondi to “investigate and take appropriate action concerning allegations regarding the use of online fundraising platforms to make ‘straw' or ‘dummy' contributions and to make foreign contributions to U.S. political candidates and committees, all of which break the law” and report results to the president and his general counsel, according to the fact sheet. Why shouldn't foreign billionaires and hostile governments be able to pour billions into U.S. elections and organize non-citizen voters to decide who represents us? That would imply we make distinctions between countrymen and strangers, which the editors of Christianity Today (some of them donors to groups aligned with Act Blue) reliably inform us is alien to “gospel values.” Speaking of funny money, Ashley Biden's nonprofit is having trouble with the IRS. That's what happens when you don't report honestly. The Free Beacon has the real story: Ashley Biden's charity has a $500,000 discrepancy in its books, a watchdog alleged in a complaint filed with the IRS on Monday. … To Paul Kamenar, an attorney with the National Legal and Policy Center watchdog group, the documents show that Ashley Biden's charity clearly violated IRS rules by failing to disclose $500,000 in contributions it received in 2023. Let's remember the immortal words of now-embattled New York Attorney General Letitia James: “No one is above the law.” Abortion Clinic Targets Children for Sexual Grooming Remember the old libertarian talking point about “keeping the government out of our bedrooms”? Now we realize the government and the LGBTQ movement need to be kept out of the nursery, too. See the latest outrage, courtesy of Libs of TikTok: The State cannot sit neutral. It can't reach a stopping point at “consenting adults,” the way Classical liberals pretend. Either the government will make laws based on the Natural Law which God wrote on the human heart — which you don't need faith or grace to understand — or it will base laws on something darker and falser. It took the rise of Christianity in the Roman Empire to rescue women and children from sexual slavery. As the Gospel recedes from people's hearts, the vacuum it leaves will be filled, and filled by spirits. The explosion of transgender madness, child castration, and attacks on Christians as “unfit parents” in the wake of the 2015 Obergefell decision shouldn't surprise us; it should goad us to counterattack with the truth. The Next Pope? I'm not following the conclave that's gathering to elect a successor to the disloyal Pope Francis, largely because the people he appointed to the College of Cardinals transformed that body into a lavender Jacuzzi. One of Francis's appointees, Filipino Cardinal Luis Antonio Tagle, is considered a frontrunner among “progressives” who wish to continue transforming the Catholic Church into the chaplaincy of the World Economic Forum. Here he is performing John Lennon's utopian, atheist anthem “Imagine” for a crowd that we can hope was duly puzzled by it. Imagine Pope Francis II. (It's easy if you try.) Catholics don't believe that God picks the popes — otherwise, we'd have to explain why during the Renaissance He always picked the cardinals who'd paid the biggest bribes or were the illegitimate children of previous popes. We just have to pray for Jesus to protect us from our shepherds, who seem to have developed a taste for lamb. Proposed outdoor trials may involve spraying aerosols into the upper atmosphere or artificially brightening clouds to bounce sunlight back into space in order to help cool the earth. … The experiments are being pushed under the premise that humanity isn't cutting emissions quickly enough to avoid an environmental apocalypse, at least, according to scientists still clinging to worst-case climate scenarios. Scientists backing the proposals believe that, if the tests yield promising results, the techniques could be expanded and rolled out on a wider scale within a decade. These people want to control the weather, to make the earth less fertile so it can feed far fewer people. But it's a reminder that the U.S. doesn't just celebrate its laws when it's convenient—it does so deliberately, and sometimes, geopolitically.A federal judge ruled that Apple violated a 2021 injunction meant to promote competition in its App Store by improperly restricting developers' payment options. U.S. District Judge Yvonne Gonzalez Rogers found that Apple defied her prior order in an antitrust case brought by Epic Games, the maker of