Freedom of expression on college campuses has been under assault across America for years, and at Cornell University the problem was particularly bad, so a group of alumni decided they'd had enough. Through hard work and dedication, they persuaded the President to launch a university-wide free expression initiative. Cornell Alum Paul Rossi and Cornell Professor Randy Wayne join me to discuss how the University's freedom of expression initiative is working as we approach the one year anniversary of its implementation. Paul Rossi is an active high school math teacher and the co-founder and CEO of Terra Firma Teaching Alliance, a peer support and placement network of traditional K-12 teachers. He is a biophysical plant cell biologist, in the Laboratory of Natural Philosophy, who researches the nature of light. We were reminded by Justice Alito's words this week, which is telling about the feeling of religious liberty in America. He stated, "It pains me to say this, but in certain quarters religious liberty is fast becoming a disfavored, right." Which means that there are politicians and individuals of academia that religion is not considered a liberty, a right under the constitution. We have seen this with the lockdowns in many states where churches were shut down. Pastors did not stand up and fight to keep their churches open, they bowed down to government and let government shut the doors of churches. At least we have a good example of what should be done in our fight for religious liberty. The Little Sisters of the Poor had a case where the Obama administration was trying to force them to go against their beliefs. The justice talked about this, he said, "Take the protracted campaign against the Little Sisters of the Poor in order of Catholic nuns, the Little Sisters or women who have dedicated their lives to caring for the elderly, poor, regardless of religion.......despite this inspiring work, the little sisters have been under unrelenting attack for the better part of a decade. Why because they refused to allow their health insurance plan to provide contraceptives to their employees. For that they were targeted......! But the sisters fought for their beliefs and stood firm and won. However, today government shut our churches down because of covid and pastors did nothing. Just a handful stood up, but most fell and obeyed government instead of God. Remember, God was praying in the garden and the disciples lay sleeping. God was upset because they lay there sleeping. Today God is angry with todays pastors for sleeping and allowing government to shut them down. Where are you now? Stop praying for God's help when you sit there silent and allow government to shut you down. The justice is so right, pastors you are wrong. Defy government and open up your doors. More fallout in the aftermath of North Carolina's infamous law that prevents local governments from passing LGBT protections. Bruce Springsteen and former Beatle Ringo Starr are among the artists who have cancelled shows in the Tar Heel state. Meanwhile, Mississippi has passed HB 1523, the "Protecting Freedom of Conscience from Government Discrimination Act," which more or less allows anyone to discriminate against LGBT citizens as long as they cite sincerely held religious beliefs. This law is seen as so extreme that some other state governments (including New York and Washington) and even local governments have issued (largely symbolic) bans against traveling to Mississippi for government business.  Finally, Tennessee Governor Bill Haslam has vetoed a bill aimed at making the Bible the official state book, saying it trivializes the Bible (rather than giving the more obvious reason that the law is blatantly unconstitutional). There's a Supreme Court showdown just over the horizon.

David Kaye is Clinical Professor of Law and Director of the International Justice Clinic at UC Irvine School of Law, and he is UN Special Rapporteur on the Promotion and Protection of the Right to Freedom of Opinion and Expression. Prof. Kaye's scholarship and teaching focus on public international law, especially international human rights law, international humanitarian law, accountability for violations of human rights, and the law governing the use of force. In August 2014, Prof. Kaye was appointed by the UN Human Rights Council to serve three years as Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression worldwide. With the assistance of students in his International Justice Clinic, Prof. Kaye reports to the UN on some of the key issues in free expression worldwide, such as the safety of journalists, severe restrictions placed on Internet access and usage, the chilling effects of electronic surveillance, hate speech and incitement to violence. http://www.law.uci.edu/faculty/full-time/kaye/
