And what does it tell us about what the Trump administration has planned for November?“I Hear the Jury's Still Out on the Fourth Amendment.” Over the past week, whistleblowers have revealed that ICE has issued a series of internal memos to agents advising that they do not need judicial warrants to detain or search the homes of people suspected of being undocumented immigrants. Instead, ICE has attempted to side-step the regular judicial process by suggesting that agents only need an administrative warrant, a controversial move that will almost certainly be challenged in court. What do we think of ICE's decision to shift to such a legally dubious policy, and where do we expect it to go from here?“Ex Post Justification.” Last month, the FBI conducted a search on the home of Washington Post reporter Hannah Natanson as part of an investigation into alleged leaks by a Defense Department contractor. The weeklong “Operation Reclaim and Rebuild” campaign was part of a yearly effort by the Los Angeles Regional Human Trafficking Task Force and 80 local, state, and federal law enforcement agencies. Los Angeles County Sheriff Robert Luna laid out the exact numbers at a news conference, later posted on X. A total of 611 criminal arrests were made and 156 adults rescued as part of the operations, Luna told reporters. In addition, 14 children were rescued from sex trafficking. Observers are concerned that the search is the beginning of a broader effort to relitigate the 2020 election—especially as Trump calls for Republicans in Congress to “nationalize elections” in advance of the November mid-terms. What do we know about the legal basis for this search? And what does it tell us about what the Trump administration has planned for November?“I Hear the Jury's Still Out on the Fourth Amendment.” Over the past week, whistleblowers have revealed that ICE has issued a series of internal memos to agents advising that they do not need judicial warrants to detain or search the homes of people suspected of being undocumented immigrants. Instead, ICE has attempted to side-step the regular judicial process by suggesting that agents only need an administrative warrant, a controversial move that will almost certainly be challenged in court. What do we think of ICE's decision to shift to such a legally dubious policy, and where do we expect it to go from here?“Ex Post Justification.” Last month, the FBI conducted a search on the home of Washington Post reporter Hannah Natanson as part of an investigation into alleged leaks by a Defense Department contractor. During the search, agents seized Natanson's personal and professional devices, which drew concern from media outlets and civil liberty groups over potential First Amendment and privacy violations. A magistrate judge has now ordered that the FBI cannot access Natanson's materials at least for now, while some of these issues are litigated. How should federal law enforcement balance the need to conduct leak investigations with press freedoms? Donald Trump just claimed in an interview that the events in Minnesota suggest that ICE needs to use a “softer touch.” He also struggled to create the impression that he's been working constructively with local officials there. While all this is just spin, it reveals an awareness that these events have put him in a politically weak position. Indeed, this comes as Trump's plans for vast migrant prison camps are hitting angry opposition in unlikely places: In a deep red, partly rural county in Virginia; among Republican officials in other states; and even in Mississippi, where a GOP Senator has come out against a planned camp there. We talked to Brian Beutler, who's been arguing on his excellent “Off Message” Substack that Dems need to take charge of debates like these. The Chicago Council on Global Affairs has been tracking American views on foreign policy since the end of the Vietnam War. Last week, it released its 2025 survey—and the results point to a widening partisan divide on some of the most fundamental questions about America's role in the world. That was not always the case. For most of the past 50 years, Democrats, Republicans, and independents largely agreed on the proper role of the United States in the world. There were always differences, of course, but they tended to exist at the margins. On big-picture questions—such as alliances and working cooperatively with other countries—there was broad consensus. That consensus began to shift in 2015 with Donald Trump's entry into the American political scene. Now, ten years later, this latest survey shows partisan divides that are deeper than ever. America's domestic polarization has finally caught up with its foreign policy. To discuss these survey results, I'm joined by Jordan Tama, a professor at American University in Washington, DC, who specializes in the intersection of American public opinion and foreign policy. We begin by discussing the historical sources of bipartisan foreign policy consensus, before turning to a longer conversation about how and why that consensus has fractured—and what this shift suggests about the future of American foreign policy. Congress is facing a serious crunch to reach a deal on funding the Department of Homeland Security for the remainder of the fiscal year. Democratic demands over reforms that they want to see implemented within ICE are being met with resistance from many Republicans — leaving little space for compromise.