Fortnite. The judge referred Apple and its vice president of finance, Alex Roman, to federal prosecutors for a possible criminal contempt investigation, citing misleading testimony and willful noncompliance. She emphasized that Apple had treated the injunction as a negotiation rather than a binding mandate.Epic Games CEO Tim Sweeney praised the ruling as a win for developers and said Fortnite could return to the App Store soon. Apple had previously removed Epic's account after it allowed users to bypass Apple's in-app payment system. Mahdawi, who was arrested during a citizenship interview, has not been charged with any crime. Judge Geoffrey Crawford found he posed no danger or flight risk and compared the political environment to McCarthy-era crackdowns on dissent.Crawford emphasized that Mahdawi's peaceful activism was protected by the First Amendment, even as a non-citizen. In this case, the court considered this issue: Can a plaintiff state a claim under ERISA's provision prohibiting a plan fiduciary from knowingly engaging in transactions with barred parties, solely by alleging that such a transaction took place?The case was decided on April 17, 2025.The Supreme Court held that To state a claim under Section 1106(a)(1)(C) of ERISA, a plaintiff need only plausibly allege the elements listed in that provision itself: that a plan fiduciary knowingly caused the plan to engage in a transaction involving goods, services, or facilities with a party in interest. The plaintiff is not required to plead that the transaction does not qualify for an exemption under Section 1108. Justice Sonia Sotomayor authored the unanimous opinion of the Court.Section 1106(a)(1)(C) establishes a clear, categorical prohibition on certain transactions between a pension plan and a party in interest. ERISA's structure places relevant exemptions, including those for reasonable and necessary services under Section 1108(b)(2)(A), in a separate statutory provision. Because those exemptions are laid out apart from the prohibitions and refer back to conduct already defined as unlawful, they function as affirmative defenses. As a result, plan fiduciaries who wish to invoke an exemption bear the burden of pleading and proving it. Plaintiffs, on the other hand, are not obliged to anticipate and refute every possible statutory or regulatory exemption.Reading exemptions as affirmative defenses also aligns with longstanding legal principles and avoids unworkable results. Requiring plaintiffs to negate all exemptions—especially when ERISA includes 21 statutory and hundreds of regulatory exemptions—would be impractical and unfair, particularly because the relevant facts are often in the defendant's possession. Procedural safeguards such as pleading requirements, discovery limits, and Rule 11 sanctions enable federal courts to deter and manage meritless litigation without shifting the pleading burden to plaintiffs. Consequently, only the elements in Section 1106(a)(1)(C) must be pleaded to survive a motion to dismiss.Justice Samuel Alito joined the majority opinion in full and authored a concurrence, in which Justices Clarence Thomas and Brett Kavanaugh joined.The opinion is presented here in its entirety, but with citations omitted. Here are 3 big things you need to know—   One — President Donald Trump has announced far-reaching new tariffs on nearly all U.S. trading partners. That includes a 34% tax on imports from China and 20% on the European Union. Trump says he was placing tariff rates on dozens of nations that run trade surpluses with the United States, while imposing a 10% baseline tax on imports from all countries in response to what he called an economic emergency.   Two ----  The man who was found outside Supreme Court Justice Brett Kavanaugh's home with weapons in 2022 intends to plead guilty to a federal charge of attempting to assassinate a justice of the United States. Roske was found in June 2022 outside Kavanaugh's  Maryland, home armed with a gun, knife and burglary tools, according to court documents. He could face a maximum sentence of 20 years in federal prison.   And number three —    Hunter Biden is going to be permanently stripped of his law license in Washington, DC.  The son of former President Biden agreed to "consent to disbarment" in an affidavit filed on Tuesday after a recommendation from a disciplinary agency.  The DC Court of Appeals must now accept the recommendation to then accept Biden's consent to disbarment before making it official. 

