In this episode: Nic comes out against the SBR on Bloomberg More Prometheum nonsense MicroStrategy acquired an additional 15,350 BTC for roughly $1.5 billion, bringing the company's total holdings to 439,000 BTC. Microstrategy was also added to the Nasdaq 100 this week, which will lead to the stock's inclusion in several large ETFs including Invesco's QQQ. Anchorage Digital has received New York BitLicense approval, enabling them to offer digital asset custody and trading services to more customers in the state such as RIAs and other institutional asset managers. The US Senate scrapped a vote to renominate SEC Commissioner Caroline Crenshaw in response to immense backlash from the crypto community, led by Coinbase-backed non-profit Stand With Crypto, for Commissioner Crenshaw's treatment of the digital asset industry. A Texas state representative, Giovanni Capriglione, introduced a bill for the state to create a strategic Bitcoin reserve. Riot Platforms, the publicly traded Bitcoin miner, acquired 667 BTC this week for $67.4 million to add to their balance sheet, bringing their total holdings to 17,429 BTC. The NFT collection CyberKongz announced they had received a Wells Notice from the SEC. A California judge sided with Coinbase in a suit brought by BiT Global over the exchange's delisting of wBTC. Coinbase had recently moved to remove the asset, a tokenized version of BTC tradeable on Ethereum-based networks, following BiT Global, a custodian closely affiliated with Tron founder Justin Sun, assuming custody services for wBTC. “The U.S. is trying to disconnect from Ethereum," that's what Joe Lubin the CEO of Consensys said in today's conversation. He was talking about those in power trying to unplug Ethereum from the citizens. The SEC is going after Kraken, Coinbase, Uniswap and Metamask. They're trying to turn every non-custodial wallet into a broker-dealer. We brought on Joe Lubin, a crypto OG and CEO of Consensys the company behind a number of massive crypto projects including the popular Metamask wallet, and Matt Corva, the General Counsel at Consensys, leading the charge against the SEC Joe and Matt are producing evidence that the SEC is coming after Ethereum itself. Sending discovery requests to Ethereum core developers, threatening their employers - pushing a coordinated effort to claim Ether is a security so they can control it. So Consensys is taking them to court to settle the issue. If they're successful it'll be the first time we get a clear court ruling that Ether is a commodity and not a security. ------

Aaron Kaplan founded Prometheum to create a trading venue for digital assets that is compliant with federal securities laws. However, Kaplan's firm came under fire following the SEC's approval of Prometheum's special purpose broker-dealer license back in May of this year — the only such license issued by the SEC to date. In this episode, Kaplan lays out how Prometheum managed to secure the special purpose broker-dealer license and why he believes strict adherence to the federal securities laws is the key to increased institutional participation in the digital asset industry. While companies like Coinbase claim regulatory ambiguities exist surrounding digital assets, Kaplan firmly believes that existing federal securities laws can be applied to digital assets without alterations. As Kaplan explains, "Our approval shows that if you put your head down, you work hard, you focus on how the regulators have laid out the rules and regulations, that you can be compliant."
