This day in history in 1814 Francis Scott Key penned “ The Star-Spangled Banner” after Key witnessed the flag still waving over Fort McHenry at daybreak withstanding some 25 hours of British bombardment in the War of 1812. The patriotic song grew in popularity becoming a pregame ritual in our sports and finally becoming our national anthem when congress made it so in 1931. South Dakota has new law that public schools will display the national motto, “In God We Trust”, and many people are unhappy about it. Every circuit court has deemed it constitutional and it has been upheld that the motto has nothing to do with the establishment of religion. Learn more at FirstLiberty.org/Briefing. Under a new law, South Dakota’s public schools will now display the national motto on school property. But, not everyone is very happy displaying “In God We Trust” on public property. One anti-religion activist called the idea “exclusionary and aimed at brainwashing American schoolchildren.” Well, the only brainwashing seems to come from anti-religion activists with a bent to exclude, based on inaccurate information! Indeed, few words are more in keeping with our history and law than the National Motto. Francis Scott Key included the line, “And this be our motto: ‘in God is our Trust’” in the further verse of the Star Spangled Banner. It went on our coins in 1864 and became the official motto in 1956, a year before it appeared on all our currency. It’s even displayed above the Speaker’s Rostrum in Congress! Every one of the 11 circuit courts of appeal to consider the motto has deemed it constitutional. The Ninth Circuit has twice upheld the motto, explaining in one case that the motto “has nothing whatsoever to do with the establishment of religion.” So, the next time you hear someone suggest that it violates the constitution, just use the words of the Sixth Circuit who determined that a court removing the motto from government property would be “ludicrous.” To learn how First Liberty is protecting religious liberty for all Americans, visit FirstLiberty.org.

The original “Star-Spangled Banner" that flew over Fort McHenry, inspiring the national anthem that helped the flag become the ubiquitous symbol it is today, is part of the collection at the Smithsonian Museum. Jennifer Jones, curator for the Star Spangled Banner, shares with us what it takes to preserve this national treasure and why it matters.

In honor of the War of 1812, World Footprints will travel the "Star-Spangled Banner" Trail by land and by sea through Maryland, the home state of Francis Scott Key. Our first stop will be two historical sites in Baltimore--Ft. McHenry and the Star-Spangled Banner Flag House. Then we will explore Southern Maryland and travel to historic Jefferson Patterson Park and the Sotterley Plantation where we’ll learn about the two largest naval battles in Maryland’s history—the Battles of St. Leonard Creek. Finally, we will travel to Maryland’s capital in Annapolis to visit the U.S. Naval Academy for a behind-the-scenes tour of the Academy where we’ll learn about many artifacts from the War of 1812. The "Star-Spangled Banner" that kicks off opening night concerts across the U.S. is often believed to be a great patriotic tradition. But some people think it's out of place and out of mood. The Fort Worth Symphony recently drew criticism over its practice of playing the anthem before every concert. A Dallas musician sounded off on Facebook that orchestra concerts were not meant to be patriotic events, and that the anthem ruined the mood a conductor was trying to set. Many others agreed. In this week's podcast, two experts weigh in on the anthem at the orchestra. Marc Ferris, author of Star-Spangled Banner: The Unlikely Story of America's National Anthem, says he has no problem with the piece's appearance, which is a holdover from 9/11 in many concert halls. "Just to shoehorn it in there just for the sake of doing it could take away from the thematic program," Ferris said. "But you don't have to do it at the beginning. You could do it after intermission. You could do it at the end." He notes that the first time it was played at a baseball game was during the seventh-inning stretch at 1918 Brooklyn Dodgers game. Leon Botstein, the conductor of the American Symphony Orchestra and president of Bard College, is more ambivalent. "I don't think it necessarily spoils the mood," he said in the second part of the segment. "But to repeat it at every concert is a kind of cheap patriotism. It has, unfortunately, a negative effect. It's like repeating a prayer every day without understanding its meaning." However, Botstein believes the "Star-Spangled Banner" can be effective when American orchestras play it on international tours. He also thinks it provides an opportunity for an otherwise passive audience to participate in a concert. Ferris dismisses the notion that the anthem's octave-and-a-half range and complicated lyrics are overly challenging. "It's a real myth that this is hard to sing," said Ferris. "What, a professional singer can't remember 81 words? We're only singing the first verse." Botstein disagrees. "The 'Star-Spangled Banner' is not a great national anthem," he said. "It happens to be ours. It's slightly unsingable and the words don't really make a lot of sense. But it is our national anthem. If the audience actually likes it, maybe it doesn't spoil the mood."