In this case, the court considered this issue: Are economic harms resulting from personal injuries properly considered injuries to “business or property by reason of” the defendant's acts for purposes of a civil treble-damages action under the Racketeer Influenced and Corrupt Organizations Act?The case was decided on April 2, 2025.The Supreme Court, in a 5-4 decision authored by Justice Amy Coney Barrett, upheld the Second Circuit's ruling that Horn's loss of employment and associated economic damages qualified as injuries to "business or property" under RICO. The majority concluded that the statute permits recovery for economic harms directly resulting from racketeering activities, even if those harms stem from personal injuries. Justice Barrett emphasized that "injured" in the context of RICO simply means "harmed," and thus, economic losses like lost wages are recoverable. citeturn0news12Justice Ketanji Brown Jackson concurred, highlighting that RICO should be liberally construed to effectuate its remedial purposes. In this case, the court considered this issue: Did the ATF exceed its statutory authority in promulgating its Final Rule purporting to regulate so-called “ghost guns”?The case was decided on March 26, 2025.The Supreme Court held that the Gun Control Act of 1968 authorizes the ATF to regulate weapon parts kits and unfinished frames or receivers that can be readily converted into functional firearms. Justice Neil Gorsuch authored the 7-2 majority opinion of the Court.  Weapon parts kits qualify as “weapons” under the statute when they contain all necessary components to build a gun and their intended function is clear. Everyday language permits describing incomplete objects by their intended use, just as a disassembled rifle remains a “weapon.” The statute reinforces this understanding by treating starter guns as firearms even though they require modification. A kit like Polymer80's “Buy Build Shoot,” which can be assembled in about 20 minutes using common tools, meets the law's definition because it can be “readily converted” into a functioning firearm, just as a blocked-barrel starter gun qualifies when easily modified for live fire. While not all kits may fall under this definition, the statute clearly covers at least some, making a facial challenge to the rule invalid.  The definition of “frame or receiver” also includes partially complete versions that can be finished quickly with standard tools. Ordinary language and the statute's serialization requirements support this reading, as identification numbers are required on unfinished frames and receivers. Law enforcement has long treated such components as regulated firearms, and even the challengers conceded that some unfinished frames fall within the law's scope. While some objects may be too incomplete to qualify, the statute reaches at least those requiring only minimal work, making ATF's rule facially consistent with the law. Concerns about unintended consequences under the National Firearms Act are misplaced, as the government disavowed any authority to classify AR-15 receivers as machine guns, and the doctrines of lenity and constitutional avoidance do not apply where the statute's meaning is clear.Justices Sonia Sotomayor, Brett Kavanaugh, and Ketanji Brown Jackson each joined the majority opinion and also wrote separate concurring opinions.Justices Clarence Thomas and Samuel Alito each authored dissenting opinions.The opinion is presented here in its entirety, but with citations omitted. As a legal correspondent covering the Trump trials, I've had a whirlwind few days. On March 10th, I was in a packed New York courtroom as Judge Juan Merchan sentenced former President Donald Trump to unconditional discharge in the hush money case. The judge's decision came as a surprise to many, given the 34 felony counts Trump was convicted of last May.The very next day, I rushed to Washington D.C., where the Supreme Court was hearing arguments on Trump's claim of presidential immunity in the federal election interference case. The justices seemed skeptical of Trump's broad immunity claims, with even conservative Justice Brett Kavanaugh pressing Trump's lawyers on the limits of their argument.Meanwhile, in Georgia, Fulton County District Attorney Fani Willis was fighting to remain on the election interference case against Trump and others. Yesterday, Judge Scott McAfee ruled that Willis could stay on the case, but only if she removed the special prosecutor she had been romantically involved with. It was a mixed ruling that left both sides claiming partial victory.This morning, I'm back in New York, where Trump is appearing for a hearing in the civil fraud case brought by Attorney General Letitia James. The AG is seeking to enforce the $454 million judgment against Trump, arguing he hasn't posted sufficient bond to cover the amount while he appeals.As I sit in the courtroom, I can't help but marvel at the unprecedented nature of these proceedings. Never before has a former president faced such a barrage of legal challenges. Trump, for his part, continues to claim all the cases are politically motivated witch hunts.Outside, Trump supporters and protesters clash, their chants echoing through the streets. It's a stark reminder of how deeply polarizing these cases remain.With the clock ticking down to November's election, the outcomes of these trials could have profound implications for Trump's political future and American democracy itself. As a journalist, it's both exhilarating and sobering to be chronicling this extraordinary chapter in U.S. history.Tomorrow, I'll be flying to Florida for a hearing in the classified documents case. It's exhausting keeping up with all these trials, but I wouldn't want to be anywhere else. This is history in the making, and I have a front-row seat.

This Day in Legal History: Lend-Lease ActOn March 11, 1941, President Franklin D. Roosevelt signed the Lend-Lease Act into law, fundamentally reshaping U.S. foreign policy during World War II. The legislation empowered the President to provide military aid to countries deemed essential to American national security, even if they could not immediately pay for the supplies. This marked a decisive shift from the nation's prior isolationist stance, allowing Roosevelt to support the Allies without directly engaging in combat. Under the act, the United States sent over $50 billion in war materials to nations such as the United Kingdom, the Soviet Union, and China. The aid included weapons, vehicles, food, and other critical supplies, strengthening the Allied war effort against Axis forces. British Prime Minister Winston Churchill described the act as crucial to his country's survival, calling it "the most unsordid act in the history of any nation." The law also laid the groundwork for closer U.S.-Allied relations, ensuring American economic and military influence in global affairs. While many supported the act as a necessary step to combat fascism, isolationists in Congress criticized it as a step toward war. Their fears proved correct when Japan's attack on Pearl Harbor in December 1941 led to full U.S. involvement in the conflict. Lend-Lease remained in effect until September 1945, helping to shape the postwar world order. The program reinforced the role of the United States as the "Arsenal of Democracy," a term Roosevelt had coined to describe its industrial and military production for the Allied cause. The principles behind Lend-Lease also influenced future U.S. foreign aid programs, including the Marshall Plan. By prioritizing strategic alliances and military support, the act cemented America's role as a dominant force in international relations.U.S. Circuit Judge James Ho resigned from the Federal Judges Association (FJA) over its recent statement addressing rising threats, criticism, and violence against the judiciary. Ho, a Trump-appointed judge and potential Supreme Court nominee, objected to what he saw as a selective concern for judicial independence. The FJA, which represents over 1,100 federal judges, warned against "irresponsible rhetoric" and security risks but did not name specific cases or threats. The statement came amid increasing attacks on judges from figures like Elon Musk and Trump allies, particularly targeting those blocking conservative policies. FJA President Judge Michelle Childs cited growing threats, including intimidation and impeachment efforts, as challenges to judicial independence. Ho criticized the group for not issuing similar warnings when conservative justices, like Brett Kavanaugh, faced threats, arguing that defending only certain judges politicizes the judiciary. He announced his resignation at a Federalist Society event, framing his departure as a stand against perceived bias. Colorado officials maintain that the law regulates professional conduct, not speech. Lower courts upheld the ban, citing evidence that conversion therapy is harmful and ineffective. The Supreme Court's decision to take the case follows its recent pattern of ruling in favor of religious interests over LGBT protections. The Court previously declined to hear a similar case from Washington state, though conservative justices dissented. The case will be argued in the Court's next term, starting in October. The ruling could have nationwide implications, as over two dozen states have similar bans. The United States Supreme Court on Tuesday directed Oklahoma to vacate the murder conviction of Richard Glossip, the state's most famous death row inmate, finding that prosecutors violated Glossip's civil rights during his trial more than 20 years ago. “Glossip is entitled to a new trial,” Justice Sonia Sotomayor wrote in the majority opinion for five justices. She was joined by Chief Justice John Roberts, and Justices Elena Kagan, Brett Kavanaugh, Kentaji Brown and Amy Comey Barrett, who dissented in part. Glossip has spent 26 years on death row, had two trials, nine execution dates and three last meals. Fourteen years ago, Amy Chua published Battle Hymn of the Tiger Mother. It was received less like a book and more like a nuclear bomb. Here are some headlines from the time: “Why I Will Never Be a Tiger Mom.” “Why Amy Chua Is Wrong About Parenting.” “Amy Chua Is a Circus Trainer, Not a Tiger Mother.” “The Human Race Needs Elephant Mothers, Not Tiger Mothers.” “Amy Chua's Recipe for Disaster and the Externalized Cost of Book Sales.” Then, just as the publicity around Tiger Mother died down, Amy came out with The Triple Package, about why some ethnic groups succeed. People called her racist. Then she came out in support of Brett Kavanaugh's court nomination in an op-ed in The Wall Street Journal (before he was accused of sexual assault by Christine Blasey Ford). Afterward, people accused her of misogyny and grooming. And she was almost forced out of Yale for it.  Then, in 2021, she was accused of hosting boozy dinner parties during COVID lockdowns and “dinner party-gate” was born. Yale punished her by barring her from teaching her “small group” first-year student contingency.  Fast-forward to 2025. And the tables have turned. Being a strict “tiger mom”? In. Free speech? In. Wokeness and hypersensitivity? Out. Covid lockdowns? Definitely out. Vicious character assassinations at Senate confirmations? Out. As Free Press reporter Peter Savodnik just wrote: “The ideas that Chua was pilloried for are suddenly back in fashion.”  Just a few weeks ago, she attended the inauguration of the incoming president and vice president—one of whom happens to be her former student and mentee.  It's easy to be a weather vane—to go where the wind blows.
